Gabe says this is the multi-state lawsuit.
Apparently they didn't overturn the whole law but without the mandate, the whole scheme collapses. Of course, it's going to the Supreme Court but it's good to be going with at least one win.
The case stems from a challenge by 26 U.S. states which had argued the individual mandate, set to go into effect in 2014, was unconstitutional because Congress could not force Americans to buy health insurance or face the prospect of a penalty."This economic mandate represents a wholly novel and potentially unbounded assertion of congressional authority: the ability to compel Americans to purchase an expensive health insurance product they have elected not to buy, and to make them re-purchase that insurance product every month for their entire lives," a divided three-judge panel said.
2 of the 3 judges in the case were appointed by Democrats so that talking point bites the dust.
The 6th Circuit has rulled in favor of the law and the 4th still has a case outstanding. Off to SCOTUS we go!

Umm... at least two, yes? Or is this the FL suit, and the whole circuit is ruling on it? If so- since the Judge who determined that case struck down the whole mandate, aren't they just either upholding or denying his ruling? In which case, wouldn't they be affirming that the whole thing is unconstitutional?

It all unravels without the mandate because that was what got the insurance companies to go along with the rest of the crap - they cannot afford to cover all preexisting conditions, cover kids up to age 26, etc. unless they get this big new pool of customers who are mostly healthy.
Of course, if Obama is reelected, the fix for this is a public option.

Wasn't this the appeal of Vinson's ruling that struck down all of Obamacare, not just the individual mandate? If so, this is actually a defeat for the arch conservatives, because there's no longer any court ruling that strikes down the whole law.

I've NEVER identified with being a victim. The direction I'd like to go in is this-"Hey, we sold the house and are moving out of state and taking our tax $$s with us (which is a considerable amount). I do sex crimes almost exclusively and I do not like the use of the term "victim." I prefer "complaining witness." I don't think labeling someone as a victim helps with their recovery and the recovery of their self esteem, emotional health etc. Regardless the word "victim" is used repeatedly in the statutes so it looks like its here to stay. In the victim impact statement, they are primarily interested in any financial loss that you incurred, any emotional or nontangible loss that you incurred (for which you will not be compensated), and what type of punishment you think would be just in the instant case. If you have decided to move out of state because of this incident, I think that it is fine that you tell them so. I suspect that the judge will interpret this as less pressure on him to impose a punitive sanction since 1) the problem is taken care of if you leave and 2) you won't be around to look over his shoulder. In all likelihood, the VIS will be seen by the DA, the judge, the defendant and his counsel, the drafter of the presentence report, and very few others.

Little off topic but poking liberalism in the eye so...I'd like some help here.
While back, a group of teenagers broke out our garage window. Not just an act of random vandalism, they were planning on entering. The Castle Doctrine law here in Maryland is very weak and really has no teeth so we'd be the ones going to jail for being over protective of our home. The perp was caught, we have a court date, I'm just waiting to go testify. The Victim Advocate called this morning to advise me to come up with a Victim Impact statement...that's what I need help with.
I've NEVER identified with being a victim. The direction I'd like to go in is this-"Hey, we sold the house and are moving out of state and taking our tax $$s with us (which is a considerable amount). So when you see programs being cut or entitlement checks without COLAs...I want you to think of me."
Any ideas?

I'm having a hard time with the ruling that the individual mandate was severable. Not only was there no severability clause, but unless I'm mistaken the feds have been arguing until they're blue in the face that if the individual mandate is overturned, the rest of the legislation goes down with it (as if that were a bad thing). I'll have to read the opinion to see how they got there. Not the ruling that I'd hoped for, but it beats another ruling that the mandate is constitutional.

As I see it *IF* the SCOTUS repeals the entire Obamacare as unconstitutional, that means Barky's entire legacy will be reduced to "He got OBL" as his single accomplishment valid as a liberal talking point. Even the liberals aren't happy about the "stimulus" package these days as every time it's brought up they can't name a single thing it's funded but they keep getting punked over individual graft and itemized spending involved (IE: 350 jobs paying $40K being created at $2M each.) So the sum of his accomplishments will come down to "he got OBL and he made Jimmeh Cahter feel a LOT better about his presidency."

BTW, the whole GOP leadership is celebrating this decision more than anyone else, since they have been counting on the court to do their job of getting rid of this amazingly un-American, stupid, wasteful, commie health takeover and feral government expansion. I know 2-3 sentences by strangers in internet text are a terrible way to discuss big things. I didn't say they did the same behavior only that in terms of cultural acceptance they are similarly helping to dig their own hole. Though I know theire are many around, I am not one of those people who think we would be better without social conservatives. In fact I would say I agree/sympathetic with social conservatives about half the time, and most of the time I disagree its only from a what should government outlaw.. not what is morally wrong position.
I also don't think you would argue that social conservatives have over the years had a number of flawed messengers and have struggled with a "brand" problem. Sure the media tried to destroy them but their missteps often made the medias job like T-ball.
I think a great example, the old way religious conservatives handled abortion versus the newer way. Their smarter handling of it has helped the country away from lefts abortion on demand positions over the last half century. How many social issues can you say the country has become more conservative on in the last decades? Think of the movie Juno being written by lefties in the 60-70-80- even the 90's? Yet there it was shown in 07 without much noise from even leftists.
Like my original point, Unions will probably either disappear or learn similar lessons. It all reminds me of that old book "who moved my cheese."

Rush just had an interesting point. ObamaCare was passed by the Senate as a budget reconciliation, not as a regular bill. Under the rules of budget reconciliation, a bill cannot have a significant impact on the budget. The mandate was how they got ObamaCare to be scored as revenue neutral by the CBO.
Without the mandate, ObamaCare is no longer budget neutral.
I'd be very surprised if the courts would rule that the bill was not properly passed, since reconciliation is a Senate rule and the court has a long history of staying out of such fights.
On the other hand, under the rules of reconciliation, a bill that is not revenue neutral must expire in 7 years. (That's why the Bush tax cuts had to be renewed.)
If the SC does strike down the mandate but leave the rest of the bill intact, would that mean that ObamaCare must expire in 7 years unless it is renewed?

You know I've always wondered about that with Pig Latin. I know the standard is to take away the first letter, but since that rule doesn't apply to words beginning with vowels would ch-,th- and sh- require a special rule as well? So instead of Harles cay, wouldn't you actually want to go with Arles chay?

I asked the same basic question above, and from what I've heard, it appears the bill would have to go back to the House to fix that issue. No idea what happens if the House says, "not interested".
