The Obama Precedent: Congress, Who Needs It?

The Obama administration has one again unilaterally and unlawfully extended the delay in enforcement of the Obamacare employer mandate.

The government will now exempt companies employing between 50 and 100 full-time workers from complying with the mandate to offer employees affordable health insurance by another year, until 2016.

It will be such sweet turnabout to use the Obama Precedent against Democratic programs in 2017. The Obamacare employer mandate is actually a tax enforcement statute. Having established that Presidents can simply decide not to enforce taxes they do not like, I can't wait for President Perry to start nixing taxes by executive fiat. Also, that pesky EPA that holds down economic growth? Sayonara sucker!

[Update 5:45pm] CAC has informed me that I misspelled "President Walker" in this post. I regret the confusion, but I was referring to the 46th President, Rick Perry, not the 45th President, Scott Walker, whom I'm sure you all fondly anticipate uses the Obama Precedent not to enforce the federal income tax. Again, I regret the confusion.

OK, then, turn it around: Any person who refuses to abide by the ACA individual mandate to buy insurance and is fined by the government should sue, on the grounds of selective enforcement.  At least one court has already cited the selective enforcement as a reason for throwing out the contraception mandate for conscientious objectors. 

 

A law that is only selectively enforced should not be honored or obeyed by anyone, for it is illegitimate.   At some point you exempt so many people and businesses that anyone who actually complies is simply a chump.

 

This is how Obamacare gets killed.  When people simply start laughing at the government and refuse to comply with any of it.

Left-wingers in the Congress who disagreed, and who actually had the intestinal fortitude to use the power of the purse against an incumbent President, then inserted appropriations language which specifically forbade any federal funding for the contras -- the Boland amendments.

And then they dared Reagan to veto those budgets containing those prohibitions.

Reagan folded. (And then tried the ridiculous gambit of extralegal funding which eventually exploded as the Iran-Contra Affair.)

Obamacare promises the states federal reimbursement for the Medicaid signups that have come via the Obamacare exchanges. The House could take a meat ax to those reimbursements, and leave the states which have heavy Medicaid burdens to pick up the extra costs ahead of schedule, which would be a lovely thing to watch those predominantly Obama-fellating blue states endure.

(I live in Commiefornia. That would be an iceberg below the waterline for this state's finances. A disaster for we Commiefornians. But so much fun.)

I looked at the WeatherUnderground radar image minutes before we lost power. The freezing rain line was well above Philadelphia. 750,000 households lost electricity above that line. Something like 5,000 lost (or claimed to have lost) power in Philly. The number of outages in the 'burbs' dropped by the thousands every hour in the 'burbs' while the number in Philly dropped by single digits. Apparently some people in Philly thought they could cash in by claiming an outage; sending sorely needed crews to verify their lies, while the Bible clinging/gun toting peeps in the 'burbs' shivered as their homes approached the freezing point. I've had it with that city and it's people. The FSA deserves a special place in hell.

JackStraw, I am aware of no measure by which the "shutdown" was a win or loss for anyone.  Maybe I missed something.  I do know that the exits in VA did not show it hurting Cuccinelli, which is about the best real-world proxy I can think of (timing, extent of welfare, er, government employment in VA).

 

Regardless, the GOP lacks "leverage" in actually insisting on lawful governance, with respect for example to budgets, because it simply lacks the will.  Or, alternatively, we have a situation where there really is no rule of law whatsoever, and the GOP lacks leverage because there exists no mechanism in the system to require compliance with the constitution and law in governing the country.  No other possibility, logically speaking.

 

The primary control mechanism that actually is in the constitution, and which has in practice been the major "lever" for limiting lawlessness, is in fact the House's power of the purse.  It has even sufficed for forcing national security disasters on the country, and that area is constitutionally dominated by the executive (abandonment of South Vietnam prior to the Northern offensive in 1975).   The House simply refuses to use that power.  CRs serve to gut the House's normal budget clout - heck that was true back when they usually were for 1 month or so.  Now that they have essentially replaced the appropriations process, the House has in effect ceded its key power.

I loved Monticello when we went there on a family vacation when I was 15 or so, the magnificent library/study especially. In most homes the kitchen is the heart of the house. Jefferson's study was the heart of his home, I think. At least, that's where I thought his presence was most strongly felt.

As Dave J understands, the Treasury Department is declaring that the law is not what it used to be last week. The law did NOT say the Secretary would develop regulations on the subject.
