ThatÂ’s the scenario Dave Kerber, the chairman of the Arapahoe County Republican Party, spells out in the most complete memo to date about what what happen if GOP gubernatorial candidate Dan Maes fails to capture 10 percent of the vote in November.
Some of the impacts already have been discussed, including fund raising and ballot position, but Kerber pointed out Republicans would be reduced to minor-party status is both 2012 and 2014.
Maes has been struggling since former GOP Congressman Tom Tancredo joined the race on the American Constitution Party ticket, arguing that Maes canÂ’t beat Democrat John Hickenlooper.
HereÂ’s KerberÂ’s memo:
MINOR PARTY STATUS
“First the determination of whether the Republicans would be a minor party is if the a party’s candidate for Governor receives less than 10% of the vote. Should Dan Maes receive less than 10% of the vote, all Republican candidates for the next two election cycles 2012 and 2014 will have minor party status.”
BALLOT PLACEMENT
“The current rule is that the major parties (currently Republican and Democrat) have a lottery to determine which candidate will be first and second for all races. Then the minor parties have a lottery to determine their respective order beneath the major party candidates. Finally independents appearing on the ballot through petition will have a lottery to determine their ballot placement below the major parties and minor parties.
“The effect of the designation of minor party status for the 2012 election would be that our candidate for president will not be in the top two lines which will be reserved for the Democrat and American Constitution Party candidates. We will be left to compete for ballot position with the Greens, Socialists, American Communist Party, Libertarians. Prohibitionists etc.
“Our state house and senate candidates will similarly be relegated to bottom positions. In 2014, when we have our US Senate, Governor, Attorney General, Treasurer etc races, again, we will be at the bottom of the ballot fighting the libertarians etc for ballot placement. As we all know, being at the top or toward the top can mean several percentage points in the vote, enough in a close race to secure victory.”
FUND RAISING:
“Being a minor party can cut the ability of our candidates to raise money. Under Colorado law if a minor party candidate is designated by the party’s assembly for the ballot, that candidate will automatically be designated for the general election ballot without the need of a primary.
“The purpose of this was to save County Clerks from having to print up and distribute minor party primary ballots where there are so few voters and a primary would be meaningless. The major parties on the other hand are on all primary ballots even without competition. As a minor party, all of our candidates who would not face a primary challenge would automatically be designated for the general election ballot.
“The problem arises in that campaign finance rules allow for a State House candidate, for example, to raise $200 in the primary election and $200 in the general election. As a major party and therefore a primary, all our Republican house candidates can raise $400/ donor. As a minor party, that candidate would only be able to raise $200/donor for the general election only.
“The Democrats, as a major party, would continue to raise $400/donor. This would put our candidates at a great disadvantage through two election cycles.”
Kerber pointed out the finance rules does not apply to federal candidates for Congress.
He appealed to Republicans to consider the consequences of shunning Maes.
“We need to take a longer view and not damage our good Republican candidates in the 2012 and 2014 election cycles by dropping into minority party status,” Kerber wrote. “It would truly be an embarrassment to our party and in a close election potentially damaging to the country to have voters have to search (the ballot) for our 2012 presidential candidate.”
If Tancredo wanted to run, he should have run in the Repub primary. He didn't, so fuck him.

And Hick needs a new ad if he is still running that one. He was using that in July.

I'm living in Western CO and people here are pissed. The job losses here are huge...not NV huge but getting there. People are gun totin' individualists who love their freedom and country a la Pinera vice Obama.
There have been huge Tea Party rallys since the movement began at least here in the west. Tancredo is sure to carry the day here.....don't know about Boulder, denver, etc.

Hickenlooper refused to answer. I think he was surprised that even Silverman sort of turned on him. You know- liberals are supposed to stick together no matter what. I vaguely remember that there is/was speculation that Hickenlooper may have given money to a left-wing group who supports radical Palestinian causes.
That's where I give C&S credit. They sometimes dig into issues the MSM won't touch. Especially if those issues reflect poorly on a lib.

This may all be true for CO but there are ways around everything. For instance the auto listing, double raising of funds for primaries vs general election. All the Rs would have to do is sign up a token opponent for every race so it looks like a primary. The biggest way around all of this is if Tancredo wins and he switches back to Republican, then everything is as it was before. The worst case scenario is if Maes gets less than 10% of the vote AND Tancredo loses. Then the Rs will have to do all the workarounds for 2012. But only 2012. Any R candidate for President in 2012 is bound to at least finish second so things are back to 1-2 for Ds and Rs for 2014.

I've decided to vote for Tancredo. I believe Maes would have won with a unified party behind him. The negative ads directed towards Maes are nothing compared to the ads against Buck and Buck is going to win his Senate race.
I'm pissed at Tancredo, but the GOP has a chance to recapture both Houses of the legislature and I would like to have a conservative governor when it come to redistricting. Among other things, Democrats want to shift 25,000 voters from the ultra blue CO-1 to the balanced CO-7.
I am concerned with the ramifications of the GOP being a minority party and it's going to be extra painful if Tancredo doesn't win. The state GOP suffers from incredibly inept leadership.
I've seen one ad being run for Maes, a couple for Tancredo, and a couple of new ones for Mayor Opie. There may be no room for gubernatorial ads because the airwaves are wall-to-wall with Buck/Bennet and pro/anti-Markey ads.

Maes was flawed from the outset, and many of us knew it... he was sooooo going to loose.
I'm glad Tanc is in, and will support him...
As to the Minor party stuff, its never been challenged in court, so could very well be Unconstitutional, as it gives some Parties a clear advantage over others... and it could also easily be changed in the State Legislature (where Repubs should also make big gains this year from what I can see sitting in South Denver)
