Surprise: Dems Lied About 72 Hour Advance Posting of HealthCare Bill
— Gabriel Malor

Perfidy! Lies and scum and bad faith and treachery and deceit! The false, tricksy, faithless KNAVES! DEMOCRATS!

Oh, whatever. Like anybody is surprised at another broken promise from Democrats in Congress. Hell, no one is surprised at the kid glove treatment that CNN is putting on it either:

House Democrats appear to be softening their pledge to allow the public 72 hours to review the health care reform package online before a House vote. "We will certainly give as much notice as possible, but I'm not going to say that 72 hours is going to be the litmus test," said Majority Leader Steny Hoyer on Friday.

"I'm a little bit taken aback that now that 72-hour rule has been completely cast aside, since nobody in the House has seen what's in the reconciliation bill," said Rep. Eric Cantor, R-Virginia. Speaker Nancy Pelosi promised earlier this year Democrats would make the final health care bill public at least three days before voting.

Ramming it through. No time to waste. Gosh, what if people actually knew what Congress was doing?

1 The Final Countdown?

I guess Pelousi was serious when she said we'd have to pass it to "see what's in it".

I hate these Dem clowns with such a perfect hatred.

2 The Dems are going to write the bill after they pass it, right? Which is why they can't post it? Or am I getting confused with the 3rd-to-last time they tried to pass this "bill"?

So if the House "deems" the Senate bill to "be passed" we all know that it is trickery - they never voted on the bill before them and so the President's signature means nothing.  The problem of course is no one will do anything about it and a lawsuit, though certain, will take years.

But what if a Republican lead congress in 2011 simply brings the Senate bill up for a vote?  After all, it was never voted on.  And then they proceed to vote it down.  The President's signature is in error.

I'm not so sure about it taking years for a lawsuit to be filed (or did you mean something else?), because there's several fired up and ready to be filed.  The problem will be, as Vic always points out, is that somebody with "standing" will have to file the lawsuit.  I'm not a legal beagle, so I dunno what that entails.

44 ran into a libtard in a store line today, who actually brought up obamunistcare.  i asked him specifics on a few items, none of which he knew.  Then, i asked him if he had ever known the House to "deem" a bill winning a vote without a vote.  He looked at me like i was insane; then I loudly, simply informed him that this is what Piglousy is doing.  He looked stunned.  He was then directed to look up a few websites because a TEABAGGER like myself is an ignorant racist.  As the rest of the people in line looked on, (all libtards) not one of them could respond, but several asked for the web addresses. Then I slammed them with, but, uh, Piglousy promised to post them online beforehand, but, since she hasn't, you will just have to find all you can about the process, because the companion bills are and will not be online.  The i placed the pudding on the conveyer.

69 "But what if a Republican lead congress in 2011 simply brings the Senate bill up for a vote?"

They couldn't.  All unfinished legislative business--i.e., bills, resolutions, proposed constitutional amendments--dies at the end of each Congress.  As opposed to executive business, referring to treaties and nominations submitted by the President, which remains pending and carries over from one Congress to the next.

"How in God's name did we get to a place where our Congress is actually considering amending the rules which deem a bill passed despite the fact it was in fact, not passed?"

As I noted in another thread, part of the confusion here is terminology re: the word "rule."  This not a proposed amendment to the standing Rules of the House.  Rather, what the House calls a "rule" in this context is a separate stand-alone resolution that the House adopts to govern debate on a bill, or on group of bills.  This is how the House runs its business, which is why the House Rules Committee is so powerful.

"Rules are not fucking bills. As such, the vote on a rule can't be treated as a vote on a bill."

Yes and no: the House has in the past adopted "self-executing rules" that take effect contingent on some other action either by the House or the Senate, but not attempting to amend statutes that don't exist, or whatever insanity they're trying to pull in this rule.  Why they are trying to do this is to sidestep the fact that they can't amend the Senate bill, because they know the post-Brown Senate would then kill it.

While the Senate bill is currently in the House's possession, any amendment to the Senate bill would mean it would have to go back to the Senate, accompanied by a request that the Senate do concur in the House's amendments, or appoint conferees.  A vote in the Senate to do either of those things would be subject to cloture and thus to a 60-vote supermajority.

78 February 16, 2010 Dear Mr. [Chap], Thank you for contacting me with your views regarding the need for transparency in our lawmaking process and in particular during the debate on health care. I appreciate you taking the time to voice your thoughts and concerns. As you know, our country is experiencing the worst recession since the Great Depression. The national unemployment rate stands at 9.7% and Ohio's rate is 10.9%, consistently higher than the national average. With millions of Americans without work and health care, people are angry and rightfully so. For those who are fortunate to have health care, the cost of premiums for an average family of four is projected to increase by $1,800 every year. There are millions of uninsured Americans and millions more who are underinsured. Further, a vast number of bankruptcies are the result of health care debt experienced by individuals who assumed they had "good coverage." And according to the Center for American Progress approximately 14,000 Americans lose their health insurance each day. Millions more of them are underinsured. We cannot afford the costs of continued inaction. During the 111th Congress, the House of Representatives conducted 33 related hearings prior to consideration of health insurance reform, several of which I participated in as a member of the House Committee on Energy and Commerce. In addition to these committee hearings, members of the House of Representatives had more than 120 days to review detailed reform proposals that were made available on the Internet. Conference committees have never been broadcast whether controller by Democrats or Republicans. The conference committee is also working out differences between existing versions of legislation, not crafting new provisions. All debate, hearings, and markups were open to the public and will continue to be open to the public. In the House alone, there were over 100 hours of hearings on health reform where we heard from over 181 witnesses, 83 hours of committee markups where 239 amendments were considered, and 9 hours of floor debate, which was available for the public to watch online and on CSPAN. The final legislation will also be available to the public for at least 72 hours before the House votes on final legislation. In the House, the three versions of the bill have been merged into one bill. On November 7, 2009, I voted for and the House passed H.R. 3962, the Affordable Health Care for America Act. While the debate surrounding health care reform will continue, this bill moves to improve the employer-based coverage for 420,000 residents in my district, to improve Medicare for 107,000 beneficiaries, and to move to close the prescription drug doughnut hole for seniors across this country. The legislation passed by the House is available and my constituents can view it at www.thomas.gov. The Senate passed its version of the health care reform bill on December 24, 2009. Both the House and Senate are working to reconcile the two bills into one final bill. The final bill must be passed by the House and Senate before being signed into law by the President. Until then, I will continue to work with my colleagues in the House to devise and advocate for a final version of the health care reform bill that works for and with the American people. I appreciate and recognize your concern regarding this matter. I will continue to push for more transparency with any and all legislation. Please contact my office if you are in need of further assistance. Sincerely, Betty Sutton Member of Congress

79 Don't lose courage now. The fact that they are even considering this unconstitutional trick means they don't have the votes. It's a Saul Alinsky bluff to give the impression of inevitability.

Nancy and the MSM was us to think they are going to win so we will give up. Actually WE are the ones who are close to winning.

There is NO WAY they will be able to pass the bill in this manner. If they make any changes at all, it must go back to the Senate. The Constitution clearly says the bill must be voted on by both houses.

Don't give up - call those Congress-critters!  Better yet, show up at the rally on the 16th! (see www.freedomworks.com for details).
