— DrewM Yeah, I'm pretty sure that the actions of Democrat Bob Etheridge of North Carolina fit the definition of assault.
The Congressman says he has a right to know who these two college kids are. Um, no. Actually, they do have the right to do exactly what they did, the Congressman can even look that up.
Etheridge is no doubt a little cranky about being tied to the Obama agenda because, well, it's killing him. Especially on health care, which he wound up voting for despite what his district was telling him.
In EtheridgeÂ’s district 47% of voters said theyÂ’d be less likely to vote for him this fall if he supported the bill. And 47% said theyÂ’d be less likely to vote for him this fall if the Democrats in Congress passed the bill, regardless of how Etheridge himself voted.
I hope these kids file charges.
BTW- Am I the only one surprised to find out that a Congressman who voted for ObamaCare is actually a violent tea bagger? Big tent indeed.
Update: Bob "Hands Of Furry" Etheridge has himself an opponent, Renee Ellmers. I'm not saying you should vote for her because she's a nurse and an attractive woman. That would be wrong. I'm saying vote for her because she calls ObamaCare,, um, ObamaCare on her website and seems to be solidly on the conservative side down the line.
Her campaign really needs to use this Etheridge video in a spot. Start with him saying "Who are you" and then cut to voters saying they live in the district and are upset with his votes on issue a,b,c, then show the Who Are You? bit and have Ellmers say, "I'm Renee Ellmers and I approve this message because it's time we send a conservative to Washington who will fight the Pelosi/Obama agenda, not citizens who ask questions".

There's nothing to be gained from willingly giving up your rights, especially your right to self-defense. The kid likely didn't hit the shitstain dem because he feared being jailed for it. Sure the Kennedy's are nice drunks but the problem with them is that all too often the Kennedy ego writes a check that the Kennedy central nervous sysstem can't cash. For example
- Driving a car onto a footbridge at 2 in the morning while drunk
- Flying a plane into foul weather even though you're a rank amateur pilot

If it's legal, how can it be imprudent? If it's legal, then the result of the confrontation would be the police coming in and the traitorous dem being jailed. But, I understand that you are really worried that the kid would hit the shithead in defense and the kid would end up in jail. My vision for how to vector that one in ten is that the electorate has to be en masse shifted to the right then polarized against the hard left. Which means leaning the squish in our direction. The election commission has already said this is BS.
2. Anecdotal evidence from voters and poll workers that there were "extremely unusual" incidents during the primary. These included voters who repeatedly pressed the screen for Rawl only to have Greene's name appear, workers who had to change program cards multiple times in the voting machines, and at least one voter in the Republican party who had the Democratic Senate race appear on her ballot.
"Anecdotal" means a couple of ignarant poll workers. Doesn't rise to enough to offset the HUGE number of Greene votes. This should be thrown out.
3. A well-documented unreliability and unverifiability with the voting machines used in South Carolina.
Well documented???? This is the first I have ever heard of it. If it is so well documented why are we still using them? The Dems have been happy with the machines before. This sounds like BS. Should be thrown out.
My prediction; unless he comes up with more OR we have a payoff he will get nowhere. If the election is thrown out look for Greene to protest to the DOJ and if he does, since we are under Title V it will all get tied up in court.

I know I'm going to catch shit for this but I can sorta, kinda sympathize with Etheridge. He was just walking down the street minding his own busines, not bothering anybody, and without warning two strange yutes comes out of nowhere, points a camera phone in your face and started asking him questions.
I don't care who you are, that would be at best damn annoying and at worst a potentially dangerous situation for the congressman. Just because claims of tea party violence is bullshit doesn't mean violence in general isn't possible.

The more power you have in America, the less you are expected to use it. Even if somebody's offending you.
On a scale of 1-10, pointing a camera at a private citizen in public and questioning him is grounds for a harassment charge or maybe a punch to the solar plexus.
Not so for a public figure. He's expected to either answer the questions or go on his way.
As for the potential for violence to the Congressman, that's ridiculous. A couple of clean-cut kids with a video camera in daylight isn't a likely set-up for an assault. No jury would take his side.

The only reason that the congressman is 'apologizing' is because he began to realize that his actions have placed his a** in a sling - and for no other reason. He no longer thinks he can get away with it so he is trying to limit the damage.

What the victims here probably need to do is sue Etheridge civilly.

As a crime that existed at common law, an assault, at least in a public place as here, is probably a breach of the peace. A glance at the DC Code shows it's only punishable by up to 180 days, so it's a misdemeanor rather than a felony. But there might arguably have been a felony committed here: if not enough to prove beyond a reasonable doubt and charge criminally, at least to assert for purposes of piercing civil immunity.
In Florida, where I practice, what Etheridge did could at least theoretically be charged not only as misdemeanor battery, but because he restrained the victim and kept him from moving away at will, as false imprisonment, a felony. DC does not appear to have the crime of false imprisonment, but just maybe one could argue these facts amount to kidnapping, which appears to encompass what here would be the separate offense of false imprisonment:
"Whoever shall be guilty of, or of aiding or abetting in, seizing, confining, inveigling, enticing, decoying, kidnapping, abducting, concealing, or carrying away any individual by any means whatsoever, and holding or detaining, or with the intent to hold or detain, such individual for ransom or reward or otherwise, ... shall, upon conviction thereof, be punished by imprisonment for not more than 30 years." DC Stat. § 22-2001 (emphasis added)

Meh...my first gut reaction was that I wouldn't have shown the restraint that those kids did, and it does look worse for Bob to be an uncontested bully.
My second thought is that Billy Beck is indeed right....all politics now is just dress rehearsal for civil war.
My third thought is that ten, or even five years ago, we probably would have cheered a pol who wouldn't put up with being accosted on the street by kids posing as journalists. But now, we need to use Alinsky tactics at all times, and give no quarter. There should be at least one R congresscritter demanding his resignation no later than tomorrow, and other Dems should be asked to denounce this mans behavior, no dodging allowed.
