— Gabriel Malor No duh, says the 48%. How did we know? Well, back during the months-long fight over healthcare reform legislation the President said it wasn't a tax -- "I absolutely reject that notion" -- so anyone with a working brain knew it was.
Oh, but now it's time to defend the legislation in the courts and the Obama Administration is saying health insurance mandates come under the federal government's power to tax:
Administration officials say the tax argument is a linchpin of their legal case in defense of the health care overhaul and its individual mandate, now being challenged in court by more than 20 states and several private organizations.Under the legislation signed by President Obama in March, most Americans will have to maintain “minimum essential coverage” starting in 2014. Many people will be eligible for federal subsidies to help them pay premiums.
In a brief defending the law, the Justice Department says the requirement for people to carry insurance or pay the penalty is “a valid exercise” of Congress’s power to impose taxes.
Congress can use its taxing power “even for purposes that would exceed its powers under other provisions” of the Constitution, the department said. For more than a century, it added, the Supreme Court has held that Congress can tax activities that it could not reach by using its power to regulate commerce.
The tax argument comes with its own special brand of hell. As anyone who has had a tax dispute knows, the law requires you to pay disputed taxes first, before you're allowed to contest them at the IRS or in the courts. The Administration is arguing that the lawsuits should be dismissed because same rules apply to ObamaCare.
On the other side, the states suing agree that the penalty for failure to purchase health insurance goes to the federal government and so takes the form of a tax. But that's only the penalty. Before you get there, ObamaCare requires individuals to buy goods and services from private (in the sense of non-public) entities: the insurers. That's something very different than a tax. That's compelled economic activity and no court has so far "discovered" constitutional authority for the federal government to compel Americans to take part in private contracts against their will.

You must buy a new car from Government Motors every 4 years or pay the government a $3000 tax to cover your share of the government's infrastructure burden (normally paid through vehicle and fuel taxes).
You must purchase homeowners/renters insurance or pay a $400 tax to cover your share of the government catastrophic insurance burden.
You must have a checking account or pay a $250 tax to cover your share of the government's financial transaction processing and validation costs.
etc. That's the future of progressive liberalism. That and being restricted from exploiting your god given talents lest you make it unfair for other people.

I don't know that ads will be all that effective. Obama already raised taxes on the middle class with the cigarette tax. I suppose the GOP has an easy and ready defense now if they call it a tax or use the words tax and spend or whatever. Regardless, I think people who are angry over Obamacare know what it's about and it can be attacked directly.
I also think they thought large parts of it would be declared unconstitutional, which is why they loaded it with so much unrelated crap.

IF I WANT TO PAY CASH, I CAN'T WITHOUT PAYING THE PENALTY. IF A BUSINESS DOES NOT PAY 90% EMPLOYEE PREMIUMS, IT PAYS A PENALTY.
This will kick MORE people on the "federal teat" when small businesses just pay the penalty instead of providing insurance and then those people WILL NOT have a choice about their insurance.

Congress is not allowed to just lay taxes for anything it wants. That's beyond crazy. We went through this whole argument while the Washington junta was busy shoving this piece of shit health scare through and the traitors screamed that anyone who said it was a tax was a racist.
-->Congress can use its taxing power “even for purposes that would exceed its powers under other provisions” of the Constitution, the department said. For more than a century, it added, the Supreme Court has held that Congress can tax activities that it could not reach by using its power to regulate commerce.
Again, the Indonesian and his band of treasonous lunatics are arguing that the feral government can do anything anything it wants ... and charge Americans for the government's pleasure.
Further, while the tax is illegal (as Congress is not allowed to just think up any tax and slap it on Americans) the expenditures on the other side are even more illegal, with the feral government clearly overreaching its bounds - as the idiots in the Washington junta are trying to claim they have every right to do.
The situation reminas the same: the US or The Precedent. Only one will emerge from the Indonesian's term intact. America, take your pick.

Of course it does. It sets the minimums for a policy that you can buy. You cannot buy a plan that is solely catastrophic. In fact, every plan must have certain things (like maternity care - that seniors and males so desperately need).
Also, the act of being forced to buy insurance is an invasion of your right to privacy as insurance companies will be giving your medical records to the government without your consent.

That's one thing Osama Obama won't do. Donations can be deducted from your taxes, at least as of 11:27 CDT on 7/18/11.
The rest I agree with. Why the Traitor-in-Chief isn't sitting in a cell awaiting trial right now -- instead of costing us another fortune by taking yet another unearned vacation -- defies logic.
Now that Eric Shabazz Holder and the Department of Justice For Some think they can determine the law without recourse to courts or Constitution, we are nearing realization of the Chicago Jesus's dream: he was born too late to be part of the hip happenings in Moscow back in October, 1917, so he needs to make it all happen again.

I think this is because many are coming to the realization that this nation is going to split up, anyway. There are something like 6 independent tracks on which one can expect to see serious state nullification in the next year or two. The system is broken beyond repair and the only way to get back to a truly Constitutional basis (and preserve some of the American tradition and creed) is to start over. I believe that coming credit crisis 2.0 will be the catalyst for this change, since we have nothing left to buy time with.
That's how I see it, anyway.

I started writing something out that was a play on the Indonesian's attempt (I forget when this was) to reduce charitable deductions, because he claimed that the highly progressive tax rates meant that rich people got disproportional benefits from charitable deductions! I remember laughing at how the Imbecile was arguing for flat rates on charitable deductions - for "fairness" - but was allowed to continue to scream about making the current tax structure even more progressive without much of a pushback from our guys with megaphones. But ... the whole thing got too complicated, so I just left it out.

Also, the rosy economic growth assumptions built into the cost estimates for this monstrosity are so out of whack with reality ALREADY that it will require even more tax increases.

But, the previous court rulings on "the power to tax" are based on the 16th amendment and the government's power to levy an income or head tax.
This is NOT and income tax and trying to market it as such to a fair court is ludicrous. The new law does have taxes in it but the "fines" to people who do not buy insurance can not be skoffed off as a tax.
Obviously they are depending on communist judges to throw the constitution in the trash and rule in their favor. While I am sure that the left 4 will I am also sure the right 4 will not. Which leaves us right back to what side of the bed Kennedy gets up on.
This is a sad state of affairs when ludicrous rulings hang on the mood of one man and whether or not he is pissed at Skalia that day.

Well, there is. Medicaid. The whole thrust of the piece of shit health scare is to drain Medicare (leave the old people out in the elements when they get to be too much of a hassle) and to supercharge Medicaid. THe feral government assumes full control of all plans via the "exchanges" and the requirements the feral government dictates for any plan to register with an exchange - thereby giving them the simple ability to kill off most of the private sector with little effort, further enhancing the power and scope of Medicaid.
It is all so un-American that only an Indonesian could hold this nation and our institutions in such contempt that would be required to shove this down America's throat against some of the strongest opposition.
The health scare isn't a tax. It's a suicide bomb.

WASHINGTON (AFP) – Vice President Joe Biden brushed aside suggestions on Sunday that Democrats will suffer big losses in November midterm elections, vowing that Barack Obama's governing party will "shock the heck out of everybody."
Speaking on the ABC News program "This Week," Biden dismissed prevailing wisdom that Democrats, 17 months into Obama's transformative residency in the White House, would suffer a drubbing at the hands of salivating Republicans.
"I don't think the losses are going to be bad at all," Biden said. "I think we're going to shock the heck out of everybody."
Biden
said he was "confident when people take a look at what has happened
since we've taken office in November and comparing it to the
alternative, we're going to be in great shape."

I had been mulling this over a few nights ago and another thought occurred to me--if this is a tax, then the insurance companies are de facto federal contractors and all the normal federal acquisition rules need to come into play if they have not been specifically set aside in health care enabling legislation.
It's not so much that I want this to happen--it's more a sign that our "rulers" can't understand the law or the idea that not only are their second-order effects, there are first order ones as well. Or--that they knew this, and deliberately are attempting to get by stealth and deception what they cannot get by agreement.
And naturally, both can be true...

CLEVELAND (AP) - Ohio plans to build a sound barrier made out of soil and plants in the state's first eco-friendly attempt at muffling highway noise.
A spokesman for the state transportation department says the 12-foot high wall will be like a Chia Pet: Workers will water bags filled with soil and seeds and watch it grow.
The transportation department says the noise wall will be built this fall. It will span 400 feet along a westbound stretch of Interstate 70 near Columbus.
Wisconsin tried a similar idea. It built a sound wall made out of plastic forms filled with soil and plants, but removed it in 1996 after part of the barrier collapsed and weeds spread.

But taxing powers so broad that they can force you to do anything, may in fact be a bridge too far for the Supreme Court. If not then they can make you buy or do anything -- just call it a tax, and presto they tell you what bread you can buy on what day of the week you can buy it. Just call it a bread tax.
And how about the issue of having bureaucrats actually write the laws ... Like they did in NAZI Germany when they passed the Enabling Act of 1933 which overnight turned Germany into a dictatorship.

That would still take place within this same system. I wouldn't trust such a procedure. I don't know how many would. It's like the whole amnesty debate. Those who want to aid and abet the illegals by making them legal argue that it would be inhumane to enforce the law. THey argue that we have to surrender and legalize all of the illegals, though we will enforce the same sorts of laws against those who refuse to do the paperwork and future illegals ... It's just inhumane to enforce al that NOW. I see this same attitude in all of our governmental institutions.
I don't see an Article V Convention being called, myself. I think that events will overtake plans, anyway.
-->But lets assume that there would be a new application by enough states that meets all the extra-contitutional requirements. If at that point Congress refused or failed to call a convention, that would be a *major* constitutional crisis. One with very unpredictable results.
Posted by: ManeiNeko at July 18, 2010 01:55 PM (TiE76)
This is where we split. We've already had more than a few *major* Constitutional crises and they've just blown right by. There is no restriction to logic or good sense in our public discourse and the operations of our governmental institutions (which are assaulting the citizenry, now). This cannot be repaired by demands for logic and sense. The left just refuses these demands and has only gotten worse and worse - and they impose themselves on everyone else more and more.

If they want to call it a tax fine. The Supreme Court has already ruled against them though in Bailey Vs. Drexal Furiture.
259 U.S. 38: "Where the sovereign enacting the law has power to impose both tax and penalty the difference between revenue production and mere regulation may be immaterial, but not so when one sovereign can impose a tax only, and the power of regulation rests in another. Taxes are occasionally imposed in the discretion of the legislature on proper subjects with the primary motive of obtaining revenue from them and with the incidental motive of discouraging them by making their continuance onerous. They do not lose their character as taxes because of the incidental motive. But there comes a time in the extension of the penalizing features of the so-called tax when it loses its character as such and becomes a mere penalty with the characteristics of regulation and punishment. Such is the case in the law before us. Although Congress does not invalidate the contract of employment or expressly declare that the employment within the mentioned ages is illegal, it does exhibit its intent practically to achieve the latter result by adopting the criteria of wrongdoing and imposing its principal consequence on those who transgress its standard."
259 U.S. 41: "the court, speaking of the extent of the taxing power, used these cautionary words:'There are, indeed, certain virtual limitations, arising from the principles of the Constitution itself. It would undoubtedly be an abuse of the power if so exercised as to impair the separate existence and independent self-government of the States, or if exercised for ends inconsistent with the limited grants of power in the Constitution.'"
259 U.S. 43: "The court, there, made manifest its view that the provisions of the so-called taxing act must be naturally and reasonably adapted to the collection of the tax and not solely to the achievement of some other purpose plainly within state power. For the reasons given, we must hold the Child Labor Tax Law invalid...."

One side in the legal wars likes to argue that if a right is not funded by the government, it is a functionally denied right.
Now, let's say that I am required to purchase a mandated insurance plan, from a federally approved authority, via the tax power. I can actually see this as perhaps within the scope of the Congressional powers. I consider it a very poor use of the tax power, and one that no liberty-loving people should put up with, but I will not flat out say that the law violates the letter of the Constitution. Spirit--no doubt. But perhaps not the letter, and though I would fight it, it would perhaps not be beyond the pale if the ruling said "yes the Congress may so legislate". In that case, a liberty-loving people would beard that Congress via the amendment process.
But back to the mandate. There is then the matter of the free association clause of the First amendment. Why cannot I choose to pay the tax penalty and contract with a non-compliant insurance carrier? What if the insurance carrier is entirely within one state and one state only? Has not my freedom of association been infringed upon? If not--what power does Congress have to regulate and license trades? Is that not a state power--not just historically, but in fact today? Yes. Congress may not license trades, only interstate commerce, and the mere fact of existence does not make a business an interstate commerce. This is a tiring argument, to be sure, but the mere fact that the courts have so ruled that almost everything under the sun may start to be considered interstate commerce does not mean the mass of the people have also so ruled. Else they would have created and passed a Constitutional amendment to that purpose, which they have not. Which means the old clause is still the only valid one, Constitutionally, and it is the courts that are wrong. Now, why?
First--as I said, the old clause giving the power to Congress to regulate interstate commerce can not be superseded by a court ruling, not even a Court that has been given wide power via Title 28. It is also not within the power of Congress to enable the Supreme Court to overrule preexsting clauses of the Constitution via Title 28 language. The courts can overturn legislation that conflicts with the Constitution (a grant of power via Title 2
Thus, second--there is a clause of the Constitution that says that Congress may regulate interstate commerce. This automatically implies there is then such a thing as intrastate commerce, else there would no need for the qualifier "interstate". Furthermore, there being no additional grant of power from the people (in the form of Constitutional amendment), Congress has no power to regulate intrastate commerce and no court has the power to rule there is no such thing as intrastate commerce, as the only grant of powers the court has comes from Article III and Title 28; Article III does not grant it and Title 28 cannot. The courts quite simply cannot rule existing clauses of the Constitution out of existence; and thus neither can they ever rule there is no such thing as intrastate commerce, as the mere mention of the word "interstate" in the Constitution means there are other forms of commerce upon which Congress may not trod. And regardless of whether or not the Court agrees with this, it can do nothing, as the only agency that can legislate the idea of intrastate commerce out of Constitutional existence is the people--and they have not so acted.
Thus, there is such a thing as intrastate commerce, and Congress cannot regulate it. In addition, if it did so, it would be violating the right of free association, for once we agree that Congress does not have the power to license a trade conducted within a state we have to agree that it has infringed upon my right to conduct business as I choose--my right to associate.
And, to finally use that bit of liberal logic I first mentioned, even if Congress relented and allowed me to contract with insurance carriers that serve only my home state, the fact that they have taken my money for a essentially nationalized insurance carrier has robbed me of a functional freedom of association, as I will not be able to afford the extra expense, and thus the national mandate is a functional violation of my First amendment rights. If you use that kind of logic, and while I would not, it is part of current precedent and case law and therefore to not apply such logic evenly in this case as well is to deny me due process of law (as we are frequently reminded in other liberally-supported causes).

I think tanning salons will be out of business completely in 2-3 years anyway.
I can't tell you how many pieces of junk mail I've gotten since that tax hit. At least seven or eight just in the past couple months.
Those honest and ethical enough to report on it though will couch it as a downfall of people being more UV conscious and buying more self-tanning products.

They're already sorta taxing you into buying smaller cars.
Cities like Cambridge, Mass are making their parking spaces smaller; only big enough to accommodate a small car no bigger than, say, a Prius. And some parking spaces are designated for 'energy efficient' cars only.
And the govt is already offering tax credits for buying electric cars and shit.

The Supreme Court cannot render already existing Constitutional clauses null and void. Article III does not grant such power, US Code Titles cannot.
Therefore, the mere act of existence means the Court must pay that clause a certain amount of respect. It cannot be made functionally useless. Therefore, because a clause of the Constitution says there is such a thing as interstate commerce that Congress may in fact regulate, the Courts first duty in all such cases must be to determine--honestly--whether the economic activity is mainly intrastate or interstate in character. Not intrastate with an effect on national economic life rendering it really interstate commerce--for to do so then neuters that clause, which the Court does not have the power to do (but has nevertheless done). Intrastate or Interstate, period. There are no other choices. The Court may believe that in fact there is no longer such thing as intrastate commerce. This does not matter. If the Constitution said the Earth was flat and Man cannot land on the Moon, then it would be an error, but the Courts hands would be tied--as far as the law is concerned, the Earth is flat and Man cannot land on the Moon.
Only the people, via the Constitutional amendment process, could rectify the problem and say that the Earth is in fact quite round. Not Congress by itself, nor the Court in concert with Congress. Only the people, via Congress and state governments; or via convention process.
Legitimately, that is.
Thus, the Court must pay honor to the commerce clause as meaning there is such a thing as intrastate commerce (whatever their private beliefs) and a classification decision in all such cases must first be made--intrastate in nature or interstate. And if intrastate--then the statue is dead, automatically, as Congress has no grant of power.

The mere existence of a clause in the Constitution means that in all cases before the Court consideration must be given to whether clauses are being violated. This brings the 9th and 10th amendments into play again.
Inclusion as a rule, not by exception.

MEXICO CITY (Reuters) - Drug hitmen kill 17 at party in Mexico http://bit.ly/a0SoR6
Gunmen in five SUVs drove up to the party in a walled patio and garden on the outskirts of the city in Coahuila state across from Texas, smashed down the door and opened fire on party-goers at about 1 a.m/0500 GMT, Coahuila's prosecutor's office said.
"They came in, opened fire and shot against everything that moved," said an official at the prosecutor's office who declined to be identified.

But now that it's time to defend the legislation in the courts, Obama's
statists are saying health insurance mandates are Constitutionally
covered under the federal government's power to...TAX.
In a brief defending the Health Care "Reform" law, the Justice Department says the requirement for people to carry insurance or pay the penalty is “a valid exercise” of Congress’s power to impose taxes. The government claims Congress can use its taxing power “even for purposes that would exceed its powers under other provisions” of the Constitution.
Okay, lots of good points above, but I think most have missed a huge point: All three branches of government have at one time or another sought to expand government power by torturing various provisions of the Constitution beyond recognition. Example: The Constitution explicitly gives the federal govt the power to regulate "interstate commerce." So eventually congress (I never capitalize that worthless piece of shit of a body of liars) called on this power to claim that the Constitution *ALLOWED* them to do anything they wanted, AS LONG AS the thing could be considered to affect "interstate commerce" in ANY way, shape or form.
As Gabe, Ace or many of our attorney-morons can tell you, this so-called reasoning violates a host of legal principles. For example, it makes any attempt to limit federal powers a "nullity," meaning, "why did the Founders bother trying when the X clause permits the govt unlimited power in a certain arena?" (Hint: the law doesn't believe people devote time to provisions in contracts designed to have zero effect.)
So...they fast-balled that one by most non-statist scholars. And now they're trying for another bite of the apple--this time that the explicit Constitutional authority to TAX allows the government to levy ANY form of tax, for any purpose, even if the use to which the tax is to be put is not allowed to the federal government by the Constitution.
Did you catch that? Statist/thugs/leftist/socialst/Dems claim "It doesn't matter that there's no Constitutional authority to force people to buy private health insurance--we can still levy any desired tax because the Constitution gives us the power to tax. Regardless of the UnConstitutionality of the *purpose* of the tax."
THIS is why they need killin'. (Okay, just being metaphoric--need to be *shot out of office by a majority of votes actually cast by living American citizens.)

Lawsuits dismissed because it is a tax and it needs to go into effect first. The deciding Judge is given a nice appointment.
Tax goes into effect and lawsuits refiled. The lawsuits are dismissed when the federal government argues it is not a tax, and the appropriate time to challenge it was before it went into effect. The deciding judge is given a nice appointment.

"because to not do so is to render it meaningless, and the Court does not have the power to make any clause so. During his debate with conservative, former Congressman, J.D. Never mind that all of his talking points and all of his pats on his own back were revisionist history, and never mind that he lied repeatedly, accusing his opponents of having taken positions on issues which Mr. Magoo had taken on those issues himself, repeatedly projecting his own positions onto his opponents, and fighting dirtier and dirtier as the debate went on. That's Mr. Magoo, our sleazy senator from Arizona, successor to. Barry Goldwater, who must be turning in his grave.

Okay -- this is O/T but still whiplash inducing:
On the July 17 broadcast of "The McLaughlin Group" during the predictions segment, both Newsweek columnist Eleanor Clift and MSNBC political contributor Pat Buchanan made astounding predictions about what the situation would be in a post-2010 election cycle.
"After the Democratic in November, there will be a push to put Hillary Rodham Clinton on the ticket in 2012," Buchanan declared.
One could be skeptical and say Buchanan was just throwing an outrageous prediction out there since he's conservative and opposed to a lot of President Barack Obama's policies. However, his panelist, a very pro-Obama Eleanor Clift agreed.
"And she may trade places with Joe Biden and Joe Biden may be the next Secretary of State," Clift added.
"Exactly," Buchanan added.

This was my first attempt at cooking it. I wound up dry rubbing it (chili powder, cinnamon, Chinese 5 spice powder, pepper, and brown sugar) and grilling it, then serving it with a mango-peach salsa (peaches are really good here right now). It turned out well (judging from the contented belches Mr. Y-not is emanating). I cheated though and got the meat from Fossil Farms.
The meat has more consistency than pork tenderloin (grainier, which I prefer) and is darker. Somewhere between pork and beef, I'd say. I've read that you should brine it, but I was too lazy to do that. I thought it turned out fine, not dry.

Ours is a pepper tree. Spontaneously lost a couple of major branches last year. Really annoying.
We don't have an HOA but we do have old people who "volunteer" to walk around the neighborhood ratting out their neighbors if their trashcans are left out too long or they dare to touch a tree. Our neighbor, although not elderly, is a tree Nazi. 'Can't wait to leave this neighborhood of uptight aging (rich) hippies.

This is the same neighbor who has declared our shared fence hers. Fine, but it's falling down, but she won't repair it or replace it because, get this, supposedly her father built it.
It's a standard wooden fence, nothing unique, and it's a POS, but we cannot replace it because she has some sort of bizarre attachment to it.

From Fox news: (Wonder if Robyn has to blow before the move?)
Disgraced Hollywood actor Mel Gibson is planning a move to Australia with his soon-to-be ex-wife, the Daily Telegraph reported Sunday.
Gibson, who is facing allegations that he beat his former girlfriend, Oksana Grigorieva, during a dispute last January, has reportedly sold one of his homes in the U.S.
The actor sold his New York estate, Old Mill Farm, for $28 million, according to the newspaper. He also reportedly put his Malibu, Calif., home on the market for $17 million.
The newspaper also reported that Gibson plans to relocate to Australia with his estranged wife, Robyn, who defended the actor in a written statement last week, in which she said "Mel never engaged in any physical abuse of any kind toward me before, during or after our marriage." The two were married for 28 years.

That equals about 2.5 feet diameter (width) at breast height -- which is really thin for a 40' tall silver maple. They can be very nice trees and thrive for well over a century, but once they're over the hill it's best to get rid of them. It might be worth hiring an arborist to evaluate the health of the tree. Unless you just want to cut it down anyway.

Don't buy a damn house that has those. Or if you do get stuck with them work assiduously at breaking them. HOA's only have as much power over you as the deed covenants allow. Deed covenants ALL become unenforceable if you can find one in the neighborhood that is not enforced.
That is what a lawyer told me here when I asked him about a requirement that all "outbuildings" had to match the house in every detail. (what I was told when I bought the house). When I went to put in my pool building I started asking because one of the neighbors had put in a cheap Sears and Roebuck tin storage shed.
After checking the deed filing at the courthouse we found that there were no such covenants anyway but it is still a way to get out of them.

Jeb Bush may be a candidate, but he will have three large hurdles to clear.
1. Son's arrest for DUI and resisting arrest. The circumstances were kind of funny, actually, but not as funny as when he and his girlfriend were busted for being naked in the back seat of a Jeep Cherokee in the parkinglot of a shopping mall. Give the guy a break. He is a normal, healthy, well-adjusted 21-year-old who just likes to have a good time.
2. Daughter's arrest for prescription fraud. Yeah, the Bushies are wild 'n crazy kids alright, and Nellie ain't too bright ...,
..., but ..... , although Xanax is a controlled substance, it is a mild sedative, not a hard drug like Cocaine. The MSM exaggerated that story. They probably didn't even bother to try to find out what Xanax is.
3. Wife Columbas' detention for deliberate US Customs fraud for failure to declare $19,000 in clothing after a trip to Paris. Yeah, well, she ain't no Oksana either.
4. BTW, you neglected to mention that Jeb was an outstanding governor, who was very well liked, and who got a lot accomplished and who worked well with Republicans, Democrats, whites, blacks and Latinos, alike.
