My take is that it is unconstitutional, unless they did that BS ploy like they did with the healthscam bill where they took a bill that had already been passed in the House and amended it to strike everything in the existing bill and replace it with the new stuff.

I would have liked to see one of the States challenge the healthscam bill on that score as well so we could put a stop to that kind of shit, but as far as I know they have not done that.

BTW, the House has passed a CR to take the gov to Fe 2011.

As far as getting standing it all depends on which federal court you take it to. Whoever files suit would have to go "court shopping". That is the sad thing about the law in this country now.

So let me get this straight. Congress submits a budget which the President doesn't agree with. It's the President's fault if he is Reagan, but it's Not his fault if he's Clinton.

Same thing with congress. If the Congress is Democrat, it's the Republican President's fault, but if the Congress is Republican, it's the Republican Congresses fault.

After 30 years of progressive politics it has become a place with no spark, driven only by the inertia of government money, and the infrastructure is falling apart, so it is no longer quite so attractive to the eye.

45--Philly has two court systems set up and run specifically to attract litigation "business"--the mass tort program, and the commerce court program.  Philly is not alone in this regard--many large cities have set these programs up to compete against similar programs in other cities for litigation "business" benefitting lawyers, judges, reporters and hangers on.  the court system collects fees from all of litigants and lawyers to participate in cases in those courts.  Jurors--local citizens forced to donate their time--make the scam work, handing out verdicts that attract new filings, and charging nothing for their "services."

As other philly area morons will confirm, litigation is and has been the only growth industry in town for the better part of three decades.

This is a variation on a tactic the Dems have always used. When they are threatened with budget cuts, they claim that Police and Fire Protection will be compromised, or that Teachers will be laid off. They never threaten to get rid of meddlesome bureaucrats in government, or bloated general service employees. . 

I recall reading that Clinton got okays from the Various public service unions to help him make as much noise as he possibly could about the evil Republicans shutting down the government. (No Union Members were injured in the filming of this farce.)

No shit. I had to pull my daughter out of a small private school here after the 7th grade because the school shut down the higher grades.

There wasn't enough parents who wanted an education as much as they wanted football and cheer-leading. It so pissed me off.

If it was up to me there would be zero sports in school other than the informal games played during recess. I would force the professional sports teams to go to the European model of private sports clubs rather than a tax subsidized farm club. 

School should be dedicated to learning, not sporting. In lieu of that, I would make all schools private and shutdown tax subsidized union schools.

What happened to personal responsibility? If you kid chokes and dies on a toy you sue the toy maker. And the parents bear no responsibility for watching their child?  A kid can get killed with literally anything. I remember hearing a statistic that said at least 30 people die a year drowning in a bucket. Like the kind of bucket you use to mop your floors. Does that mean the bucket company should be sued?

Sledding can be very dangerous, especially if there are trees around, and this being PA we are covered in trees, so parents need to take extra procautions when letting their kids sled.

It doesn't help that when there are a bunch of slip and fall attorneys who hover around accidents like this like Hyennas waiting for a meal. They know the state our county has limited means in the way of legal defense funds and almost always settles.

I belonged to a pool in the early 1990s when i was a kid. They had a high dive, like 15 feet or more, i can't remember the exact height. Anyway, kids would slip off it and get hurt, so they put a material on the board that made it feel like you were walking on sand paper, to prevent slipping. I think some kid got badly hurt again, so they just got rid of it altogether. I don't know if it had anything to do with lawyers, or they just assumed kids couldn't handle the responsiblity

I am surprised that they even allowed you to have a pool at all. It isn't just diving boards that are disappearing. Entire community pools are as well. 

When I had my backyard pool built I went to the insurance company and told them and asked how much my rates were going up. I was told none at all. The agent told me that I was covered for one pool accident and one dog bite, after which neither would be covered in the future.

That is if they didn't cancel.

On blaming the judges and the juries for this crap I disagree. It is the entire tort system. It is, and has been, completely broken. It no longer functions at all.

I blame the State and Federal legislatures made up of lawyers who make it exceedingly easy to sue for virtually anything. Laws that allow them to venue shop and to pack the juries with people who believe in "social justice" and "jackpot judgments".

In fact the system is so broke that if I was a "dictator for a day" I would permanently ban ALL tort law. Torts would be settled by the claiment (not a lawyer), telling jury of working peers picked randomly as possible, their side of the story. Then the defendant (also not a lawyer) explaining their side of the story.  The jury would assign who was wrong. The most that could be paid out would be restitution.

Most especially there would be no:

1. Partial liability that forced a deep pocket to pay 100% when any actual problem was merely incidental.
2. Pain and suffering
3. Punitive damages (which I think are unconstitutional)
4. Absolutely NO government initiated tort at all.

Not completely true, although some States/Counties do not require a fence. (Mine didn't and still doesn't).

I talked to a lawyer about that. His response was that a fence is a big help, particularly like one I built that was 6 foot high.

He said that in defending against a civil suit if someone who trespassed into your pool and was injured had to climb over a fence to access it juries were in favor of the homeowner. If someone is old enough and big enough to climb a fence then they are old enough and big enough to know better. 

Now that may not hold up in some blue States like CA.
