If the third SEAL is found not guilty, the person that has the most to lose in this situation is the Major General who recommended non-judicial punishment.

My question:  Who within the Obama Administration spoke with the Pentagon and demanded the SEALS be punished?  This didn't happen in a vacuum, and Gates knows the answer to the question.

SEAL training is probably $500,000 per guy at least, not to mention less than 10% make it through BUD/S.  All because some butcher got a bloody lip. This was a really well thought out plan.

I'm all for putting the plastic bag over their heads, and securing with the plastic ties. These SEALS should never have been charged in the first place, and when they were, the brass should have immediately stepped in and cleared them.

When the Major General recommended non-judicial punishment, it was probably due to political pressure from the Pentagon or other sources.  After the men refused the Captain's Mast and requested the Court Martial, the better course of action would have been to re-review the evidence if any, and dismiss without prejudice. 

Now, it has become a public nuisance and embarrassment for the Major General, and he only wants this trial to disappear.  I assume General Odierno writes his ER, and even if they are buds, this won't be a major gig but probably an annotation and that's enough to stall any future promotion.

FWIW, the rumor that I heard was that the Obama Administartionwanted the SEALs tried as payback for the SEALs jumping the gun and rescuing the captain of the Alabama Maersk. The administration wanted to try lawfare and get their attorneys on site, but the on-scene commander gave the SEALs the go-ahead (his right, by the way).

Obama was pissed, and wanted some payback. This was it. As I said, a rumor that I heard, FWIW.

37 Well I am very happy that two have been cleared.  Unfortunately that opens the door for a "fair" result.  That way everyone gets a trophy.

38 I for one take little solace in this, although I do pray the third man is also acquitted, as he should be.

Unfortunately, the way elite units like the SEALs work is that once a guy is court-martialed, his career is essentially over, at least as a SEAL.  They may find the guy a nice desk job pushing paper somewhere, but he won't return to his unit.

It's very sad, too, because a freaking terrorist with a bloody nose crying for his mullah was all it took to ruin three brave American servicemen whose only "crime" was in doing their job and bringing in the evildoer they were assigned to capture.
