Democrat enthusiasm is way down this year, so their turnout is likely to be far lower. In 2006, a midterm election that was also a big year for Democrats, there were barely 200,000 votes cast in the 5th District race. So if there is a similar turnout Nov. 2, and Lollar merely matches the GOP’s 80,000 total from 2008, that puts him at 40%. Add another 15,000 votes, and he’s in shocker-upset range.Three weeks ago, I thought Lollar had a shot, based simply on analyzing the district and reading his biography: An up-through-the-ranks Marine intelligence officer — a major in the USMC Reserve. But after having lunch Friday with Lollar, I’m telling you flat-out: This guy’s a winner, if we can just get him the money to do it.
He's also black, which will help. And also-- handsome. Also, Marine.
I think this guy can do it. Someone's getting shocked on November 2nd.
Dick Morris noted there were Democrats in real trouble who don't even know it yet, since few bother to poll districts like Hoyer's.

Still...meh, I don't see it as a big issue. I'd much rather have a reservist than a guy like Blumenthal. There's much lower hanging fruit to go after.

The problem with that line of logic is that either everyone has to retire completely from (and promise never to return to) their private-sector profession upon taking office or you get an even more entrenched "political class" because they're the only one's who don't have a "conflict of interest."
Find me some specific examples of reservists doing what you say they do, and I might get excited about it. Until then, I tend to think that anyone who is at least willing to be a reservist should get enough benefit of the doubt that I'm okay with them also holding office.

i think it is safe to assume all 47 are losing their internal polling and have decided to back the tax cuts for that reason.

Why would having a Reservist be any worse than a person who never served? Or one who served before? The result is the same; none would be deployed while in office. I would agree that perhaps it would be better that he transferred to the IRR while he was in office.
Having said that, there are far more opportunities for a conflict of interest in someone like a lawyer, contractor, or accountant.

"Southern Maryland" is not not NOT the DC suburbs of Montgomery and Prince George's County. They still tend to vote for Democrats down there, but that's mostly force of habit, similar to how a lot of old Catholics are still pulling the lever for Jack Kennedy. Southern Maryland Democrats tend to be far more conservative than the national party, and Hoyer, as leader of that party, is too liberal for the fifth district. I'm not certain, but I think the district may have gone for McCain. If it didn't, I'm sure it was closer than most of Maryland.
I'm not saying that we have a strong chance of picking up Hoyer's seat, but it is the kind of place that should be sending someone more conservative than Hoyer. Alas, Hoyer has name recognition and goodwill, but I can't say he's unbeatable.

I couldn't even go see her or my grandkids this year because we were still trying to help my son who was unemployed for 18 months, an ailing mom and mom in law. Jewells, I'm so sorry to hear that. Colt and I had to short-sell our house last year and were forced into a punishing promissory note. We bought the house on the income he was projected to make--instead he lost his job--three degrees between us, and we made one really dumb decision. It was devastating; my credit was perfect. It was a very, very hard lesson to have learned.
But you know what, there are a LOT of people in the same boat. I have found that there is more understanding out there than I ever thought there would be.

Usually Pelosi wins with 80% of the vote and only 24% voter turnout.
I understand that this election cycle is atypical and possibly even unprecedented (that remains to be seen), but even stipulating that the Republicans enjoy a full extra 30% voting edge this year (which they don't), Pelosi would probably *STILL* win in SF.
As mentioned above, the only possible way she could lose her seat is if she did something that strongly energized her highly liberal base to go out and vote against her. Not only didn't she do that, but in turn she supported every crackpot liberal cause for the last two years.
She's about as close to a "lock" as you can get.

Herr is absolutely right, Jewells. If they can pony up a couple grand for a lawyer who knows what they are doing, you can buy time. I work in a firm that challenges non-judicial foreclosures all the time, and on average we're getting 4/5 tossed on pre-foreclosure procedural issues the lawyers for the note holders fucked up.

I know there were a bunch of shockers in 1994 where high-ranking Dems who had been in power forever got turfed, such as sitting Speaker Tom Foley (D-WA), but it seems unlikely that such a powerful pol gets turfed short of him doing something to REALLY piss off his district.
In Hoyer's case, he's been trying to play the middle against both sides, so he isn't as big of a lightning rod as Pelosi or Harry Reid when it comes to national issues vs. local issues.

Little things like not being the actual holder of the note and mortgage, falsified affidavits, affidavits that are pure hearsay, shit like that. It's everywhere. I would venture that the vast majority of foreclosures filed now have such deficiencies. The system is collapsing because of the volume.

Oh, I agree. It's terrible out there. I guess I mean that we can't predict how the choices we make are going to turn out. Sometimes we take risks that pay off, other times we get nailed. What makes a decision "bad" has a lot to do with luck.
When Mr. Y-not and I moved to California, it was for a major career upgrade (for him). And he did extremely well (set all sorts of records for his institution and within his field), although I wound up unemployed. But we had to leave that situation for reasons beyond our control, which means we're selling our house at a terrible time and back to renting. Kind of sucks.
I think you could look at the decision to move to California four years ago and say it was insane, but really at the time it made sense. We thought. Live and learn.

You'd have your mortgage for 6 months and then all of a sudden you would get a notice saying "don't pay us anymore, we sold you to them, pay them" only they didn't say they sold you, but, they sold you, bundled with a lot of other folks.

@138 - down here it's bad appraisals. The note holders get banks to find appraisers who SEVERELY lowball the appraisal, sell it on the courthouse steps by power of attorney back to the bank, who then wants to turn it around and sell it for more then the previous owner owed on it, then go after the former borrower for the difference between what was owed minus the lowball appraisal.
They are trying to make money on the re-sale and then get a deficiency judgment on the former borrower. It's pretty sick.

These guys are right about the lack of correct legal documents the people who innitiate forclosures hold. The majority of loans ended up in mortgage backed securities that are held by firms who don't really know what's in them. They depend on loan service companies to collect the payments and service the loan.
In most states in the event of a forclosure the actual wet signed copy of the loan agreement has to be produced at the proceedings if asked for by the borrower. There have been several cases where the loan servicer only had a copy and couldn't come up with the original and the forclosure was thrown out.
It may or may not help but there is a good chance it could buy them some time.

Second; there is little difference. His part time profession is the military, and yes there exists the possibility of a conflict of interest. And yes, that conflict can be direct (how much do officers get paid). For a doctor or a lawyer, it can be just as direct (tort reform, reimbursement rates for health care providers).

The problem with Hoyer is he's such an entrenched bring-home-the-pork guy that even moderate Republicans like my dad will cross the line to vote for him. No shit. When I still voted absentee in Maryland (which is pissing up a rope for a conservative), Dad used to tell me vote for Hoyer.
Case in point. When BRAC shifted most of the Naval Air Warfare Command (NAWC), it ended up at Patuxent River NAS, Maryland. Sure, why not. Three-star admiral's billett and a shitload of personnel. Lots of contractors. Job market took off, and this was a town where you used to have to drive 45 minutes up the highway to Waldorf if you wanted McDonald's until the late '80s. This was seen in Southern Maryland as validating the power of Stenny Hoyer to do good things for the area.
St. Mary's County is one of the few areas of MD where the housing bubble hasn't popped yet. One, they aren't making any more waterfront real estate and with the environmental regs you can't build on whatever hasn't been. Two, there are enough rich retired naval officers now working locally for Lockheed Martin, BAE, Northrup Grumman, or whoever that they'll pay through the nose for "a place on the water".

Your term was "conflict of interest"- well, anyone who isn't a professional politician (and many who are) or who isn't specifically going to retire from anything except punditry/professional speaking after their stint in Congress has the same thing. It may not affect them as directly, but it does affect them.
If you point is about the fighting/dying part of being in the military... well, yeah. Again, and? Until you show me a pattern of Reservists doing things that would prevent the reserves from going to war, I'm not concerned about their votes. As for not serving full deployments, let me ask you: if you were an Army LT with a "private" who's full title was "Mr. Congressman" in your unit, wouldn't you be just as happy to send them home? Really?
You can argue that the Army should automatically move people to IRR, or even give some kind of discharge to Reservists who get elected to congress, but that would be a military issue, not one regarding who could get elected, or not.

We were told that our short sale wouldn't get approved unless we stopped paying the mortgage. It was appalling. The sound of all my German ancestors whirling in their graves made me physically ill, and it went against everything I believe, but the broker kept insisting it was the only way, and we didn't have a lot of time. So now in addition to the short sale, I have several months of not paying the mortgage on my credit report. The horrible irony is that the house was in my name because Colt's was wrecked due to his outrageous student loans. But, he had a direct government job, and was firmly told we'd be in that location for at least 20 years... and we were already getting the place for maybe $50,000 under market at the time... and it wasn't an ARM... and we thought we'd be stupid to be flushing money down the rent toilet... and... there you go. Seemed like a good idea at the time.

At some time during court proceedings have the lawyer ask for the lending agency to produce their original note for the loan. The court may give them some time to do so but if they can't then you can't foreclose.

It's not quite so simple.
A nonjudicial foreclosure requires no court involvement at all. The lender gives up the right to a deficiency by electing to go nonjudicial. Since California has a strong anti-deficiency law anyway (prohibiting the collection of a deficiency on most residential mortgages) nearly all residential foreclosures here are nonjudicial.
This means that you have to hire an attorney to file a lawsuit to stop the foreclosure. Not cheap. Once it's filed, you have to get the court to issue a preliminary injunction to stop the foreclosure until the case is decided. To get an injunction, you need to convince the judge you're going to win the case in the long run. If you don't persuade him/her, the foreclosure goes forward, lawsuit or no lawsuit.
In California the lender doesn't need to produce original documents. The Deed of Trust is recorded; get a certified copy from the County Recorder and you're good. If you claim you didn't sign the Note, you have to convince the trier of fact that the copy is not authentic. You're not likely to succeed unless you actually didn't sign the note -- i.e., its a legitimate case of forgery.

I tend to think of it like the old days of Football franchise building: you get rid of the weakest ones first, but keep enough veterans around so your rookies can get their legs, then get rid of those veterans who still aren't up to snuff and replace them. Like how the Cowboys went to back to back (which should have been a three-pete: Thanks Jerry!) Superbowl wins back in the 90's. Things she should bear in mind, among other things, are, is the entity that commenced the suit the original lender? Was the mortgage assigned? Was the assignment validly executed? Was the assignment properly recorded? Was notice of the assignment given to the borrower? What does the mortgage say about assignment? Was the complaint properly verified? Does the person who executed any affidavit on behalf of the plaintiff have actual knowledge of the lender's files?
There are also state law issues to be considered. Did the state institute some sort of pre-suit resolution process? Was she properly served? Did the plaintiff name everyone on the mortgage and note?
Every state is different. In NY, for example, you don't need to produce the "original" mortgage, just a certified copy (which is recorded with the County Clerk), but at the same time, all assignments need to be recorded before someone can assert rights thereunder.

I personally hate to see the religion of my childhood becoming associated with left-leaning causes. Yes, it has always been more socially moderate, but I don't want to be a member of a church that is at odds with the values that I hold.
There may be a "Tea Party" in the Methodist church's future as well.....

There simply aren't enough Republicans in San Francisco to vote her out of office. I can't imagine much more than 20%. So there would have to be a huge backlash among the dems against Pelosi to combat the reflexive voting of the progressives in that beautiful but royally fucked-up city.
