Chicago: 80 Year Old Army Vet Shoots and Kills Armed Intruder
— Dave in Texas

An armed intruder in his 30s, breaking in at 5:22 in the morning, who also shot back at the elderly man defending himself, his wife and 13 year old grandson.

At about 5:20 a.m., the homeowner and his wife, also in her 80s, discovered the intruder entering their home through a back door. The homeowner, who had a gun, confronted and killed the burglar on the doorstep, police said. Cops said the intruder also fired his gun during the struggle.

"It's a good thing they had a gun, or they might be dead," said Curtis Thompson, who lives next door to the couple, the Chicago Sun-Times reported.

He may run afoul of Chicago's law outlawing possesion of handguns, which is being challenged after the DC decision. An attorney named Joel Brodsky has already offered to defend him pro bono* if authorities pursue charges.

I am willing to bet he doesn't go to jail, but is brought up on charges for illegally owning a firearm. I then will be the NRA backs this guy to the hilt and uses this to show that the Chicago gun back will kill the elderly and defensless and protects the thugs who won't obey the laws on the books anyway.

sadly, i was just thinking that. Did he shoot the guy on the porch or in his home. I was under the impression you can only shoot someone who breaks into your house, not just on your property. Otherwise all elderly people would shoot that damned whipper snappers that congregate in their yards.

that said, i think the fact the perp fired his gun will mitigate the fact he was on the porch.

I wonder who fired first?

I hope this guy doesn't get in any trouble.

No Top Headlines (as yet) thread so I will post this here, with a bit of explanation. This was sent to me in an email from someone with military connections.

This is part of the videotape showing the Russian Navy commandos on the Somalian pirate ship. You may remember that the pirates captured a Russian oil tanker. The EuroUnion navy that patrols these waters could not interfere because there could be casualties.

All explanations are in Russian and, with a single exception when a wounded pirate tells something in English, all conversations are between the commandos - in Russian. Sorry if you don't understand Russian but the pictures speak for themselves.

The soldiers freed their compatriots, moved all the pirates to their own (pirate) ship, searched the pirate ship for weapons and explosives, and took seven Somalian pirates. Then they left the ship and exploded it with all remaining pirates on it.

I did note that the Russkie Commander can speak near perfect English, right down to the proper use of profanity. BTW, this is the correct and time tested method of getting along with pirates.

19 The story cited does not specifically state whether the homeowner used a handgun or a long gun.  (Rifle or shotgun).  If I understand right, you can have a long gun in Chicago.  (I don't know the law specifically, but likely similar to DC where you have to keep it disassembled into it's constituent atoms and locked in a platinum lined vault buried beneath a mountain, with ammo stored at least 7 light years away.)

The home invader must have been standing with his feet outside Chicago, though, since we know a revolver is illegal and how could he possibly have such a thing?

30 The Greatest Generation is still alive and kicking ASS. I read two stories like this in the NY Post police blotter yesterday. One was a 74YO woman mugged at Peter Cooper Village. The kids tried to grab her purse, but she held on tight as they dragged her about a block. Security cameras caught them on tape, and arrests have been made. Another was a 49YO asked an 80YO if he would like some odd jobs done. The old man said he didn't need a handyman. So, the guy attacks the old man with a hammer, hit him in the head a couple times. Then  the old guy grabs the hammer and starts beating down his attacker. He ran off and is still at large.

Common law allows for the protection of your CASTLE which is the domain on which it sits as well. When one BREAKS the CLOSE -- crosses your property line, theya re in peril. IF thise guy was on the porch and not RUNNING AWAY, the homeowner can be ok...UNDER COMMON LAW...howevah! Statutes and ordinances may alter that and put conditions that are more restrictive. Remember Texas?  There, you can even shoot a person on yoru neighbors property. So......gotta check the Chicago law.

that is my concern. I imagine chicago law is a draconian as it gets concerning guns.

I know a lot of states now have those "stand your ground" laws, i know my state of Pennsylvania is in the process of pushing one throught the state legislature, but i can't imagine chicago has one.

I doubt they will press charges. The last thing Dick Daley needs on his anti gun PR offensive is a poster child like this 80 year old vet who probably would have been murdered along with his elderly wife had he not shot the intruder.

Most of the guns that were turned in were rusted out and probably hadn't worked in years but they still got the gift card. That's 7 very long minutes if a 30-year old (strong, prime of life) armed goblin is kicking in the door. At the risk of outing myself as a complete gamer moron nerd, let's break that down. there are 6 melee rounds (about 10 seconds) in 1 minute. That's 42 chances for the goblin home invader to successfully enter the house, kill or injure everyone inside, and quickly loot the place before the police cruiser pulls up outside. Want to try out the chances of success on that? Add 6 more rounds/chances for every additional minute it takes for the police to arrive. If the homeowner has a firearm available, his chance of preventing the goblin from breaking in & wreaking havoc are at least equal to the number of shots currently loaded in it.

Politicians and activists who don't want want regular American citizens to own and use firearms want the goblin to break in, do his worst, and evade justice. They may not desire our communities to be overrun by goblins, but that is what is going to happen.

69 exdem13, you expose the problem of modern combat games. In a CQB the rounds are a lot shorter then days parry, thrust, riposte. Most modern weapons can be reloaded in 10sec. So go with a melee round 1sec, a standard action 10sec. If your unarmed, 7 minutes provides a lot of time for goblin mischief.

We had those here in San Diego.  A friend a mine went to one of these events with a sign that said "See me first.  I pay $100.00".  He got some pretty good deals on some very nice rifles.

U.S. Army Gant fought to keep us free. When he returned from war, we were entering a proseperous time in America. Now, it sounds like his neck of the woods looks more like the Korean villages he likely fought through. SOO glad that shooting a gun is like riding a bike....you never forget! HOOO-RAH Mr. Gant! 94 As of right now, both Daley and Weiss are unwilling to comment on whether the man will be charged. Daley did say "we can't have people running around like it's the widl west." This is a big slap in the face to Daley and his gun ban just days after he threatened to shoot a reporter to show the gun ban worked.

95 Oh and I was kicked off of Hot Air after the health care bill passed because they dug up a 2 month old post in which I said we need to win elections, protest, change hearts and minds to stop the violence that always follows tyranny. when i couldn't log on I emailed Hot Air thinking it was technical. Allah emailed me back saying how i was promoting violence and my brand of hate speech was intolerable. Never mind i was pointing out how to stop violence. I think Hot Air checked out of the sanity department a while ago and became way too thin skinned. They seem to be too fond of the banhammer.

The 80 year old Korean War vet will not be charged for shooting to death the 29 year old burglar, just heard that on the radio. 

Heard a Mayor Daley soundbite that went along with the story, he's stammering mad about the whole thing and kept blabbing about how access to guns is the whole problem.  Um, if it wasn't for access to guns, right now that 80 year old man, his 83 year old wife, and their young grandson would be dead, because once guns are outlawed only outlaws have guns.
