— Ace Apparently Breyer has been pushing to make Free Expression a "collective" right, subject to a veto from the majority, for some time.
But it was only in the McCutcheon case that he found three other "liberals" willing to endorse his bizarre theory.
In his book Active Liberty: Interpreting Our Democratic Constitution (2006), Justice Breyer offered an overview of the First Amendment which posited that its primary purpose was not to protect speech from government control or limitation but “to encourage the exchange of information and ideas necessary for citizens themselves to shape that ‘public opinion which is the final source of government in a democratic state.’” A statute limiting independent spending on political speech is thus defensible against a First Amendment challenge and indeed serves First Amendment interests since it “facilitate[s] a conversation among ordinary citizens that will encourage their informed participation.”In his dissenting opinion in McCutcheon, Breyer takes that a step further, concluding that “the First Amendment advances not only the individual’s right to engage in political speech, but also the public’s interest in preserving a democratic order in which collective speech matters.” (emphasis in original). The First Amendment, he maintains, must be understood as promoting “a government where the laws reflect the very thoughts, views, ideas and sentiments, the expression of which the First Amendment protects.”

It is difficult to read the McCutcheon dissent without recalling two of the Court’s landmark First Amendment rulings of the past. Both were unanimous. Both would be at risk if the First Amendment were somehow viewed as anything but a limitation on the government’s power to limit speech, even in the supposed service of “preserving democratic order,” vindicating “collective speech,” or the like.
They really like government power, and they really don't like individual liberty.

Looks like Abrams is smart enough to realize that without those individual rights you are subject to the whims of who is in power. So good for him.
Breyer apparently feels that his collective will always be in power.
But maybe he is right. The one thing I have noticed about leftists in the past few years is they are done pretending and they say what they really believe. So they must also believe they have now gained permanent power.

We'll know the fix is in if the Democrats manage to hold the Senate this year. Given Obamacare, the Keystone Pipeline, and all of the other foreign policy and domestic disasters associated with the Democrats, it should be impossible for them to retain control of the Senate. However, if they do keep the Senate--and I'm guessing if it's rigged it would be a near thing for the sake of believability--then they would be defying all odds and all historical precedent.
Keep this in mind: there will be enormous pressure coming from the White House to DO SOMETHING to ensure that a Democratic Senate majority is retained since a Republican-majority Senate would cripple President Obama's agenda and threaten his legacy, such as it is.
That, to me, will be the big indicator, but it won't be conclusive. For all I know, the Democrats may be willing to give up the Senate in the midterms for appearances' sake, banking on the votes of millions of now-illegal aliens to put Hillary over the top in 2016. But, you say, these newly minted, not-quite-yet citizens but on the pathway to citizenship won't yet have the right to vote.

For a while there, Prussia had a system whereby there were special courts whose writ was exclusively to hear cases involving overreach or abuse by government officials.
Those courts went after that job with Prussian levels of detail and discipline. No official regarded a summons from one without discomfort. The operations of government became much cleaner.
Of course, if such a system were to be bruited for use here, there would be the same problem we have with the existing federal courts. To wit, how to keep the government from packing the new oversight-court benches with judges who leniently view the infinite expansion of federal power.

Thing is, leaving aside guys like Webb who proposed that CIA was drugrunning as deliberate Agency policy, to keep the bruthas down, there is a disquieting thing to think about.
Anyone who regards government as an inherently corruptible enterprise staffed by sinful and flawed human beings has to give at least some credence to the idea that over the years, certain Agency officers might have used their official powers to go into side business for themselves, moving narcotics.
CIA have had officers sell the names of deep cover agents for money, knowing that this meant the deaths of the agents. Why would such personalities not get involved in other dirty business?
I talked at one point to a guy who had worked on the spec ops side of things in Southeast Asia back during the Late Unpleasantness.
He said that his CO (Army lifer as was he) was very concerned about the way that the Agency contingent in their joint office maintained amicable ties with Golden Triangle poppy princes. Nothing good could come of it, that CO averred. (The Agency said, you gotta talk to these lowlifes if you want to know what's what.)
