Year in Review: The Lawless Obama Administration
— Gabriel Malor

Over the weekend, actually on Christmas, the NYTimes published an article about the President's plans to go ahead with end-of-life advisory incentives even after Congress removed it from ObamaCare after massive public outcry. Ed says "better get used to this process" since it's how the President is going to get around the GOP House for the next two years.

In fact, the end run around Congress has been a regular feature of the Obama Presidency and it's been getting more frequent over time. He wanted Cap & Tax, Congress rejected it. Lo-and-behold the EPA, under Obama's direction, will do it anyway via regulation. He wanted Card Check and other pro-union laws; Congress rejected them and rejected his pro-union NLRB nominee, Craig Becker. Surprise! He recess-appointed Becker, who has been issuing pro-union regulatory decisions.

His executive fiat was also rejected this year by the courts. Both houses of Congress approved offshore drilling in a bill signed by Bush 43. Obama used the Interior Department to put a halt to it by regulation . . . until the courts found the regulations "arbitrary and capricious." That's legalese for "lawless." Both houses of Congress approved the Yucca Mountain nuclear waste project in a bill signed by President Reagan. The legislation specifically prohibited future presidents from halting the project. That didn't stop Obama's Interior Department from pulling the plug last year. The courts stepped in again and found that it was indeed arbitrary and capricious for Obama to contravene the directly expressed wishes of Congress.

Most recently we've seen the same process at work at the FCC. First Congress rejected net neutrality. Then the DC Circuit did. That didn't stop Obama's FCC from proposing new net neutrality rules this past month.

Obama uses his control over Executive Branch agencies to do what Congress or the courts have forbidden. It's worked, sometimes, for him over the past few years. But he's out of time now: the GOP-led House can defund many of these efforts, even if it can't put a stop to them completely.

Thing to Look Forward to in the New Year: Watch as the Left repositions itself to yell "Obstruction!" every time the House fails to pass more appropriations for Obama's lawless agency action.

Even though Obama supposedly has banned the word "triangulation", the question for 2011 is going to be, can the president triangualte successfully against Congress, while Harry Reid and Chuckie Schumer are still running half of Congress?

The voters threw Pelosi out for a reason, and the Democrats and the big media folks are going to try and make it seem as though Obama's all that stands between the Republic and some sort of John Boehner-led corporate fascist nightmare. But can you get the moderates to believe that if none of the House Republican efforts ever make it to the president's desk to sign, because Obama still has the Democrat-run Senate to block any major reform legislation?

5 I am not an expert strategist,  but I think the House should probably pass a revocation of Obamacare ASAP,  so that when Reid refuses to bring it up they can keep asking about it.

You have to put the democrats on defense immediately,  I think.

Second priority should be defunding the EPA.

i saw a great link from either HA or Instapundit about hunters in america and their sheer numbers.

The article started off talking about how hunting season in Wisconsin had seen some 600,000 hunters and not one death related to hunting.

Well the author went on to point out, that if those hunters, in Wisconsin, got together, they would be the 8th largest stadning army in the world.

He then pointed out that if you added Pennsylvania(750,000), West Virgina(250,000), and Michigan(700,000)  you have the largest standing army in the world.

Imagine if you included Oklahoma, Texas and the rest of the south and midwest.

56 Gabe, you are one of the most impressive contributors to Ace's Little Blog. I truly learn something from just about everything you post.

I did not expect the Michael Moore's and Soros' of the world to yell "Nazism!" when Obama decided to actually do what they falsely accused Bush of doing. It has always been a given that the liberal loons have no clue what "hypocrisy" means. If they honored consistency, they wouldn't be liberals.

My question is this --- why should we as conservatives fear if they DO yell "obstructionists"?  Isn't that why the conservatives displaced the Democrats to begin with?  Voters, for the most part, woke up to what Obama and his minions wanted to do and reacted accordingly. They didn't say to themselves, "Let's elect more Democrats to put a check on this guy!"

So, if I were the GOP I would stand in front of the camera when they start shouting "obstructionists" (and eventually "RAAAACISTS!" (credit: Michelle Malkin)) and proudly accept that label. Nothing we do will ever sway the left wing loons but they form only a small part of the electorate. The US is still largely a conservative country and with the upcoming redistricting process favoring the GOP and under the control of the GOP in many important places, the US will remain so. We only have to stop the Puss Belt from having so much influence on future elections and we do that by standing up and proudly displaying our brand name.

"We're tired of sorry socialists and we're not gonna take it anymore!"

In other words, let's develop the attitude that we own as much of the communication as the liberals and stand up and be counted for what we are, not for what they hope to paint us. We should never be ashamed of explaining WHY we oppose socialist crap no matter how Obama tries to package it.

Reaching across the aisle didn't get us very far, Gabe. There's a reason why.
