I don't recall for sure, but I think Ace "encouraged" a practice of no longer linking to moonbat sites such as Huffington Post when pointing out their stupidity. So, I won't. No need to give those morons any more links and hits than need be.

Well, somebody over there named Martin Lewis must be screaming for attention. This clown is calling for a military coup, led by Gen. Peter Pace in his role as Chairman of the Joint Chiefs of Staff, to replace President Bush. Oh well, nothing new. This was the same site that called for another terrorist attack prior to the 2006 elections in order to oust the GOP. So, nothing should be surprising.

That in it itself would not be postworthy here at AoSHQ. But Captain Ed's utter evisceration of Lewis is. Suffuce it to say, Lewis is short on his knowledge of the Constitution and the military-civilian leadership exist and would be ashamed, if he had any shame, to be schooled so thoroughly on this topic.

To be fair, they're not trying to hound this guy out of the profession like those tranny nuts. But the left establishment has been working to prevent a scholar's data collection. Why?

Because the scholar is challenging the self-satisfaction on race that's so important to liberal Boomers:

Mr. Sander calculated that there are fewer black attorneys today than there would have been if law schools had practiced color-blind admissions--about 7.9% fewer by his reckoning. He identified the culprit as the practice of admitting minority students to schools for which they are inadequately prepared.

Specifically, Mr. Sander found that when black and white students with similar academic credentials compete against each other at the same school, they earn about the same grades. Similarly, when black and white students with similar grades from the same tier law school take the bar examination, they pass at about the same rate.

Yet, paradoxically, black students as a whole have dramatically lower bar passage rates than white students with similar credentials. Something is wrong.

Of course, under current doctrine, black and other politically favored "minority" students aren't there for their own benefit; they're there so their minority magic can rub off on the other students. (Seriously. Ask Sandra Day O'Connor.) So if a couple of hundred kids in over their heads yearly fail out and screw up their lives, what's that compared to everyone else getting their required daily dose of diversity? Omelet. Eggs. Google it.

An academic study you can dig.

How violent was the Wild West? Well, in California the homicide rate seems to have been seven times the current US per capita rate. (Homicides I imagine meaning what it does in law, i.e., any taking of a human life by a person, not necessarily murder (murder being a sub-category of homicide)).

That's pretty wild.

The academy seems to be always willing to be swindled by big, sexy counterintuitive claims that reverse previous "myths." Even when those myths are actually true.

Correction: Actually, the study does seem to be using the word "homicide" as a synonym for "murder."

Which makes one wonder about the additional homicides (self-defense, "fair fight" (which isn't a legal thing, but seems to have been a custom), etc.) there were on top of the actual murders.

Correction to the Correction: Now that I think about it, the guys must be counting all those as homicides. Why wouldn't they? They must just be using imprecise and sloppy language in then talking exclusively about "murders."

Do a man's crime, pay a man's fine:

The Falcons will try to recoup $22 million already paid to suspended quarterback Michael Vick, a person with knowledge of the team's plans told the Journal-Constitution on Saturday.

Vick was suspended indefinitely by the NFL on Friday after he pleaded guilty to federal dogfighting charges in Virginia. That cleared the way for the Falcons to pursue money paid to Vick in signing bonus money.

Vick has received roughly $40 million in guaranteed bonuses — and even more in base salary — but teams are only allowed to try to recoup money paid in signing bonuses, per the collective bargaining agreement with the players' union.

To collect the money, Vick must remain on the Falcons' roster. Therefore the team will not release Vick until the matter is resolved, the person familiar with the situation said.

The Falcons are expected to cut ties with Vick, once their most popular player, once the signing bonus matter is finalized.

If Atlanta receives payment from Vick, the money would be applied to the salary cap of the upcoming season. For example, should Atlanta receive all of the $22 million it seeks before the 2008 NFL calendar year, it would be credited toward the 2008 salary cap.

That would provide a huge windfall of cap space for the Falcons to use in pursuing free agent players.

As for this season, the Falcons will not have to pay Vick his $6 million base salary. However, he will count roughly $8.5 million against their salary cap. Though Vick will remain on the roster, he will be placed on a suspended list, which will allow the Falcons to add a player in Vick's place.

Can anyone tell me-- do these actions usually work? Does the NFLPA stop teams from recouping money like this? Or does the NFLPA have no say?

Everything I've seen and read treats it as a forgone conclusion. The 22m was advanced for future performance, if he was cut/released the dough is his to keep. If they keep him, and he does not play due to suspension, incarceration, retirement etc he owes the team the money. Similarly to Strahan's "holdout" with the Giants. If he retires the team could force him to return some portion of the contract's bonus money. They had the option with Tiki as well, and did not exercise. Same deal unfolding with Jake the Snake. I believe the team is looking to recapture 7m.

I just retired (staff) from an NFL team. The players union has no bone in that fight - it's all contractual. They'll get it back. Like Abe said, signing bonuses are based on expected performance.
