Thirteen white city firefighters and one Hispanic firefighter were promoted to lieutenants and captains. They were among the firefighters who sued after the city threw out of the test results because too few minorities would have been promoted.
The formal ceremony takes place on December 10.

What would be better political theater would be founding a study center for firefighters to help all ambitious firefighters - Black or white or dyslexic or whatever - to study for the promotion exam at low-cost or for free. And then demonstrate that the study center is more effective at helping minority firefighters win legitimate promotions than affirmative action is at helping them get fake passes on the promotion exam.

I applied to the Fire Department shortly after returning from Iraq and was straight up told by the firefighters that due to my melanin content I might as well set my application on fire. They had had people who had volunteered for years, taken all the tests and passed with flying colors, apply for 4 or more years in a row and not get hired. That is the day I also found out my vet preferences count less on a federal application than minority status. Made my heart warm with joy let me tell you.

It took years to eliminate race based promotions, but entry level hiring today is mandated at 80% minority.
Consent decree? That's a different ball-o-wax altogether.
A lot of people have no idea what kind of systematic abuse like this has been imposed by the courts.

This is also why I take the "sexual perference is hard-wired" claim with extreme skepticism. Sexual preference is a lifestyle choice, not a feature of human biology.

I've handled a number of Title VII cases (I don't often get to pick and choose the matters I work on based on my own politics) and I find disparate impact to be one of the most objectionable legal doctrines I've ever had to argue. It's a wide-open swinging gate inviting "results-oriented" jurisprudence.
Rulings based on this doctrine are so tendentious and case-specific that they provide no guidance to other employers regarding how they should conduct themselves to avoid violations (as evidenced by the central debate in this latest mess).
As a result, the employers are left in a constant state of fear and uncertainty that most often seems to result in minority employees either a) ruling the roost with unreasonable behavior for which the employer is terrified to discipline them or b) simply not being hired at all - neither of which were the desired outcomes of Title VII.
The courts are supposed to explain, clarify and define, not to obfuscate, confuse and frighten.
