March 20, 2010
— Gabriel Malor Since my last count yesterday, Pelosi got Sanford Bishop, Scott Murphy, Suzanne Kosmas, Brad Ellsworth, Allen Boyd, Tom Perriello, Dina Titus and John Boccieri. (Harry Mitchell announced again, but I already counted him in the "yes" group.)
She lost Jason Altmire, John Barrow, Lincoln Davis (officially; he was already headed that way), Peter DeFazio (a surprise from "yes" to "no"), Heath Shuler, and Harry Teague.
So Nancy has 199 "definitely voting yes" congresscritters. She is 17 short of the magic number. There are 214 publicly declared "no" votes. There are 18 undecided/undeclared congressmen left (including Cuellar):
Yes votes in November now undecided:
Tim Bishop (NY-1), Mike Capuano (MA-8 ), Gabrielle Giffords (AZ-8 ), Bill Foster (IL-14), Baron Hill (IN-9), Paul Kanjorski (PA-11), Alan Mollohan (WV-1), Bill Owens (NY-23), Earl Pomeroy (ND-All), Nick Rahall (WV-3), Zack Space (OH-18 ), John Tierney (MA-6).
No votes in November now undecided:
Brian Baird (WA-3), Rick Boucher (VA-9), Jim Matheson (UT-2), Glenn Nye (VA-2), John Tanner (TN-8 ).
Of the maybe's left, I suspect enough have told Pelosi privately that they are voting "no" that she believes she has to peel apart Stupak's bloc to pick up the final handful of votes. That's why all the effort last night. Unfortunately, the Pro-Choice Caucus mutinied and Pelosi is running out of "maybes" to turn.
Stupak bloc of "no" votes remaining:
Bart Stupak (MI-1), Marion Berry (AR-1), Joe Cao (LA-2, Republican), Jerry Costello (IL-12), Henry Cuellar (TX-28 ), Kathy Dahlkemper (PA-3), Joe Donnelly (IN-2), Steve Driehaus (OH-1), Marcy Kaptur (OH-9), Dan Lipinski (IL-3). Cuellar is thought to be "leaning yes", but he's refusing to take the President's phone calls.
My take: Pelosi doesn't have the votes. They did a great job yesterday not letting the panic show. Many believed that something was going to be worked out, and I think something probably was...until the Pro-Choice Caucus put its foot down.
Update (11:44AM): Bill Owens will vote yes. (h/t William Amos.)
So Pelosi has 200. She needs 16. There are 17 maybes left.
Update (11:47AM): Baron Hill will vote yes. (h/t Guy Fawkes). Also, I missed Tim Bishop's announcement yesterday. He's a yes. (h/t Patrick Archibold)
So Pelosi has 202. She needs 14. There are 15 maybes left.
Reminder: it will get closer before this is over. Change your pants and tighten up those sphincters. She'll be closer than 210 before this is over. Doesn't matter if she doesn't get the 216th vote.

I'd be drop dead surprised if Cuellar isn't a yes if it gets that close. One of his offices locked their doors yesterday so letters against HellCare couldn't be delivered.

I chatted with U.S. Rep. Marion Berry this morning. The tide of opinion (Catholic nuns and hospitals, etc.) that Senate health bill language on abortion doesnÂ’t liberalize government policy hasnÂ’t swayed Berry.
“If they don’t take the [anti-abortion] Stupak language, I cannot imagine being able to vote for the bill,” he still says
But Berry dropped a hint or two that an up-down vote on the legislation as now written isnÂ’t the only way this weekÂ’s drama will play out. And he called himself still undecided.

Rep. Henry Cuellar of Laredo says he is still unsure how heÂ’ll cast his vote.
“I want to be sure there are no federal dollars going to be used on abortion,” Cuellar said. “I want to see health care, but I want to be dutiful on making a decision and continue talking to my constituents.”
Cuellar and the other congressmen said they are also concerned with how hospitals would be reimbursed for uninsured patients under the new law.

One of the key undecided members of Congress on health reform, U.S. Rep. Marcy Kaptur (D., Toledo), remained uncommitted yesterday but said she is "leaning" in favor of the bill after getting some personal attention from President Obama and Senate Majority Leader Harry Reid.
"I am leaning toward voting for the bill if we can properly deal with the abortion issue and we are fast about that task," Miss Kaptur said.
A photograph taken yesterday shows both Mr. Obama and Mr. Reid (D., Nevada) with hands on Miss Kaptur's shoulders while they were all at a signing ceremony at the White House for a newly passed jobs bill, an unrelated measure.
"[The President] just greeted me, said hello. He gave me a kiss on the left cheek," Miss Kaptur said.

U.S. Rep. Jerry Costello, D-Belleville, was still on record as of Thursday that he will vote no on the Senate version of the health care reform bill the House is set to vote on this weekend.
But observers familiar with Costello and congressional deal-making said his opposition likely stems from an effort to wring concessions from House Speaker Nancy Pelosi and President Barack Obama.
These observers expressed confidence that Costello will ultimately vote yes on a measure that has become the No. 1 issue for his party's top leaders.

Totally OT, but in yesterday's headlines, there was an article about a young blogger whose husband died over in Afghanistan. They have a brand new baby, and the wife had just started a sock drive to send new socks over to the troops in Afghanistan.
They have a fund set up for their daughter in lieu of flowers, if anyone is interested in honoring this Marine's life. He had just turned 26, and his wife is only 23. It's just so sad; we sometimes forget how young all of the kids are who are defending this great country of ours.
Here's a link to her blog, with information about where to send donations for their daughter, as well as information about "Semper Socks":

I don't think an Obama executive order saying no funds can be used for abortion would hold up in court. Such a move will just create an open and shut case for any plaintiff to sue the President. The court will read the law. The Senate Bill won't have restrictions on prohibiting funds for abortion. Plaintiff wins. Funds flow.

Pelosi says there will be no separate votes on abortion, and that she will have votes for passage when she comes to the floor.
UPDATE: Reps. Driehaus (D., Ohio) and Dahlkemper (D., Penn.), two Stu-Packers, just went into Pelosi's office. Of the meeting, Dahlkemper says "we're still working on it."

The Democrats have no decency and are succeeding in turning this country into a banana republic. To me, this descent accelerated in 2000 when they made a mockery of our election process by portraying the process and the winning candidate as illegitimate to the country and the rest of the world. Every close election since then in which the results were close has resulted in them finding and manufacturing votes, which has hurt everyone's belief in the true results of close elections. It's certainly hurt our country's moral standing to the point where our system looks corrupt and the country no longer look like the beacon of democracy. The way the Democrats are trying to pass this health care bill, with the payoffs and manipulations, is perhaps the most egregious example of their unethical win-at-all-costs mentality, which is destroying the country. It makes me sick to my stomach what they've done -- and what they plan to do -- to this country.

If Obama does an Executive Order it will be to clarify that the Hyde Amendment applies. Well, we already knew that.
They're screeching over at Kos. A sample:
@Obama if Stupak wins you #fail
If you stab the women of the United States in the back, I'll never:
forgive you support you again support anyone who calls themselves a "Democrat" againYour choice.
Get a backbone and make the right decision.
Another:
Obama's clear inability to engage in the rough-and-tumble of governance at the national level, as opposed to the pretty-boy showtime of giving speeches in front of adoring audiences.
He's not campaigning any more.
As he seems to have forgotten, he won.
It's way past time for him to roll his sleeves up and get dirty.
Or is he afraid to?
And if he's afraid (as I think he is) what is he afraid of, exactly?

What if they try this shenanigans?:
1) Twist enough arms that a deem-and-pass can get 216+ votes.
2) Pass it, which by definition (theoretically) passes both the Senate bill that was passed on Christmas Eve, and a "fixes" package that would then be sent to the Senate.
3) Granny Rictus McBotox stuffs the "fixes" package in her handbag and promptly forgets about it.
4) Granny Rictus sends the Senate bill to Teh Won, because it did "pass the House."
5) He signs a bill that passed the Senate on 12-24, and "passed the House" on 3-21.
6) Forget that "fixes" package, it's not needed anymore.

What I find is the "my mind is made up, don't confuse me with facts" attitude. They know the talking points, they've gotten twelve emails this week alone with all kinds of instructions and with all kinds of things to do to remind their reps and their friends and neighbors that BO's presidency depends on this and that "we want this". yet, when you can argue with them long enough to get passed the talking points, they are empty shells, they don't know or refuse to acknowledge that you have given them a fact that does not jive with their small view of the situation. They then resort to name calling and saying you are brainwashed or a bigot.
Their main thing, that they keep repeating is that "we have to do this for ba rock, for his presidency to matter, we can't let him down." In the absence of a good debate, how does one deal with that kind of blind adulation.
