Palin E-mail Hacker Sentenced to 366 Days

Even though it's November and the days are getting shorter, colder and darker, there are still those days when you wake up and have to put a smile on your face, such as when things like this happen. (AP article via Yahoo)

"KNOXVILLE, Tenn. Â– A former University of Tennessee student who hacked into Sarah Palin's e-mail during the 2008 presidential campaign was sentenced Friday to a year and a day, with the judge recommending a halfway house instead of prison."
"U.S. District Judge Thomas W. Phillips also said David Kernell, 22, should get mental health treatment, based on defense comments Friday that he has had conditions including depression since he was 11."

Yeah, you stick with that story and you should be fine...

The prosecutors' pre-sentence filings said Kernell, a Democratic legislator's son, had posted online that he found "nothing that would derail her campaign as I had hoped, all I saw was personal stuff, some clerical stuff from when she was governor ... And pictures of her family ... I read everything, every little Blackberry confirmation ... all the pictures, and there was nothing..."

Yeah, it seems a disservice to him. What kinda' half-assed tats is he gonna' get in a halfway house? And the shanking opportunities are much more limited, though I suppose he could stab someone with a fork at the group-house table for taking the last chicken leg. But that really doesn't build up that much street cred.

20 A halfway house is to aid the prisoner's transition from prison back into society. It's not easy incarceration. I'm not sure if other prisoners would be treated like this. He can go to a minimum security prison farm.

33 Kernell was convicted of unauthorized access to a protected computer and destroying records to impede a federal investigation. Jurors acquitted him of wire fraud and deadlocked on an identity theft charge.

Why wasn't he charged with the same crimes as Scooter Libby and Martha Stewart, that old general charge they love so much when they can't prove anything else on someone they want; "obstruction of justice". That is essentially lying to investigators about the original crime.

Martha Stewart got 5 months actual prison and two years supervised parole plus other stuff. In a much worse travesty of justice Scooter Libbey was sentenced to 30 months in prison and a $250,000 fine. Tose sentences were "commuted" by Bush (instead of the full pardon he should have got) but not the other stuff.

He was disbarred in his home State and Washington DC, thus removing his chief from of earning a living. Note that Clinton was convicted of perjury in court which to me is much damn worse and all he got was a temporary disbarment for 5 years.

In any case we know that there is no justice in this country if the crime in any way involves political motives. Or even if there is no crime but the charge is political. Basically you are screwed if you are a Republican, especially a conservative Republican, and yu will get off with a finger wave if you are a Democrat.

At least in this case he was still convicted of a felony. But they will probably get that removed after a few years since his father is a politician.

I suppose the light sentence is because he did very little harm with this stunt. Of course, if he had found anything that could be spun as negative to Palin he could have seriously harmed her.

Maybe the only reason he was sentenced at all was because he failed.

I rank what wittle depressed Kernell did to someone breaking into my house, finding where the documents are stored, and then running out into the neighborhood tacking the docuemnts to whatever surface he can. Burglary and home invasion plus invasion of privacy.

Sending such criminals to a half-way house is criminal since a half-way house is intended to transition a prisoner back to normal life. Just like two killers in CT who met up at a half-way house. Or criminals who have been remanded to half-way houses, signed out, and committed other crimes like rape. The message the judge in the Kernell case is sending is, hacking is not really a big thing. Kernell needs to be somewhere with fences and such to drive the point home he did a crime.

51 I admit that my "nice person" card expired long ago, and I have not sought its renewal. That said, I have no problem with the little Leftist spawn having his life ruined. I would have favored a sentence at the upper level of not the recommended sentencing range, but rather statutory sentencing range, due to the intent of the hacking. However, we do not live in a country where there is equal application of the law, other than the sense implied in Orwell's Animal Farm.

When he gets out, while technically a Federal felony conviction would stand as an obstacle to the career of anyone who is not related to the Political Class; his pathway to success is assured so long as there is a Leftist infrastructure remaining in this country. Just like with street criminal gangs, to the Democrats a felony conviction and jail time for a crime aimed at advancing the power of Democrats is a resume enhancement. He will be cared for by the Nomenklatura as an exemplar to others.

I personally wish for him that he experience the full range of correctional lifestyle available in the half-way house, and not miss an iota. And actually, I wish [with no realistic expectation of it happening to an offspring of the Political Class] that he actually goes to a real prison. One dynamic that I have noted during my career in law enforcement [on a state and local level, can't be sure that it exists in Federal custody but I suspect that it does] is that his family connections are not going to be conducive to his safety.

There exists a pecking order in any prison or jail. As a new fish inmate, he is going to be at the bottom. Even with no outside connections, a new inmate is going to be threatened to accept the "protection" of the established order. Usually, if the inmate will stand up for himself, he can get through this to do his time.

However, if the inmate is known to have family connections to wealth or political power, the threats move to another level. Other inmates will know who he is. Maybe not at first, but believe me, inmates in county jails and prisons get the news.

He will be approached and given to understand that if rich, politically-connected [and keep in mind that daddy's connections go to the White House as far as the inmates are concerned] daddy does not pull strings that help the release, conditions and location of incarceration for selected other inmates, and/or transfer more than a little bit of wealth to designated third parties outside the prison system; Davie-boy's life might get far more traumatic than he would like. No matter how much or little cooperation Davie gets from daddy, the demands will continue.

The grooming process will start with demands for items from the prison canteen [inmates are allowed to buy certain luxury and hygiene items from a prison store, but are not allowed to transfer them to another inmate] and escalate from there, probably over a period of 1-2 months.

If we are lucky, his experiences will be a bad example to counter the pedestal the Democrats are going to put him on when he gets out.

In any case, since he committed a crime to try to steal an election, he deserves to be a criminal.
