The claim made -- which I guess is plausible; I mean, who kills people openly like that? -- was that he thought he was reaching for his Taser. I guess the jury bought that: two to four years.
Seems... well, I don't know. It seems light. But I'm guessing the guy testified about his fatal error and came across as truthful.
In Oakland, radicals and "community activists" have been agitating for a riot unless "justice" was done, and I'm guessing they'll have their riot after all.

The cop didn't set out that night to shoot an ex-con druggie resisting arrest. They'd already found two guns on that line that night, and the guy wouldn't show his hands. The cop seemed surprised as hell too.
Judge not lest ye be judged. He was judged and it seems about right.

I'm not in love with cops and governmental authority, but I'm not crying over the thugs, either. My only criteria is "if a private citizen did this, what should happen?" And if there were three normal people and 15 thugs, and one of the normal people accidentally shot a thug when the normal person was trying to leave or break up a fight or whatever, I wouldn't consider it a criminal act.

So, if the CIA wacks a jihadi, that's a crime against humanity, because they didn't give the guy a fair trial first. Apparently, though, a "fair trial" is one in which the government is allowed to set the outcome ahead of time, just in case the jury is thinking of getting uppity.

But here's the thing: yes, we can. Well, why not? Because of differences. Well, can we overcome these differences? No. Can we find each other and connect with each other in spite of these differences? No, we can't. But, we have to try. . . .

The main famliy spokeman said he wasnt responsible for how people in Oakland react. He didn't suggest peace. He suggest avoidance of destruction of Oscar Grant friendly businesses.

Posted by: Blazer at July 08, 2010 04:08 PM (t72+4)
Additionally - the holsters are different. An officer has to depress a button on a retention holster to draw his service pistol. The taser does not have a similar button. That's premeditation.
The good news is that with the legalization of pot in California, the rioters will prioritize robbing the pot stores - a self-limiting problem.

I would, but I keep seeing those cheering throngs of black folks celebrating in the streets after OJ got off.
So some black criminal got removed from the gene pool. Guess I don't much care. Let 'em riot. They'll just fuck up their own shitty neighborhoods anyway.
Grant served two state prison terms for various felonies including a conviction for drug dealing. In 2007 he was sentenced to 16 months in state prison for fleeing "from a traffic stop while armed with a loaded pistol".
Oh, how nice. What a good family man. We sure will miss him.
During that incident, near his Hayward home, San Leandro police shot him with a Taser to subdue him after he threw the pistol into the air and ran.
The arresting officers testified that even after being Tased, Grant "continued to resist efforts of the officers to handcuff him".
Records at the main Alameda County Courthouse in Oakland indicate that Grant had 12 separate cases between April 12, 2004, and May 8, 2008. But the records for all of those cases are at the Hayward Hall of Justice and werenÂ’t immediately available.

No manual safety on the Glock - if that's what Oakland uses.
TIme Traveller - My holster is an older model, and is not a retention holster. Draws quickly without button-push, just like the taser does.
Posted by: Wyatt Earp at July 08, 2010 04:12 PM (zgZzy)
Glocks don't have safeties (of course, neither do revolvers). Back to the ergonomic point, maybe if they were carrying a 1911 .45 "cocked and locked" the act of thumbing off the safety would've made him stop before he fired.
They should put the Taser on the weak-hand side of the rig (i.e., the left side for righthanded officers and vice-versa).

What is the value of a white woman's life among the black community in America?
Answer: Less than zero. They cheered when her murderer got off. And not just the ghetto rats in LA. They were cheering on college campuses, too.
Fuck this thug. I'm glad he's dead.
Rule of law? Whatever. President Wee Wee threw all that out, remember? Black Panthers may now stand outside of polling places while threatening and intimidating whitey.
These are the new rules. They voted these rules in at 90+% , so it's time to play by their rules.
It's all outcome based now, right? Well, I approve of the outcome, therefore I approve of as much leniency as possible. If I were on that jury I would have voted him not guilty.

Officer Mehserle's Taser was placed to the left of his belt buckle; his gun was on his right hip. He should not have been so confused by the placement that he reached for the wrong weapon simply on that basis. He may have drawn his pistol because he thought Grant was reaching for a pistol (he said that he saw him reach for a pocket) or he may have drawn his pistol because he flat-out panicked and got fundamentally mixed-up between the two weapons: thinking "Taser" but reacting via muscle memory with "pistol."
The video doesn't support the idea that there was an immediate threat from a hostile crowd or even that the guys being apprehended were posing a physical threat to the BART cops. Of the four guys being detained, two are sitting, one is on his knees and the fourth -- Grant -- is on the ground face down with a BART cop kneeling on his neck. Mehserle, instead of reaching in and handcuffing Grant, decided to stand up and draw a weapon: he either didn't have nearly enough training to deal with that situation or the training he got didn't stick through the stress of the situation.

I don't necessarily agree with that sentiment. I was a cop in a city of 350 thousand for 10 years and we were usually given the benefit of the doubt in situations where deadly force was authorized. I love the man on the street interviews. People are so stupid. The people being interviewed and the reporters selecting the interviewees. Sometimes I wonder if reporters put the stupidist people in the world up for comedic value. But then I remember how stupid they are so probably not.

Officer Mehserle's Taser was placed to the left of his belt buckle; his gun was on his right hip. He should not have been so confused by the placement that he reached for the wrong weapon simply on that basis.
I'm just playing Devil's Advocate to counterbalance the commenters who want the officer hanged. In Philly, the Glock and Taser are next to each other. Didn't know if Oakland had the same system.

Seems like it. This tragic death isn't a rational justification for the race-pimps to instigate a riot in the name of "justice", but when have they listened to reason?
I'm waiting for the Cincinnati race pimps to try to pump up the thugs; they got the riot they wanted in 2001.
Then again, maybe their influence is shot. When they tried to shakedown a local restaurateur, he turned tables on them by standing firm. He refused to serve O.J. Simpson, told "protesters" outside of one of his restaurants to get hosed, then partnered with Bootsy Collins to start another restaurant.

At this point I kinda think the verdict is a moot point -- it is what it is, and people are welcome to agree or disagree, form their own opinions as to what "really went down".
It's not good that a cop shot somebody like this -- I'm not at all feeling badly for the victim, as he was clearly scum -- next time it could be somebody who wasn't scum though. That has to be kept in mind -- either more/better weapons training or a better placement of that tazer, or both.
At this point the main thing is the impending riot. While I'm kinda siding with ol' Satan here (would be hilarious to see the lefties running, screaming to the "cop oppressors" for help and defense), by the same token, you know the good citizens will have to pay to clean up all this shit (if it happens, which seems likely) and it will be the shopkeepers and everyday Joes who will likely be hurt the most by this. I'm kinda hoping the city comes down hard on the rioters, or just nips any riot in the bud...but I'm not holding my breathe.
And my condolences Russ.

The thug he shot? He won't be on the streets anymore. I'm trying hard to come up with a modicum of sympathy for him, but I'm coming up empty. When a person chooses to live a violent, law-breaking life, then they damned well have to accept that their life is going to end in a violent way.
And the rioting? Should be met with extreme measures.

This year, Oakland, Calif., was named an All-American City by the National Civic League. City officials worked long and hard to win this designation, and it's the source of considerable civic pride. Mayor Elihu Harris will tell you that one of his proudest moments in office was accepting that award.
And on the city's police department short-list for 1993 Officer of the Year is William Grijalva. If he wins, someone else will be accepting the award for him at the ceremony. The 19-year department veteran was killed in the line of duty Dec. 15.
The previous day, the police department's animal control section -- our modern version of the town dogcatcher -- had attempted to pick up Chewy, a pit bull that belonged to Luke Grinage, age 21. Chewy had bitten a neighbor and, since his rabies vaccinations had expired, the law requires quarantine. Mr. Grinage refused to turn his dog over to the officers.
When they returned the next day, Mr. Grinage stood firm. The officers called for backup; Officer Grijalva was one of the officers who responded. As Mr. Grinage still refused to relinquish the dog, the officers tried to arrest him. When he resisted, they used Mace to subdue him. But as they tried to handcuff him, he broke free and ran into his house.
Officer Grijalva chased after him, not realizing that Mr. Grinage had picked up a shotgun that was just inside the front door. The first blast caught Officer Grijalva in his side and spun him around; the second blast hit him in the buttocks.
Officer Grijalva then drew his gun and managed to return fire, as did one of the other officers. Caught in the cross-fire was Mr. Grinage's father, Rafael, who was sitting in a wheelchair just inside the front door. Both father and son were fatally wounded; reports confirm that Rafael was killed by a police round, possibly fired by the dying Officer Grijalva.
There you have it: three men killed senselessly. Once upon a time, the community's reaction would have been predictable: There would have been sympathy for the cop's widow and two children, an outpouring of grief for the fallen officer -- a past departmental winner of a medal of valor for saving a disabled person in a house fire. Today, the community's reaction is just as predictable: outrage that the supposedly insensitive and confrontational style of the Oakland police led to the death of an innocent, wheelchair-bound man.
Certainly the cops shouldn't have shot him. But that "shouldn't have" is at the end of a long trail of "shouldn't haves" that leads back to the pathetic origins of this incident.
Luke Grinage shouldn't have picked up a shotgun and opened fire on the police -- putting his own disabled father in peril. Or pulled away from officers who had the right and the duty to handcuff him. Or refused to turn his dog over to animal control officers for quarantine. Or allowed his dog to bite other residents of the neighborhood. Rafael Grinage, Luke's father, shouldn't have let his son grow up without any respect for the police, or for human life itself. The city of Oakland shouldn't have tolerated the gradual development of a culture of hatred toward the police.
As a consequence of this toleration, there exists a segment of America's population that has no concept of the rule of law or social order -- it regards the police as an implacable enemy.
The Oakland police department was once noted for its excessive vigor in enforcing the law. (My own father, a public school teacher at Oakland High until his retirement, was once beaten by Oakland police officers at a school board meeting when a peaceful demonstration turned ugly.) Under the prodding of responsible community leaders over the past 25 years, the city has been successful in reforming the police department. Now the department is composed of, for the most part, highly professional officers like Officer Grijalva who serve a cynical community.
Oakland can garner as many awards as its city hall can hold, but it will continue to be racked by violence, drugs and murder unless its elected officials and community leaders stand up and give true support to their police department. Surgeon General Joycelyn Elders has it backward: Violent crime has become the root cause of poverty and economic decline in cities like Oakland, and not the other way around. Oakland -- all of America -- needs to rebuild a culture of civility and social responsibility. And a good place to start is to teach its young people to respect and obey police officers.
Congress is preparing to pass a bill to put an additional 100,000 cops on the street, and Oakland is hoping to get its fair share of them. Let's pray that they meet a better fate than did Officer Grijalva.

I had been a city cop for 8 years when I got pulled over by a rookie Highway Patrolman on our interstate for doing 65 in a 55. When he came up to me, I showed him my badge and he began to lecture me about speeding. I then proceeded to tell him that you either write me a fucking ticket or let me go. Do not lecture me about speeding, especially when the limits went up a week later. That's what you should tell the officer. If you feel you do not need a lecture then advise him of that.

I was in jail on a Domestic Violence charge. The alleged victim was Frau, and the police, the judge, and the prosecutor refused to listen to her.
Six months later, after forced separation from my family, at trial, the judge heard the facts. He proceeded to tell me that the charge was bullshit, and granted the defense motion for acquittal after the government's case in chief. We didn't mount a defense because we didn't have to.
The police officer lied on the stand, he had gone around our small town calling her a whore and me a wife-beater.

A decorated Marine with the 1/5 , an honor guard at the Tomb of the Unknown, and a good cop (gave up a pro football career to be in the Marines and be a cop; Giants scouted him); the sort of cop that patrolled his beat on foot sometimes -- got to know the people, looked out for the law abiding ones.
One day, when he was home for lunch he heard that a neighborhood bank was getting robbed....so he jumped up, grabbed his holster, and took off around the corner to the bank (probably should have waited for back up but he was not the type of person to hang around and wait for back up when he thought his people, his neighborhood was in trouble).
He disrupted the robbery and chased the robbers...and he got shot in the chest. Managed to kill one and wound the other before he died. The suspects were reported to be either members or affiliated with the Black Panthers, based on testimony from the bank patrons and employees...and because of "racial solidarity against the Man" the people in the neighborhood refused to be forthcoming with any tip offs that might have led to their whereabouts.
Some cops are crap, but some aren't -- but thugs and those who would support them? They are always shit.

You know what's a good idea? Allowing and even promoting lack of respect for authority. Do it from childhood up. Take fathers from homes. Mothers get your money from the government. Trot a half dozens boybriends through your home and bed during the formative years of your kids. Don't allow spankings. Let the government take care of it. Don't enforce discepine in schools, either. Its a wonder we don't have more incedents like this.

We have not completely financially recovered.
Don't look for sympathy for a man like that from me, and you are goddamned right that it tars every one of them.

I like that we have them and we need them but they have their share of idiots and crimminals just like the rest of society does. Because I like having them and realize the need I don't automatically trust them.

TIme Traveller - My holster is an older model, and is not a retention holster. Draws quickly without button-push, just like the taser does.
Posted by: Wyatt EarpI use a Blackhawk CQC retention holster, and I can draw quicker than with my old IWB non-retention one.
I also carry a Glock 21, which had only the "Safe Action" safety, which in the heat of the moment means basically no safety at all. Which is why I switched to the CQC... to draw you have to depress the release and the drawing motion automatically places your booger hook along the frame, instead of on the Bang Switch. So you have to make a conscious decision to put it on the trigger.
There's been many times I've seen LEOs with their sidearm and taser on the same side and thought, "That's a recipe for disaster. If I were him/her I'd go cross-draw on the taser and practice 'til I was proficient at drawing it from that position."
It sucks for the cop that he shot the REPEAT OFFENDING SCUMBAG, but the scumbag brought it on himself. I won't shed any tears for him or the family that allowed him to grow up to be a scumbag.
Just so's ya know, I'm not just some Gun Geek spouting off, I'm a former MP Gun Geek spouting off.

SF's ex-mayor Willie Brown opines that BART cops shouldn't carry guns:
My bet is Johannes Mehserle gets involuntary manslaughter in the killing of Oscar Grant. No intent to kill and no real prison time.
The whole case raises the question of why BART cops even carry guns. It's not like they are real police officers out on patrol. They are transit cops.
They aren't going to be in a shootout with anybody. Not on a BART platform, or in a parking lot or in a BART car. Too many people could get hurt if there was a real shootout.
As for any fallout from the verdict: Some people are just going to go off, no matter what the outcome.
I guess Da Mayor never heard of 3/11 in Madrid or 7/7 in London. When the Al Qaeda sleeper cell decides to blow up a BART train smack dab in the middle of the underwater Transbay Tube, the only law enforcement officers who will have any chance of stopping them will be the BART cops. I would rather see them with the arms AND the training to do that job than to think that all they'd be able to do is add to the organic material that becomes fish food in the aftermath.

I have no idea how similar a taser is to the guns the BART cops carry, but in terms of belt placement, I can see how the belt sharing could have caused some confusion in that regard.
Since this incident, BART has loosened the purse strings enough to give each officer his own belt.

Well, I had been thinking that the gay mafia had warned him that he better make sure Clinton kept his promise on gays in the military or they'd out him, and that when the DADT decision came down, he killed himself to avoid being publicly humiliated (ergo the missing page of the suicide note and the commencement speech he gave a few weeks before about the incomparable value of personal honor).
But yours is cute, too.

I like the guy as far as NBA players go, I think he's handled himself pretty well. Going to Miami (if its true) isn't caring about basketball tradition though. It's also a sign of weakness in a way. Top dogs want second bananas on their team, not peers.

Like pulling an 11 year old kid out of Boy Scout line up, calling him a liar and a tent-slasher and a thief in front of 400 kids when he hasn't done a damn thing wrong? Like that?
That was me.
Yeah that wasn't fair. Guess what, life isn't fair. Never was, never will be. It was unfair when my Dad would raise welts on my back, ass and legs with a belt for being afraid of the dark as a little kid. Hit me in the head with my own fist for being a little dyslexic and forgetting the direction a J should face when learning cursive. Beat the hell out of my Mom and Brother. It wasn't fair. You learn to stay out of the way and deal with it untill you can get out. With all that fair stuff out of the way I stand by my sarcastic sumnation before of lack of respect for authority, creating a more dangerous society.
I am not in anyway for Cops shooting unarmed citizens but shit happens. They are in a very dangerous profession. When they f' up they can f' up big. Punish the guy in proportion to the crime. As for Cankles, there was much speculation about her and Foster, and her and her female aide Huma Abedin, and most recently remarks about her being smitten with David Miliband, Britain's last foreign minister before the current one. I imagine that Hillary has been so sex-starved since Chelsea's conception that she'd hump a dead armadillo in the middle of the road -- except that once he saw her coming, even a dead armadillo would find the motive force to run the hell away.

I think it's that revenue generating part that causes the most animosity. I already told the story of my most ridiculous ticket and i'm sure most people have similar tales. It's pretty annoying to be on my commute and see 2 or 3 constable unit speed traps every day knowing there's going to be people who lose their pay for that day (or more depending on how much they make of course) for nothing more than going a few mph over the speed limit. Pile that on top of the taxes people already pay for the roads etc, and it's a wonder there hasn't been an armed uprising.

I was born in Oakland and raised in San Leandro. I lived in Oakland again from the ages of 20 to 28.
The last place we lived, off Oakland Avenue, was up the block from an apartment building that was a known supermarket of illegal drugs. My wife and I got together with some of our neighbors and contacted the police department about forming a neighborhood watch group. Among the various items of useful advice we got from the police sergeant was to purchase a shotgun, not a handgun, so that we didn't send slugs through each others' houses, and to be sure that if we ever shot anyone, they were facing toward the house and were at least halfway inside through the door or window. We left Oakland for good not long afterward, though I've worked in the city at various times since - including now.

Adrenalin shoots your nerves to the sky
Everyone knows this town is gonna blow
And it's all gonna blow right now:.
Now you can smash all the windows that you want
All you really need are some friends and a rock
Throwing a brick never felt so damn good
Smash more glass
Scream with a laugh
And wallow with the crowds
Watch them kicking peoples' ass
But you get to the place
Where the real slavedrivers live
It's walled off by the riot squad
Aiming guns right at your head
So you turn right around
And play right into their hands
And set your own neighbourhood
Burning to the ground instead
[Chorus]
Riot-the unbeatable high
Riot-shoots your nerves to the sky
Riot-playing into their hands
Tomorrow you're homeless
Tonight it's a blast

I didn't get a ticket for riding a bike without a helmet. Kids my age could own a 22 rifle or a pocket knife. Not smoking in the presence of someone that didn't was courtesy not law. Healthy eating habits were determined by your parents not the law. There is a whole lotta stupid being passed by legislators and beauracrats justifying their existence and lining their pockets by doing so. Turning off our brains and goose stepping to the leftards drum is the direction we have been heading since the 60's. I prefer common sense and common courtesy.
Though I owned a knife it wasn't a weapon. It was a tool. I didn't own a knife but knew one kid who did. We weren't afraid of getting shot in school. I've had the misfortune of meeting a lot of bad cops. Don't trust them. But, I still give them respect.
LAPD threw me down once for "fitting a description" as I was walking down the street. Told me if they saw me again, I was going to jail. Got a ticket for going 80 once....had the cruise control pegged at 60. Cop laughed and said he could do whatever he wanted and it would be his word against mine in court. I've had about 30 run-ins with cops (mostly when I was young and thuggy looking), and most were mutually respectful and nothing came of it, but they still stopped me just to perk up their shift.
And, oh yeah, there was the time I got arrested for breaking up a fight in school. Gangbanger punching a young lady in my class. I was charged with "unwanted touching of a minor", an assault. Two years of my life and 25K later, all the charges were dropped.
Oakland cop shot a dude on the floor in the back. If it were my kid, I'd want his hide. He deserves more than a year and a half in jail. Kid had it coming, but that's not the cop's job.

I suspect the transition from "peace officer" to "law enforcement" had some impact, too.

Herr, I'm with you on bad cops. No doubt. Try to be respectful, but without that gun and badge, they wouldn't be needlessly hassling me and their smile would be gone.
Ohio Dan....sounds like we grew up a lot alike. I got some pretty bad burns, even stitches once...foster care, blah, blah, blah, all before I was 10. No sense living in the past, but it does fuck one up in the head. Hard to be normal after that, but I try.
This place is awesome for morons like us. Blazer summed it up best...this place is great therapy, and I'm glad I get to read what you guys put down.

I can't beleive it, but Mayor Dellums and the new Poice Chief Batts are on top of this situation. Effective messaging and communications.
Dellums is extending his willingness to support the famliy if they feel there has not been justice. I hate the idea of getting Eric Holder involved, but you kind of have to see that Dellums must be sympathetic to those that do not feel like justice has been served. The police are respecting freedom of speech and maintaining order.

The question is what do you do in that sort of situation? Do you even care about 'Justice', or do you just hope more of the bad guys get wasted regardless of how it's done?
We of course are not there yet, but we have come a long way from what it used to be. Citizens were once able to control themselves and had no wish or need for government to step in and dictate their lives to them. For how many is that still true?

And no, I'm not honestly saying we're rolling down totalitarian highway
I'd say we're on our damn way. The laws aren't getting any better, either, and the cops will enforce them. In the due course of events the swat teams will be beating your ass on the ground for illegal possession of a large quantity of sodium.
If a conservative is a liberal who got mugged (by a criminal), maybe a libertarian is a conservative who got mugged - by the state.
Just look at Europe - especially the UK.
When it comes to cops, especially the UK. Law Enforcement there does not keep peace, it keeps control. It keeps the peaceful citizens in line, comes down hard on them, and mostly strives to avoid the violent thugs - because unlike taking a nightstick to grandma, those guys are dangerous... and not really a threat to the political structure, so long as the violence isn't directed at the State.

Top Brass has determined that the peaceful protestors are done for the evening and the 300 remaining are not planning on being obedient. Dellums told the senior citizens volunteers to clear out. Chief says they have issued order to dispurse and cops will begin to put the squeeze on. Now dealing with professional anarchists. These dudes still seem to have in under control. Minor stuff only so far.

These same cops who want wiretapping laws to be misinterpreted to prevent citizens from recording them as they perform their official duties in public.
I don't trust the police. Not because I'm a criminal. I've never been in any kind of trouble with the law. It has been at least 15 years since a police officer has even talked to me in an official capacity. I don't trust the police for the simple reason that power corrupts. Many of the people who go into police work are there not to protect the public or ensure that the law is applied as written, but in order to act out a personal power trip. Not all mind you, but enough that I consider the police as a whole to be a necessary evil, just like government in general.

I happen to think that a conviction for involuntary manslaughter is probably just in this case. There is no reason to believe that this cop killed this man intentionally.
The crime he was charged with fits the events that occurred.

For one thing, the gun weighs about 2 times as much.
Also, officers never just pull the taser and fire. They pull it and point it at the perp and issue warnings. This was just another hyped up cop mad with power pissed at a guy that wasn't cooperating.

That's why the agency I retired from mandated that the Taser be on your weak side on the gunbelt. Yes, the cross-draw is not quite ideal but I couldn't mistakenly grab my side-arm.
