— Gabriel Malor John Adler is a "No." I've moved him from the "No, But Maybe" group into the "No Means No" category, which means Pelosi now needs 25 out of 28 "maybes". See update below.
Put another way, we only need four of the "maybes" to vote "no" and there aren't enough Dems left to pass the bill.
Additional signaling today came from Marion Berry, one of the Stupak Dozen, who voted for the reconciliation bill in committee, and from Allen Boyd, one of the supposed "No, but Maybe" guys, who voted against the reconciliation bill in committee.
Berry swears he ultimately won't vote for abortion funding, but, well...he lies. A lot. Boyd hasn't told anyone what he's up to, and he may still be courted by Pelosi. Without more info, I'm not moving them from where I've got them.
Oops. And More Updates:
First, I only had eleven folks in the Stupak Dozen. That's because I left off Tom Perriello (VA-5), who has said several times that he will not support the Senate abortion language. His staff just confirmed to one of our commenters that "if the abortion language is not changed he will vote no." I've added his name to the Stupak Dozen category below (and checked my math to make sure all 255 Dems are accounted for).
Second, Gabrielle Giffords (AZ-8 ) released a statement a few minutes ago, announcing her willingness to be bought. She says, "When and if these problems are addressed, I will publicly commit to vote for this historic health insurance reform legislation." Based on that, I'm not ready to move her out of the "Yes, but Maybe" category. I think it very likely that she will vote for the bill, but she hasn't said that she will yet.
Pelosi's goal is still 25 out of 28 "maybes."
Thanks to Nick and Brian for the updates.
Whip Count is below the fold: Nancy needs 216 votes. She has 191 Democrats definitely on board, so she's 25 short. Here's where she can get them.
No Pretty Much Means No:
These were twenty-two "No" Democrats in November who still make noises that sound like "no". Nancy is trying to get a few of these to change their votes and the President is prepared now to offer bribes like the Louisiana Purchase. This group goes in the Definitely Not, Not No Way, Not No How category, having already announced that they will stand by their earlier votes.
John Adler (NJ-3), Dan Boren (OK-2), Bobby Bright (AL-2), Ben Chandler (KY-6), Artur Davis (AL-7), Chet Edwards (TX-17), Tim Holden (PA-17), Larry Kissell (NC-8 ), Suzanne Kosmas (FL-24), Frank Kratovil (MD-1), Dennis Kucinich (OH-10), Jim Marshall (GA-8 ), Mike McIntyre (NC-7), Mike McMahon (NY-13), Charlie Melancon (LA-3), Walt Minnick (ID-1), Collin Peterson (MN-7), Mike Ross (AR-7), Stephanie Herseth Sandlin (SD-All) Heath Shuler (NC-11), Ike Skelton (MO-4), Gene Taylor (MS-4).
Wont Vote For A Bill That Kills Babies:
Then there's the Stupak Dozen. These are "yes" votes in November that are now "no" votes. The confirmed members are: Bart Stupak (MI-1), Marion Berry (AR-1), Joe Cao (LA-2, Republican), Jerry Costello (IL-12), Kathy Dahlkemper (PA-3), Joe Donnelly (IN-2), Steve Driehaus (OH-1), Brad Ellsworth (IN-8 ), Dan Lipinski (IL-3), Tom Perriello (VA-5). The conjectured final members include Henry Cuellar (TX-28 ), Marcy Kaptur (OH-9).
It's An Election Year:
Then there's the other "yes" votes who have publicly switched: Mike Arcuri (NY-24), Chris Carney (PA-10), and Luis Guterrez (IL-4). I wouldn't count on Gutierrez to stand by his "no" threat, though. He looks like he's trying to wring some concessions out of the leadership on the proposed comprehensive immigration piece of shit. Carney is a lock; he wants to get re-elected. Arcuri sounded pretty sure of himself, but we'll see.
Maybe:
That leaves the maybes. There are thirteen who voted "yes" the first time, but have refused to commit to voting the same way this time:
Tim Bishop (NY-1), Mike Doyle (PA-14), Gabrielle Giffords (AZ-8 ), Baron Hill (IN-9), Paul Kanjorski (PA-11), Ann Kirkpatrick (AZ-1), Dan Maffei (NY-25), Alan Mollohan (WV-1), Solomon Ortiz (TX-27), Bill Owens (NY-23), Earl Pomeroy (ND-All), Nick Rahall (WV-3), Zack Space (OH-18 ).
And there are sixteen fifteen who voted "no" the first time who could be victims of Rahm-in-the-lockerroom-with-the-lead-pipe bullying or Cornhusker Compromise bribery because they haven't declared yet what they plan to do:
Jason Altmire (PA-4), Brian Baird (WA-3), John Barrow (GA-12), John Boccieri (OH-16), Rick Boucher (VA-9), Allen Boyd (FL-2), Travis Childers (MS-1), Lincoln Davis (TN-4), Bart Gordon (TN-6), Betsy Markey (CO-4), Jim Matheson (UT-2), Scott Murphy (NY-20), Glenn Nye (VA-2), John Tanner (TN-8 ), Harry Teague (NM-2).
So Pelosi needs 25 out of 28 maybes to break her way, 15 of whom voted "no" on the House bill once before.
NOTE: If you think I've got one of these guys in the wrong group and have a statement from the Congresscritter demonstrating it email me at [gabriel.malor at gmail] and I will update the count.

Marion Berry - Yes on Crack and Hookers, but No to a huge reparations bill that would benefit tons of my constituents, because it also pays for abortions.
Do I have that right? Really??

7: Epitomy of a Seattle liberal.
Brian Baird represents the Vancouver, WA area, which is not a typical Seattle liberal area. Not hardcore conservatives, but made up largely of refugees from the Peoples' Republic of Portland. So, tends to be conservative. Yes he is screwing his constituents who avoided/fled Portland because of the high taxes and would probably have been voted out of office this year if he had run for re-election.

I understand the sentiment, as it shows how dire the circumstances are that we have to hope enough Democrats do the right thing and vote to kill the bill. But the fact is that only a few of the undecided Democrats need to vote "No" for it to fail, as Pelosi doesn't have any margin for error to pass the bill. Personally, I think the odds are 50/50 that it passes. But even if it does pass, the next fight will likely be in the courts, with the Supreme Court's ruling over a decade ago that the line-item veto was unconstitutional establishing the possible legal precedent for ruling the "Slaughter Rule" is unconstitutional, as illustrated at The Corner:

Yep. That's why Democrats are going to pass it. They don't care about losses in November. If we end up with 535 Republicans and Obama impeached, the Republicans won't have the guts to repeal this turkey. It will stand, the public will become resigned to it, and Democrats will just grin and start the climb back to 50-50, with Republicans sputtering impotently.
It will become just the newest "third rail" of American politics. The Republicans will no more be able to rid us of it than Social Security, Medicare, Medicaid, or any of the other nanny state batshit.
Democrats understand one basic principle; government is a ratchet. It can tick forward, but it never ticks backward.

Rick Boucher (VA-9). This guy is from the appalachian area. He is in love with crap n tax because then, he says, his district will get direct help from the govt and will not get the perks if it is pushed through via the EPA.

Yeah..and bring me a fucking coke.
i thought this may have been interpreted as such when i channeled my inner paris hilton before posting. nevertheless, i suspect it's not much effort on gabe's part to format the list one way or the other but it makes a big impact on readability. Which would be a good thing if the reader wanted to take action based on the info presented. which would make it more useful.
what if, at the margin, a lurker was about to call up their congress critter to yell at them about this crappy bill and that call changed the critters vote, which defeated the bill? but then the lurker gave up because it was too hard to find his critter.
like, omg, gabe would be crushed knowing this and he would've thought, "why didn't some lurker come to me like a fucking man and tell me to order my congress critters in list format?" thankfully, that won't happen now. whew!

Gabe, better listen to this braying cockmunch and stop wasting your time posting whip counts. They don't matter. Everyone knows health care is a done deal by August October Thanksgiving Christmas January this week. If you're expecting to be saved by *Democrats* then you're waaaaaaay too fucking stupid to be posting stuff on this site and you need to be replaced by somebody who goes around giggling that all is lost and we should just sit here with our dicks in our hands watching the destruction of America with a smile.
People in Massachusetts, don't elect any more Republicans. In fact, don't even bother re-electing Scott Brown in two years; kick him out and replace him with a Democrat, somebody like Martha Coakley, or maybe even dig up another Kennedy you can entrench for forty years. See, Scott Brown is only one Republican from a state dominated by *Democrats*, and he serves in a U.S. Senate dominated by *Democrats*; and if you're expecting his vote against nationalized health care to mean anything in the face of that then you're waaaaaaaay too fucking stupid to be trusted to handle your own elections, and ought to have Brown kicked out and a Democrat appointed in his place just to get this health-care thing over with faster.
Republicans in Congress, do not do ANYTHING to fight back against ObamaCare when it passes. Don't even THINK about trying to repeal it once we've got both Houses and the Presidency in two years. See, in order to get back into power you'll need the votes of a lot of registered *Democrats*, and if you're counting on *Democrats* to sweep you into the majority then you're waaaaaaaaaay too fucking stupid to be trusted with it. Give us a lot of sweet talk about how much better you can "administer" ObamaCare instead; we'll eat that shit up.
And most importantly of all, GOP Congresspippls, whatever you do, do not, not, NOT oppose cap & trade, card check, amnesty, or anything else the Teleprompter Messiah wants to do from here on out. See, until next year, the only way these things can be defeated is with the votes of *Democrats*, and if you're counting on *Democrats* to save our asses then you're waaaaaay too fucking stupid to be trusted with your offices. In fact, maybe you should all be voted out this fall and replaced with *more Democrats* so that we'll all have more opportunity to whine that we can't get anything past the *Democrats*.
Roll over and die. Everyone shoot yourselves in the fucking heads now.
(See, I can be a worthless, defeatist shit-for-brains Obama tool too.)

They won't back down. They'll promise the sun, moon, stars, and however many billions are necessary to secure the vote of (insert whoever here). They understand - and I guess some of us are just too fucking stupid to get this - that seats lost in November are a tiny price to pay for gobbling up a sixth of the whole economy *forever*.
How to stop them? Kinda late now. Gawrsh. Mebbe we shoulda voted for Lincoln Chaffee back when it mattered whether we were handing *Democrats* 60 votes in the Senate - *without which would wouldn't be in this fucking fix right now*.
If we had defeated the House bill, it would be over. If we had defeated the Senate bill, it would be over.
But we lost two huge elections. Hey. Radical thought. Next time *vote for Arlen Fucking Specter* if the alternative means losing a filibuster-proof majority to Democrats.

"Kids, I'd love to believe that A Magic Coalition of Mythical 'Moderate Democrats' are going to rise from Granny Botox's Kingdom and killing off this abortion of a bill, but you're whistling past the graveyard if you're pinning your hopes on *Democrats* putting the best interests of the country before their own sick, pathetic ideology."
Nobody is betting that the Dems are going to vote no out of a sense of honor. They will do it out of a sense of self preservation. Yes, The One will empty the Treasury. Yes, he will burn this country down if he has to. He will promise anything to get this through.
But, remember November is coming and not every Dem is a dedicated ideologue like The One. Hell, I'm not that sure about Pelosi is, she's totally safe no matter what happens.
I'd like to point out that there are a lot people on this site who doing more than whining about the situation. They're actively calling their representatives and demonstrating. I'm sure that keeping their morale up ain't the easiest thing in the world. I'm sure that your heart is in the right place, but you're not helping.
You may be right. It may be a done deal. If that is the case, there will be time enough to cry about it latter.
Please cut out the eeyorism.

anyway, san soucy, i have an profitable proposal for you: since you are certain that this bill will pass, you should have no problem accepting a wager at 20:1 odds (since you estimate probability of passage at 100%). I will put $1000 into an escrow account and you can put $20,000. If it passes, you get $1000, plus I will pay 10 times the interest that the equivalent treasury bill would've yielded on the 20k. If the bill fails to pass, i get the 20k and won't hit you up for the interest foregone on my 1k.
easiest thousand bucks you'll ever make. plus you can impress ladies with how smart you are and how you schooled some chump out of a thousand bucks due to his political ignorance. and how he now has no farm (my farm is very small) but that's okay because he's too stupid anyway

Well. Golly. Wouldn't it be nice to have that fat, ineffective buffoon Dennis Hastert back in charge of the House? Gimme Duke Cunningham taking a long, warm shower with Mark Foley any day of the week - when the alternative is President Jughead Clodhopper getting control over whether (maybe literally) I live or die.
The point? Hugh Hewitt keeps trying to make it; JUST HOLD YOUR FUCKING NOSE AND VOTE REPUBLICAN. A primary challenge against Arlen Specter might give conservatives everywhere a stiffie, but when Asshole Specter *changes parties and hands the Democrats a filibuster-proof majority*, then you just stamped on your own Johnson.
Here's my philosophy; I don't give a flapping fuck if Olympia Snowe aborts the Baby Jesus while dancing the Hubba-Bubba naked with Hillary Clington - as long as she's got an (R) after her name and it means 47 Republicans in the Senate instead of 40, and a fighting chance of strangling Clodhopper's agenda before it gets anywhere near where it is now, then sign me up with the fucking RINOs.,
Sheesh.

If I were in the House, I would want this healthcare bill to die and save me from voting on more shitty legislation that would effectively kill my career.

See, purging the RINOs gave you a mansta hardon, but it played right into Democratic hands, because if a weak Republican is only half-good enough for those who are bothering to come out and vote, why not go full-retard and elect a Democrat?
Waddle over to the mirror, Tattoo, and repeat the following:
"Asshats like me helped Al Franken get more votes than Norm Coleman. I'm a fucking dildo, because Coleman would have been useful."
Again. Hugh Hewitt has it right; crawl through a mile of broken glass to vote Republican ... even if the guy's name is Lincoln Chaffee.

so 2 diff issues here:
1) your opinion on what the correct conservative political strategy would've been to avoid this current debacle
2) your estimate on the probability of passage.
only the second offers a chance to have your beliefs tested w/ outcomes of a consequential nature. offer's still good, btw. personally, i really don't know how this will turn out. but i'm near certain the probability of passage is less than 95%. intrade is at 65, but good luck getting money out of there.
on the first point, you seem like a conservative. you talk about hewitt, etc. and i can understand your frustration if you believe that conservative anti-RINO sentiment is what got us in this mess. in that case, our current mess would seem like an obvious self-inflicted wound. and so you would say, duh, this is your own fault dumbass.
however, that would be the liberal approach. it's possible you're wrong; it is possible for different folks to look at the same body of evidence and arrive at different conclusions. maybe anti-RINO sentiment was a necessary but not sufficient condition. your tone of certainty as regards your conclusion is more fitting at the end of a mathematical proof.

Sen. Olympia Snow, the sole Republican to vote in favor of a health care reform bill that passed the Senate Finance Committee today told ABC News she chose to break with party lines because, "I do happen to believe that we have to move the process forward, on this very difficult and challenging issue."
Early on, say those who are familiar with talks, Snowe was the lone voice in Baucus' bipartisan "Gang of Six" negotiating group complaining that the federal subsidies his bill would provide to help individuals buy insurance were far too skimpy.

Lincoln Fucking Chafee. There goes all your credibility.
Chafee did not even vote for the Presidential nominee of the Republican Party in 2004, but he sure as hell supported Barack Obama in 2008 while publicly trashing Sarah Palin. After losing re-election in '06, he was out of the GOP so fast that the impression of his Senate seat was still on his ass. It was widely believed before the '06 midterms that if the Senate came down to a 50-50 split -- which it would have had Chafee won -- he'd have pulled a Jumpin' Jim Jeffords even before Congress convened.
Parties matter? Tell this fucker that.

It's beyond politics now, folks.
The Democrats see a heaven-sent opportunity to gobble up a part of the economy that can literally rule over the lives of voters. Let me put that another way; the Democrats know - in their little rat-brains - that government control of people's healthcare is the most profound control of people's *lives* imaginable.
"Politics" is the art of "do as the voters wish, else they'll vote you out of office."
This thingie here is a matter of, "If you'd like your child to get that lifesaving operation next year, please continue to support the good efforts of The Community Organization For Child Welfare Panel. You *do* support them, right?"
Are you getting the message?
So they'll pull out all the stops. Absolute thermonuclear pressure will accompany this push ... because they're this (fingers 2mm apart) close. They don't mind being voted out of office, because they're going to end up in charge of your lives.
That's better than being in Congress.

The point is that when you're party has devolved to the point where you've only got 40 votes, the only thing standing between you and this Chicago Hillbilly's versions of America is the least tightly-wrapped guy with an (R) after his name.
Yeah. Whew. Specter would make 42 Repubs. And Chaffee 43. And poor ol' brain-damaged Jim Jeffords? 44.
If we'd had even *one* more Republican willing to come along in December. Even *one*, ObamaCare would already be history.
Clue: Easier to get *one* when you've got four or five to spare.

Yeah, "Gerry" [mis]represents my district. (But hopefully not for much longer) My email to him:
Congressman Connolly, I see from news reports that you are listed as currently "leaning Yes" on the next Healthcare vote. I wish I knew what I could say to help sway you to a firm No vote on this bill. There is no end to the problems with this bill, and no amount of 'fixes' will make this an acceptable piece of legislation. Every step of the process which produced this abomination has itself been deceptive, corrupting, and outright dishonest. Please vote NO on the Healthcare Reform Bill. There are many pressing needs on health-care issues, but this bill is NOT the way things should be handled. Right now, the single greatest thing that could be done for the nation on the health-care front would be give businesses the confidence in the future to start rehiring the millions who've become unemployed. That alone would would grant most of them health-care coverage while increasing the revenue to the Social Security and Medicare trusts. Sincerely, Mike Wxxxxxx
Posted by: MikeW at March 15, 2010 06:31 PM (g4tB5)
Except if that were the case, Tokyo Rose, the bill would have passed long ago and we'd be talking about crap and tax now. That puts you back at Square One.
Posted by: Tattoo De Plane at March 15, 2010 06:33 PM (mHQ7T)
your theory is based on analysis at the wrong level. there is no "they" as it refers to democrats now. it is now down to individual congress critters for whom their partisan allegiance is only one factor in the decision making process. on smaller matters (which, at this point, looks like every single piece of legislation ever produced), you would be correct to analyze at the level of party because party affiliation would be the primary factor for every decision maker.

"If you're relying on *Democrats* to save the situation, you're crazy."
And - unfortunately - that's what we're reduced to, and I'm not sure there exists this mythical creature often called "The Moderate Democrat." I think these scumbags can be relied on to pull a little Wormtongue action to "moderate principles," but too often the moment Granny Botox bobs her misshapen skull in their direction, they simply line up and vote like Patsy Leahy.
I hope I'm wrong. But I don't think so. I think that between now and the weekend, the Democratic leadership is going to turn all the dials to eleven.
And we're gonna rely on an "pro-life Democrat" to save our bacon?
I call bullshit. There's no such critter when the chips are down.,
