By the way, am I the only one who thinks the charge he got convicted on is bullshit? Lying to the FBI? As far as I know, this charge isn't for lying under oath, but just bullshitting the FBI during an interview.
So let me get this straight... a citizen who lies to the FBI gets busted. But the FBI can lie to the citizen without consequence?
I'm calling bullshit on that.

IL Democrats like Jacobs and Boland say it tells us citizens don't want to "criminalize politics". They say that is how it works, "you do something for me, I do something for you". I'm not sure where that leaves the constituents.
Boland said he shouldn't do jail time because he has kids, and "nobody died".

You know, the first time I saw this animated news stuff was that Tiger Woods one.
Prior to it, the story going around was that the wife busted out the back window to rescue him. At the time, I thought to myself "hmmm, that's possible I suppose, ...but it seems more likely she was busting that window in a rage."
But after I saw that recreation, I knew, I mean I FRICKIN' KNEW that the wife's story was a total fabrication.

Seems like everyone should invoke the Fifth when the FBI shows up. It's just literally true, you are liable to incriminate yourself. Nobody should talk to the FBI without a lawyer present. Depending on how broadly the court interprets the word "material" any misstatement could be a federal crime. I've had to talk to the FBI on background checks for other people. Could ordinary business transactions like that become federal crimes if your memory glitches?

Ed,
The lying to the feds is the weakest charge and may be thrown out.
This was for statements he made in 2005! Way before all this other stuff and before they were wire tapping him.
The analysts say that he could appeal this charge on the basis that he could have been telling the truth at the time.
This is likely the reason Fitzgerald will press on for a retrial. A lot of folks here think as long as Blago is going to jail on the lying charge, we shouldn't bother to re-try him. (we are all rather sick of this here in Illinois and would just like to see Blago off our TV screens!)

You don't need to invoke anything during an interview with the FBI - just refuse to answer questions and that's that. They have no power to compel you to answer. It's when you're put under oath in courtroom, before congress or that sort of thing that the 5th amendment has some relevance.

Well, an article about this says something a little different. It seems that what they recomend isn't taking the 5th. You just say that you want to discuss this with your lawyer first, i.e., invocation of counsel. The article says that being totaly silenct can be used against you in some circumstances.

--That tip is so obvious that people don't believe it. The cops mentioned in the book Homicide said that they dread a suspect lawyering up and use every trick in the book to get him to waive that right, including lying and saying that lawyering up "looks bad" at trial.
