— Jack M. Let's engage in a thought experiment:
The year is 2015. President Jim DeMint is offered the opportunity to name a replacement to the United States Supreme Court following the surprise health related resignation of aging jurist Antonin Scalia.
President DeMint nominates long time friend and current Solicitor General Gamey McCock, age 50. McCock is the current solicitor general, having been confirmed over the objections of 31 Senate Democrats who felt he lacked the experience to serve the administration in what is essentially a temporary job. Because Scalia is a member of the court's conservative wing, the McCock nomination is not viewed as likely to change the balance of the court.
Prior to his service in the DeMint administration, Gamey McCock worked in the George W. Bush administration, helping to shepherd nominees John Roberts and Samual Alito through difficult confirmation proceedings. He also spent a year as a clerk for Justice Clarence Thomas. From there, he worked for several years as the Dean of the Law School at the University of South Carolina School of Law. To top it off, he was also a paid advisor to Bear Stearns, a company currently alleged to be engaged in questionable, and possibly criminal, business deals that many feel accelerated the stock market crash of 2014. Bear Stearns also happens to be a major contributor of funds to President DeMint. As it turns out, Stearns currently faces criminal investigation, and the case could theoretically appear in front of the Court. Now, McCock has never been a judge, and, in fact, has no practical experience as a litigator. He has never argued a case before the Supreme Court, and he has a paper trail consisting of only a couple of law review articles, none of which appear particularly controversial. In fact, McCock's chief credential seems to be that he used to hang out in Columbia with Pres. DeMint, and they have a friendship that extends farther back than the beginning of DeMint's political career.
McCock has, however, taken one public stand that gained some national attention. While Dean of the USC Law School, McCock barred the Justice Department from allowing DoJ recruiters on campus in response to the Obama administration's promulgation of regulations designed to get around the Supreme Court's "Heller" decision. The USC ban occurred after congress had passed the Schumer Amendment, in which schools that denied access to DoJ recruiters faced the loss of federal funds.
"Denying a person their right to bear arms is a moral injustice of the first order," McCock is quoted as saying. Since this occurred, states have taken a variety of approaches in dealing with 2nd Amendment rights, and legal observers view it as exceeding likely that the USSCt will be addressing this issue within the next couple of terms to resolve a growing spilt between the circuits. Pres. DeMint has recently angered some gun right's supporters over his failure to aggressively overturn 11th hour executive orders related to gun-rights passed by Pres. Obama in the closing days of his administration.
Needless to say, after leading the successful repeal of the Obamacare legislation through a contentious session of Congress, Pres. DeMint is looking for a nominee who won't provoke a fight. In fact, he views McCock's relatively scarce record, and his youth, as assets not only in obtaining confirmation but in ensuring a long term stamp on the court's direction.
Given the above scenario, who here believes that a Democratic Minority, down to only 41 members following the 2012 and 2014 elections, would acquiesce to the confirmation of Mr. McCock?
I don't. I believe the Left would be howling in anger. And, in this instance, they would be Right (heh) to do so.
Because the left would understand this pick for what it is: a crony appointment of a wholly unqualified nominee based primarily on the facts that: the nominee shares a high profile view on a single issue that is "politically correct" in the Administration's eyes; that appeals to a specific voting block in the President's base; and that provides a major fundraiser with the "understood" assurances that their legal interests will have someone keeping an eye on them.
The Kagan selection is "Crony Capitalism" extended to the Federal Bench. It is emblematic of everything that is wrong with the "Chicago Brand" of politics.
In its own way, is it even worse and more cynical than the selections of Sonia Sotomayor (who was confirmed) and of Harriet Myers (who wasn't). While I disagreed with both of their nominations, I never imagined their selections to be inherentlycorrupt in their inception.
I can't say the same about this pick.
Which is why I believe that the GOP has to aggressively fight this nominee. Even if that means Kagan is replaced by a more aggressively liberal choice.
Because this pick is Barack Obama thumbing his nose at the entire system. It's about rewarding campaign contributors and targeted subsets of supporters.
But mainly It's about destroying the last vestiges of respect for notions of "justice" and "equality before the law" and "fair play" that the Federal Courts rely on for their moral authority
You think that isn't worth it's weight in gold to a President seeking to "fundamentally transform" America?
I do.
So I urge the GOP to fight this nomination. They should filibuster Kagan and expose this Chicago style "cronyism" for exactly what it is.

The network: Fox. The reporters: Jane Skinner and James Rosen.
The gist of their phony back and forth is that Kagen has taken some conservative positions, she has argued before the court on some Bush-era security policies, and the left is going to be upsset with her nomination.
In fact, she might move the Court to the right!!!
Honest to God, they actually said this. I do not like it when the reporters think I am a dim bulb. Skinner is a lib, and I always thought Rosen had more integrity. It was disgusting and should give us a clue as to how they are going to try to foist this woman on us.

In the end will we get a better (more tolerable) nominee out of this administration than her? Nah.
The only part that concerns me is that her story is "sure, she's a leftie, but she listens to other views. "
That was also the take on Obama and how well has that worked out?

Nevergiveup -
100 x 0 = 0
While a person having no judicial background being appointed to the SCOTUS is not without precedent, it is certainly not par for the course either. I think an essential part of the process of attaining that high an office is some sort of track record. Prior decisions on the bench comprise the track record. How is her judging capability to be assessed properly without it? Just what she says during hearings? Bah! She can say ANYTHING and on what basis, absent any prior decisions can she then be challenged?
That said, glad that you seem to not be endorsing her.

Why is it that liberal women are so damn ugly?
I've actually always had a theory on lesbianism, as it is clear Kagen is gay, "not that there's anything wrong with that." ©
There are real lesbians, women who truly are attracted to other women from birth, or an extremely young age.
And then their are girls who had such bad experience with men in middle school or highschool that they've decided to be a lesbian. These girls tend to be more homely, but that is not required. I know two girls in my highschool who fit that perfectly. One was treated so poorly and thoroughly embarrased by a guy she loved that she just decided to be gay because she perceived that women wouldn't treat other women as badly. The other girl wasn't good looking and shunned by men, so she decided to become a man(although i don't know if she had the addadictome procedure).
I am guessing Kagan is of the latter category.

You are not judged on ability, that is never the rationale. If you can afford the admission price, the elite admission price, this is apparently the only route to get on the bench. That sucks and smacks of elitism rather than merit. In fact, it could be said- that it is flat out discrimination-as long as you know the secret handshake and the code words.

“Our Founding Fathers intended the Court to serve as a neutral arbiter of disputes and to defend the public from the overreach of a distant ruling class in our nation’s capital."
Well, no they didn't. If you look at the actual Constitution, you will see that Congress has extraordinary power to basically pre-determine Court outcomes on appellate cases via Article III, Section 2:
In all the other Cases before mentioned, the supreme Court shall have appellate jurisdiction as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.
Marbury v. Madison did not create the right of the Court to trump Congress--it showed that the Court could get away with it if the political climate was right. I argue instead that the Courts current role as check-and-balance on Legislature derives more from the early 20th century reform movements, which used the Article III, Section 2 grant of power to encodify the Court's role in the US Title Code dealing with the judiciary.
As far as the Founder's are concerned, I think a fair reading would be that they intended it to be fairly well under the thumb of the legislature (with the system made up personnel as selected by the President and approved by the Senate, operating under laws and procedures as passed by Congress), with the high court acting as guide for the lower courts--but not as a check on the other two branches in a Madisonian Constitutional sense. That role has come later, and is grounded in the U.S. Code, not the Constitution.
The role of the Court is not sacrosanct, and should not be considered so, and I think it might be coming nigh time to discuss the proper Constitutional role of the court, as well as the makeup of the court regarding numbers and tenure, as well as if other means of checks and balances are needed, both of other branches on the Court, and Court on other branches.
But overall, if you think that in England the courts overruled the King or Parliament on a regular basis then I will grant you the Founders intended for ours to do the same with President and Congress. I'm not sure though that was the case. Making local magistrates--even if appointed by Crown or Parliament--follow the law, yes, absolutely. But check the Crown itself, or Parliament, on a law they passed and signed? No. I don't think it happened, but this is a useful discussion to have, for it will shed light on what Senator Sessions said, for I do not think he is right in his one small statement. Nothing else do I have a large issue with.

Maybe not. Keep in mind how much the political mood of the country has changed in the past eighteen months. There's lots and lots of ammo and a target rich environment. I think the nation is ready for some real substantive discussions about the course our county is on.

We don't know that Kagan isn't a dyed-in-the-wool Marxist. Not a lot is known about her. But from what we know about Barry, everything he does should be fought to the last inch. Supreme Court Justice appointments have a lasting affect that goesfar beyond other more reversible things a POTUS has the power to do.

I suspect that is part of their master plan. There will be designated seats on SCOTUS for all of the "protected" groups. All in the name of ensuring social justice for all. I guarantee you subject of not having a gay member on the court came up really quickly in Obama's first conversations on his nomination.

Expediting Obama's activism and relieving him from political pressure is not in the Republican's best interest, so why do it?
Why not fight tooth and nail to the bitter end? They (Democrats) would do it, and have done it. Time to replace the squishes with conservatives who are more concerned with the future of the country and less about how they look on CNN while "making points". CNN is going to cut them out of the coverage anyway, unless they do something they can portray as "mean spirited".

"Of course, if you filibuster this nomination, when Toonces comes back with a died-in-the-wool Marxist we've used up our bullets. You can't expect the Gang of 14 to trot out the "unusual circumstances" more than once per nomination."
This occurred to me as well. Then I think back to the Bork nomination. The Democrats fought that one bitterly, and to the best of my recollection when they squashed his nomination, their reaction was not, "Okay we fired our only bullet, we're out of ammo. Let's hope Reagan does not double down." It was more along the lines of, "We rolled you punks. This will happen again and again until you send us a nominee that WE deem to be acceptable."
I know the politics and alignments are different, but still...

First of all, there is no symmetry between the left and the right. The dems filibustered perfectly decent people and they did it for judicial positions of all sorts, not just SCOTUS nominations. For the SCOTUS nominations, they went beyond filibusters into full scorched-Earth.
Secondly, this is the nation that is at stake, not some game of political niceties. Allowing the Ineligible Imbecile From Indonesia to put ANOTHER unqualified, and America-hating, leftist on the Court to destroy what little is left of our Constitutional basis would be a death blow.
Thirdly, there is nothing wrong with filibustering SCOTUS nominees. If the Dems want to remove the judicial filibuster, as the GOP threatened, then let them try.
The left, led by the Indonesian Imbecile are trying to destroy this country, and they are very close to succeeding. This reality needs to be acknowledged by the Senate GOP, and, more importantly, the GOP members on the judiciary committee who should not even let this nomination come to a committee vote.
>>>Much as I hate it, elections do have consequences,
And the Constitution has a proscription against people who are not natural born citizens (which entails never having held any other citizenship) from ever occupying the Oval Office ... but no one respected that - and for which the US has paid dearly.
>>>which in part allows an inexperienced Marxist POTUS to nominated an inexperienced progressive candidate to SCOTUS.
And which charges the Senate with disallowing such a nomination to get through. That is the point of "advice and consent", just as with any idiotic treaty that The Precedent might sign and try to obligate the US to.
>>>Also, there's no way in hell that a filibuster will happen. The Senate will grill her and then confirm her.
Posted by: physics geek at May 10, 2010 01:57 PM (MT22W)
Probably - though I don't think we'll even see a "grilling", as Sotomayor didn't get even a tenth of what she should have, before being laughed out of the Senate chamber. But the Senate GOP are mostly turds, so the left always has that going for them.
Posted by: progressoverpeace at May 10, 2010 10:33 AM (Qp4DT)
I would love to see this. That is a damn good reason for the Repubs to keep this in committee. Let the commies kill the judicial filibuster in the committee.
Posted by: Vic at May 10, 2010 10:36 AM (6taRI)
Before spending time, effort, and political capital on a fillibuster, you really need to consider the consequences. This diatribe only considers the consequences of not fillibustering, and does so by proposing a specific scenario that is unlikely.
Fillibuster her, and worse options will likely be nominated. The public will end up pressuring the GOP to accept one of them. Else, it will negatively affect the GOP in hte November elections.
Pick your battles. This one isn't even close to being worth fighting, IMO. We lost this one in 2008 - elections have consequences.

"Fillibuster her, and worse options will likely be nominated. The public will end up pressuring the GOP to accept one of them. Else, it will negatively affect the GOP in hte November elections."
All depends on how the GOP presents their side of the matter. If they can rise above the cries of "Party of teh Noes!" that we can all expect, and make each person a unique case-study in Bad Justice Appointments, then it can work out as a positive, as a "we're looking out for America" message.
Kagan is bad because she's completely out of her league here.
The next one is bad because of whatever reason they're bad for (blatant socialist, part-time legislator, whatever...).
And the next.
And the next.
Until someone reasonable finally shows up in the roster.

>>>Fillibuster her, and worse options will likely be
nominated.
So what? Everything The Precedent does is bad for the US. He needs to be stopped in his tracks. Period.
>>>The public will end up pressuring the GOP to accept one of
them.
Says who? Why do you assume this? What does the public care if there are 8 or 9 justices on the Court? The Court doesn't stop working, and it becomes a 4-4 split (with even a slight possibility to go 5-3 in favor of the Constitution on some issues) to put a halt to some real liberal idiocy ... for a little while. I don't see why you think Americans will even give any thought to how many justices are sitting on the Court.
>>>Else, it will negatively affect the GOP in hte November elections.
If anything, demonstration of a little backbone by the GOP will energize the base further. Libs won't be moved by it.
>>>Pick your battles. This one isn't even close to being worth fighting, IMO. We lost this one in 2008 - elections have consequences.
Posted by: connertown at May 10, 2010 02:41 PM (+q3dR)
Every single attempt by The Precedent and his Washington junta need to be fought to the very end. EVERY SINGLE ATTEMPT. The GOP dropped the ball on health scare (because they didn't understand how un-American The Precedent really is and thought that health scare would die a normal death - as it would if an American were President (Shrillary would have folded on it back during the Town Halls) and the country got royally screwed - irreparably. There aren't many fights left before this nation goes under for good.

Since when were political victories supposed to be shared like Oreo cookies and turns on the tire swing?
Fillibuster her, and fillibuster the next unacceptable move, and keep doing it -- Republicans will be pilloried as being the party of "no" anyway, they are already in fact. The real problem is that the other half (or more than half) of the country sees them as the party of spineless pussies who are secretely in bed with the opposition.

I think your whole point is BS. Political capitol? WTF? Where is this finite well of political capitol? How deep is it. How many gallons of political capitol do we get to waste before the "public" starts pressuring them to confirm Chairman Mao? Since she has no judicial record to draw inferences from, just how the hell do you know who could be worse?
Who decides what battles to fight and which ones to spread our cheeks for?
Bullshit, thats just stupid.

Why all this talk about what the Democrats did to Bork? He wasn't filibustered.
As I recall, the Dems really tried to smear Bork, and it got pretty dirty. But, there was no filibuster.
Bork's nomination went to the full Senate and it was defeated in an up or down vote. (After the Judiciary Committee voted against him, I believe)

As far as give her harsh questions then go ahead and rubber stamp the appointment, we already did that with the last one, and what exactly was the gain? Nothing. The left's victory on that just encouraged them to push harder on other fronts.
Thanks for all the concern about using up political capitol and good will from the lesbian lobby, but I'm not buying it.

"In our own times, a coherent socialist movement is nowhere to be found in the United States. Americans are more likely to speak of a golden past than of a golden future, of capitalism's glories than of socialism's greatness."
Now, that, all by itself, should be enough to have Kagan laughed out of the Senate. Of course, she was just a dumb undergraduate (as opposed to the dumb bull-dyke she now is), but then there was this nugget:
"Why, in a society by no means perfect, has a radical party never attained the status of a major political force? Why, in particular, did the socialist movement never become an alternative to the nation's established parties?"
She wondered why a "radical" party never became a major political force (until the dems of today and their America-hating ineligible Indonesian retard came onto the scene). This is pretty close to Sotomayor's claim, also while a Princeton undergrad, that adjectives don't exist in Spanish. What is it with Princeton and retarded undergrads? White hot white guilt. The sasquatch did her undergrad at Princeton, too. And wrote a barely literate senior thesis that was nothing but whining about race and assorted idiocies that would have gotten a
"C" at most normal high schools.

Man, you sure can get labeled a "concern troll" and a lesbian quickly 'round these parts.
Make no mistake - I want to see a bloodbath at the polls in November that turn both houses over to conservative majorities.
But the timing is EXTREMELY important. The pendulum could very well swing back to the left enough for the Dems to save their comfortable majorities.
The question I put back to the group is "whose votes are you trying to win?"
It ain't the votes of true conservatives that are at stake if the fillibuster backfires. It's the moderates and undecided pansies. The people who let the mainstream media dictate their agenda and follow like sheep. Those idiots are capable of changing the outcome of lots of elections, because there are so many of them.
What votes do you hope to gain with the fillibuster gambit? Because I maintain that there is too much to lose. The November elections are just that much more important to me. I don't care how old or gay she is.

The November elections are going to be decided by Americans voting their paychecks and their economic pain. They are mad a hell about ObamaCare and about the attempt to pardon illegal aliens.
Conflating the Kagan nomination with the November vote is BULLSHIT.
Kagan needs to be filibustered because she is a socialist radical that is going to be determining precedent CASE LAW for the entire U.S. for the next 30 years if she gets a seat on the SCOTUS.

Of course, the problem with your hypothetical (in the Obamabots' minds) is that McCock was "only" dean of USC's school of law. I mean, c'mon man, they have a real athletics program at USC and everyone knows that that, combined with being in the South, makes it a second-rate law school... unlike Hah-vahd!
