— Gabriel Malor Talking on Meet the Press this morning, House Majority Whip James Clyburn says Pelosi is full of shit, in so many words:
You just heard Mr. Axelrod say that he is confident, Congressman Clyburn, that the bill will be passed. As of this morning, do you have the votes that you need?REP. CLYBURN: No, we donÂ’t have them as of this morning. But weÂ’ve been working this thing all weekend, weÂ’ll be working it going into the week. I am also very confident that weÂ’ll get this done. I have been talking to members for a long time on this, and they have the will to do it. TheyÂ’ve been looking to us to create a way to do it. I think we have gotten to a place where we do have the way to do it, and I think the members are going to, to vote for this.

They're going to add more districts to the House until they can get a majority. Maybe we'll wind up with a North Dakota 99, Virginia 12, and a Rhode Island 2, 3, 4, and 5.

Pelosi & Co. may be out of touch with reality, but that have a disturbing tendency to shape reality to fit their vision. And that's what scares me more than anything.

Posted by: Z Ryan at March 14, 2010 04:01 PM (cMo6P)
Let me get this straight:
1. If they can't get the votes to pass the Senate bill, they're going to pass a "correction" bill separately, meant to proscribe the changes the House wants to see (i.e. abortion language)
2. They will then change the House rule and deem the Senate bill as having passed the House.
3. The conference committee will merge the corrections bill and the Senate bill and send it to Obama to sign.
Am I describing the Slaughter option accurately? Seriously, I don't quite understand how this will work.
Grateful for any explanation.

2nd, they will not let this go because, B to the O has staked His presidency on it.
The 2 are interrelated because the demos, at their core, have no regard for the Constitution, our laws, or the governing principles this nation was founded on. If they are willing to circumvent the Constitution for BtotheOCare, then they will surely have no hesitation to pull similar yoga maneuvers to keep B to the O in office for life.
Think it's far-fetched and lunatic fringe, right-wing nutter thinking? Ask yourself if what's going on right now was even fathomable after Scott Brown won just a few short weeks ago?
The only questions that remain, IMO, are when does the revolution start, what is the final trigger to start it, and how bad does it get?
I pray that I am wrong and that somehow all of this goes away shortly, but I can see not alternative endings, as this leadership has gone all in on a full-on statist takeover of our nation. And unfortunately enough of the populace is in favor of socialism to go along quietly.

No. All the procedural shenanigans are designed to AVOID a conference, or anything else that would return the bill to the Senate. If the House were to amend the Senate bill, the bill would go back to the Senate with a message from the House asking for the Senate to concur in the amendments, i.e., to pass the bill as amended by the House, or alternatively to appoint conferees. Either of those things would require a cloture vote in the Senate with a 60-vote supermajority.

I give the GOP about a 90% chance of taking the House, but there's no way it'll be a 2/3 majority. I give the GOP about a 10% chance of taking over the Senate: they'd have to essentially run the board nationwide to do that, keeping in mind Joe Biden's tie-breaker. Even if they did, their majority would be one vote. So, unfortunately, that "probably" is more like "definitely."

This is what I meant when I said I can't trust what anyone's telling me -- both sides are so adamant that it's impossible to get an accurate, dispassionate assessment of the situation. Something tells me that if/when this thing gets voted down, they'll just keep doing it again, harder, until it finally goes through. It's the same tactic as the kid who won't stop asking his parents for something until they're finally so worn down that they say yes just to shut him up. (The parents in this case being the congressional opposition.)

I'm just trying to figure out how this "Slaughter" option could even be remotely Constitutional.
IF they do execute this plan, I'm wondering if the Supreme Court might take this up immediately, emergency-style like Bush v. Gore. On the surface, it seems like it would be a 9-0 slam dunk rejection.

It's time to pull the plug
"Health reform: Down the stretch it comes. President Obama has gone so far as to postpone an overseas trip in a last-ditch push to get a comprehensive reform bill to his desk.
He shouldn't waste his energy.
Not with unemployment justifiably the nation's top concern and the possibility of a double-dip recession still looming. Remember how Obama said, in his State of the Union reboot, "Jobs must be our No. 1 focus in 2010"? Well, apparently he doesn't.
Not with the American people abandoning the President's prescription in huge numbers. Just one in four voters supports the reform bill as written; half want Congress to start over. Compare that with the popular support other major pieces of social legislation enjoyed before passage, like welfare reform (68%), Medicare (63%) and civil rights (60%)."

"Not with health care costs having risen 73% over the last decade - with Medicaid growing at 21% a year - and showing no signs of coming down to Earth. Controlling costs is the absolute, unconditional, a-blind-man-could-see-it prerequisite for expanding coverage.
Not with American health care quality actually quite impressive in many respects, including world-leading rates for patients surviving cancer and among the shortest wait times for hard-to-find treatments and surgeries.
Not with a half-dozen accounting gimmicks built into the legislation - including the fact that federal budget projections are based on 10 years worth of tax collections and just six years of spending increases.
Not with the Senate, lacking even a single Republican vote, having to resort to reconciliation, a little-used parliamentary maneuver, to get it through. Sure, it's been used before - but not on anything that has such limited public support.

Think about it: all the Dems have to do is say "OK, let's just start over and do it exactly the way Obama promised we would." and you know what, they might get a bill!
But that way they would not get 100% of the credit, and they would not get 100% of the power.
So what do they really want: a) Healthcare, or b) all the credit and all the power?
I'll take b), for the mortgage, Alex.

Gerrymandering creates "safe" districts that stay "safe" during normal times. BUT, these are not normal times. A 10-15% swing the other way can destroy any "safe" gerrymandered advantage. That 10-15% can come from independents, defecting democrats or extraordinary Republican turnout.
If the double-dip comes between now and then, which seems quite likely, the Democrats will be blamed because they've already vociferously taken credit for the "recovery"; hence they own it all now. I doubt even the media would allow them to pin the blame for a double dip on Bush at this point.

they don't have the votes and they won't use the slaughter solution. How is it that alot of dems will not use the reconciliation process cuz it wasn't meant for this but they will make it up as they go, violate the constitution and effectively destroy all law?
You've got the same handful of corrupt idiots making the slaughter claim that made the redconciliation clai.m: Pelosi, Ried, Gibbs, Hoyer. Notice the dogs that aren't barking. How many Dems that voted yes the first time have not spoken publically how they will vote this time? Abot 200? As if Pelosi would allow them to go on record. And how is it that they would use an illegal and impeachable tactic AND let it be known they were going to almost 2 weeks before voting? If they were going to use it, they would have either done it immediatly or kept it completely queit so it wouldn't get out
I can't help but think they are pushing people with insane ideas they "have the votes for" in the hopes people wil ldo something stupid. All but the insane leaders were queasy about reconcilliation, they are even queasier about throwing all law in this country out. It's the same lefty tactic we have seen again and again-up the ante to try and make your opponent afraid. Big mistake on their part, it just made people that didn't feel strongly about it, now livid.

Here are a rundown of Obama's problem according to Sun Tzu,
The Moral Law: The leaders and rank and file must believe in the cause. While Obama, Pelosi and Reid are behind this not many democrats are as they are more concerned how this will effect their election come NOV 2010.
Heaven: This is the conditions He is operating under. The Political Situation is not in his favor, the public is more concerned about jobs not health care.
Earth: This is about logistics, getting the message out. For a community organizer and campaigner, he has had trouble getting the message out as the Tea Parties and private citizens have taken charge of the debate and turned it to their favor. Obama has been trying to rally the troops , SEIU, ACORN and college kids. Kids should be behind him as they came out in drove to vote in the elections, they too are more worried about the economy, 18-35's are not all that worried about Health Care at this point, many are becoming disillusioned on the president as well.

27 : Clarification Request
Ok, as I understand the Slaughter proposal, more or less it would work something like this. The House has passed one version of Obamacare, the Senate passed a much different version. In order to be eligible for reconciliation, a bill first has to become law. Now, in order for this thing to become law, either the House has to pass the Senate version and have it signed by the president, or the Senate would have to pass the House version and have it signed.
Since there is no way to get the House version passed in the Senate, their concentrating on getting the Senate version passed in the House. The problem is that most House members don't really like a lot of what's in the Senate version, and once this thing is signed into law all the Senate has to do is deny any changes and reconciliation dies and the Senate version is still law.
Since a lot of House members don't trust the Senate, the "Slaughter Rule" is basically and end run around this process. The House would "deem" the Senate version into law without really voting on it or having the president sign it. Then they would make revisions to it, and then present that for reconciliation. The Senate version would never actually be enacted into law so the House members wouldn't have to depend on the Senate to keep it's word and fix it after the fact.
In essence it's a total short circuit of our Constitution. The House does not have the authority to "deem" something into law. In order to be considered a law it has to pass both the house and the Senate by 2/3 majority vote and be signed by the President, period, according to Article 1 Section 7 of the United States Constitution.
However unless it is already a law it can't be considered for the reconciliation process to begin with, so basically what were looking at here is a monumentally terrifying power grab. If this is allowed to stand you'd no longer need a 2/3's majority vote in either house to get a law passed, just a simple majority and you could pass any legislation you wanted, something our founders were absolutely crystal clear on, that is a huge no no.
So if they do manage to pull off this serious feat of legislative prestidigitation you might as well shred the Constitution, because it will no longer be worth the paper it's printed on. Not sure what's worse, the fact that they even suggested such a thing or the fact that as of yet almost no one in the media has started screaming bloody murder over this, because they should be and they shouldn't stop until this whole "Slaughter Rule" nonsense is stopped dead in its tracks.

Against this is the vague, unquantifiable notion that Obamacare is a huge power-grab by govt, or that it will worsen the deficit. First, what Dem gives a crap about either point? And second, such charges can easily be dismissed as merely speculation by conservatives.
Pelosi/Reid/Obie have put all their prestige into passing this, which means that *literally*, no bribe is too big or too brazen to be ruled out. Show me a congresswhore who will refuse the biggest bribe the Dem leaders (spit) can offer--I'd be most surprised to find even one. And remember, Pelosi-Reid-Obie can work on ALL the no's, and only have to turn 2 or 3. And once they have the votes, the gravy train stops. If you were a congresswhore, you wouldn't want to wait one minute too late, would ya?
InTrade thinks this will pass. So do I, even though I think it's absolutely wrong.

As I wrote in my first post on this topic, human rights and human dignity must be at the center of any health care discussion. Government health care will not reduce the cost of medical care; it will simply refuse to pay it. And who will get left behind when they have to ration care to save money?
It will not pass. They don't have the votes. The Slaughter strategy will become a bigger albatross than the Alien and Sedition Acts. They're utterly fucked.

First, they've been hardly working on it. None of them even read the damn thing! Obama got them all psyched up for this with the Stimulus Bill. They thought the money train was rolling in, but despite the negative nellies here insisting bribes solve everything -- this ain't Chicago.
Obama has never had to deal with opposition, and there are career politicians thinking about the long term. Bribes are all fine and dandy for the here and now, but do you think they would give up their cushy jobs to satisfy his ego? NO. Otherwise, this would have been wrapped up long ago.
Let's revisit his list of failures... shit, someone else can do it. Off the top of my head, Copenhagen, Gitmo, the Olympics. It was an SNL skit.
