UPDATE
— Gabriel Malor A copy of the complaint is now available (PDF) and yes, the lawsuit is officially captioned "The United States of America v. The State of Arizona." As anticipated, there is a preemption claim. Also a supremacy clause claim and a commerce clause claim.
More info, including the GOP response is at the Blog of Legal Times.
Update: Here's the government's motion for preliminary injunction. It goes much further into the legal nitty-gritty of preemption, supremacy, and commerce.
Ed Morrissey notes that the lawsuit does not allege racial discrimination. Well, no. It's quite difficult to demonstrate pre-enforcement discrimination for a law that's facially neutral. Discrimination suits are apt to follow (if, you know, actual discrimination occurs rather than just predicted discrimination).
Preemption is, as Ed's correspondent writes, the obvious choice for a suit at this stage. Remember, they got Capone on tax evasion. This is lawfare and not to be mistaken for anything resembling common sense.

To defend the state, Brewer has hired John Bouma, chairman of Snell & Wilmer in Phoeniz, because ArizonaÂ’s attorney general, Terry Goddard III (D), has removed himself.
Why in the hell is that not grounds for Brewer to fire this sorry SOB?

If the Obama administration doesn't like the AZ law (which exactly recapitulates Federal law) then it can simply try to change the Federal law. . .
Since that isn't going to happen, now its resorting to this bullying.
What's Obama going to do when this law survives his stupid challenge and then five other states immediately come out with their own versions of the same?

§ 1101,
et seq. The INA also vests the executive branch with considerable discretion in
enforcing the provisions of the federal immigration laws, generally allowing federal agencies
to ultimately decide whether particular immigration remedies are appropriate in individual cases.
18. In exercising its significant enforcement discretion, the federal government
prioritizes for arrest, detention, prosecution, and removal those aliens who pose a danger to
national security or a risk to public safety.
Ewwww.... so the case revolves on the idea that the President has discretion to NOT enforce the Law... and that Arizona enforcing Federal Law infringes on his power to NOT enforce the Law...

United States of America v. The State of Arizona
The pay per view event of the Century! Sure, the heavyweight USA is bigger and stronger than the featherweight state of Arizona, but don't count them out on the canvas just yet.
The USA has the awesome punching power and advantage of reach, but Arizona has a lightning fast jab, and a good dose of common sense. The federal government? A big clumsy brawler, where as Arizona? A true boxer.
So who will win this epic fight? As with most boxing matches, it depends on whoever pays off the referee the most to get the fix in.
And now, Don King.

It's really not that clear cut.
I wonder how Scalia will come down when it gets there.
IIRC, his Raich opinion (while it was a Commerce Clause case predominately) also talked a lot about the right and preeminence of a federal regime (in that case the Controlled Substance Act). So even though purely intra-state pot wasn't part of inter-state commerce it undermined the whole regime of drug control. Now in that case the statutes were in conflict, unlike here where the law is essentially the same but the enforcement/policy choices are different.
Now I hated Scalia in Raich but I could see him using the same logic and lower courts relying on it.
Federal law preempts state law. I bet a court finds that the federal policy/enforcement choices that flow from those laws preempt state action.

For me, I believe that the 'take advantage of crises' model that prevails in Barry's administration has triggered the unintended consequence that Barry has become addicted to crises. It's a required fix for him. Like a junkie, he needs a new fix earlier after each previous one.
It's gotten to the point that they no longer even need to take advantage of the crisis du jour. They just need a new crisis, even if it means ruining the relationship with one of the states.

I'm just starting to read through this case, but something jumped out at me right on the first page:
The nationÂ’s immigration laws reflect a careful and considered balance of national law enforcement, foreign relations, and humanitarian interests.
Arizona is doing nothing to make law about immigration (and I'm sick to death of hearing people phrase it that way - just like that disingenuous "illegal immigrant" bullshit). Further, our nation makes our immigration laws based on what WE want and need, not because of foreign relations and certainly not because of humanitarian interests. The sovereignty of the US is not beholden to foreign relations and humanitarian interests.
As to foreign relations, though, having Washington attack a US state and ally with a foreign nation to attack a US state (as with that despicable shithead from Mexico - who should have been unceremoniously kicked out of this country when he made those pathetic statements about Arizona) is as un-Constitutional and un-American as it comes. We have an Indonesian in the White House, allying with foreign nations in his attack on us. I hope that America realizes that these transgressions will have to be seriously addressed, at some point. People need to be put away, and worse, for what they are doing to the US from within the federal government (and the others who have used their state and local governments to attack Arizona).

Ok, so if the court rules in favor of USA in this case, could AZ turn around and file a civil suit for damages incurred to both natural and taxpayer resources due to the Feds failure to enforce their own law? Also, wrongful death suits from families of individuals killed by illegal aliens coming over the border?

Let me see if I have this straight. Arizona is being invaded by Mexicans. Its the Feds job to protect them. The Feds refuse to do their job because the Dems need more voters. The Feds use our tax dollars to sue Arizona and force them to stop doing the job the Feds are supposed to be doing for them in the first place. So the Feds position is bend over Arizona and take it up your wazoo from the invading Mexicans.

Most of the time those photo ops where a leader travels somewhere to "see the damage first hand" are just useless pap, but I really feel like Obama should travel to the border and witness what's happening there first hand. Because he either has no idea what the fuck is going on there, or he's utterly defaulting on his oath to protect this country. That would at least tell us what we're dealing with here.

The federal government is now admitting it cannot do it's job.
We can't do our job so Arizona shouldn't be able to make us? This is a deadly argument if accepted by the court. It basically admits and argues that the Federal Government cannot protect the Sovereign Territory of the United States from foreign incursion. This is a fundamental failure of the principal of Federal Government, whose number one charge is to protect the sovereignty of the member states from foreign influence. One could argue based on this, that the federal government has violated the premise of a federalized union, denied a state the right to be secure in their sovereignty, and as such the state's obligation to obey federal authority, an agreement entered into on the basis that the federal authority would protect the state, is nullified.

I haven't read the filing but even if they have asked for an injunction I would think the court would not grant it. An injunction will not be granted unless there is a reasonable probability of finding for the plaintiff. Since both the local federal court and the 9th circuit court have already ruled for the AZ law "reasonable chance of winning" is not in the cards.
As for awarding the U.S. costs, I don't think there is a provision in immigration law that provides for that so that is out the window right off the bat. Besides that, it smacks of a slapp suit.
Of course if they shop for the right judge, say someone like Kagan, they can get anything they want until it reaches the appellate level.

Exactly. It's not only that the feral government is totally incorrect in claiming that Arizona is making "immigration law" (which it isn't) but that Arizona has no right to make the feral government follow the Constitutional demand that it (Art IV, Sec 4):
The United States [...] shall protect each of them against Invasion;
And, as you point out, the feral government claims that they are allowed to selectively enforce law and all states must shut up and live with the consequences.

They argue so many idiotic cases with straight faces these days that it's hard to be surprised by this. Just the fact that Kagan took an intensely pathetic and stupid case to the SCOTUS and got smacked down 8-0, but is still in the running to be put on the SCOTUS, itself, tells us that there is no integrity or reason left in this system. We have just been overrun by people who have no sense, no shame, no integrity, and no sense of humiliation, at all.

You know? Under normal circumstances, if those charged with enforcing laws were purposefully not enforcing those laws, I might rationally begin to think that there were corrupt influences in play that were acting on the enforcement officials to take a position utterly opposed to their mandate. Say - making money off of the drug trade or human trafficing.
But that's not possible, is it?
Didn't think so.

Team Obama is trying to control the news cycle for that explosive testimony. He knows everyone knows about the AZ illegal immigration issue and the politics have been baked into their campaign cake. He also knows that the voters remain ignorant of the legal proceedings of Holder et al. and their indefensible bias in how justice is served, especially when the issue is voting rights. It's an outrage that's surviving because of so many other issues sucking up attention and because of Holder's previous disinclination to help any investigations.
Team Obama seems to have timed this AZ-Illegal alien case to trump the attention of another legal proceeding with new, unmeasured political consequences that will definitely anger the electorate... if they discover and follow it.

The funny part is that the Commerce Clause has been totally abused in this whole debacle - not by Arizona, but by the federal government, itself, which has allowed states and localities to organize boycotts against Arizona, along with allowing federal agencies to also boycott Arizona. This goes to the heart of the real Commerce Clause, which tasked the federal government with stopping exactly this sort of action by one state against another or by the federal government against a state. ... But, the feral government picks the point of their own abuse and blames Arizona, the victim, for violating that law that the federal government and other states/localities are violating in the loudest terms possible.
This sort of crap is why I have no respect left for our judiciary. There is no sense left in our institutions, at all. None, whatsoever.

My latest idea... since the BLM is the largest landowner in the country, I'm sure we could find good land to TRADE to those living on the border (ranches and such)... heck, give em a 2 for 1 deal if you have to.
Then Nationalize a 20 mile "buffer" zone and give it to the Military (think DMZ) where they can use said land for counter insurgency training.
As tresspassing on Federal Land IS a Federal Crime, Military Police CAN enforce trespassing laws on Military installations, thus no Posse Commitarus problems.
Then the military hands over the illegals to the Border Patrol...
This solution would solve the problem, and even with relocation costs, still would be cheaper than what it costs to support all the illegals making it to our country (healthcare costs, education costs and such...)

Although states may exercise their police power in a manner that has an incidental or indirect effect on aliens, a state may not establish its own immigration policy or enforce state laws in a manner that interferes with the federal immigration laws.
If someone can explain how Arizona is establishing "immigration policy" (which would entail giving legality to the residence of aliens or taking it away, or giving or taking away citizenship, or deporting people from the US) then I've got $10,000 for you.

Haven't had time to read all the comments, but anybody catch this: ArizonaÂ’s attorney general, Terry Goddard III (D), has removed himself? The Governor should fire his ass.
This paragraph tells you what side the ACLU is on if you didn't know already: The DOJ lawsuit does not seek to invalidate the entire Arizona immigration law, known as S.B. 1070. It targets sections 1 through 6 of the law (PDF), leaving alone sections about employment and the impounding of vehicles. By contrast, the complaint (PDF) filed by in May by the ACLU and others asks to have the law struck down in its entirety.
Posted by: Kratos (Ghost of Sparta) at July 06, 2010 01:07 PM (c0A3e)
It [SB 1070] will conflict with longstanding federal law governing the registration, smuggling, and employment of aliens.
I don't know who the illiterate was who wrote this pleading, but the way this sentence was put together makes me think that Hah-vahd doesn't bother with checking verbal and written skills.
It will altogether ignore humanitarian concerns, such as the protections available under federal law for an alien who has a well-founded fear of persecution or who has been the victim of a natural disaster.
More total bullshit that even a 3rd grader would laugh at. The illegal aliens detained by Arizona suffer nothing other than being incarcerated IN THE US, and handed off to the federal authorities for them to deal with. Just the fact that such an insane line is in this pleading is enough to show that this is not even close to serious.
And it will interfere with vital foreign policy and national security interests by disrupting the United StatesÂ’ relationship with Mexico and other countries.
LOL. And the fact that the US points out MEXICO in the pleading shows that there is racial/ethnic profiling at the federal level that they want instituted by all the states, whereas Arizona refuses to engage in such, instead treating all illegals the same way. A Swede whose English is clearly not his mother tongue and who has no driver's license or other documentation to show their legal residency is treated the same as a Mexican whose English is not native and who has no documentation, either.
Maybe this pleading is really just a joke to lighten up the nation's mood? I can't think of any other use for it.

But the United States Constitution forbids Arizona from supplanting the federal governmentÂ’s immigration regime with its own state-specific immigration policy
How is Arizona's law an "immigration policy"? Is Arizona issuing green cards, visas, and citizenships and deporting people from the US? Does anyone in America even know what the word "immigration" means, anymore?
– a policy that, in purpose and effect, interferes with the numerous interests the federal government must balance when enforcing and administering the immigration laws and disrupts the balance actually established by the federal government.
Those "numerous interests" again. This has been mentioned three or four times in the first few pages, though without any actual explanation of these "interests". And the federal government is actually arguing that the inflow of illegals identified (and that the federal government then has to deal with) by Arizona will cause them to stop other enforcement.
I can't take any more of this. It's too insane. The proper reaction to this pleading would be to burn the Ivy law schools to the ground and fire every Ivy lawyer. They are anti-American scum with low IQ's and egos the size of Mount Everest.
America should be embarrassed that this case has been filed. Everyone associated with this case on the federal government's side needs to sit trial and answer for their stupidity and anti-Americanism. Then, they should all be deported to their favorite third world shitholes.

the impact the law could have on immigrantsÂ’ willingness to cooperate with local police in criminal investigations,
I always considered this a complete bullshit argument. Let's take LA as an example with Special Order 40, which is the main apparatus for making LA a sanctuary city. Cops are ordered not to ask about immigration status. The prime justification is willingness to cooperate . So, just how many illegal aliens testified for the prosecution in felonies in LA during the reign of Special Order 40? And how many illegal aliens committed felonies in LA during that same period? I don't know, sorry, but 'll take a WAG at 100 illegal alien committed felonies for every one illegal alien that testified.

Further, the federal government has broad authority to establish the terms and conditions for entry and continued presence in the United States, and to regulate the status of aliens within the boundaries of the United States.
How is Arizona doing anything to change "the terms and conditions for entry and continued presence in the United States" or to change the status of aliens in the US? The federal government established the status and Arizona is just finding out what it is.

OT: San Francisco achieves purity level of 100% Fucked.
Newsom's directive, issued in April but whose practical impacts are starting to be felt now, bars calorically sweetened beverages from vending machines on city property.
That includes non-diet sodas, sports drinks and artificially sweetened water. Juice must be 100 percent fruit or vegetable juice with no added sweeteners. Diet sodas can be no more than 25 percent of the items offered, the directive says.
There should be "ample choices" of water, "soy milk, rice milk and other similar dairy or non dairy milk," says the directive, which also covers fat and sugar content in vending machine snacks.
It's all part of Newsom's effort to combat obesity and improve San Franciscans' health, similar to a national effort being championed by first lady Michelle Obama.

Your assuming that they wouldn't file a case unless it had merit. Clearly, looking at the pleading, this is not the case. You can now set aside the pretext that any of this will make sense and stop torturing yourself looking for reason in the unreasonable. Clearly it is every reason a court might allow argument on rather than a well thought case, which just reeks of delay tactic, because all of this will have to be argued and decided separately. Now the question of how the courts will deal with the steaming pile of poo from assorted animals.
Apparently they are OK with the double-whammy of losing the border issue + inciting electorate rage, as long as they can delay massive state enforcement for a little while. That actually scares me, a bunch, because that means they are planning to do something else to "solve" the "problem" of illegal aliens between now and then.
Look there goes a lame duck right now. I wonder why it sounds like "amnesty" when it quacks.

Wait, you're asking the Federal Government officials to do their legally mandated job even when it's hard?
Well that's just illegal, and wrong. Expect a lawsuit. Government workers don't have to do their work when it's hard, and nobody else gets to do it either because that might make them look bad and/or hurt their feelings; which is also illegal and wrong.
I'm pretty sure there's a Union rule that their work can't be a burden; and as we all know, Union rules trump laws.

This is incredibly weak as a legal argument, and that's an objective analysis. The bottom line is that the feds have claimed their neglect to enforce the law is public policy, and Arizona has infringed upon this choice. In other words, this is about "pre-emption" of a policy choice, not a pre-emption of law. To my knowledge, pre-emption never has been argued on a resource allocation basis. This is not in any way about state law trying to triumph, and this pleading admits as much. An objective court will not find for the feds.
The main goal has been accomplished, though, and it was political. Something has "been done" to please left-wing Hispanic interest groups like La Raza. I think the only way for an injunction to have issued was under the pre-emption argument. No other issue was ripe enough to claim irreparable harm.
Arizona needs immediately appeal the mere issuance of an injunction. That will force the feds to tip their hands and show how little they hold. The bottom line is that the Obama/Holder communist clown cabal has argued any state action that results in resource allocation the federal government doesn't like is pre-empted. I shudder at the implications of such an assertion, but am confident even today's courts will have none of it, and rather quickly.

Art I, Sec 8:
To establish an uniform Rule of Naturalization, ...
To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, ...What this states us that only the federal government makes and executes law regarding who becomes an American citizen. This has nothing to do with those illegally present in the US, as that is not an issue of "Naturalization".
As to invasion, which is also a federal responsibility mentioned later, this is not a "Power" given to Congress or the federal government, but a responsibility assigned to it. As such, States are always free to combat that on their own, as that is part of the responsibility of each individual, sovereign State's government. We see this same dynamic in other areas, such as bank robbery, which is a federal offense but that the states have laws about and are EXPECTED to be on the scene, first.
The fact that any argument that Arizona's law impinges on "federal immigration law" is accepted as anything less than a total joke is a terrible indictment of the state of American institutions.

Keeping abbreviations short is a trend within the government. Like CDC -- that stands for Centers for Disease Control and Prevention but you don't get the "and Prevention" part by looking at the abbreviation.
The same with NASA, the National Aeronautics, Space and Earth Improvement Administration.
(By the way, is there a government agency charged with protecting the environment? That thing in the Gulf of Mexico seems like it could get messy, eventually.)

Bolden created a firestorm after telling Al Jazeera last month that President Obama told him before he took the job that he wanted him to do three things: inspire children to learn math and science, expand international relationships and "perhaps foremost, he wanted me to find a way to reach out to the Muslim world and engage much more with dominantly Muslim nations to help them feel good about their historic contribution to science ... and math and engineering."
Obama ordered him to do this. Note also that it perpetuates the myth that "Muslims" had great contributions to math and science. Any contributions coming from the area occurred long before it became dominated by Muslim rule. Most of the "math" contribution attributed to Arabs actually came from the Hindus.
But I guess Jugears was falsely impressed by Wendell Goler of Fox when he showed everyone the Great Pyramid at Giza and remarked what a fine example of Muslim arts and sciences it was.

Among other things, as discussed above, S.B. 1070 seeks to override, and would impair the ability of DHS to execute, the federal enforcement priority to locate, detain, prosecute and remove violent criminal aliens who pose significant risks to the safety and security of our NationÂ’s citizens. This assault on federal priorities is not speculative; it is the avowed purpose of S.B. 1070.

My later post highlighted the Constituional language of "Citizens of each State" to show that the Constitution acknowledged each State's powers and responsibilities over legal residency moreso than the federal government (since it is the State's that actually come into contact with people).
I do admire the total shamelessness (in a legal brief, even) that the Executive branch is claiming that they aren't going to be able to ignore certain residency laws if Arizona starts reporting back on illegals it finds. It just boggles the mind.

While the application for an injunction is better drafted, it suffers from the same fatal flaw as the complaint. "Pre-emption" is being defined in a political, public policy context rather than as a legal concept. Again, this is an argument for non-enforcement because of limited resources (a blatant lie, but nonetheless what is claimed).
If the Executive Branch prefers to enforce a law to curtail Tea Party speech rather than deport illegal alien rapists, that doesn't mean the laws against the latter are non-existent. If the State of Arizona enforces the laws of the United States, and defers to the feds on questions of function, there is no pre-emption. Arizona cannot force the United States to take the illegal alien rapist into federal custody for deportation. This doesn't mean it cannot enforce the law and seek that result. In fact, there is case law to support Arizona on this point.
While I didn't think the United States would prevail on the merits, I did think an injunction would issue. I no longer do. The only goal of this lawsuit, pandering to left-wing Hispanic interest groups, has been achieved. This isn't even a half-assed effort to prevail on legal merits.
In my wildest dreams I never thought the U.S. case would be this thin. It makes me concerned about what this lame duck Congress will do. We need to remember these left-wing maggots have never held real jobs and will try to get into non-profits and jobs as lobbyists and consultants. Make certain your soon-to-be unemployed representative knows you will pick up the phone and give any prospective "employer" an earful if he gets hired after fucking you and the rest of the country.

No one ever says that about the American Indians and only once in a while does some crackpot claim that about the Africans, and that's usually when said crackpot is trying to claim that the Egyptians were black (despite Egyptian art to the contrary).

Back in the 14th century, Ibn Khaldun has some interesting words about arabs (The Muqaddimah):
25. Places that succumb to the Arabs are quickly ruined. The reason for this is that (the Arabs) are a savage nation, fully accustomed to savagery and the things that cause it. Savagery has become their character and nature. They enjoy it, because it means freedom from authority and no subservience to leadership. Such a natural disposition is the negation and antithesis of civilization. All the customary activities of the Arabs lead to travel and movement. This is the antithesis and negation of stationariness, which produces civilization. For instance, the Arabs need stones to set them up as supports for their cooking pots. So, they take them from buildings which they tear down to get the stones, and use them for that purpose. Wood, too, is needed by them for props for their tents and for use as tent poles for their dwellÂings. So, they tear down roofs to get the wood for that purpose. The very nature of their existence is the negation of building, which is the basis of civilization. This is the case with them quite generally.
Furthermore, it is their nature to plunder whatever other people possess. Their sustenance lies wherever the shadow of their lances falls. They recognize no limit in taking the possessions of other people. Whenever their eyes fall upon some property, furnishings, or utensils, they take it. When they acquire superiority and royal authority, they have complete power to plunder (as they please). There no longer exists any political (power) to protect property, and civilization is ruined.
Furthermore, since they use force to make craftsmen and professional workers do their work, they do not see any value in it and do not pay them for it. Now, as we shall mention, labor is the real basis of profit. When labor is not appreciated and is done for nothing, the hope for profit vanishes, and no (productive) work is done. The sedentary population disperses, and civilization decays.
Furthermore, (the Arabs) are not concerned with laws. (They are not concerned) to deter people from misdeeds or to protect some against the others. They care only for the property that they might take away from people through looting and imposts. When they have obtained that, they have no interest in anything further, such as taking care of (people), looking after their interests, or forcing them not to commit misdeeds. They often level fines on property, because they want to get some advantage, some tax, or profit out of it. This is their custom. It does not help to prevent misdeeds or to deter those who undertake to commit (misÂdeeds). On the contrary, it increases (misdeeds), because as compared to getting what one wants, the (possible financial) loss (through fines) is insignificant.
Under the rule of (the Arabs), the subjects live as in a state of anarchy, without law. Anarchy destroys mankind and ruins civilization, since, as we have stated, the existence of royal authority is a natural quality of man. It alone guarantees their existence and social organization. That was mentioned above at the beginning of the chapter.
Furthermore, (every Arab) is eager to be the leader. Scarcely a one of them would cede his power to another, even to his father, his brother, or the eldest (most important) member of his family. That happens only in rare cases and under pressure of considerations of decency. There are numerous authorities and amirs among them. The subjects have to obey many masters in connection with the control of taxation and law. Civilization, thus, decays and is wiped out.
'Abd-al-Malik asked one Arab who had come to him on an embassy about al-Hajjaj. He wanted him to praise alÂHajjaj for his good political leadership (for the benefit of) civilization. But the Arab said: "When I left him, he was acting unjustly all by himself."
It is noteworthy how civilization always collapsed in places the Arabs took over and conquered, and how such settlements were depopulated and the (very) earth there turned into something that was no (longer) earth. The Yemen where (the Arabs) live is in ruins, except for a few cities. Persian civilization in the Arab 'Iraq is likewise completely ruined. The same applies to contemporary Syria. When the Banu Hilal and the Banu Sulaym pushed through (from their homeland) to Ifrigiyah and the Maghrib in (the beginning of) the fifth [eleventh] century and struggled there for three hundred and fifty years, they attached themselves to (the country), and the flat territory in (the Maghrib) was completely ruined. Formerly, the whole region between the Sudan and the Mediterranean had been settled. This (fact) is attested by the relics of civilization there, such as monuÂments, architectural sculpture, and the visible remains of villages and hamlets.

It IS an interesting topic. The people that are forwarded as "native Americans" by the MFM (who we all used to call the Indians) are of Asian Inuit stock, supposedly from the Asian land bridge crossing.
We now have several archealogical sites that were older than the land bridge and show evidence of being of Polynesian extraction.
There are some that are suggesting that there is evidence that Europeans came here as far back as 20,000 years ago.

24. Arabs can gain control only over flat territory.
This is because, on account of their savage nature, (the Arabs) are people who plunder and cause damage. They plunder whatever they are able to lay their hands on without having to fight or to expose themselves to danger. They then retreat to their pastures in the desert. They do not atÂtack or fight except in self-defense. Every stronghold or (locality) that seems difficult (to attack), they bypass in favor of some less difficult (enterprise). They do not attack it. Tribes that are protected against (the Arabs) by inaccessible mountains are safe from their mischief and destructiveness. The Arabs would not cross hills or undergo hardship and danger in order to get to them.Flat territory, on the other hand, falls victim to their looting and prey to their appetite whenever they (have the opportunity of) gaining power over it, when there is no militia, or when the dynasty is weak. Then they raid, plunder, and attack that territory repeatedly, because it is easily (accessible) to them. Eventually, its inhabitants succumb utterly to the Arabs and then they are pushed around by them in accordance with changes of control and shifts in leadership. Eventually, their civilization is wiped out.

Yes and the physical features of Native Americans (I've been cowed by the PC folks, evidently) share distinct features with Asians. Strong pointed chins and cheekbones, deep set eyes, lack of thick facial hair.
There are some that are suggesting that there is evidence that Europeans came here as far back as 20,000 years ago.
I believe that too. If there is one thing that pisses me off about mainstream science, it's that if they aren't holding a piece of physical evidence in their hands, an alternative or opposing view is not only unacceptable but even laughable in the elite world of academia.

Show me where Arizona is actually attempting to adopt its own immigration laws rather than to enforce federal law that the feds themselves refuse to. Show me where the Constitution prohibits what Arizona is doing. And no, the Supremacy Clause alone doesn't do that, nor does Congress's power over immigration, nor does federal law preempt state law WHERE THERE ISN'T A CONFLICT.

True, but the Osiris reactor was just a precursor and could have certainly provided plenty of irradiated material for crude weaponry , not to mention Iraq was involved in a brutal war with Iran and were looking to ramp up and would have if Israel wouldn't have taken it out since they were in our good graces then. The Syrians had one taken out in 2007 by Israel provided by the Norks. A) That illegal immigrants are a good whose interstate trade is being restrained? See C) below,
B) That Mexico is a US State? (Though admittedly states can't form separate alliances or tarriffs with other nations.)
C) That the Federal government is arguing that it has an interest in protecting illegal trade in goods and services (by people here illegally), or in the illegal trade in the labor of those people?
It seems to me that the Federal Government isn't just arguing that it has a right to prevent the enforcement of certain laws, but to protect the breaking of other laws.

We should have bombed them back to the Stone Age and left (except that we should have taken the oil fields and gulf access of Iraq, since that is the source of their threats against us and civil.ization).
As to Iran, they will need to be reduced to rubble, themselves. Your idiotic contention that they haven't killed as many as the Soviets, Nazis, or other commies, yet, is pretty silly. Attorney GeneralÂ’s willful failure nullified Federal apprehension and detention Laws; the moment they denied Federal process of prisoners referred to ICE from Arizona: http://bit.ly/arN2Lx
TITLE 8 > CHAPTER 12 > SUBCHAPTER II > Part IV > § 1226
§ 1226. Apprehension and detention of aliens
(d) Identification of criminal aliens
(1) The Attorney General shall devise and implement a system—
(A) to make available, daily (on a 24-hour basis), to Federal, State, and local authorities the investigative resources of the Service to determine whether individuals arrested by such authorities for aggravated felonies are aliens; (---)
AZ law has already been upheld by the Court of Appeals for the 9th circuitÂ… This tells me that Amnesty has already entered its stages of processÂ…
* Sorry if I've over-looked a prior mention of this....

If this is overturned by the courts, then there is no reason for any State to try to conform or support ANY federal law.
This lawsuit may rise to the level of crap, but only if it can find something to stand on.
In all seriousness, if the the states cannot assist in supporting laws the Federal Government CANNOT or WILL NOT enforce, WHY THE HELL do we support or adhere to the dictates of Washington, DC?
The courts turn down ArizonaÂ’s attempt to control their border, it is getting high time to start cleaning weapons and considering shootingÂ…What the hell is the Federal Government good for, if that is the case?
We may as well go it alone. I’m out-going to go listen to “the night they drove old Dixie down” 10 times and try to remember when this country wasn’t so god damn stupid and fucked up.
