If you exclude some customers for any legal reason from any commercial transaction you have to do so in advertising, otherwise you could get sued. (must be 18, offer not valid in CA)

If the scholarship is private charity, then it's pretty simple: private donors can give to whomever they choose and aren't obligated to donate to anyone else.
In the case of housing discrimination, restrictive covenants don't restrict what you do with your own property -- but restrict who can become the NEXT owner of your property, with an eye to limiting the freedom of the "wrong kind of people" to engage in commerce on the same footing as anyone else and to live where they can afford to.
The two things are qualitatively different.

The case was JONES v. MAYER CO. and reads like the abomination that it is. They ruled that deed covenants were in fact unenforceable because the law prohibited their action but that the advertising could have the desire of the covenant in it.
Their justification for congress regulating sale or rental of private property for the purposes of race was made possible by the 13th amendment. The second part of the amendment said congress shall have the authority to legislate fore the purpose of prohibiting slavery.
I guess that if Joe Sixpact can't refuse to rent his house to a black he is engaging in slavery. This was obviously a very bad reasoning because it took them several pages to justify this link.

Last I checked UNCF was a corporate non-profit meaning that yes, as a corporation, if they participate in racial discrimination, they are essentially doing so with government permission. A corporation does not have the "right" to racially discriminate like natural persons in their transactions.

You could argue that the wholesale denial of the ability to participate in commerce and reap the fruits of their labor essentially forces them to labor without fruit. (Which any dietitian will tell you is bad) which could, if done on a large scale, become an equivalent to slavery.

I would have tied it to the 14th amendment if I were going to rule as they did under the equal protection clause. That is a stretch as well but is a closer fit than the 13th.
Personally, I think the law IS unconstitutional and I agree with Rand Paul. Be that as it may there is zero chance of getting rid of it.
Hell, they upheld section V of the voting rights act recently which is blatantly unconstitutional.
