— Ace It's my guess this case never should have gone to trial. I am guessing the defendant was credible before the jury when he stated he grabbed his pistol instead of his taser, and therefore he was just as credible when relating this to prosecutors.
And let me guess further then that they, like the jury, believed him, and really knew that the involuntary manslaughter charge was appropriate. And should have offered that plea, avoiding the trial (and the chance of a life sentence for intentional murder).
But they didn't do that because of politics. Specifically, racial politics.
So the guy -- I am guessing -- has already been exposed to the possibility of life in prison for an intentional murder he didn't intend.
Is there anything else we can do to this sacrificial lamb to appease the gods of racial grievance?
Why yes, now that you mention it, there is.
The U.S. Department of Justice will conduct an independent review of the Johannes Mehserle case in order to determine whether or not the shooting merits federal prosecution, according the department."The Justice Department has been closely monitoring the state's investigation and prosecution," the department said in a statement.
"The Civil Rights Division, the U.S. Attorney's Office, and the FBI have an open investigation into the fatal shooting and, at the conclusion of the state's prosecution, will conduct an independent review of the facts and circumstances to determine whether the evidence warrants federal prosecution."
I suppose if the case is merely "reviewed," and then the Justice Department finds that the shooting was just as the jury called it, this could have some positive effect: ameliorating current passions while not doing much to cause additional injustice.
Still, I can't help but note that the "facts and evidence" did not support any sort of case against the guilty-as-sin New Black Panthers, but here we've got a white guy, found guilty of a serious crime (involuntary manslaughter), and Eric Holder needs a look-see at this case.
A nation of cowards, eh? You know, one misstep I never thought the Obama Administration would make was a determination to insert itself into high-profile racially-charged situations (and to pander to his community activist sort of radical buddies). I just thought he was smarter than that.
But race is like catnip to these guys. They can't help themselves.

He didn't
They were charged with Attempted Murder, not "Beating the Hell Out of A Guy Unnecessarily". And, BECAUSE they were charged with Attempted Murder the jury found the cops did not set out to kill Rodney

The federal government makes the dumbest and most ridiculous "supremacy" argument against Arizona, but now they are looking to impose double jeopardy on a guy because the state didn't put him away long enough for them. Obama doesn't seem to be, consciously. But at least one of the people who direct him is a damn genius.
Remember your first reaction on this? You thought the sentence seemed light. What pushed your position toward what seems to be the not-Obama position (though he hasn't openly taken one)?
Don't rationalize. Think about what actually happened. There are people whose side you didn't want to be caught on (from race-baiting Democrats to looting "anarchists" to outright cop-haters like me), so you left it. The point of all Obama admin "missteps" is to make the people split hard from each other.
By the end of the DOJ inquiry, every moron is going to sound like some Hot Air commenter blaming the black guy for thinking it's not every cop's job to execute him on sight.

After a review of the case by the Justice Department, the EPA says they will review the case for violations of the Clean Air Act, focusing on the toxic gases released when Mehserle discharged his weapon. A spokesman for the IRS said investigators are forecasting the lifetime potential loss of Grant's tax revenue Mehserle has cost the agency and may place a lien against him for that estimated amount. Several other Federal agencies are looking into what they can do to help the country with some post racial healing.

The man was convicted and the jury decided he was guilty of involuntary manslaughter. People will agree with that verdict and others won't. Judges and juries make bad decisions all the time - O.J. Simpson comes to mind. It's not like this is the first time it has happened, but the officer was convicted!
I am not sticking up for the officer, but I can see the (understandable) outrage if he was set free or given probation. I am just sticking for the thousands of my fellow good cops out there who were savaged here last night because of their chosen profession.

The difference is that Cops are expected to interdict into hostile situations. Civilians are expected to try and avoid them. This makes proof of intent very hard. I wasn't at the trial, neither were you. You got to see the most damning piece of evidence and did not have the benefit of listening to the defense lay out argument and testimony. After only a few hours of deliberation the jury was convinced murder was not appropriate. You can play the arm chair all you want. But ultimately it comes down to one question. Is it reasonable to say he might have been going for his TASER? If yes then manslaughter is appropriate.
Beyond reasonable doubt, that is the standard of evidence in this country, it results in many not getting the punishment they deserve, but prevents many from getting punishment they don't deserve. Under normal circumstances, a regular person placing themselves in that situation voluntarily is proof of intent. For a Cop who's job is upholding the law, proof of intent beyond reasonable doubt is much more difficult.

Actually, federal "civil rights" only ever applied to blacks (and other minorities). This was from the very beginning, through all of the insane court cases where we learned that racial affirmative action quotas weren't quotas and that purely race-based affirmative action wasn't race-based.
The difference since the Indonesian Imbecile slimed into office is that now we have a true enemy of America (and the West) running our Executive and it is now official US policy that whitey is the devil and that the federal government is built to help everyone who isn't white while it crushes our nation into the ground.
The US chose Suicide by Indonesian on Nov 4th, 2008, and now we are experiencing the process. Don't worry, it'll be over soon.

Police are not robots. People make mistakes. I worked for a power company and one of the lineman, with 15 years experience, was up a pole testing a transformer, like he'd done 1000's of times. He determined it was bad and told his groundman they would change it. He reached around the pole to get a better position and he forgot for a split second that it was still connected. 7200 volts blew him off the pole. He lost a thumb and part of his foot. In this case, he paid for his mistake, not someone else like the shooting, but they both carry the same gravity - life may be lost with a simple brain fart.
He got a fair trial, and probably got more punishment due to fear in the jury of another riot. Maybe HIS civil rights were violated because of that fear of rioting by the jurors.

56 Ace, I don't understand your credulousness about this at all. Why do you insist that it was some wacky mistake? Watch the video again. He pulls out a gun and shoots a man in the back lying prone on the ground.
True as far as it goes. The questions are: did the cop intend to shoot the man. What did the cop think he was doing when he shot the man.
I don't pretend to know why he'd do such a thing.
The trial was aimed at answering that question, even if you will not.
Only that it is an empirical fact that he DID. There was nothing "involuntary" about it, outside of suffering some bizarrely specific seizure.
People kill people in car accidents when they drive drunk. They generally are charged with manslaughter, not murder, because they didn't intend to kill anyone, but acted negligently in driving under the influence.
The case is different if you get drunk and run down your Old Lady because she's been shtupping out on you.
If a man accidentally discharges a firearm and kills a kid, he is generally charged with manslaughter, not murder, for the same reason. He perhaps acted negligently, but he didn't intend to kill anyone.
Again, I ask if anybody actually believes that this would have been the result for anyone other than a cop.
Irrelevant. How many people other than cops have the power to arrest and handcuff you, and carry pistols and tasers to help enforce that power ?
If I shot a man in lying on the ground in the back, and tried to claim later that I was totes reaching for my cell phone (which is the same color as my gun and also kept in my pocket) to snap a picture, do you actually think that would fly?
But your hypothetical has nothing to do with the FACTS of the case. YOU don't have arrest power, and you were not engaged in effecting an arrest.

Thank God for Thomas Sowell, Justice Thomas, Walter Williams and other courageous blacks to help me remember that this racial resentment is just another way that government/media/socialist conspiracy is trying to control and to suppress us.

I'm having a lot of trouble ignoring these numbers when it comes to my general impression of the American black population.
Because, basically, this suggests that 90% of blacks wishes ill upon me and my family. At the very minimum, they want Obama to use the power and force of government to reach into my pocket and steal from me.
At the most, they seek retribution for grievances I had nothing to do with.

Well that probably means a bunch of things, many of them not good. But that one person in ten deserves to be judged not by the statistics of a particular demographic that they fall into, rather without prejudice from the content of their character. You can't form an opinion about a group without prejudging the man, their really isn't any other reason to form such an opinion of a group, unless you like to play Exploitative Identity Politics (From DNC Board Games Inc.) To stop racism, first, you must be committed to not participate in it. Then you work on others.

This guy Holder is a nearly perfect AG for our radical socialist race hustling President. They will be gone soon enough. It is important to remember who put them in power, however, and to be thinking about ways to make a break from those people who will be around to repeat the same horrible mistakes long after Maobama and Holder are gone.
And remember these GOP Senators who voted for Holder, some proudly: Alexander, Bennett, Bond, Chambliss, Collins, Corker, Graham, Grassly, Gregg, Hatch, Isaakson, Kyle, Lugar, McCain, Murkowski, Sessions, Snow, Voinovich. Some of these guys are on their way out. The rest, except Sessions perhaps, should be forced out.

Question: how does all of this (from the incident through to this "looking into" by the DOJ) affect the future of law enforcement in this country (or at least Oakland and other urban areas?).
I think back to what happened to my godfather, and it certainly didn't help relations between the cops and that community -- I think public relations between the cops and the public works both ways (same to a certain extent as it does with the military).
...and yeah, I am kinda calling on all those who went off with the "all cops suck, and I hate them" vents last night (I'm not saying you don't have your reasons for your opinions, but...)

Well, I didn't steal any land from no Indian and I never owned any slaves, muthafucka. This shit happened centuries ago...to people who are long dead...by people who are long dead.
Enough already. And you know what? I don't feel guilty. Not one bit. I had nothing to do with it. And there's a single muthafuckin Indian alive or black person alive today who's a victim, or is even the son or daughter of a victim of that shit.

It's beginning to look like Obama and his thugs like Holder have declared war on white people, and on an ever expanding variety of fronts. We've got a madman in the White House and another one headsing up the DOJ. History shows us that it was predictable.

Warden is just pointing out the dangerous nearly-monolithic nature of the black vote, and that this nearly-monolithic vote supports the most anti-American piece of shit that the US has ever had to contend with. The fact is that the black vote and huge, insnae black support for the Indonesian Imbecile says quite a bit. It says that they don't care about the US, so long as "their guy" is running things (into the ground). That is the fact of the situation.
There are many conclusions that are reasonably drawn from this extremely odd support pattern and you would be making a great mistake to ignore it. We are talking about people who support the dismantling and destruction of the US - enthusiastically so.
Of course, this doesn't apply to all American blacks, but 90%+ (steady through all of the incredible shit we've all seen) is a figure that ought to scare anyone, for all of what it means - and none of it is good.

Let me ask you this? What do you think of muslims, generally? Palestinians?
I'm not trying to start shit here, and I know this is a sensitive subject, but am I supposed to ignore the animosity directed toward me (and my whiteness, I guess) from this one group? Is it racist if I notice? Is it racist if it starts to get under my skin a little?

No - with the Zero crowd, race is the agenda - not an occasional fling. He's a Marxist - which means open, violent class warfare. And what better kind of class warfare than race warfare - because, unlike economic issues, Zero can be sure to appeal to his base. The economy is iffy, because some Blacks are starting to realize that a socialist economy isn't all that great. But race - that's a sure-starter every time.

They don't trust him and Bibi is getting a little backwash for even going back to DC to cover Obama's ass with his fleeing Jewish donors.
Netanyahu is under some kind of impression that saving Obama's ass is somehow good for Israel. Obama's and the Left's defeast in the US is the best thing that could happen for Israel.
When a dumbass like Obama decides that Israel doesn't trust him because of his middle name, the dumb fuck shows how ignorant he is of Israel - easily the most multicultural place that I have ever been to in my life. The streets are filled with blacks, falashas with tsetses, black hat Chassids, modern orthodox blonds with six blond kids, phillipinos, Sudanese, hundreds of Arabs, tattooed hookers, gay surfers, Armenian monks, gorgeous tri-racial IDF girls with Uzis, and about a hundred other "types".
In the Old City, we had lunch (shawarma and pizza, natch) with a black guy from Longview, Texas wearing a UT/Austin t-shirt who is the principal of the largest American high school in Cairo. He was visiting an old friend of his in the Jewish Quarter. He used to teach in Gaza, and he had a lot of interesting info about that area.
For a non-entity putz like Obama to lecture such a nation about "diversity" is comical and an embarrassment to the stupid traitorous fucks who voted for him and his stable of Israel-hating "advisors".

The idea that 90% of any group, racial/ethnic or otherwise, would support a candidate for office in modern America is anti-American, much less when they "bitterly cling" to them in the face of glaringly poor performance and outright (serial) duplicity. It's damned near impossible to get 75% of any group of Americans to support you on anything. You can't even say that 90% of the GOP wants lower taxes or 90% of the Democrats want us out of Afghanistan.
The near-monolithic black support for Obama is motivated by race, plain and simple, and that kind of shit has no place in American politics. I'd call it "pushback" racism but for the fact that its 2010 and we still have race-baiters acting like the Bay Area (which elects pols like Pelosi by whacking huge margins) was 1960's Alabama.
Why is it everyone remembers the "I have a dream" part of the speech then forgets the colorblind society part ?
The constant turn of the race card is generating nothing but resentment among larger and larger numbers of non-blacks*. No one's saying anti-black racism has been eradicated, but it's been reduced to the lowest level practically achievable. It is no longer socially acceptable to sound like Sheets Bird. Yes, some people still don't get it, but we can't fix 100% of stupid, and letting the Sharptons of the world cash in on every last nitwit's stupidity means we'll never, ever stop having this debate. Meanwhile anti-white racism has run rampant, unchecked and uncriticized since the 1960's courtesy of the win-at-all-costs, fuck the good of the country Left and their handmaidens of hate in the public school system - which might as well be a madrassa for "hate Amerikkka" bullshit. If blacks are ever going to be truly assimilated into the melting pot rather than being a permanent grievance class, this has to stop. It's time the mainstream of American society, white, brown, red, yellow and otherwise called out the John Edwards and Eric Holders for picking at a very old scab so they can draw one last little bit of blood to suck up.
*Regrettably, that resentment is also encouraging the <5% of us non-blacks who are in fact racist knuckle-draggers to say out loud what that Michael Richards voice in their heads is whispering. And guess who's going to be wearing their asshattery around their necks courtesy of our friends in the MFM ? The rest of us on the Right. For anyone who's crying about the Banhammer, this is why I support Ace for it, even if it may be draconian justice and some may claim it's just buying into the baiters' game.

Almost 90% still approve of him.

Large swaths of American blacks were happy with a murderer getting off. Why? For some bizarre idea of retribution? Settling the score so whitey sees how it feels?
You can't tell me they thought he was innocent. They knew. Most knew. Oh, the glee when that verdict was read. Rooms erupted with cheers.
Ever see the pictures of what OJ did to that woman? He nearly cut her head off with that knife.
And they celebrated after he got away with it. After he murdered two innocent people.
What kind of fucked up group pathology is in play here?
But the frustrating part is that we aren't even allowed to discuss it. We're not even suppose to notice. Or if we are, we're supposed to shrug and say, "Well, a lot of bad shit was done to them. You don't know what it's like."
Yeah, I guess I don't. But I'm not so sure what a 20yr black girl in college has to be so angry about that she jumps up and down and high fives the person next to her when a black man gets away with murdering his white wife and some poor fella who happened to be there in at the wrong time.
But again, the most appalling part is how we're not supposed to talk about it. And even conservatives hang their heads and abide by this unspoken rule -- this bullshit bit of condescending leftist PC. That's just how they are, see?
Yeah? Well who's the fucking racist, then? Me or the people who insist that some groups have to be treated as children rather than adults.
We've been indoctrinated and we don't even know it.
And no, it's not directly relevant today. And no, I'm not looking to have a big fucking discussion about the OJ trial.

Almost 90% still approve of him.
And even if we take both these numbers as 100% accurate, your still looking at a very small percentage of total population that voted in the last election and a miniscule fraction that were polled on these approval numbers.

In November of 2008, many whites voted for a man they beleived transcended race.
Now, it is clear that this administration and Eric Holder, do not transcend race. In fact, race motivates much of thier conduct and they are not apply the law equally to whites and blacks.
Once America becomes aware of the Black Panther non-sense, and the disparate treatment of officer Mehserle, I think many white voters will cease support for an adminstration that applying the law unequally.

It's basic human nature. Retribution is a powerful and inescapable moral force in humanity.
Posted by: s'moron at July 09, 2010 01:51 PM (UaxA0)
I would just note that this is not the only way to look at the situation. As with many other modern problems, the Old Testament directly addressed exactly this issue of a freed population. The Jews were made to walk the Sinai for forty years, in order to give time to get rid of the slave mentality and allow a free generation to grow. In America, affirmative action (and like policies) didn't allow for anything of this sort and only fed into an idea that retribution be sought - since affirmative action was self-executing retribution that was allowed to pervert and destroy our nation's legal framework in order to buy some emotional satisfaction for whites with weak personalities and emotional difficulties.
And, as the 90%+ black support for the Indonesian imbecile, this is not indicative of racism, exactly. It's illustrative of a more tribal character (which we also see, to a lesser extent in Jewish voting and policy - though Judaism is, without any question, a tribe and has always had very tribal quatilites). Tribalism among voting blocs is far more dangerous than mere racism. And when it is combined with racism, it's deadly ... even though many like to put their heads in the sand and pretend none of it is happening or means anything.

Tribalism works for me in this context, but I think it's a larger concept of which racism's more of sub-set. And Barry (much like OJ), doesn't seem to have the bona-fides to be "one of" his "tribe." He's multi-racial, privileged and wealthy, went to Harvard and by all accounts has never lived the day-to-day life of the middle-class and poor blacks who so staunchly support him.
That's why I'd say racism's the more fine-point accurate description.

The "Mississippi Burning" cases were an exception. They represented the tip of an iceberg where numerous cases were being decided based on black/white issues - often with the juries openly flaunting their disregard of the law to reach results-based verdicts.
More and more people are coming to the realization that "social justice" only cuts one way and the one-sidedness is starting to piss more and more people off. The verdict sucked, but the "remedy" isn't going to make it any better. If the DOJ somehow got this BART jagoff lynched, is that going to be taken as "justice" by the rest of us ? s'moron, we actually have very little evidence for which language was spoken along the east coast of pre-Saxon England, from East Anglia up to Northumbria.
Everyone agrees that west of that, some form of Breton was spoken: Cumbric, the modern Welsh dialects, Cornish, and Breton itself (in France).
But, to give one example, Julius Caesar ran into "Belgae" in southeastern England. Plus, it makes geographic sense that the east coast was always English: where the west's trade would have been with Britanny and other Celtic parts of Europe, the east's trade would have been across the North Sea, where you ran into Germannia Inferior, the mouth of the Rhine, Denmark and Norway.

as someone who has carried a taser and a M-9, i feel sorry for the bart cop
i carried my weapon on my right thigh and my taser on my left hip so mixing them up is really difficult
now onto the verdict,it was absolutely correct. the issue here was INTENT, the was no intent therefore involman was correct.
does he deserve some time for his screw-up? sure, there is an awesome responsibility to go with a weapon. does he deserve murder charges and life in prison, of course not. this was an accident

To be fair, while I find it implausible that he mistook a taser for a piece, I also find it implausible that he just deliberately executed this guy because he's a psycho-cracker who was having a bad day. Among the alternatives available to the jury, I might have pushed for something heavier, but I don't know whether it was all-or-nothing for intent vs. negligence. If it was a binary choice, I'd have come down for negligence along with the jury. I've always thought negligent homicide/manslaughter should be more like 8-10 years than 2-4, but in the end that's up to the legislature.

the Celts and their entire culture were pretty much wiped out by the Anglos, no? And then the Romans beat the Anglos and ruled the land now known as England for a while, no?
Or do I have that backwards?
Very Briefly:
Celts got conquered by the Romans, became the Romano-British when the Romans pulled out 400 years later, were overrun by the Anglo-Saxons who gave England its name, language, and culture, absorbing the local population. The Anglo-Saxons were overrun by the Vikings, but survived culturally and politically although incorporating some new words and genetic material along the way. They were conqered politically by the Danes in the late 10th -early 11th century, but surviveed as a distinct entity, and became independent again after a generation. Very shortly after that they were conquered by the Normans, and became the Anglo-Normans and then the modern English.
Scotland and Ireland are different - Ireland was Celtic up until the invasion of the Normans in the twelfth century, but managed to absorb the Normans. They were conquered again a bit later, don't remember the details. Scotland is a mix of Anglo-Saxons, Romano-British, a Irish tribe called the Scotti, a tribe called the Picts (presumably celtic, though I don't think we know for sure - they could have been older like the Basques), and vikings. They are usually refered to as a Celtic nation, although the most important places spoke a dialect of English....
It should be noted that "Celt" is a very broad term, and people have questioned whether the culture in the British Isles in the Medieval period really had much in common with the tribes that invaded Italy in the 5th century BC. Problematic word...

I guess that's the point of the shooting then, improper, or a lack of training in the proper discharge of a firearm here. All the people that have ever gone through the training myself and other do at my club emphasize weapon awareness. Especially if they carry more than one. I can completely understand that in the heat of the situation if you hadn't had proper training, and your weapon setup, such as carrying both on your strong side, would lead to something like this. What I don't get from watching the video is why he felt the need to pull and more importantly discharge the weapon when the perp is clearly outnumbered and looks to be subdued to a large extent.

Grey Fox's 360 is pretty much what I was taught in (a border English / Welsh) highschool. It mostly fits what we know. (Including about the Picts, a very controversial group.)
That stuff I said about eastern England possibly being proto-Anglo-Saxon speaking before the Romans is a minority opinion; I got that from Stephen Oppenheimer's "Origins of the British". He bases his hypothesis upon DNA and "linguistic archaeology".

Another comment above mentioned that radicals and their ilk are looking to start some kind of a "race war". I relly wonder who they expect to fight it - as if all blacks are all the same loud mouthed agitators that the media constantly gives face time too. i read not to long ago that most cops never regularly train with their weapon, basically they just take it to the range to qualify once a year (any leo out there lurking can confirm this please)
as far as should he have gone to his taser, i won't second guess the bart cop's judgement from a video (professional courtesy) i wasn't there, bad video angle, what does he see, what happened before, what is the threat, what does regs say, i just don't know

Most depratments have a 12 month requirement to qualify, with access to the range and trainer year round(in Ohio and Indiana anyway)
they train about as intensely with their weapons as the Army does when totally at peace which is to say, "not enough".

But the problem here is that your attributing the actions and statements of a subgroup onto an entire group. Not all black people feel the same way nor would it be logical to assume they do - of coursethe MSM and liberal groups want you to believe this, it feeds into there strategy of divide and conquer. If you want to rant against a group like the new black panthers or a guy like Jeramaih Wright then yes, this makes perfect sense and I see your point completely. Where it goes off the rails forme is when you try to make the inference that all black people agree with them wholeheartedly, when I know for a fact this isn't the case.

Technically, I was at their mercy, but one of them, without my asking, said, "Hop in my cruiser and I'll run you home."
Fast forward to last year and I awoke to a cop knocking on my door after midnight to tell me that I had left the gate open on my SUV and that I should make sure everything was still there and secure it.
Now, I realize that according to some of you, in both instances, I should have yelled, "Fuck you, pig! Get your goddamn jackboot off my neck!"
However, there are undoubtedly thousands of instances where the police serve their communities with honor, which will never get them a word of praise. I've received shabby treatment from cops, but more often from people who are not cops. It's as rational for me to shit on plumbers, dental hygienists, and mimes as it is to paint cops as all good or all bad based on the limited interactions I've had with them.

Double jeopardy requires successive prosecutions by the same sovereign. The feds are not the same as the State of California.

Thank you Ace for writing this. It's spot on. I should know. I did this work for a quarter century.
People make fucking mistakes under stress. Terrible mistakes. The fact that an angry mob always searches for the worst in people is not surprising. That they are incapable of comprehending this is a choice. Forgiveness is not in their hearts. They are spiritually sick.
And a sick... politically driven system wants to play football with this guy. I hated that life. To get spiritually correct meant I had to find the exit. It's a sad world that judges all people on their actions yet individually each of us judge ourselves on our intentions.
If we judged all others on their intentions and only ourselves on our actions...well Ace...the world would be a beautiful place. Until that happens, football anyone?

Same as with the Rodney King cops. The Feds wouldn't be charging him with murder, but for a federal Civil Rights violation- a different "crime" than the cop was already tried for. They'd have to argue that the cop acted out of racism and in doing so deprived the victim of his civil rights.
Yeah, it's a little fishy, and I don't think they could really make a case- but it's no surprise coming from Holder.

Where it goes off the rails forme is when you try to make the inference that all black people agree with them wholeheartedly, when I know for a fact this isn't the case.
All?
No.
About 90%
But you don't believe that polling is representative of anything, according to your statement above that that number is only based on asking a small percentage of the population.

Posted by: Something Wicked This Way Comes... at July 09, 2010 11:57 AM (GOG1H)
See, Stuck on Stupid, that's why I quoted the number.
90%
90% means 90%
It doesn't mean all.
It means 90%
Which is why I brought it up instead of saying "all".
Posted by: Warden at July 09, 2010 11:58 AM (QoR4a)
Because the courts have ruled that it is not.
Supposedly their reasoning was that the "hate crime" is a different crime. Never mind the fact that it falls from the same act. The issue rests on the doctrine of separate sovereignty. Both the State and the Feds can prosecute for the same crime. The Constitution prohibits double jeopardy by the feds.
And besides, the AG is supposed to do a "strict review" before opening a case under the statute. Double jeopardy is supposed to be taken into consideration. Hahahahahahaha, the AG has to certify this "in writing". Hahahahahaha
Also, enhanced penalties for hate crimes are not a violation of the 14th equal justice rule because they speak to "intent" which has always been a part of enhanced penalties and the state has a "compelling interest" in discouraging these type of crimes.

He went thru all 5 stages of grief before reaching acceptance. I watched. At sentencing, he asked the Judge for probation stating that he didn't want to see two lives lost. In fact, that is very often the case. Sister Helen Prejean has actually polled victim families and found that half of them do not want to see the murderers of their loved ones sentenced to die. It is the system of self promotion and hatred, and personal success among prosecutors that seeks the harshest punishment.

Happens in Philly all the time. I had a case where a man was convicted of involuntary manslaughter and received time served and probation. Juries make questionable verdicts all the time, and Lord knows drunk drivers get almost no punishment for killing another driver. Is it fair? No, probably not, but life isn't fair and the American judicial system is the still the most fair on Earth.

I'm not following your argument.
If you accidentally killed someone, say a motorcyclist while driving, would you want the motorcyclists mom to decide your punishment?
There is a reason why the parents don't get to sit on the jury nor decide the punishment. Mostly because their sense of proportion will likely be compromised by emotional stress, which would likely bias them to harsher than appropriate punishment.

I do not want that man carrying a gun under the colour of the authority of the State any more than I want the wicked little shits he's lying for doing so.
Eons ago I worked as a bouncer. Had a guy who was 5'5" tall and 140 lbs soaking wet throw me over, not onto mind you but over a pool table. There were 4 of us, we had him 'subdued" in as much as he was prone and we were all right there, one of us was even on his back holding him down.
I was the smallest bouncer involved at 6'2" and 275 lbs. This guy broke loose and threw all of us around like ragdolls. Found out later he was all hyped up on a mixture of pcp and coke.
After that I gained a much better appreciation of events like this - most cops/security don't want to use excessive force, but it's not so black and white as to whats excessive - especially when you do guess wrong and either you or one of your fellow officers might well pay for that mistake with their lives.

He got off way to light. You guys would see that too if you took your cop-blinders off."
I know that cop-blinders line got many of your panties in a bunch, but what other explanation is there for your do-no-wrong attitude toward cops? Let me tell you how it is. The worst nightmare a cop can endure is shooting someone. It is horrific. The outcry and pressure is intense. I've watched grown cops lying naked in their driveway, crying like babies. 95% of all cops who shoot someone, quit within a year or two. The stress is so intense it's mind boggling. If the charge of murder was on the table, and I honestly believed the death was an accident, I would plead not guilty. You can't pick and choose charges without a plea-bargain and I doubt the DA was willing to bargain knowing the debacle that would cause.
In either case, if someone ends up dead, caused by another person, it is either an accident, in which case they will plead innocent to murder, or deliberate.
If it was deliberate, the person either feels justified for doing it, or they don't.
If they felt justified they will plead not guilty because they don't feel they deserve murder punishment.
If they don't feel justified, then they are an immoral person, which means they will go for minimal punishment and plead not guilty so long as that is the best route.
Murder is not a law people practice civil disobedience over. "He just needed killin'" is not an affirmative defense.

Not in this State. A drunk driver who has a wreck with a death is hit with felony DUI and 25 years.
EVEN IF THE ACCIDENT WAS NOT HIS FAULT.
As for questioning the jury here, how can anyone who didn't sit through the trial question their verdict?
The cop was tried by a jury of his peers and found guilty of negligent manslaughter, not murder which requires intent to kill.
People may not like that finding but that is what it was. Hell, at least they didn't go all jury nullification the way the OJ jury did.

I cannot run around hating, taking everything personal.
When I recently found myself being overconsumed by politics, I stopped logging on at breakfast and reading things that I knew would piss me off.
It was setting a very bad tone for the day.
Instead, I started taking my 4yr old for a walk right before breakfast. You want to talk about starting your day off right -- that kid jabbers my ear off the entire way as his imagination and curiousity run wild. Meanwhile, I just walk, take in the pretty sights, nod and smile.
Mostly I think about how much I love that boy, what a wonderful family I have and how blessed I am.
It rained today so we didn't go, which may just explain my relatively shitty mood today.

If the charge of murder was on the table, and I honestly believed the death was an accident, I would plead not guilty.
Agreed, and I'm ignorant on all things legal, so I'm sincerely asking. Since the jury convicted him of involuntary manslaughter, did that necessarily mean he had the option of pleading to that charge before the trial, or was the jury just given the option afterwards?

It was one of the cornucopia of charges that are associated with a case like this. From murder 1 down to inv manslaughter. If their is no plea deal offered by the prosecutor, which there likely wasn't, then when you go to court, you either plead guilty to all of them (and therefore accept the higher murder 1 punishment) or plead not guilty to all of them. At the end of the trial the jury gets to pick the one they think fits best, and in some circumstances, the jury may ask to consider a lesser charge not part of the indictment.
To answer your question. No, he couldn't just plead to inv manslaughter.

First off, let's dispense with calling the victim here a "kid". That was no "kid"; he was a thug -- and wrongful as his death might have been I'm really not finding it in myself for feeling really bad that he is no longer taking oxygen away from more worthy people. It would perhaps be an interesting question at this point to ask "just how many Black people were victimized by this "kid" before he met his end"? So much for Mr. Grant as martyr to cop/white violence -- the dude was no saint and deserves very little pity imho. He does not deserve any outrage on his behalf from the Black community -- he preyed upon that community, because he was scum and he likely wound up dead because he chose to be a thug, and in the process let's be perfectly clear here: thanks to the type of person he was he smeared the good reputation of how many Black people because he lived up to every bad stereotype, and even in death it's still causing problems. Sad, but true (it's the same as my paesans who stuck up for Gotti -- what stupid bs; no self respecting Italian American should ever stick up for or whitewash the image of those pos thug leeches in anyway -- they don't deserve it and we should be especially happy when they are put away or wind up dead...this is the same thing). Get over wasting emotion for people who don't deserve it.
Secondly, since nobody here sat on that jury we don't know what other testimony was brought forward that caused them to reach the verdict they did -- suffice to say that they did not find this case passed the test for a murder charge; there must have been something there that we are not privy to. It is also worth noting that this transit cop did not exactly get off scot free -- which seems to get lost in the equation (and with this new bit from the DOJ -- well, imho, it does raise some double jeopardy issues, which is a breach of justice; that it is looking very much like race pandering/baiting makes it all the more odious). As to using this as a way of making our law enforcement better -- training our police better, better equipment, better tactics, better screening for fit for duty conditions -- well, that should be the take away, so it doesn't happen to a real kid. Maybe using this as an opportunity to finally say that we need to throw away the race card bullshit and start thinking ourselves Americans first and foremost, and well, agreeing that thugs are thugs, no matter what skin tone they are sporting and we should all do ourselves a favor and start thinking of ways to reduce their numbers -- that works -- and we need to have a better, more community integrated police force that "serves and protects" (which means we acknowledge and respect). But throwing a fit because of personal dislike of cops, over this, for what outcome (certainly won't be better relations between the cops and you -- and that could turn into a real problem down the road now couldn't it)? That doesn't seem worth much to me.
If this means I have "cop blinders" on, so be it -- better that imho than having the opposite.

Jane, first, he was a kid. A really, really, really dumb fucking kid, but 22 is a kid. And he died in a situation where he shouldn't have. That's just a fact, no matter how much of a leech this kid was.
Second, the cop fucked the pooch with incredible competence. This was a fuck up for the ages. "I thought it was a Taser" is an indication that Meserhle, also a kid, is A) none too bright, and B) about as well trained as my beagle that still shits on the carpet.
In the end, two dipshits, in conjuction with piss poor policies and training, came into interaction, with predictably tragic results.
Finally, the outcome was about right. FootLocker would disagree, but involuntary manslaughter is the right conviction. Meserhle does some time, and moves on. Oscar Grant is thermally challenged, and doesn't.
Maybe we should make it our policy to keep dipshits away from each other...

At least the cop isn't hiding behind a wall of denial and self-victimhood.
His letter from before the verdict:
Mike -
Please try to get this message to the public:
I don't know what the jury in this case is going to decide, but I hope those who hate me and those who understand that I never intended to shoot Oscar Grant will listen to this message.
I have and will continue to live everyday of my life knowing that Mr. Grant should not have been shot. I know a daughter has lost a father and a mother has lost a son. It saddens me knowing that my actions cost Mr. Grant his life, no words express how truly sorry I am.
I hoped to talk to Ms. Johnson (Wanda Johnson, Grant's mother) and Ms. Mesa (Sophina Mesa, Grant's girlfriend and the mother of his daughter) in the days following this terrible event, but death threats toward my newly-born son, my friends and family resulted in no communication occurring. I hope the day will come when anger will give way to dialogue.
For now, and forever I will live, breathe, sleep, and not sleep with the memory of Mr. Grant screaming "You shot me" and putting my hands on the bullet wound thinking the pressure would help while I kept telling him "You'll be okay!" I tried to tell myself that maybe this shot would not be so serious, but I recall how sick I felt when Mr. Grant stopped talking, closed his eyes and seemed to change his breathing.
I don't expect that I can ever convince some individuals how sorry I am for the death of Mr. Grant, but I would not feel right if I didn't explain my thoughts as I wait for a decision of the jury.

560 22 is NOT a "KID"!
I've got 2 adults younger than that who are deployed or getting ready to go (2nd tour, in fact). I know plenty of people with adult children under 22 in the same boat. I know 22 year old adults who go to work, or college, or are raising families the best they can -- not playing on the playground. I know adults under the age of 22 who grew up under similar circumstances as Mr. Grant, and were going much the same way, and decided to take stock of themselves and quit thugging. Those aren't "kids" and neither was Mr. Grant.
But enough people who give 22 yo. adults the "oh, they just kids" leniency will more than guarantee we will have more people just like Mr. Grant -- good job!

NO, the first one is an adult with bad clothing taste (unless he/she is a criminal, in which case he/she is a thug) -- there is no difference in the former or the latter other than their character and/or their life choices (which is also part and parcel of their character).

I don't really think we have any disagreement.
Oscar Grant chose to be a thug. True. And he died as a thug. We may disagree about how much chance a 22 year old black guy in Oakland has of being anything but, but that's small beer.
Meserhle fucked up by the numbers. He got an appropriate conviction (when the judge gives him 18 mos. for negligent homicide, and then adds 10 years for a firearms stipulation, we'll talk again. I expect it, actually, and it's sickening).
I didn't come to start a fight, and I hope you know that. I think the whole fucking thing is tragic. Whether the "black community" in Oakland, whatever the fuck that is, can ever accept it as more than a chance to score some new Nikes is the real question to be faced.
I got no answers, just observations, and if somebody calls bullshit on those observations, I readily admit they have at bare minimum a 50% chance of being right.

OK. I get that better after a second thought.
You're damned right I wouldn't judge your kids, or mine, by the same standards, because they were raised differently. Neither of us would have a 22 year old kid that behaved this way and bought a bullet in the back from the cop. Agreed? Cuz we would've shitkicked that venom out of them long before.
Just as an exercise, please understand that has not a damn thing to do with Oscar Grant.
Do I pity Oscar or his family? Not his family. I guess I admit to some slight tinges of pity for Oscar, because he was a dumbass black kid who grew up in a culture in which he fulfilled every iota of its requirements. Do I pity Meserhle? Yeah. He fucked up.
They're not my kids. My kids fuck up, no pity. They knew better. I would imagine you feel the same.

568 I know more than enough young, Black, White, or Hispanic adults who came from circumstances just as bad as Mr. Grant (Chicago southside, Harlem, Kansas Cty., and EStL are not exactly gardens of earthly paradise) who chose to either not be thugs or decided to quit thugging. The only difference is they don't get any media time -- and they deserve it, because they decided at some point to be stand up people and decent human beings. At some point personal (or family, or both) responsiblity does come into play -- same as it does for everyone.
I know plenty of suburban and trailer park rural boys and girls who are just as thuggish pos as Mr. Grant, and for whom I just can't find much empathy -- it all comes down to a person's character. At some point you just can't make excuses for where a person is from or anything else about them.
Posted by: unknown jane at July 09, 2010 02:54 PM (5/yRG)
571 Hey, I'll cut you some slack because you don't know me and my family background (and because you seem like the type of person I could sit and have a beer with the family, which makes me think I could like you all) -- living the thug/mobster life would have been really easy to fall into for my family, some did (Yale to jail, that's us; we have war heros and private school scholarship winners...and state super max inmates in my family) but some had enough in them to say "no".
At some point everybody has to decide for themselves what sort of person they want to be; unfortunately for everybody concerned Mr. Grant liked being a thug. The only thing we as a society can do about that is to try and convince people who could turn out like Mr. Grant that it is probably a bad idea, but the choice is individual.
Posted by: unknown jane at July 09, 2010 03:01 PM (5/yRG)
I own one pair of shoes for church and seven pairs of boots. I know these rural kids, and they turn out at an only slightly better rate than an inner city black thug.
I'm not sticking up for Grant. I'd just ask people to look at this as more tragedy than some kind of justice. There is no justice for anyone here, in any way.
I'm getting old and soft, I guess.

Seriously, sometimes I know I don't understand others' family dynamics. I was raised in a rock-solid family, as was my wife, and we try to hold the line at that paradigm. It's hard as shit, but we're trained at it by upbringing. I have no known relatives in prison. (In the whole family, however, you're probably talking to the prime candidate.) Divorce is rare.

Of course, when the "official" spokesmen for "black America" espouse and support those actions and statements, the attribution to the group is fair. It's kind of like Muslims with Jihadis. The Jihadis have claimed, rightly or wrongly, the mantle to speak for *all* Islam. You don't hear too many Muslims saying "Whoa! That clown doesn't speak for me and mine!" Not completely accurate, at least depending upon the state. Some states allow for conviction on "lesser included" charges, i.e., manslaughter when the defendant is charged with murder. A relatively common defense attorney tactic is to move to have the "lesser included" charges dismissed in order to leave the DA with only the most severe charge, thereby increasing the likelihood of acquittal. But absent a waiver/dismissal of the "lesser included" charges, you could still be convicted of a lesser offense.

But right off the bat you proceed from a false premise. There is no spokesmen for Black America anymore than there is for White America or Hispanic America for that matter. Harry Reid, Nancy Pelosi and their ilk are white, and they don't speak for all white people. Do they speak for you? Would you consider it fair if all blacks or all hispanics assumed that they did?

There is a time and a place to shoot people, but that is irrelevant to this topic, this thread, this case, this circumstance.

This is the most insidious part of what Obama--what the Left--has done. Should tensions ramp up even further, no white person who thinks that all blacks are out to get him and his, who thinks that this black person is out to get him and his is going to stop me or my parents and ask us whether or not we voted for McCain or whether we're looking for "payback," or whether we're recent African immigrants. Such a person will--rightly--play the law of averages.

A civil war: blacks vs. whites vs. hispanics vs. all others, with the drug smugglers--mostly Mexican--streaming over the open border to aid their ethnic kinsmen. Hatred, suspicion, death...mostly for the blacks, since, with the aid of the illegals, we would become, by far, the minority (thank you, Margaret Sanger).
But in the chaos, guess who would come to the aid of the black Americans? That's right: our Muslim "brothers"--the ones who have been setting up camps like Islamburg for decades. And the ones who Obama has been kissing and kissing and kissing up to for a year and a half.
And most of the black population--ignorant of the decimation that Islamic "Civilization" has wreaked on black Africans and is still wreaking (Sudan and other places), ignorant of the fact that the Arabic word for 'Negro' is abd (slave)--will accept that help, and thereby seal their own OUR OWN re-enslavement and destruction.
Wake up black people and white people and all others who value the American Way of Life! Wake up, Americans, and don't become Obama's tools. There are enough of those already.

Repeat: Middle Aged, Middle class people don't riot. They vote.

So tell me. In light of the fact that blacks vote in lockstep with Liberals, why is it racist to say that blacks hate America?
You can't have it both ways...

When you start off with a faulty premise, everything else thereafter is error. All Liberals do not hate America.

Do you read about Gramsci? Alinsky? Are you familiar with Cloward-Piven strategy? The platform of the Weather Underground? Have you ever perused Horowitz's Discover the Networks site?
Try any of these and you'll begin to see what the Left's plan has been. Don't be their stooge.

On the contrary, I've connected the dots quite well, thank you. However, there exists more dots than you, sir, are taking into account.

You just can't help yourself, can you? You're not a stooge of the left because you "don't give blacks a free pass for their behaviors." I "don't give blacks a free pass for their behaviors" either. That was your erroneous assumption as to what I meant. Again, everything after a faulty premise is error and more error.
What I'm saying is that the state of affairs which this country finds itself in has long been planned. Most blacks, were kept ignorant and oppressed in the time period before what known as the Civil Rights Era. We emerged from that state ready to be real Americans. Unfortunately, many of us felt that this government owed us something for our prior state. Equally unfortunately, much of the government was run by the Left by then (McCarthy was right) and the Leftists in the government say an opportunity to make blacks their tools. They did this by various means--the most well know of which is are the Great Society programs.
The Great Society programs made it so that a woman need not get married, if she was having a baby. And since much of black America felt it was owed something from the past, all too many women felt no stigma in bearing children and getting a check from the government. (Couple this phenomenon with the parallel rise of another Leftist ideology: feminism.)
Take all that and what do you have? The destruction of the black family--were men are not needed and boy have no fathers. If it is true that women are the civilizing influence of men, then it's obvious why too many black American communities are in a state of un-civility.
It is my belief that this destruction of blacks and stoking of old hatreds was planned by the Left. That doesn't excuse black adult behavior at all--I try to help many black Americans see this historical time line also.
It's necessary to, as you say, connect all the dots. But one needs to make sure one is in possession of all of the dots. You are the one who said that because nearly all blacks vote liberal/Leftist that they hate America, all I'm trying to do is give you a little bit of the history that you don't seem to know.
As the Left has stoked black anger for generations, now they are stoking white anger--you are proof of that. Yes, blacks have been fooled by the Left. All I'm trying to say to you, JS, is to not fall into the same trap.

The bolded-words come from your willfully erroneous inferences and, therefore, are your bad-faith assumptions. They do not logically follow from anything I said or implied.
They do what they are told.
Your words; not mine.
Maybe you're right. But if you are, you lend credence to the racist notion of certain races being inferior.
Since you continue to put words and ideas in my mouth, I'm going to assume that the above is a conclusion you want to come to, regardless of what is said to you.
Have fun being part of the problem.
