Federal Judge Shuts Down Secret "John Doe" Investigations of Scott Walker and Right-Leaning Groups

I haven't written about this because honestly I continue not to understand it. I read almost the entire order shutting down the investigation (providing injunctive relief telling the progressive prosecutors from five counties to Shut It Down) and I looked up other writers discussing it but I still don't really understand what the prosecutors were doing.

John Ekdahl brought it up on the podcast a few times, and I didn't understand it then, either.

Well, I understand only the vaguest outline of it:

Prosecutors from five, get this, progressive-leaning counties were conducting a never-ending investigation into groups that just happened to support the union-limiting reforms in Wisconsin, based on a flawed reading (or deliberate misreading?) of campaign finance laws, and furthermore demanded that each target of the probe (and there were many) remain absolutely silent about it.


A judge has shut this anti-democratic, thuggish abuse of conservatives down.

The four-year effort by Democratic prosecutors to criminalize political speech in Wisconsin has hit the wall of the U.S. Constitution. In a ruling that could have consequences nationwide, federal judge Rudolph Randa issued a preliminary injunction Tuesday ending the secret John Doe probe of allies of Governor Scott Walker.

We've been telling you for months about the secret Wisconsin John Doe, which operates like a grand jury and forces targets to remain silent. The targets are right-of-center groups disliked by Milwaukee County District Attorney John Chisholm, his special prosecutor Francis Schmitz, and the left-leaning state Government Accountability Board that regulates campaign finance...

Prosecutors had justified their dawn raids and harassment in the name of exposing illegal coordination between the Walker campaign and conservative groups. But Judge Randa ruled that the investigation was based on a mistaken reading of campaign-finance law that violated Mr. O'Keefe's First Amendment's rights.

One of the judge's key findings was that the law, supposedly put in place to prevent corruption and the rigging of political contests, cannot be permitted to be used as a club for corruption and the rigging of the political contests.

There's a minor epilogue as Judge Randa's order was technically defective but now he's reissued a correct order.

As I understand it, the main complaint was that prosecutorial resources were being warped for partisan purposes.

As Wisconsin Reporter first revealed, the investigation, launched in early 2012 by the Democrat-led Milwaukee County District AttorneyÂ’s office, aims to prove conservatives illegally coordinated activities in the historic recalls of Gov. Scott Walker and Republican state senators, multiple sources say.

One source with knowledge of the investigation has told Wisconsin Reporter the ultimate goal is to bring down Walker, the bane of Wisconsin liberals.

Conservative targets and others close to Wisconsin’s latest politically charged John Doe contend the probe is nothing more than a “taxpayer-funded, opposition-research campaign.”

“This is not a question of what conservatives did wrong. It’s a question of one party in this state using prosecutorial powers to conduct a one-sided investigation into conservatives,” said one source who spoke on condition of anonymity due to his proximity to the probe.

What is striking is that no liberal organizations appear to be targeted in the John Doe, particularly interesting in light of the tens of millions of dollars pumped into WisconsinÂ’s unprecedented spate of recalls in 2011 and 2012 by union and left-leaning groups.

And it should be noted that these prosecutors were searching for evidence in their probe. One can then wonder why they didn't also think of searching for evidence of illegal coordination among Walker's opponents.

27 Little bit more from various local radio interviews as it gets a lot better.

There is a federal civil rights lawsuit ongoing with 1st Ammendment stalwart David Rivkin taking the lead as counsel for the conservatives targeted. They are going after the John Doe investigating DA's civilly also so they will have personal liability in this not covered by the taxpayers.

Rivkin also is intimating that the Government Accountability Board (GAB) which is supposed to be non-partisan was working hand in hand with the investigation...a major no no which could likely lead to its dissolution which would be great for the State of Wisconsin.

The DA's are going to pay for this one out of their own pockets big time...they've likely destroyed their own families in the attempt to take out Walker and they deserve everything that happens to them.

OKeefe deserves high praise for risking it and speaking out in the WSJ against the gag order that these DA's put out to anyone involved in the investigation

MILWAUKEE (WRN)  For the second time in three days, a federal judge has ordered a halt to the John Doe probe into campaign activities surrounding WisconsinÂ’s recall elections.

Just a day after a federal appeals court stayed his initial order in the case, Judge Rudolph Randa ruled that an appeal by prosecutors to keep the investigation going was frivolous. The decision puts a preliminary injunction back in place ordering an end to the probe and the destruction of evidence.

I am willing to give some leeway to conservatives running in blue states who have to get elected there. Not complete leeway, but some. I look at things in the aggregate, and Walker looks a lot different than say Christie. I'm not sure whether he has ever really thought about it - why would he as gov of Wisc? Unless there is something out there I don't know about, I'm willing to reserve judgment on how he feels about that issue for now.

As the link points out, the appeals court basically told Randa how to fix the injunction.  Which he did.  Ace's post is about the fixed version of the injunction, which now must be appealed on its merits instead of on a legal technicality.

 

Or in other words, the investigators need to try and convince the higher court that their fishing expedition is justified.

Randa said in Thursday's order he would not consider such a request while the appeal is pending, so that issue will be put off at least for now.

Hans von Spakovsky, a fellow at the conservative Heritage Foundation and a former member of the Federal Election Commission said he believes the Wisconsin Club for Growth would be able to recover attorneys fees but not the damages they are seeking. To do that, they would have to prove prosecutors knowingly and intentionally acted maliciously. "That is a very high bar," he said.

Confused, but if I understand correctly, the District judge yesterday smacks down these prosecutors. The prosecutors filed an emergency appeal.

Last night the appeals court reviews it and reverses the ruling based on some technicalities. Literally some forgot to cross the t's and dot the i's level of bullshit. Appeals court judge doesn't seem to sympathised with the prosecutors though, as his ruling included step by step instructions on how to fix the technicality.

Today the district judge applied said fixes and now all is well with the ruling.

Or am I more lost and confused then I think I am?

I would accept "I'm a lawyer" on a case by case basis, so long as they actually practiced law independently or as part of a firm and have a valid law license (unlike Bubba, Hillary!, SCOAMF, and Moochelle). Elected office should not a be career or even a job. It's a responsibility that someone takes on grudgingly or out of a sense of duty, despite the fact that they can do something else that is productive.

The no-knock SWAT raid that killed that guy trying to defend his home was just another example.  And Dupnik was one of those law officers who refused to enforce Arizona's immigration law.
