Health Care...What's Next?
— DrewM

Well, it's still America so the obvious answer is.... more laws and lawsuits!

Bills and resolutions have been introduced in at least 36 state legislatures seeking to limit or oppose various aspects of the reform plan through laws or state constitutional amendments, according to the National Conference of State Legislatures.

"There's going to be a big free-for-all lawsuit about this," said Michael Bird, legislative counsel for the NCSL.

...So far, only two states, Idaho and Virginia, have enacted laws, while an Arizona constitutional amendment is seeking voter approval on the November ballot. No anti-health care reform legislation has emerged in Democrat-dominated states like Illinois and New York, according to the NCSL.

Idaho Governor C.L. "Butch" Otter signed a bill on Wednesday allowing the state's attorney general to file a lawsuit opposing federal healthcare legislation requiring individuals to buy medical insurance.

Otter sees federal legislation as overreaching and bound to add to medical expenses of state governments, spokesman Jon Hanian said .

"He's concerned we can't afford it," Hanian said, adding that Otter, a Republican, is disappointed in how the Democrat-led U.S. Congress is handling the legislation.

Florida's AG (who is also running for Governor) and his counterpart from South Carolina have vowed to sue over the individual mandate.

Right now we are pretty sure the underlying Senate bill will pass tonight. After that the Senate may or may not take up the reconciliation "fixes" and even if they do, big chunks of it might not survive the process. Then on top of that there's the possibility that one of the linchpins of this disaster, the individual mandate will be thrown out in court.

As crappy as this system they are about to pass is, it could actually get worse as pieces are pulled out leaving gaps in funding and 'logic'. All this risk is being taken simply because Democrats are desperate to get something, anything, on the books. Once it's there the issue will be how to 'fix' it, not get rid of it.

It's breathtaking in its recklessness. In other words, about what you would expect from Democrats.

22 Anyone catch Stupid talking to Greta when she asked about "preexisting conditions" and it appeared the bill only covered "preexisting conditions" for children? She asked him "children or adults", then he said children and then he evaded.

So here's what's built into the system, my peeps:

Further down the line when the system is inevitably going bankrupt....

Because preexisting conditions for kids must be covered, all wombs will eventually have to be screened for certain "preexisting conditions". If that condition falls into a certain category, then because that "future" child must be covered under the terms of the bill, what follows is the federally funded mandatory abortion to save society the burden. It's built in. It's a feature and not a bug. Call me whatever you want. This is why I believe abortion is covered in the bill by the party of death.

Ezra Klein

The Stupak negotiations have been vaguely farcical from the beginning, as the bill is already very restrictive on abortion. But the upside of the farce is that the deal theyÂ’ve reached isnÂ’t particularly objectionable: Barack Obama will sign an executive order stating, essentially, that the law will follow the law.

——–

Daily KosÂ…

WhatÂ’s particularly galling here is that the executive order reiterates the Senate bill, which Stupak could have accepted weeks ago.

27 They said Prohibition was forever too. They even amended the Constitution to enact it. America was half as big then (a lot smaller House), and a far different place politically and ethically/philosophically than it is now. And the Volstead Act took something away that most Americans liked or at least were ambivalent about (booze); it wasn't an entitlement program.

Oh yeah.  Won't take long at all for "right to abort" to become "responsibility to abort" to become "required to abort."  They won't phrase it that way, they'll just say, "if you give birth to this baby, it can never see a doctor" and then make it a crime for doctors to provide care for such infants.

When they start throwing around language forbidding the feds from collecting taxes to pay for this, I'll believe they are serious. I mean, big deal: They pass language against forcing people to buy insurance--whooptido--and all the while the citizens of the state are bled dry in taxes paying for the damn thing anyway!

What there ought to be is resolutions calling for the expulsion of all federal enforcement agents from the state--that is, no citizen of our state will be forced to pay any federal taxes--let Obama call in the military to enforce his law and his taxes.

61 Abortion is a side-issue in this bill. Don't focus too much on it, regardless of the fireworks today. The bigger catastrophe waiting in the wings is the financial collapse it will inevitably bring as the Boomers continue to age and their health declines. We're going to be funding the old at the expense of the young, which means that the young will either go elsewhere or simply stop contributing. Which is not a good recipe for keeping a civilization on a paying basis. We can keep this shell game going for awhile. At least as long as the suckers who are still working can be fooled into thinking that their own benefits will be there when they retire. But it's a lie: this Ponzi scheme can't go on for more than 20 years or so without a massive cash infusion, either by creation of new wealth (highly unlikely given the anti-business ethos of the Democrats) or by inflation of the currency (bad news if you've invested in T-bills). And taxation makes starting or running a small business a nightmare, and actually hiring full-time employees pure madness. Just remember: just having insurance doesn't equate to actually getting healthcare. Democrats just don't seem to understand that (or they plan to jawbone doctors and hospitals into staying in practice even when it is not profitable to do so -- tyrannies always resort to coercion and force when platitudes fail).

77 There should definitely be legal challenges. The majority of Americans do not support this bill, and every poll shows this. Congress is ignoring us. It is obvious that congress no longer represents the will of the American people. We, the people, do not have representation in the people's house. They give themselves pay raises, and then raise our taxes to pay for them. They look down on us, yet tell us that they are acting on our behalf, and in our best interests. They refuse to answer their phones, and they do not hold town hall meetings. They do not respect us; they think we are common, and unsophisticated. Because of their refusal to listen to us, we really have no other choice. We must challenge this horrible bill, and advocate for ourselves and future generations. I will be happy to donate any money that I can to a legal challenge. May it drag out for years, and may every single irresponsible member of congress that supported this bill be kicked out of congress by the very people that they have ignored, maligned, dismissed, and disparaged. Their arrogance is astounding, and we should no longer bank roll such hubris.

80 Meg Whitman will win in a landslide in California if she goes along with the anti-Obamacare state legislation tide.

Shes likely to win now though over Moonbeam anyway though.

The states that will ironically push back the hardest will probably be states like California and New York whose liberal governors BEFORE this vote screamed bloody murder about its cost to their respective states...and their representatives failed to give them a Nelson-like deal.

Oh yeah.  Won't take long at all for "right to abort" to become "responsibility to abort" to become "required to abort."  They won't phrase it that way, they'll just say, "if you give birth to this baby, it can never see a doctor" and then make it a crime for doctors to provide care for such infants.

We're headed towards 'back-alley births'.  No, I'm not kidding...

Dennis Miller says everyone should file for a tax extension at the last minute. It's legal, and if enough people do it at once it would shut down the government.

88 27 They said Prohibition was forever too. They even amended the Constitution to enact it.

America was half as big then (a lot smaller House), and a far different place politically and ethically/philosophically than it is now. And the Volstead Act took something away that most Americans liked or at least were ambivalent about (booze); it wasn't an entitlement program.

Posted by: Monty at March 21, 2010 05:46 PM (HQzxr)

Yeah? This is going to be TAKING AWAY our access to health care. And Obama won't be able to kill enough people old enough to remember when they had that, fast enough. Not even close.

People who think this is over and we're boned forever are either Bob or really, really don't get it. This is not Social Security. This is not Medicare. This is not something that was secured with bipartisan passage. This is not something that has the consent of the people. This is not something that will incrementally destroy us. This will fuck us up the ass FAST enough and HARD enough, in enough ways that no one will be able to escape or ignore, that the people won't stand for it. It's going to hurt a lot and it's going to cost us a lot. But in the end there will be ONE faction left standing and I guarantee you, my American brothers and sisters, I guarantee you with every cell of reason and understanding that exists within me, THERE ARE MANY MORE OF US THAN THERE ARE OF THEM.

A Republican was elected to the Senate in Massachusetts over this, ladies and gentlemen. All bets are off now. History is not a reliable guide to what is coming. But this will not end well for the statists and their enablers. I have never stopped believing that and I believe it today.

Scott Brown was the mother of all bellwethers. If he can happen, then there IS a political solution to this, and it is coming. It may not be obvious to us now, but it is coming. It may turn our historical understanding of what American politics is on its ear, but it IS coming. THAT is what is inevitable. And Barack H. Obama, and every man and woman who stood with him, will rue the day they EVER thought they could fuck with America.

I have to research this a bit more but here is something I think will happen.

Starting tomorrow it will be illegal for insurance companies to deny coverage because of pre existing conditions. There is no mandate to have insurance until 2014.

In other words, about what you would expect from Democrats.

so... remove the mandates, but leave in the pre-existing conditions.  sounds like the Marxist plan to collapse the system and start afresh with nationalization.

True!

And I believe the only reason Ofucktard won NC in 2008 was because of scheming (ala ACORN, etc.) I worked on a liberal college campus at the time and know that they were signing people up to vote/change registration state for at least a month or more beforehand... then we had early voting for two or three weeks.  Then we had the fact that the voting place for campus kids was moved from a place two or three blocks off campus right to the heart of the campus....  very suspect....

So it's going to his desk then? There is always the chance that the Bill will get challenged in the High Court. Guess what is next everyone? THE CARBON TAX! That is the next evil sandwich we are going to have to eat. The math is fairly simple now: Carbon Tax + ObamaCare(and no real economy)=HUGE DEBT=Default=No country. I sure hope Dixie has plans to bring back the Confederacy if the Government collaspes because of the Federal Debt. I am totally serious. We might not have a nation in 10 years. 170 At least the United States, a Constitutional Republic, has an hour or two left to live, assuming the slimy traitors don't move voting time forward.

Putting any faith in the current crop of Republican officeholders is an exercise in failure. They'll talk big, but when it comes to standing up against their "good friends across the aisle," they'll bend over and offer their butts just like Stupak.

Limbaugh, Levin, Palin, Malkin and the rest of the no-action babblers will rant, talk about what we can do in November -- which won't be enough -- while offering up empty threats, and continue to rake in money as the loud but ineffectual "opposition."

I'm beginning to think the only answer this side of acts I can't condone is to vigorously drum up support in free states for that word Ed Morrissey and "Allahpundit" at Hot Air will ban you for using: secession.

It's a question going sheep-like into slavery under the treasonous regime of Papa Doc Obama or standing up for America.

I feel like a sucker for believing that all of my time and effort to elect Scott Brown had put an end to this vile power grab.

Posted by: loppyd at March 21, 2010 06:06 PM (pGELo)

You're looking at it the wrong way. Scott Brown was just a single candidate, in a single election, in a single state, in January. He was all we had the opportunity for at that particular moment in time. He was the cornerstone of the unprecedented political uprising of which I spoke upthread. One powerful enough to throw off the shackles of even a plan as evil as ObamaCare.

What the January election of Scott Brown proved is that there is the will of the people, even in the bluest state of the land to fight back against statism. And in November there will be the opportunity to elect HUNDREDS of Scott Browns, EVERYWHERE.

The most horrible thing that could have happened today would have been mass public apathy toward or acceptance of what the Democrats have done. Then, we really would be finished. But it hasn't happened that way.

In January of 2009 Obama was God and the Dems figured that they would be able to do everything they wanted with the wind of public complacency at their back. They weren't counting on what happened instead, and they weren't counting on what's coming.

239 Now that this bill is about to become law, let's try to face some facts: Fact #1. Most Americans may be unhappy about the bill, but they are not going to run riot in the streets. "Red Dawn" fantasies are for losers. Fact #2. November is not far off. Hopefully, the GOP will take back the House and make strong gains in the Senate. This is the way to effect change - not by threatening violence, and not by starting a third party. Fact #3. Most industrialized countries have some version of government-run health care. They are still pretty nice places to live. (Who wouldn't want to live in Australia?) America will also still be a pretty nice place to live, at least until our rapidly mounting debt catches up with us - which will take a few years. Fact #4. Gabe owes us realists an apology for calling us "pussies." Come on, Gabe, cowboy up and say you're sorry. We'll respect you all the more for it.

They have been able to have their systems because they draft off of us (and actually leech off of us in many cases).  But the US can't draft off of no one.  As we go towards stagnation, the rest of the world loses a lot of what they have taken for granted in the post-WWII era.

The US is the engine and the US is the defender.  Without us, watch the world descend into chaos.

This is like idiot Americans who think that we pay extra for drugs in the US just for fun.  We pay extra because the profit in our system is the reason most drugs (and other medical advances) get done.  Then everyone else gets the technology on the cheap.  That will end.

I don't think anyone had any real faith in the GOP.  I never really did.  But, in addition to the cowardice that most in the GOP have demonstrated, they were blindsided by all this because they didn't understand what was pushing this whole fiasco - The Precedent and his desire to do nothing but break our nation.  The Precedent never cared about health scare or anything else (which is clear as he's too stupid to understand any of it and gave Congress full liberty with all legislation).  All The Precedent cared about was pushing our system to failure with the attempt.  Many still don't realize this.  The guy is out to exact revenge (for the third world), and little else.

The GOP, along with most people, still don't get this.  The Indonesian Imbecile is out to destroy us, and, not having any American sensibilties, he is perfectly happy to break every rule, law, tradition and taboo in the process.  I've been trying to warn people about this for a long time.

They were supposed to argue the clear un-Constitutionality of this from the beginning and all the way through.  Instead, they ceded that and concentrated on CBO scores.  They never talked about the other countries' health systems drafting off of ours, as the profit in our health care is what drives the world's health care advancements.  They could have refused to attend the voodoo zombification summit for a bill that was dead, instead of trying to be all statesman-like with the dem savages.  Mitch McConnell could have not allowed the Christmas Eve vote (anyone remember what he traded that for? ... didn't think so).

They could have called the dems the America-hating traitors that they are.  They could have pointed out that we have an America-hating foreigner (by sensibility) in the White House who is destroying our system because he has no connections to American culture.  Of course, if the GOP had the guts to do that, they would have had the guts to challenge his Constitutional eligibility to begin with.

The GOP could have done lots of stuff.

I don't think the oldest group, despite their familiarity with totalitarianism, could imagine that style of governance gaining a hold here.  So that's probably why they were so soft on Obama to begin with.  They probably felt that since he was unprecedented, and "cool," no matter what the actual data showed, there was no way he'd bring totalitarianism to our shores.

Lets go over the facts.

EVERY SINGLE HUMAN BEING IN THE US OWE'S 40,000$ plus on the federal debt, and generally around 7 on the state/county/town side (varies widely)....

The socialists started this too late. THERE ISNT ANY MONEY.

We're adding to the debt at a rate of about 5,000$ per human being per year.

The Social Security "Trust" Fund just started redeeming its notes for cash last week or so. That wasn't supposed to happen until 2016.

You have maybe five years before this whole thing ends in a fiery explosion of math.
