— Gabriel Malor Says that Obama would have to sign the Senate bill into law before the Senate could proceed to modify it with reconciliation.
In other words, the House members would have to believe the President's (and Harry Reid's) assurances that the Senate won't just quit when its version of healthcare reform becomes law. Remember, the Senate already rejected the House version when it created its own bill.
Summing Up the Past 24 Hours: The Congressional Hispanic Caucus makes a demand that already derailed healthcare reform once. The Congressional Black Caucus complains that Obama isn't listening to them. The co-chair of the Congressional Progressive Caucus announces that the President's stumping across the country isn't doing a lick of good. The Stupak Twelve announce that there will be no deal. And now the Parliamentarian makes it that much harder to get wavering Congressmen on board.
Stick a fork in it.
Meanwhile, Nancy "Nero" Pelosi keeps protesting "there's just a few minor, technical things" to work out.

Anyway, I think this thing was effectively killed when Scott Brown was elected.
Being able to ram a conference reconciliation bill through a filibuster-proof Senate was probably the only practical way to bridge the Senate and House versions. The two bills were always pretty far apart, and the tremendous arm-twisting and bribery needed to pass them through the Senate were just one example of this.
Now the question is when will the Democrats actually ADMIT that they can't pass this.

The House already approved the student loan bill, and Democrats in the lower chamber are eager to move forward, but Reid faces resistance from members such as Sen. Ben Nelson (D-Neb.).
“We’re going to talk about whether education is going to be part of reconciliation. Under the instructions that came out of the Budget Committee, we’re entitled to do both healthcare and education by reconciliation,” Reid said. “But the caucus – I want them to make that decision.”

Yeah, but there's still the problem that Slow Joe can override the parliamentarian on this thing (assuming that the house still passes it to them.)
The Repub threat of wrecking the thing during the reconciliation 20-hour debate/amendment cycle goes away if Joe just waives all the R points of order. So the Ds still have that reassurance (small or big as it may be) to give nervous house Ds.
I agree, let's not start with the mutual fellatio just yet, lads.

That's about right.
Its not entirely clear that the President HAS to sign it before the Senate takes up reconciliation, but if the House were to pass the Senate version, it really wouldn't make a difference, since Obama would certainly sign the thing whether it went through reconciliation or not.
But the bottom line is, the House would have to sign off on the Senate bill, knowing full well that
a. The Senate has NO interest in reconciling ANYTHING, and
b. The President has EVERY interest in signing SOMETHING and.
c. Even stipulating for the sake of argument that both the Senate AND the President sincerely want to please the House by attempting reconciliation (something that is probably NOT true), there is no guaranteed that the issues that concern individual House members even COULD be fixed by reconciliation, let alone that the ones that could be fixed actually would be.

Why would you need reconciliation on a passed bill?
different kinds of "reconciliation."
One is reconciling the House and Senate versions of a not-passed bill, (this is the usual meaning that we're accustomed to.)
This special reconciliation is specifically "budget" reconciliation, done to a passed bill to fix* budget problems (mainly in fairly technical ways, at least until it started getting used as a bit of a filibuster end run, see the Bush Tax cuts.)
*for a given value of fix.

As others have pointed out, not good enough. There will have to be a clear death to this legislation. Call for investigations of all the criminality and abuse of power/funds used to drag this rotting carcass around all these months ... long after any normal American had assumed it was killed (as Drudge illustrated wo well with his little list of 'death of health scare' headlines). Only an offensive against those pushing this monstrosity will stop it. People need to start calling The Precedent an idiot and a liar - which he is and we all know but everyone is afraid to say. They need to talk about the un-Constitutionality.
So much was allowed to get through in the first year of The Precedent's term, but people have to start pushing back on them all. They can't let the retard and his useful idiots get away with this stuff, anymore.

Fortunately, the way the system is set up, there's a pretty limited amount of crazy he can pull off without help from a lot of people who answer to the voters. Obama may be willing to ignore the polls, but people in Congress didn't spend their lives climbing that greasy political pole so they can leap off on Obama's whim.
I mean, all you have to do to stay in Congress is listen to your focus group and raise money. In a normal election cycle 99% of them get reelected. Who would want to throw away that kind of gig?

Obama should write a book - "How to piss off everyone while accomplishing less than nothing".
GALLUP:
Despite signs of a strengthening economy and improving unemployment, Obama doesn't seem to be getting any credit. Gallup has him at a LOWEST EVA 46% today. Now when Gallup (who puts their thumb on the scale for Democrats to the tune of 5 points or so) has you at 46%, you KNOW ur in the shitter.

The Precedent has the lame streams behind him, enthusiastically and all-in with him, anyway. And he has the race card, which will be pulled with abandon (as we saw an inkling of during the Town Hall Era) and which he has no qualms about pulling on his own useful idiots the minute they become useless. He's already gone after the dems in Congress several times - in addition to the Rahm sorts of creepy/silly stuff.
The Precedent is looking to promote racial animus in this nation - as has been obvious for a very long time. He just wants to exact revenge on this nation and he is on a suicide mission to do that. He is on his run.
Posted by: progressoverpeace at March 11, 2010 11:56 AM (A46hP)
Look, Obama-care style healthcare reform will NEVER be dead, so long as there is any liberal/progressive presence in American politics that considers it the "holy grail", their #1 policy priority.
But this Obamacare iteration? Again, if the Democrats had the votes to pass this, it would already be signed law. They don't, and with every passing day, it seems that things are getting harder for them, not easier.
All the votes that can be bought off. . .have probably already been bought off.
All the arms that can be twisted, have probably already been twisted (eg ask that guy Massa), and Pelosi's arm strength gets weaker every day the November elections get closer.
In short, not only isn't the the ball getting any closer to the Dem end zone, the clock is ticking and it seems to be moving the other way.
Further, the longer the Dems push on this incredibly UNpopular legislation, the worse things will be for them. .

The best we can do is lop off an appendage and round up more ammo before it mutates into something bigger and stronger... which it will do eventually.
BTW, we still have a viable 2nd Amendment, right? 'Cause it's still the best we've got against those machines. Not sure what we'll do when they discover free-form, free-flowing metallurgy.

But, it was never really "the dems" pushing this. It was all The Precedent. At least, that's how I've seen this from the beginning. If it had been up to Nazi and Hairy, this POS would have been tossed long ago and they might have gotten Crap&Trade through before the CRU emails came out.
No, my view has always been that The Precedent was the one forcing this through, not to get it passed (as I don't think he cares about politics or governance, at all) but to destroy our legislative system and injure the trustworhiness and reputation of Congress in the process.
He got the Congressional dems roped in by letting them go hog-wild on the Porkulus, and then writing anything they wanted for the health scare (because, as I said, I don't think he cared about it) so they all owed him, in addition to the fact that all the dems were imprisoned in support of "The PRECEDENT", lest the black guy fail ...

I can't help but think that this is a TRAP! Democrats want people to stop calling, faxing and writing them over this. Obama doesn't want the embarassment of huge public demonstrations against this. I'm so jaded, I think that they want to trick people into easing up and thinking that they've dodged a bullet. I don't trust these asstards. They're evil and relentless and they are hellbent on getting this thing done.
I did get to thinking, though, remember how Prosecutor, Mike Nifong's last name became a verb? I'm thinking after all this is done and over, the word Obama could be a verb (we'll have to see how this all plays out before we give it a final definition.)

March 11 (Bloomberg) -- U.S. stocks rose, reversing earlier losses, as Citigroup Inc. and Zions Bancorporation led a bank rally and investors speculated that health care reform will be harder to pass.
Coventry Health Care Inc. and Aetna Inc. increased more than 2.8 percent after a Senate parliamentarian made it harder for Democrats to use a process known as reconciliation to bypass Republican opposition to industry reform.
“I’m getting more and more convinced that the health-care reform is completely dead,” said Scott Tapley, a health-care money manager who helps oversee $2.5 billion at 1st Source Investment Advisors Inc. in South Bend, Indiana. “You get a sigh of relief because now they know they’re not going to have radical change in the immediate future.”

The Congressional Hispanic Caucus makes a demand that already derailed healthcare reform once. The Congressional Black Caucus complains that Obama isn't listening to them. The co-chair of the Congressional Progressive Caucus announces that the President's stumping across the country isn't doing a lick of good. The Stupak Twelve announce that there will be no deal. And now the Parliamentarian makes it that much harder to get wavering Congressman on board.
So when do we get to start calling all of these groups "the caucuses of no?"

About jobs, the jobs that have left the country are not coming back. They are being done overseas for less money, and probably better than they would have been in the USA, unfortunately. High tech jobs are going next. Why? Because we have seriously dropped the ball in terms of education in the USA. India has more honor students than we have students. Think about that for a bit. College graduates had better think in terms of being inventors or business owners rather than wait for a cush corporate job to come along.
Globalism isn't sustainable. Period. We're seeing that now. It has as much of a chance of working long term as the interlocking treaties among European countries did pre-WWI. Oh, they held up for awhile, but when the system crashed catastrophe followed.
As far as jobs coming back, perhaps not from those companies. Once the system crashes the people in this country WILL vote people into power who will rescind free trade treaties and make it impossible for transnational corporations to do business in this nation. No one wants to work a service job at Starbucks for the rest of their lives.
Every person in India could be an honor's student and it won't make a bit of difference in the long term. They have cultural issues that hinder their ability to lead any global economic enterprise. Ditto for China.

The first was to send the competing measures to conference and let the conference work out the differences.
The conference committee report goes back to both houses of Congress, where it receives a majority up-or-down vote in the House but is subject to Senate rules of debate, including the filibuster.
Scott Brown cut that route off.
The second was to have the House pass the Senate version, as-is. Bart Stupak, the Blue Dogs and likely the Hispanic caucus cut off that route.
The third was the convoluted reconciliation trick, wherein House Democrats would take a leap of faith and pass the Senate bill, trusting that the Senate would make changes to its bill through reconciliation procedures. The Senate Parliamentarian has cut off that route with his ruling that the President must sign the bicamerally passed measure into law before the Senate could engage in the reconciliation procedure.
All three routes have been cut off, and there are no others left within the bounds of the Constitution. I believe Nancy Pelosi knows this, and that Harry Reid knows it, too. But the neophyte community organizer turned President is still blithely ignorant. At some point between now and March 18, Rahm Emanuel will calmly inform the President that Obamacare is trapped, cannot escape, and is dead.

Its like they haven't learned a thing from the Scott Brown election.
If there are individual House members right now who are afraid to vote for this thing, imagine how they are going to feel with Fox News beating them over the head every night for participating in an illegal end-run around the rules coming right into election season.

They've gotten away with the most egregious such offenses, already. The Scott Brown election was a case where they got away with it - not Brown winning, obviously, but the dems were able to abuse power and change the Massachusetts law to get a dem into the Senate for Teddy to vote to resurrect the health scare (after one of its many, many prior deaths). No one got in trouble for that, even though people shoudl be spenind decades in federal prison for that sort of abuse of governmental power. It's really just unbelievable, but the dems keep getting away with all this stuff, and more.

If somebody wants to improve healthcare and reduce the unsupportable growth in costs. How about tort reform. People who bring frivolous lawsuits pay the winners legal fees. Instead of punitive damages for malpractice award jail time, with the caveat that the malpractice rose to the level of criminality. Winning a malpractice suit shouldn't be like winning a lottery for the victim and a bunch of lawyers.
Reduce government compliance costs by getting the government out of healthcare where ever possible. That would reduce costs. Centralize regulations rather than having a government bureaucracy for every state. That would result in a reduction of government employees and reduced costs.
Oh, reducing costs and giving everyone health insurance isn't what socialized medicine is about? Sorry.

While the VP could try to change this ruling, there is a problem with that. The VP is President of the Senate, but that really means he casts the tie-breaking vote. The Senate is part of the Legislative branch of government, and the Senate does not look kindly on a member of the Executive branch adjusting the Senate's rules. It does not matter if the party that controls the Executive and the Senate are the same - the Senate determines its own rules and reacts accordingly to any outside meddling.
That has been the Senate's history of it's relations with the VP - titular President of the Senate.

The intent with healthcare is to nationalize the healthcare industry. The intent with crap and tax is to nationalize the energy sector. In short they turning the nation communist one sector at a time.

That is why the Senate has always reacted like this - precedent means that the opposition party can do the same thing - and Senators know this, and Senators react this way. It then becomes a fight between two of the branches of government, and each branch jealously guards its own power and standing.
Let the Executive set the rules for the Senate? I don't see that.

A very fine analysis. Unfortunately, I think your reassuring conclusion is based on a flawed premise: that the Dems will limit their options to those allowed by the Constitution. Fact is, that constraint was violated when the feds took over GM and AIG, and started taking Chrysler dealerships away from legal owners (99% of whom supported Republicans) without any compensation or legal ruling/due process--a clear violation of the Constitution.
Because they got away with violating the Consitution earlier--without so much as a murmur from the Lamestream Media-- why would they fear to do it again?
I predict they'll pass a bill entitled "Health Care Reform," with provisions/contents never announced before the final vote. They will then announce that the differences between the versions passed by the House and Senate, and the mystery version known only to Rahm, Reid and Pelosi, will be resolved thru the well-known reconciliation process.
The fact that this isn't kosher won't bother them in the slightest. Further, the Repubs can scream and shout, but if the Dems are determined, they'll pass the thing on 5
