— Gabriel Malor The proposal was made by some birdwatcher organization on August 3 and then opened up for public comment by the Environmental Prosecution Agency. That comment period was supposed to run through October, but after the bullet-ban proposal got public scrutiny this week, the agency suddenly remembered that it doesn't have jurisdiction over bullets. Really (PDF):
EPA has determined that TSCA does not provide the Agency with authority to address lead shot and bullets as requested in your petition, due to the exclusion found in TSCA 3(2)(B)(v). Consequently, we are denying that portion of your petition.
It took four weeks for EPA to figure out its own authority? I doubt that very much. Somebody at the agency, a libtard, thought this was a great idea. But that same somebody forgot that the Democrats, including the President, do not want to talk about gun rights because their always on the losing side of public opinion. So when this started to get public scrutiny this week, I bet you a beer the order to circular file this petition came from a political appointee.
EPA isn't all that popular at the moment after its botched participation in the Gulf spill cleanup. It also stands to irritate a substantial portion of the country when it starts its own carbon regulation scheme. As Ed Morrissey notes, EPA's actions threaten to inspire a bipartisan move to de-fund the agency.

The problem is that lacking a new budget, they will probably be budgeted with a "continuing resolution" which will maintain the status quo. For all the good work that is done in part by the US EPA, there are serious problems of oversight that the Congress has neglected for years, under Republicans too. This is an agency that really needs to be pruned back and brought under control.
I deal from time to time with one small part of the US EPA, and frankly if a comet crushed EPA HQ, the country would be better off. There are some very bright and helpful people there, but it is managed by a very arrogant and dismissive permanent bureaucracy, which is.....well, let's say that affirmative action runs strong with this crowd.

Congress is not my strong point, but the continuing resolution would have to be approved by Congress, wouldn't it? If the whole point of setting a "previous year - 15%" budget was to reign them in, why pass a continuing resolution?

A scrap yard had called him out to do an analysis on a large load of scrap they had brought in and didn't know what it was. He said it was stamped "depleted Uranium" and he wanted to know if there was some special thing that had to be done with it.
I told him to tell the scrap yard to get rid of it because they probably needed a license from the NRC to even have it. Also told him to get on the phone and tell them not to put it in a smelter to melt it down because it takes a lot of special protection gear for that.

Believe it or not, that is what the EPA says to do with them. They say there isn't enough Hg in them to be a hazard.

I don't know about NV but a federal court did that to Saint Louis a few years ago. St. Louis should have taken it to the Supremes but they didn't. At the time probably wouldn't have because there were a lot more liberals on the court then.
In any case the problem with States and the courts is that their own Constitution does them in. Most State Constitutions have some provision in them for "free education". That opens the door to court intervention.
Keep in mind that there is no such wording in the federal Constitution and at the time it was written the idea of "public free education" had no been promulgated yet.
That also came with the "progressive era". But, the courts can not order "congress" to fund anything. They may try if they get enough liberals on the court but they may find their self all of a sudden with a lot fewer members since congress controls the size of the courts.

Last week, hubby and I dumped a bunch of old paint onto a huge piece of cardboard so we could legally throw them both away.
Yeah, 3 inches of not-quite-solid gunk in the can, you need to make an appointment for special handling at the landfill. Pop the lid and leave it out for a day or two here in the AZ sun, throw it in with the regular trash.

LOL, I read a report several years ago about the first court case brought against the EPA on second hand smoke.
The judge reviewed the evidence and threw the EPA out of court saying that they violated their own rules in such a wholesale manner all of their evidence was tainted.
The EPA in typical liberal fashion ignored the court and continued to enforce their rules. The problem wound up being the local communities jumping on the bandwagon.
Sure the government can control smoking in "their own" buildings but then the big PC companies and locals got into the act.
All based on BS phony science and lies (just like AGW)

Boston is trying right now to ban smoking in all their public housing. When I heard that, at first I as like that's good: the city is paying the bill so they can make the rules. Then I was like waitaminute! and I came to my senses.
1) The taxpayers are paying the bill.

We never used pliers to crimp the splittshot LEAD sinkers, we put them in our mouths and used our teeth. To this day, (40 years later) I dont know of any Birth Defects or Deaths from Lead Poisoning among our group.

They never could get a pure coincidence = causation link. What they wound up doing is feeding all those poor lab rats pounds of nicotine and tar they got from machines which "smoked a large number of cigarettes at a time.
What they gave to the rats was enough to be the equivalent of feeding a human a ton of the shit. Yeah, some of them got cancer. I am surprised that ALL of them didn't just die right out.
That kind of "science" is what has now given us all of our pollution limits. But in any case, it took literally massive quantities of "smoke" to get an increase in cancer rate among those rats yet they try to say the same thing now with minute amounts of smoke from someone else smoking.

From what I remember, and I could be wrong, the studies in actuality found that children of smokers suffered a smaller risk of lung diseases later in life. statistical shit like the "hockey stick" was all that came out of it. It was a complation of studies with a phony analysis.

There are other studies out there besides the one from the EPA. That may be one of those. I have never seen one though that was not absolute bull shit.
In fact, I now automatically go into the shitcan mode any time I see any news media column on anything that begins with the term "studies show".

@fixerupper Is there a danger to prolonged exposure to lead. Yes..... but based on the my results and my general level of exposure.... I think the whole lead danger is VASTLY overstated.
Pretty much: there's a real danger from lead if you actually eat a bunch of it, or (more likely) eat something that concentrates lead (it can be a problem with some fish, and some bird that eat those fish). There's certainly some legitimate room for government regulation of lead in consumer products, but the danger is way overblown (like just about every danger in life, except driving).
Same deal with depleted uranium, BTW - there's no radiation danger, but it is a heavy metal.

Not true. U-238 is an alpha emitter. If you do anything to make it airborne and breath (or eat it) it it will eventually give you cancer.
That includes grinding, welding, or smelting the metal.

And the Republican House needs to work on that "defunding" as the first bill they do. They need to break up these big huge omnibus budget bills into several separate bills so they can attack specific wings of the executive branch bureaucracy. Like the EPA, FDA etc.
Zero out stuff like CO2 monitoring and regulation and if Bami vetoes it fine, no budget for them at all.
