What's dear leader going to say?As I recall, he was against gay marriage.... or at least said he was.
Will he have Holder file against this ruling?
Yes, I imagine he'll use every means at his disposal to stop this, just as he did with Arizona.
Oh, PS, Judge Walker--
Thanks for the extra 7% turnout in November!!!
Hugs and kisses,
Ace
PS Suck the barbed cock of Satan.

Thank God for small favors, eh?
This feels to me like Waterloo. This is the judicial establishment gone utterly lawless.

If the judge says that marriage is not defined as being between a man and a woman, then what is the new definition of marriage? Is there a new list of who is included and who is excluded?
Oh fuck, that's true isn't it? Prop 8 was not a ban per se, but a reaffirmation of what marraige is. So marraige doesn't exist? I am so confused...

So I apologize if this was covered recently, but I admit I don't really know why ace is opposed to gay marriage. The other post seemed to just assume we know it's an obviously flawed decision.
One doesn't have to be opposed to gay marriage to be pissed off about the ruling.
We're talking about a state constitutional amendment approved by voters that was overturned by an activist judge using the legal reasoning of "because I wanna". Don't matter whether the amendment bans gay marriage or banning guns- a bad decicision is a bad decision.

The answer is to get government out of "marriage" ..... period. Mexico and a number of other countries separated "marriage" and "civil union" long ago. There are two ceremonies, the legal one and the religious one. This leaves the religious definition of marriage to the religious institution of choice. Another benefit (and a fear I think is reasonable) is that it keeps gays from suing churches that do not want to perform gay marriages, as it separates one of these last few entanglements of church/state. Another possible plus... if you argue the religious angle for prohibiting gay marriage, how do you argue against polygamy when there are religions that expressly condone it?
The legal purpose of religion is to recognized a type of familial relationship... not a religious one. What is the problem of the state recognized a family relationship that the people involved want?

Polygamy (and polyandry) are inherently unequal, so a good secular argument can be made against those. Animals and children dont have legal standing, so dont even go there.
There is nothing inherently unequal about Polygamy (and polyandry).
And animals and children will have standing as soon as some judge decides to GIVE them standing (age of consent is but a stroke of a pen). I think we do need to go there before some judge takes us there.

I didn't vote yes or no on Prop. 8. I left that line blank.
The screeching vengeful creepy behavior of the anti-Prop. 8 people after the measure passed caused me to decide that if I had it to do over, I would vote in favor of it. Today's subversion of process cements that view.
See, I was indifferent when I thought it was just about teh ghey. I have other things to worry about. Now I realize that to a large extent, that was just a pretext. The real purpose is to de-legitimize existing institutions for the sake of de-legitimizing them. Today's decision undermines elections and the rule of law.
Proposition 8 passed based on large percentage of blacks and Hispanics (70% +) voting for it. So in a way, the judge is disenfranchising minorities.

I bear no ill will to Gabe or any other homosexual. Just to be clear, some of my best friends are homos. <---Not really, but it had to be said for the fake authenticity.
That doesn't have a fucking thing to do with it.
I am sick and tired of my language and my culture being subjugated to the government-instituted religion of hedonist secular humanism and identity politics.
It's funny that half of our Constitution appears to deal with the presence of blacks in America, in the various societal iterations that such folks have participated in American society, and not a damned word is said about homosexuals, or marriage, and yet within those portions of the document which really did deal specifically with a slave-class later integrated into normal society we can find an obligation to overturn all known human history as it relates to marriage.

"Its these types of things that make me get as paranoid as Glenn Beck, that the purpose is to tear down all traditions and replace them with what the state says is "good".
I hate to tell you.....but doing some research on the purpose and the history of marriage....that is exactly what this whole mess is about. This administration marks the beginning of the end in my estimation, unless for some miracle that the Republicans pull their heads out of their asses, and actually represent the Conservative majority in this country.
The reason we originally rewarded Married Couples financially was to promote reproduction and strengthen and build a middle class. Human development requires input from both a man and a woman, otherwise nature would have compensated for it long ago. Marriage is the glue of a culture, the more people that are married the larger the middle class is, the larger the middle class is, the stronger the country is economically.
Now all the adopted kids will go to same sex marriage couples, and they will use technology to birth a new culture that fits their Ideals, so that the civilization can be bakrupted from within, and once the christian religion or religion in general is finally defeatable.....the state can fill the role of God!
Homosexuals have just legislated themselves as a physical threat to the lives and freedom of an entire civilization. I'd laugh my ass off if it wasn't so F'n depressing and sad!

This decision actually is pro inbreeding. It's what someone else said; laws about marraige are ment to foster a healthy next generation. Any argument you can make about gays getting married to fulfill this purpose I can use to explain why marrying your sister or mother or brother or father should be equally protected. Gays can adopt-so can siblings. Gays can love each other-so can siblings. It's the same thing. Marraige is a biological function more than anything.

Where did this progressive, we-know-best elitism all start?
"With the decline of clerical power in the 18th century, a new
kind of mentor emerged to fill the vacuum and capture the ear
of society. The secular intellectual might be deist, sceptic or
atheist. But he was just as ready as any pontiff or presbyter
to tell mankind how to conduct its affairs. He proclaimed, from
the start, a special devotion to the interests of humanity and an
evangelical duty to advance them by his teaching. He brought
to this self-appointed task a far more radical approach than his
clerical predecessors. He felt himself bound by no corpus of
revealed religion. The collective wisdom of the past, the legacy of
tradition, the prescriptive codes of ancestral experience existed to
be selectively followed or wholly rejected entirely as his own good
sense might decide. For the first time in human history, and with
growing confidence and audacity, men arose to assert that they
could diagnose the ills of society and cure them with their own
unaided intellects: more, that they could devise formulae whereby
not merely the structure of society but the fundamental habits of
human beings could be transformed for the better. Unlike their
sacerdotal predecessors, they were not servants and interpreters
of the gods but substitutes. Their hero was Prometheus, who stole
the celestial fire and brought it to earth."
Paul Johnson,
Intellectuals, 1988.

I believe however that urban areas would erupt and the "guvs" would stick around to try to pacify and bring order to that. Meanwhile, the suburbans and rurals would just hang out at home eating ramen and sharing tomatoes with their neighbors. Meanwhile, the political process would very, very quickly remove the incompetents, and we'd back to square one. No progress.....

Herr, regarding your #243, my guess is that since the feds control the banking system they will upon the first act of nullification try to bring that state's government to its knees by freezing all accounts.
I don't think we are anywhere near violence now (except for maybe small one-offs), and since no once is really facing serious hardship I don't see it in the picture. People are angry about alot of stuff, but there's food on the table and roofs over the heads. So I don't even know if we've got enough people really angry to get much more than change in control of the government to a slightly right-of-center one over the next couple of election cycles.

It hasn't gone to an important Federal court yet. That was a District court, ruling that the California Constitution is at odds with the Federal Constitution, and the Federal Constitution wins becuase [reasoning muffled for unspeakable reasons].
It'll slide through the 9th Circus with a decision one way or the other, and then to SCOTUS where we have to hope Kennedy's wife remembered to buy coffee the night before oral argument.

I agree with you that the judge should not over-rule the express will of the people. However, our Founders never intended the United States to be a democracy (they called that "mob-ocracy"); we are supposed to be a representative republic.
The irony here is that the early 20th C. Progressives created the referendum process in California. Democracy isn't such a good thing if the ignorant, unwashed masses don't do what their betters tell them to do.

For some things, maybe ignoring it will work - logging restrictions because of owl nests, for example. But things are already starting to involve big issues. The FedGov can't let Arizona ignore them on border control, and it can't let Missouri tell them to get fucked on ObamaCare taxes. Those are effectively existential threats to the Feds.

First, full disclosure: I am a conservative/libertarian. I do not, nor have I ever, danced to the the "social" conservative tune.
Now - It is NOT a function of government to set social "order", beyond the bounds of protecting the citizenry from harm.
Government's involvement in the issue of the morality of marriage was dead and gone long ago, when government said "why yes, Tommy and Suzie, in spite of what is morally right according to religion, you may certainly go ahead and petition for a no-fault divorce whenever you'd like". At that moment, the holier-than-thou types (no matter their political affiliation) began allowing government to dictate "legal morality" in place of REAL morality, and thus allowed government to be placed higher than their own beliefs.
The word and state of "marriage" is the issue here. Think about this...Is a couple considered "married" when a governmental office says they are, or when they are joined together in a ceremony at the church or worship house of their choice? See what I mean?
In the end, what has "straight" marriage done for society, family and morality as a whole? Hmm...Well judging by the 50 to 60% average divorce rate, I'd say it's working well, wouldn't you?

By "serious hardship" I mean waiting for hours in a food line wondering if there will be anything on the shelves when you get there. I mean wondering where your next meal is going to come from. I don't deny things are bad and that people are hurting, but they are hurting by American standards, not third world revolution-around-the-corner standards.

...but...this will not go down well with Blacks or Hispanics (and the Muslims, but we won't go there) -- and while he still has support from those two groups, it is starting to decline; he can't afford to come out in support of this judge, at the same time the lefties will be expecting him too.
His base is a fair bit split on the social issues -- they are becoming split on economic issues (well off, college lefties talk a good game, but eventually they aren't going to like giving up the Lexus or the Swedish nanny because of higher taxes, now are they? heavens forbid it gets so bad that they have to forego the getaways to the health spas and shopping at Whole Foods -- and it's starting to go that way).

The next fight won't be about the churches. The homos know not to go there....yet. They will demand lessons and textbooks in the public schools as far down as kindergarten and even pre-school showing same-sex marriages as A-OK. Sex education classes will have to include buttfucking and fisting. Summer reading lists will have to include "queer lit." You think this is farfetched? With Kevin Jennings already in place as our national "safe schools czar?"
Parents will not be able to opt their kids out of this immoral and perverted tripe. There will be an even bigger mass exodus from public schools and endless fighting and controversy at every school board meeting and during every state education bill debate. Regular Joe and Jane Schmos who just want to keep the sex talk at home and not expose their young children to perversion will be called bigots and Nazis.
And this comes right as there seems to be a growing consensus behind Arne Duncan's federal takeover of K-12 curriculum and standards. It won't be long before a Federally-approved homosexual curriculum is forced on the states whetheer they want it or not. If they refuse they will be denied federal funding for needy students and special needs kids. Liberals will howl that all of us winguts are sacrificing the poor and retarded kids to maintain our bigotry against teh gheys.
Thanks a fucking lot, Ted Olson, you with no kids to worry about. May you burn in Hell while your martyred wife enjoys Eternity with the Lord.

When people allow government to tell them who they can and canÂ’t marry, they allow government to take over yet another portion of their lives.
IS THAT REALLY WHAT WE WANT TO SEE HAPPENING HERE? Because if we do, then we are, by default, ok with what government may do next, when it changes hands every so often. Savvy?
If we’re going to allow government to say “yes, this is moral, and government will uphold it”, then we have to make room for day when those who don’t agree with the morals we agree with, are in power.
The morality of marriage, and who gets to marry whom, should be left up to churches. Not government.

Do you want freedom of religion, or not?
Government budding in on issues of morality that are best left up to faith, is government taking more conrol over our lives.
If a person doesn't belong to a church, or wants a civil ceremony, they can get one, via justices of the peace or ships captains.
As for 4 wives or 12 yr olds...Why is that anyone's business if someone has multiple spouses, as long as no harm is being done?? I understand your morals may not agree with it, but others have differing ideas. And the 12yr old stuff - back in the pioneer days, kids were allowed to consent at nearly this same age. Was it right? Legally, according to today's standards, no. But back then, folks didn't live as long, and married earlier.

The legal need is to have one's spouse recognized as a family member (and a ranked family member) for inheritance, partner for child rearing, insurance and the like. Granted (and no one has brought this up) gays can have multiple contracts drawn up to do the same thing, but "marriage" does it on one stroke.
There already are legal venues to create and uncreate certain familial ties... adoption and divorce. I proposed civil unions earlier in this thread (#182) and after reading many of the responses since then, it is very clear that the problem is religion.... and many want the law reinforcing their religion's view of what a marriage is. The problem with that is that there are other views of marriage promoted by religions other than Christianity and Judaism. Under the First Amendment, we would need to abide by those as well. And it still brings us back to gay marriage as there are religions and even Christian churches that recognize it. Others have mentioned the risk of gays suing churches and Muslims forcing recognition of polygamy.
Someone challenged my indeed unsupported notion that polygamy is inherently unequal. While it might be theoretically possible to be equals in such a marriage, a basic study of how it is practiced will show that it is almost never the case. Laws that seem constitutional on their face can be ruled unconstitutional if it results in the loss of rights. That's the secular argument I was talking about. As for a judge determining that a child or animal has legal status to marry, that can happen with or without gay marriage.... but it calls into question a whole other line of judicial history... not just marriage. Child marriage used to be common, but has been almost erased. Gays had nothing to do with that.
Separate religious and legal marriage and it will be best in the long run. What many of you consider to be oppression is really the loss of a privileged place. No one is forcing you to do anything. As for your children, gay culture is already public and your kids know a whole lot more about it then you did at your age. Other "sins" exist in the world too... doesnt mean your kids will emulate them, esp. not if you teach them well.

Thanks for expressing your "concern." But the massive voting majorities for my point of view make it hard to feel overly defeated at this point. And as for the "next generation" of gay lovers, you are seriously prone to extrapolating the view of your personal circle onto the rest of society. And even if that's true - then when/if those pukes have the vote, then they can do as they wish and amend what they wish. For now, an out of control court system is the problem and it must be fought to the bitter end. Otherwise, elections are pointless.
