America's Ruling Class -- And the Perils of Revolution
By Angelo M. Codevilla; The American Spectator; from the July 2010 - August 2010 issue
Never has there been so little diversity within America's upper crust. Always, in America as elsewhere, some people have been wealthier and more powerful than others. But until our own time America's upper crust was a mixture of people who had gained prominence in a variety of ways, who drew their money and status from different sources and were not predictably of one mind on any given matter. The Boston Brahmins, the New York financiers, the land barons of California, Texas, and Florida, the industrialists of Pittsburgh, the Southern aristocracy, and the hardscrabble politicians who made it big in Chicago or Memphis had little contact with one another. Few had much contact with government, and "bureaucrat" was a dirty word for all. So was "social engineering." Nor had the schools and universities that formed yesterday's upper crust imposed a single orthodoxy about the origins of man, about American history, and about how America should be governed. All that has changed.

What a tool. Some buddy of his (a party hack or lobbyist) who's 'in' construction said he can't find people to work. What a crock. Housing starts are down. Commercial property is going begging and being foreclosed at a frightening rate. NO ONE IS BUILDING ANYTHING that wasn't already paid for and planned before 2009. Plus you can't just grab any schmo off the street as a framer or drywaller or roofer. It looks simple but that's because the guys you're watching doing it have done it hundreds of times.
Once again a Republican points up the fact that Republicans are basically mean when it comes to the working person. (mean as in stingy. Penny wise and pound foolish) Their tactic of stalling U.E. benefits will come back to bite them in the fall.
Folks hearing me rant about this always assume I'm some leftie troll who's sucking at the government tit. I'm not but it's just plain bad politics to let tax cuts go by without a worry about the deficit they cause but then draw the line when it's those out of work (fired by those rich people who are supposed to be reinvesting their money that they saved by those tax cuts) need some extraordinary help.\
Anyone who wants to pooh what I'm saying? You most likely still have your job (and quaking in your boots and sucking up to your boss for fear of losing it and what will you do when that happens? NO. Of course, YOU won't apply for U.E. benefits. Of course not you're a rough and tough fiscon 'let those who fail pay the price of their failure') and possibly have never been unemployed through no fault of your own for any length of time. (especially if you came into the workplace when W. was in Command.
If the Democrats weren't on such a megalomaniacal trip and Obama wasn't such a crypto-fascist-Muslim, I'd vote for some third party cause the Republicans ain't showing me nothing that impresses.

Nobody is covering the biggest Kagan scandal of all. Her Solicitor General's brief against the 9/11 families told glaring lies both about what FSIA's domestic tort exception actually says and about Supreme Court precedent on its application. If any senator exposes her deceptions it could well force Congress to issue a clarification of this crucial terror fighting tool, allowing the families' suit to proceed, while at the same time sinking Kagan.
How glaring are her lies? Her brief asserts (at p. 14) that the domestic tort exception:
"requires not merely that the foreign state’s extraterritorial conduct have some causal connection to tortious injury in the United States, but that “the tortious act or omission of that foreign state or of any official or employee” be committed within the United States. 28 U.S.C. 1605(a)(5)."
The "tortious act or omission" is the wrongful act (the tort) that leads to the injury. Thus she is claiming that for Saudi funding of al Qaeda to be actionable, the funding itself has to have been transacted within the United States. Compare this with the actual wording of 28 U.S.C. 1605(a)(5):
"(a) A foreign state shall not be immune from the jurisdiction of courts of the United States or of the States in any case – ... (5) ... in which money damages are sought against a foreign state for personal injury or death, or damage to or loss of property, occurring in the United States and caused by the tortious act or omission of that foreign state or of any official or employee of that foreign state while acting within the scope of his office or employment..."
According to the law, it is only the injuries caused by the wrongful act that have to occur domestically. The only condition that the law places on the wrongful act itself is that the foreign official or employee who commits it must do so "within the scope of his office or employment." For a foreign government employee, that would often be outside of America. Kagan writes as if she is paraphrasing the law, but her claim that the wrongful act must occur domestically appears no where in the law, while the condition that does appear in the law actually suggests the opposite: that the wrongful act will often take place on foreign soil.
To back up her lie about what the law says, Kagan goes on to lie about precedent, claiming that the Supreme Court in Amerada Hess: “considered and rejected the argument that domestic effects of a foreign state’s conduct abroad satisfy the exception.” In fact the injuries at issue in Amerada were not domestic. The Amerada company ship was attacked 5000 miles at sea, which plaintiffs contended was domestic on the grounds that the United States exercises some jurisdiction on the open ocean, but the Court disagreed.
There has been some back and forth about this on non-law blogs. My original post was excerpted by Gateway Pundit Jim Hoft, which prompted a Kaganesque response from Media Matters "researcher" Adam Shah. That prompted me to issue a more thorough analysis (at my link).
If these lies are exposed in timely fashion it will be an absolute crusher for Kagan. Maybe you can sic Gabe on it. Where the hell is that guy?

Why the disparaging talk? Are you a rocket scientist? If you are, Obama's gonna put YOUR ass on the unemployment line real soon.
I understand the reasoning. My argument is that this is the wrong time (just before the election) and the wrong circumstance (they had no problem letting Obamacare go through. Don't tell me that if they wanted to they couldn't have stopped it. Also they have no problem with the deficits that preserving the tax cuts will cause. So your song and dance about cutting deficit spending is a little disingenuous to say the least).
I'm surprised you didn't trot out the conservative meme about how spending has to be reined in; at least until the Republicans get elected and then OOPS.
What do you do genius? Polynike? Hedge fund manager? Broker? Gas Jockey? Hash slinger?

The Media have been known for at least 20 years to be in the tank (though they were more circumspect about until recently) for Liberal causes and therefore rooted/voted for Democrats.
Why haven't the Republicans tried to take any steps to counteract this massive imbalance in the realm of communications? Anyone with 2 brain cells to rub together can tell that Conservatives would do far better if their message could be delivered undiluted by the snark and smarm of the leftist/elitist press.
Is it myopia or are they just brain dead and really don't want to be in power? I think 1994 was as much a shock to the Republicans as to the Democrats. It showed. The Republicans didn't know what to do. Plus they were outmaneuvered and manipulated by the Democrats like a bully taking a lollipop from a baby.

You know, it may be "old" now, but I do think the tip I sent in last week about Bill Gates and how he is ruining public school education and dictating the direction of public school education in state and national government because of his "smartest man in the room" cred amongst the government and elites is a good one. Corallary is how he is doing something similar in the area of public health.
Seriously, Bill Gates is a very strong example of what VDH's article is about. He is supposedly "smarter" than all of us, and he is definitely richer than most of us so for some reason that confers the right to dictate to us how we should be living our lives. He has moved with his foundation from the good intentions of using his money to help others into the realm of dictating policy not only for the US but for countries worldwide.
Bill Gates. The guy who delivered buggy software 9 times out of 10. And don't think to blame those who created the software, in his time at the helm of Microsoft nothing went out the door without his approval.

Did that happen at SLC? The reason I ask is that, although I'm super-delighted to be relocating from SoCal to Utah next month, I've noticed that the TSA screeners at SLC are, well, jerks. I have yet to encounter one who did not have a surly demeanor and an unhelpful manner of interacting with passengers. It's pretty sad when a state full of basically nice people is represented to millions of travelers as unpleasant and incompetent.

I know what they say 'it has to be paid for' and they want it to come out of the stimulus slush fund. All well and good. My point is that this is a Pyrrhic victory (if they win) because they have stopped folks in need of getting some cash to keep their heads above water for a few more weeks. What's the point with drawing a line in the sand over this?
They couldn't seem to get the courage to stand up against Obamacare (the Senate has all kinds of rules/tricks they could've played to stop it), they have no problem about the deficits being caused by the tax cuts if they're extended. They have no problem with onerous legislation or bailouts for Wall Street but a few bucks for those who are about to go under? No they're going to stand up and be counted over Unemployment benefits.
They got played by the Democrats. They were set up to look like the mean spirited, working guy hating, rich guy loving party of no that the Democrats and they're willing mouthpieces have claimed all along.
They could've let this go and fought somewhere where it made more sense and wouldn't be as damning but no Pinch face McDonell had to look like he has a pair. Only he did it at the expense of people who're in trouble but who can ALL vote. They're Dumbasses!
You have no clue as to 'how far gone' I am. You haven't tried for one second to understand what I'm talking about. If there's someone too far gone it's you as you don't know what you're talking about. As to how long is too long; if you read one of my other comments, I mentioned that the MONEY IS ALREADY ALLOCATED. It's sitting in the accounts for people ready to be paid. The extension wasn't just for funding, it was to AUTHORIZE that money already apportioned to be paid to those who qualify.
As to how long to allow unemployment benefits? Who do you think is going to pay for these people when they can't find a job and have to go on some sort of Government handout? That's not counting the cost to the community of the economy by these peope going into bankruptcy and foreclosure. Watch the next 2-3 months and it's all going to get worse. Not just because of the unemployed but because the economy will shrink further.
YOU didn't answer my question. What do you do? Have you ever been unemployed? Do you know what the job market is like currently? Don't go by DoL stats about the unemployment rate the actual number of unemployed is at least double what is reported because they only report those who are receiving U.E.B.
There's about 5-6 people for every job opening. Mouthing platitudes about how 'the work is there' and how 'people aren't looking for work because unemployment benefits are so great'.
Yeah, right. Ever tried it? You're just some wet behind the ears kid who's mouthing what his elders are saying hoping to fit in.
Get a clue and take a look at reality. I would bet I know far more about the situation and what is being said and done on both sides than you so don't talk down to me about just reading headlines.
