In the War on Standards Standards Actually Won a Round

In one case on whether employers can use background and credit checks in hiring. The courts rejected the EEOC's complaint.

Yesterday, the U.S. Court of Appeals for the Sixth Circuit affirmed the dismissal of a challenge by the EEOC to the use of credit checks by Kaplan Higher Education Corporation. The very first sentence of the opinion, by Judge Ray Kethledge, calls out the EEOC for its hypocricy:
In this case, the EEOC sued the defendant for using the same type of background check that the EEOC itself uses.

The EEOC claimed that these kind of checks had a disproportionate effect on minorities and to prove it they brought in a crack team of "race detectives" to guess at applicants' race based on their drivers license picture.

The way the EEOC attempted to prove disparate impact is quite revealing and rather disconcerting. To evaluate the racial impact of a hiring policy, one must, of course, know the race of applicants. In this case, Kaplan did not record this information. Thus, the EEOC's "expert" had to eyeball copies of applicant driver's licenses and, in effect, guess the race. (The expert also had the names of applicants; though the EEOC insisted they weren't used to determine race, the Sixth Circuit seemed skeptical of that claim).

To guess the race of applicants from the photos on their licenses, the expert used a process called "race rating." He assembled a team of five race raters each of whom has experience in what the EEOC calls "multicultural, multiracial, treatment outcome research."

And the Court was having none of this.

The EEOC brought this case on the basis of a homemade methodology, crafted by a witness with no particular expertise to craft it, administered by persons with no particular expertise to administer it, tested by no one, and accepted only by the witness himself. The district court did not abuse its discretion in excluding [the expert's] testimony.

I almost expected the court to follow up with a Billy Madison judgment here.

In the recent Hobby Lobby Case, Justices Elana Kagan and Sonia Sotomayor said that corporations that don't want to pay for abortions should simply not provide any health insurance: "But isn't there another choice nobody talks about, which is paying the tax, which is a lot less than a penalty and a lot less than - than the cost of health insurance at all?" Dissenters from the official line must pay a tax. That sounds familiar.

Consider the ObamaCare 'Tax' penalty as just the starting jizyah dhimmis like you will have to pay for not adhering to the state religion - progressivism.

Harvard Dean: Hollywood is Being Too Friendly and Not Mocking the Military Enough

So sayeth Professor Steven M. Walt of Harvard's School of Government:

Since the early 1980s, in fact, mass-market treatments of war and the military have become increasingly respectful, even adulatory. This trend begins with An Officer and a Gentleman (1982), followed by Top Gun, a 1986 film starring the F-14 Tomcat; A Few Good Men (1992); Saving Private Ryan (1998 ); Independence Day (1996), where the villains are evil space aliens and a sniveling civilian secretary of defense; Black Hawk Down, a 1999 book by Mark Bowden and 2001 film; the Oscar-winning The Hurt Locker (2008 ); and Zero Dark Thirty (2012) about the raid that killed Osama bin Laden. You could toss in Lone Survivor, Shooter, Under Siege, Tour of Duty, Call to Glory, JAG, and Band of Brothers - the moral of the story wouldn't change much. Some of these works include conniving politicians or less-than-admirable commanders, but the core institutions and the troops themselves are portrayed in a consistently positive light. Today, only Garry Trudeau's Doonesbury is still willing to crack a few jokes at the military's expense, but his main military characters (B.D., Ray, Melissa, and Toggle) are all wounded or damaged in some fashion and the predominant tone is one of sympathy and support rather than satire.

I can think of only five partial exceptions to this pattern - Private Benjamin (1980), Stripes (1981), Good Morning, Vietnam (1987) and the two Hot Shots! parodies, but these works do not undermine my larger point.

And even the exceptions he points out aren't portraying the military negatively enough for him:

In Stripes and Private Benjamin, for example, the lead characters ultimately gain wisdom from their military experience and become better people. And Good Morning, Vietnam becomes less funny as the film proceeds, as Cronauer confronts the realities of the war and discovers a Viet Cong agent has duped him. Hot Shots! (1991, 1993) doesn't really count, as these films are really spoofs of pro-military genre films (especially Top Gun) rather than of the military itself.

Well at least Walt can console himself with M*A*S*H and all the deranged veteran movies of the 70s.

Steven M. Walt of Harvard?  This is the guy who co-wrote The Israel Lobby and U.S. Foreign Policy with John Mearsheimer.  No wonder he can wrote a piece of trash about how Hollywood isn't critical enough of the US military, because he can't write a logical argument support with facts at all.

115 Weird how food is different for siblings raised in the same house. Mom never let us have sugary cereal, and I never let my kids have it, unless we were camping, for a treat. My sister has raised her kids exactly opposite, letting them eat junk all day long, because she thinks they'll have food issues otherwise. Not sure how that will go, since her kids are still teenagers eating junk, and mine are grown with very healthy food habits. My neighbor raised her kids the way my sis does, and hers grew up to be very healthy eaters, so who knows.

Everyone, from the VP's to Management to us cube-farm dwellers to the guys out in the shop chimed in. Summer-time, we grilled something outside. When Fall hit and the weather turned sour, everyone wondered what we were going to do. I suggested "Grilled Cheese Sammich & Tomato Soup Day". It was a great hit; I brought in my Geo.Foreman Grille™, some one brought in a crock pot for the soup, everyone chipped in with a variety of breads and cheeses. Splendid. So on Friday, I'm sittin' in my cube I detect the distinctive whiff of a George Foreman Grille™ heating up (if you own one, you know what I mean). I wandered back to the break-room to find one of the guys from the shop making a grilled cheese sammich from the left-overs. Seems he had forgotten his lunch and was short on cash and decided to improvise. From that day forward, someone has made a grilled cheese sammich every day. I would clean the Geo.Foreman™ a couple of times a week, and made a point of there always being a loaf of bread and some cheese in the fridge. Not altruism, I needed a grilled cheese sammich almost every day.

188 @156 Y-not. I liked bubble gum ice cream too. When I was 8 we were visiting my grandparents, and they took us to Baskin Robbins. Of course I got the bubblegum ice cream. But my Grandpa wouldn't let us back in the car with the ice cream, so we had to eat it there.  Bubble gum ice cream is REALLY hard to eat quickly due to the little chunks of frozen gum in it. I don't remember much about my Grandpa, but I do remember having to throw away my ice cream before I was done. There may have been tears involved.

227 I'm still giving Turn a chance. I've found 1/3 intriguing; 1/3 average; and 1/3 had me laughing my ass off, sometimes for the wrong reasons from the show's point of view, but even then I enjoyed the LMAO parts. So far it hasn't been Rebel Patriot propaganda; and both sides have been shown as deadly earnest because they're fighting a war so that's fine with me. The minor inaccuracies I don't mind turning a blind-eye to although they managed to work a fag into the show. I'll see how that works out.

Still, I wish they would have made the main British bad guy fictional however as Simcoe founded Toronto (and if they kill him off in the show I won't be getting the first Monday in August off!!!) and a regiment of infantry that has a modern-day descendant, and freed the slaves/banned the slave trade in what would become Ontario even before the French Revolutionaries did so.

And as an addendum: funny how Canadian, Leslie Nielsen, played Swamp-fox Marion in the old TV show where the Loyalists Tories were the bad guys.

I can't tell you how many times I have patiently sat down and worked out the actual percentages on military spending and provided a detailed rebuttal.

Well, by no means is all of NASA or DOE military related, but you can go ahead and lump them in with the VA and lump that in with the DOD and it's _still_ not anywhere near half of the budget.

Then they insist on including CIA and NSA. (Which aren't the fershlugginer military! But put them in regardless. Still not 50% of the budget.)

And the thing is, when they're finally cornered, and I think they're about to give up, there's the undisprovable assertion. That the remaining huge chunk of money must be in "hidden black programs" not disclosed to Congress by the military.

So, um, how is that money getting into the accounts of the hidden programs? And where could it be coming from so that it could never be traced back? Some account somewhere must get debited in the end.

In that meme, the GOP was going to basically die away because we were all so enamored of Obama's creased pants. Then 2009, 10, and 11 happened, but the media kept the meme alive because a President won re-election (which is the norm) in 2012 while losing seats in the House and Senate. The internal fighting in the GOP is pretty standard as the DC Republicans have pretty much been against the State Republicans for forever. It's why GOP governors have been successful (mostly) when running for Pres as opposed to GOP Senators who have been very unsuccessful. The Dems are going to have a bitch of a time in 2016 depending on who runs because every Dem group is saying "it's our time now", but each group still doesn't want to let another have it. Blacks have the nod now, and they want to keep it. Hispanics feel they should get it along with women, so someone is going to be pissed, and blacks may not support Hillary as enthusiastically as they did Obama.

Growing up, it was cereal for breakfast.


As I slowly started taking care of myself, it was more like a continental breakfast -- tea and a roll.


When I got serious about losing weight, it was a "real" low-carb breakfast like an omelet or bacon.....because the thing I used to hate about them -- "makes me feel bloated and full all day" -- was exactly why they were good for me.

I didn't get fed cereal regularly for breakfast either.

 

It was there, if we wanted it...but my Mom always cooked bacon or sausage + something else.

 

Sometimes it was pancakes, sometimes it was eggs, or waffles or Cream of Wheat.

 

Cereal was always something that was just...'there'...if we wanted it in addition to breakfast', as a sort of dessert.

 

But with Mom being a country girl, breakfast in our house always revolved around the Meat.

 

We didn't leave the house unless we'd eaten at least a few strips of bacon, or a couple of pieces of sausage...or a piece of ham.

 

I didn't realize at the time how blessed we were.

My brothers and I, have never had a 'weight problem' as adults...and I think that these early eating habits may have had something to do with it.

I just could not sit through a Clooney movie in a theatre without heavy medication and/or the ability to stompy-boot through the screen. However, I have often considered buying the DVD for "The Perfect Storm" and "Gravity" because he 'doesn't make it' in both of those films. That's what I would call a 'feel good' moment. But I did laugh at the joke that the reason George floated away in 'Gravity' was because he would rather die than spend time with a woman his own age.

359 Today you only hear from the Republicans for 3 reasons: i) to announce how they'd like to "work with" obama ii) to denounce a fellow R or a conservative iii) to make an apology ---- I have not heard Perry, Walker, Pence, Cruz, Lee do any such thing. Obviously, there are elements of the Republican party that actively undermine the conservative base. Nothing new there. But there are also some good ones. But I'm open to the idea of wishing for the party's death so that we can shed certain elements and build a new party of conservatives. In the long run, that may be the best course.

372 Chavez the Hugo, My brother is in the hospital again, he's been on oxygen since December. I don't remember if you were around last year at this time & I'm sorry. He was so sick that hospital in Maine called me to ask if they could admit him on March 31,2013 @ five something am. I told them they could treat him. A doctor called a few hours later to say he thought it was urinary tract infection & they put him on ventilator. The next days it was same infection, strep in longs & blood. After six days of ICU nurses I called & said we are Catholic & I want him to have Last Rites. Nurse wrote in his chart for doctor to speak with me. Blood infections are nearly almost deadly, but after 10-12 days they got him off ventilator & he couldn't move any part himself & he was screwed up from drugs to keep him quiet for ventilator, it took a week & then they did full body MRI, infection was in cervical,spine. Surgeon had to remove 3 discs & now he's a quadraphonic. He has 3 kids but was a lousy father & they do pint really care.my older brother is great to me, but will not speak about younger one. It's a frigging horrible situation & I know my younger brother always & 99% of the time only cares about himself. But he's stuck in Maine & I get all the calls. He's having breathing issues since December & on oxygen all the time. He's spent last year plus # of days in hospital or rehab, which is nursing home. I got call Monday morning that he was having extreme issues breathing & his heartbeat was too fast. He's making me lose sleep & fall asleep while posting on ONT. He has double pneumonia again, it's a monthly thing. He'll go to hospital, stay & be on picline antibiotics, back to rehab & it starts all over again

It was there, if we wanted it...but my Mom always cooked bacon or sausage + something else.

Sometimes it was pancakes, sometimes it was eggs, or waffles orCream of Wheat.

Cereal was always something that was just...'there'...if we wanted it in addition to breakfast', as a sort of dessert.

But with Mombeing a country girl,breakfast in our house always revolved around the Meat.

We didn't leave the house unless we'd eaten at least a few strips of bacon, or a couple of pieces of sausage...or a piece of ham.

I didn't realize at the time how blessed we were.
My brothers and I, have never had a 'weight problem' as adults...and I think that these early eating habits may have had something to do with it.

For this and other reasons, humans aren't well adapted to the colossal amount of fructose which modern food engineering has produced at the plant level and introduced into our diets. Fructose is not encountered in nature in anything like these quantities.

The obesity spike among adult Americans correlates quite strongly with the growth of use of HFCS in foods starting in the 1970s.

I guess I should have guessed he was a gay man, because certain people could not shut up about how X-Men was some sort of gay allegory. I didn't care. It was a good movie, and I enjoyed it, and there was no whacking over the head with a message that I could see (OK, maybe 90 seconds somewhere in there). There's an interesting topic -- movies intended to convey a message that wound up not so much conveying the message as just being good. Aliens is another. Cameron apparently intended that as some sort of allegory of the ineffectuality of the military, you know, they go in with spirit and wind up at "game over." But the movie turned out great anyway, and the intended message didn't really end up in the front at all. Anyone got other examples?

Been doing a little reading about the 'Desert Tortoise'...

 

It's not currently on the Endangered Species list.

And I cannot find any evidence that it ever has been!

 

It's been considered "threatened"...in certain areas, like the Mojave Desert.

And another desert, Sonora (?) I think it was.

 

But because it was declared 'threatened' in those two areas...the Desert Tortoise was put on the Threatened List.

It is doing rather well in other areas.

 

So all these media people who keep referring to the Desert Tortoise as...

"The endangered Desert Tortoise"...are just repeating a lie, I guess.

 

Because I can find no evidence of it being on the 'Endangered' list.

Not now...and not ever.

Carbs were hard to come by.

 

And processed, over-refined carbohydrates weren't in the picture at all.

Our bodies don't really know what to do with them...except 'store them'.

 

Our species' ability to store fat is one of the reasons why we survived, though.

People often had to go hungry for long periods of time.

 

So we have this 'Store' program, built into us.

What we don't burn up immediately goes into 'store'...and unfortunately, our sedentary lifestyles don't burn the calories that we need to burn and stay at a healthy weight.

Except for walrus/seals but they have to be pretty bold to get one. Another cool clip they showed was Orcas getting a seal off the ice flow. They would first line up 3 across and go in unison to get their bow wave to tip the ice until the seal fell in. First try didn't do it so they multiplied the line.

Can't have some of these shows end because sometimes the network may decide to try and bring it back as a miniseries or a movie like 24. So yeah, the ending was fucked up, but by choice.

His parents used to send him some crazy shit in a "care box". Whale blubber, caribou jerkey, atlantic char, seal. He told me that they hated polar bears because they would break into their storage and eat their food, but if one showed up, they sure as hell tried to get the polar bear away from their food and onto their dinner table.

People thought that SyFy would pick up any show that was on network TV that had just an inkling of being remotely science fiction. I pretty much now Tivo shows that may interest me, then download to the computer to clear up space. If the show gets cancelled, no worries since I haven't gotten hooked into it. If it makes it, then I binge watch it to catch up. I tend to actually watch cable series when they come on because with those, I know that they will at least show the whole season no matter how bad the show does in the ratings.

Yeah ,as I'm finding out. I get both yes and no from different people when I ask. One told me "it has to be the kind you boil, not this instant sweetened shit". I have both, but I would rather lean on the ones that work a little better. I don't have high cholesterol, but I did lower it 20 points when I made an effort using the old fashioned kind, but the instant is nice and fast.

But strangely, 9mm is popping up more frequently then I have seen in several months at less then .28 per round for brass case FMJ. Usually, that price will get you either steel case, or reloads.
