11th Circuit Court Of Appeals Rules ObmaCare Individual Mandate Unconstitutional
— DrewM

flaming_skull2a.gif

Boom!

"...we conclude that the individual mandate contained in the Act exceeds CongressÂ’s enumerated commerce power."

Gabe says this is the multi-state lawsuit.

Apparently they didn't overturn the whole law but without the mandate, the whole scheme collapses. Of course, it's going to the Supreme Court but it's good to be going with at least one win.

More:

The case stems from a challenge by 26 U.S. states which had argued the individual mandate, set to go into effect in 2014, was unconstitutional because Congress could not force Americans to buy health insurance or face the prospect of a penalty.

"This economic mandate represents a wholly novel and potentially unbounded assertion of congressional authority: the ability to compel Americans to purchase an expensive health insurance product they have elected not to buy, and to make them re-purchase that insurance product every month for their entire lives," a divided three-judge panel said.

2 of the 3 judges in the case were appointed by Democrats so that talking point bites the dust.

The 6th Circuit has rulled in favor of the law and the 4th still has a case outstanding. Off to SCOTUS we go!

5 Onward towards the inevitable 5-4 (or 5-3 if Kagan does the right thing) clusterfuck at the Supreme Court to come ... although, if Kagan does recuse, we'll prevail even if Kennedy bails because a 4-4 split would keep the 11th Circuit in force.  Hmm ... did we just win?  Nah, Kagan won't do the right thing even though she's clearly legally conflicted.  And a liar.  There, I said it.

Umm... at least two, yes?  Or is this the FL suit, and the whole circuit is ruling on it?  If so- since the Judge who determined that case struck down the whole mandate, aren't they just either upholding or denying his ruling?  In which case, wouldn't they be affirming that the whole thing is unconstitutional?

Not a lawyer, but I did stay at a Motel 6 once. Yes, without a severability clause the whole thing comes a tumbling down. That is unless the philosophy of social justice is applied and then severability becomes a "whitey" word for punishing colored folks. So next stop the Supremes, where we find out whether the Supremes are a group of jurists or a singing team with soul. "Set Me Free Why Don't You Babe - You Just Keep Me Hanging On"

Not just an act of random vandalism, they were planning on entering. The Castle Doctrine law here in Maryland is very weak and really has no teeth so we'd be the ones going to jail for being over protective of our home. The perp was caught, we have a court date, I'm just waiting to go testify. The Victim Advocate called this morning to advise me to come up with a Victim Impact statement...that's what I need help with. I've NEVER identified with being a victim. So when you see programs being cut or entitlement checks without COLAs...I want you to think of me."

I do sex crimes almost exclusively and I do not like the use of the term "victim."  I prefer "complaining witness."  I don't think labeling someone as a victim helps with their recovery and the recovery of their self esteem, emotional health etc.  Regardless the word "victim" is used repeatedly in the statutes so it looks like its here to stay.  In the victim impact statement, they are primarily interested in any financial loss that you incurred, any emotional or nontangible loss that you incurred (for which you will not be compensated), and what type of punishment you think would be just in the instant case.  If you have decided to move out of state because of this incident, I think that it is fine that you tell them so.  I suspect that the judge will interpret this as less pressure on him to impose a punitive sanction since 1) the problem is taken care of if you leave and 2) you won't be around to look over his shoulder.  In all likelihood, the VIS will be seen by the DA, the judge, the defendant and his counsel, the drafter of the presentence report, and very few others.

206 11th Circuit Court Of Appeals Rules ObmaCare Individual Mandate Unconstitutional
Merely a flesh wound.

Posted by: Barky the Black Knight at August 12, 2011 10:32 AM (BkQvr)

207 The individual mandate, however, can be severed from the remainder of the ActÂ’s myriad reforms. The presumption of severability is rooted in notions of judicial restraint and respect for the separation of powers in our constitutional system. The ActÂ’s other provisions remain legally operative after the mandateÂ’s excision, and the high burden needed under Supreme Court precedent to rebut the presumption of severability has not been met.

211 "has ignored the undeniable fact that Congress' commerce power has grown exponentially over the past two centuries and is now generally accepted as having afforded Congress the authority to create rules regulating large areas of our national economy," Marcus wrote.

So original intent means nothing when faced with the "accepted" power's of congress?

Judge Marcus.

Since the Constitutional limitations of government are meant to protect a political minority, since, a political majority needs no such protection, how, does such a political minority express that they do not "accept" a general expansion of Congressional power beyond original intent given that the ballot box offers no relief for a violation of rights directed at a political minority?

If you will not stand and defend the rights of persons who do not want to expand the powers of Congress without Constitutional amendment, how are you forcing them to act in order their rights be protected as is their God given right?

Marcus, you are a tyrant Judge worthy of a monarchs rule. When you allow powers of Congress to expand without a proper lawful expansion under the Constitution you authorize government power without end without due protection to the rights of the minority. You have yelled at the top of your lungs "We do not care what you want or say, we will take your rights as matter of course, as *tolerated* by the majority"

In this way you continually abuse authority and usurp rights, so then you run squarely afoul of these words, the very basis of your Juris Dicta...Ass

"But when a long train of abuses and usurpations, pursuing invariably the same object evinces a design to reduce them under absolute despotism, it is their right, it is their duty, to throw off such government, and to provide new guards for their future security."

72 Hi Morons~

Little off topic but poking liberalism in the eye so...I'd like some help here.

While back, a group of teenagers broke out our garage window.

The direction I'd like to go in is this-"Hey, we sold the house and are moving out of state and taking our tax $$s with us (which is a considerable amount). So when you see programs being cut or entitlement checks without COLAs...I want you to think of me."

Any ideas?

I'm pretty sure I remember seeing your Mercedies Benz in that garage. You know.... the one that's missing now? And it had a Nikon camera system with ALL the lenses setting in the front seat before that window was busted too. And some expensive Nikes. And some guns and some jewelry....that's all missing now isn't it? I'm sure I saw it there....didn't I???

If so- since the Judge who determined that case struck down the whole mandate, aren't they just either upholding or denying his ruling? "WASHINGTON (AP) -- More than a dozen trade unions plan to sit out the 2012 Democratic convention because of their anger over the site of the meeting in a right-to-work state and their frustration over Democrats' struggles to create jobs.

If unions don't participate, it would deprive the party of millions of dollars that would have been spent on sky boxes and other sponsorships that usually help underwrite the convention. The move could pose a larger problem for President Barack Obama next year if an increasingly dispirited base of labor activists becomes so discouraged that it doesn't get the rank-and-file to the polls in its usual strong numbers."

Gosh, that's be a shame if there was a goon shortage come election day.

Just for the books, does anyone have any guess as to how much it cost the US to have the federal government spend almost all of its time, for well over a year, to pass one shitty piece of legislation that throws everyone into total confusion over what is happening and then takes another few years of massive work and court cases and votes and such to finally repeal/have ruled "obviously and trivially un-Constitutional" and kill?

BTW, the whole GOP leadership is celebrating this decision more than anyone else, since they have been counting on the court to do their job of getting rid of this amazingly un-American, stupid, wasteful, commie health takeover and feral government expansion.  If left to the GOP, ObamaCare would be with us forever.

420 Unions are learning a lesson the social conservatives learned the hard way.  If you behave in a way that makes you radioactive to the public no matter how much the party needs you, you will still end hidden off on the sidelines.

I pity the people who believe that the GOP would 'win' if social issues went away.Posted by: Bevel Lemelisk"

I know 2-3 sentences by strangers in internet text are a terrible way to discuss big things.  I didn't say they did the same behavior only that in terms of cultural acceptance they are similarly helping to dig their own hole.   Though I know theire are many around, I am not one of those people who think we would be better without social conservatives.  In fact I would say I agree/sympathetic with social conservatives about half the time, and most of the time I disagree its only from a what should government outlaw.. not what is morally wrong position.

I also don't think you would argue that social conservatives have over the years had a number of flawed messengers and have struggled with a "brand" problem.  Sure the media tried to destroy them but their missteps often made the medias job like T-ball.

I think a great example, the old way religious conservatives handled abortion versus the newer way.  Their smarter handling of it has helped the country away from lefts abortion on demand positions over the last half century.  How many social issues can you say the country has become more conservative on in the last decades?  Think of the movie Juno being written by lefties in the 60-70-80- even the 90's?  Yet there it was shown in 07 without much noise from even leftists.

Like my original point, Unions will probably either disappear or learn similar lessons.  It all reminds me of that old book "who moved my cheese."

I haven't been blogging much; working as Social Media geek for a start-up (two person) publishing company.  But have a co-blogger there who posts about once a week and does great work.

471 Hmmmm. Lets see...  I don't remember  Josef Salon Stalin having a constitution.  Let see..  I don't remember Pol Pot having one either.  Chairman Mao didn't have one .   Then there is Fidel Castro.  He didn't have one either.  Nope.  Socialist Progressives don't have those things.  Why would any one think Chairman Obama has one either.  Hope and Change down your freakin throat.

From The Corner comments section:

Rush just had an interesting point. ObamaCare was passed by the Senate as a budget reconciliation, not as a regular bill. Under the rules of budget reconciliation, a bill cannot have a significant impact on the budget. The mandate was how they got ObamaCare to be scored as revenue neutral by the CBO.

Without the mandate, ObamaCare is no longer budget neutral.

I'd be very surprised if the courts would rule that the bill was not properly passed, since reconciliation is a Senate rule and the court has a long history of staying out of such fights.

On the other hand, under the rules of reconciliation, a bill that is not revenue neutral must expire in 7 years. (That's why the Bush tax cuts had to be renewed.)

If the SC does strike down the mandate but leave the rest of the bill intact, would that mean that ObamaCare must expire in 7 years unless it is renewed?

475 494 Harles cay ohnson jay?

You know I've always wondered about that with Pig Latin.  I know the standard is to take away the first letter, but since that rule doesn't apply to words beginning with vowels would ch-,th- and sh- require a special rule as well?  So instead of Harles cay, wouldn't you actually want to go with Arles chay?

477 If the SC does strike down the mandate but leave the rest of the bill intact, would that mean that ObamaCare must expire in 7 years unless it is renewed?

I asked the same basic question above, and from what I've heard, it appears the bill would have to go back to the House to fix that issue.  No idea what happens if the House says, "not interested".
