March 19 (Bloomberg) -- Democrats need about six more votes from House members to pass a U.S. health-care overhaul, Obama administration officials said today.

White House and Democratic leaders aim to collect those votes from a pool of about 14 to 15 undecided lawmakers to get to the 216 votes needed to pass the measure, according to the officials, who spoke on condition of anonymity.

But what about those “you can’t repeal this” provisions and “supermajority requirements” snuck into the nooks and crannies of ObamaCare? They really are meaningless. Robert Alt, senior legal fellow and deputy director of the Center for Legal & Judicial Studies of the Heritage Foundation, confirms the adage that “One Congress cannot bind a future Congress.” He explains:

The only question is whether the new statute itself meets the requirements of bicameralism and presentment (ahh, something that until recently we have rather taken for granted). If it does, then it must be given effect unless it is unconstitutional — and there is nothing unconstitutional about repealing a prior bill. While the courts will give the prior statuteÂ’s language its maximum effect, the new statute would be just as much the “law of the land,” and thus a statement in the new statute that “notwithstanding the supermajority or ‘no repealÂ’ requirement in the health care bill, HR XXXX is hereby repealed” would have to be given effect by the  court

@Lucianne

THEN (President Obama, September 5, 2009):

"We have to revive this economy and rebuild it stronger than before. And making sure that folks have the opportunity and incentive to save – for a home or college, for retirement or a rainy day Â— is essential to that effort. " NOW

March 18 (Bloomberg) — Democratic congressional leaders would raise to 3.8 percent the Obama administration’s proposed new Medicare tax on investment income to generate an estimated $210 billion to help fund a health-care overhaul plan.

44 and that the competition will drive insurance prices down.

That is a true statement.  Unfortunately, this bill will squash competition--there will only be three gov't-approved plans companies can offer (and the coverage is the same in all, only the deductible/co-pays vary).  Everyone has to have the coverage the gov't deems correct or pay the fine.

Posted by: timothyJ at March 19, 2010 06:02 AM (IKKIf)

64 Joanna, what I've been saying to people is this "under normal circumstances in the presence of free market capitalism, the survival of the fittest rule would come into play and it is possible that premiums could go down.  I then caution that once they are getting a price from you for something, it is very rare for them to lower that price unless they have no choice since their competitors are lowering their prices too and they have to survive in the marketplace.   However, when a government entity is involved the rules of the free marketplace change.   Once an company who has the ability to have the laws changed when the laws are not favorable to them enters the picture it immediately puts their competition at a huge disadvantage.  When the playing feild is not level, when one entity is on a mound and the others on flat land, the entity on the mound has the advantage and ultimately can slowly put the others out of business by having the laws tailored in their favor.   this usually leads to a discussion of the housing bubble and the CDO's and how the changing of the laws and the forcing of people to write mortgages for people who had no business getting a mortgage eventually led to the mess we are in now.

1.Where is the competition coming from????? The government?!? Ask them to name one area where gevernment interference or increased control resulted in increased 'competition'.

2. If insurance companies are forced to "end discrimination" which is how they regard pre-existing conditions" why does anyone thinkg that prices will go down?

3.  The House version contained the Stupak amendment, that forbade ANY funds from supporting abortions. The Senate version approaches this, but deliberately excludes "other funds that may be authorized or appropriated". Once a new funding stream is allowed, then the restriction is cicumvented. Ask your co-worker why the Stupak amendment was rejected. If they are up for the bonus round, ask then why within 2,000 pages that they sinply didn't tie all programs and funds to the Hyde amendment, which pre-existed either the Stupak amendment or this monstrosity. When they are unable to answer, and they will be unable, you will have proven your point.

Final note on that. If Congress was about to block all abortion funding, does this co-worker really think that NARAL, NOW, Planned Parenthood and President Obama, who never met an abortion he didn't like, really be so content with the language?

"Creativity" and "innovative thinking" are most often just cover for perennial losers dissatisfied with their natural [and rightful] place in the pecking order.  They have nothing to lose by disrupting the order and everything to gain if, by some freak accident, they find themselves on top when things shake out.

It's like the little shitbags who, on getting their asses whipped again and again, don't even take a breath before demanding a double-or-nothing rematch.

So... if you're younger than 15 and older the 40, the government is going to LET YOU DIE.
