Afternoon Open Thread
— DrewM

Sean Payton is suspended for the season by the NFL over "Bountygate" and Tim Tebow is now a NY Jet.

Related: The Mayans emailed to say, "We told you so".

Oh and a top Romney adviser said something really, really dumb today. And that's all I'll say about that.

I am all torn.  I don't want to see Manning get hurt, at least not seriously (ankle sprain or something is fine) but as a Browns fan I desperately want to point and laugh.  A lot.  All of the pointing and laughing.  So torn.

That EPA ruling is actually a big honking deal.  I'll need to read it but the main issue was that there was no practical way to appeal an administrative ruling to a court.  If the draconian fines for non-compliance while appealing were struck down, that has major implications for all administrative law.

CHICAGO (CBS) — It seems you can’t have an election in Illinois, without a few bizarre problems.

And TuesdayÂ’s primary did not disappoint.

CBS 2 Investigator Pam Zekman reports from the Cook County ClerkÂ’s office, that there were some problems and the City Of Chicago did have some issues.

Once again, there were drunk judges, two of them, and one had to be taken to the hospital.

Another judge was ordered to stop selling candy to voters. Also, there are unconfirmed reports of vote fraud in the 22nd Ward, where some Democratic voters may have been given Republican ballots.

24 Kind of saw Payton's suspension coming - it was a dick move to institute the program.  Anyone starting a pool as to how many games Manning lasts before a good hit sends him down for the season?

It'll be interesting to see how Tebow is received by New Yorkers. I suspect his Tebowing will send some hard-core NYC libs into conniptions.   Most probably weren't hard-core fans, so it might have escaped their notice before.   But now, they'll have to deal with it. Can't wait - he seems like the real deal, and I hope he can continue to resist the temptations of fame and everyone telling him how wonderful he is.   It sounds like he had good folks who raised him right, so I'm hoping he proves the exception to the rule.

Wow, alexthechick, that's pretty impressive!

Well, it's not like I did it or anything.  It does have a pretty big impact on how I view the NFL though.  He wound up a pretty major drug addict due to the whole let's shoot the players up with morphine and send them back into the game thing.  It's hard for me to separate out viewing claims by former players for injuries from the perspective of knowing someone whose life went to hell in part due to playing from a more philosophical/legalistic approach to taking on known risks and the like.

The one thing it did leave me with as a deeply held view that the NFL owners and commissioner, whoever he may be, are utter dicks.  That one I don't really try to get over.

117 The Schwabe frequency band of the Zurich sunspot record since 1749 is found to be made of three major cycles with periods of about 9.98, 10.9 and 11.86 years. The side frequencies appear to be closely related to the spring tidal period of Jupiter and Saturn (range between 9.5 and 10.5 years, and median 9.93 years) and to the tidal sidereal period of Jupiter (about 11.86 years). The central cycle may be associated to a quasi-11-year solar dynamo cycle that appears to be approximately synchronized to the average of the two planetary frequencies. A simplified harmonic constituent model based on the above two planetary tidal frequencies and on the exact dates of Jupiter and Saturn planetary tidal phases, plus a theoretically deduced 10.87-year central cycle reveals complex quasi-periodic interference/beat patterns. The major beat periods occur at about 115, 61 and 130 years, plus a quasi-millennial large beat cycle around 983 years.
Finally, the harmonic model herein proposed reconstructs the prolonged solar minima that occurred during 1900–1920 and 1960–1980 and the secular solar maxima around 1870–1890, 1940–1950 and 1995–2005 and a secular upward trending during the 20th century: this modulated trending agrees well with some solar proxy model, with the ACRIM TSI satellite composite and with the global surface temperature modulation since 1850. The model forecasts a new prolonged solar minimum during 2020–2045, which would be produced by the minima of both the 61 and 115-year reconstructed cycles. Finally, the model predicts that during low solar activity periods, the solar cycle length tends to be longer, as some researchers have claimed.

136 Time to GTFO:  (From GP link to NYT):

The Americans in Afghanistan are “demons.”

They claim they burned Korans by mistake, but really those were “Satanic acts that will never be forgiven by apologies.”

The massacre of 16 Afghan children, women and men by an American soldier “was not the first incident, indeed it was the 100th, the 200th and 500th incident.”

Such harsh talk may sound as if it comes from the Taliban, but those are all remarks either made personally by the United StatesÂ’ increasingly hostile ally here, President Hamid Karzai, or issued by his office in recent days and weeks.

The strongest such outburst came Friday. “Let’s pray for God to rescue us from these two demons,” Mr. Karzai said, apparently holding back tears at a meeting with relatives of the massacre victims, and clearly referring to the United States and the Taliban in the same breath. “There are two demons in our country now.”

Don't you wish you two were the types that the other girls would tell that they had toilet paper on their shoe or hanging from their dress or pants?

194 Roger Goodell is a stuttering clusterfuck of a miserable failure. The saints should've actually cheated since they are basically getting the death penalty for paying players to do their jobs. I look forward to the nfl suing ESPN, and themselves, for glorifying big hits and layouts.

195 My, my, my... Garrett, we'll have playoff threads for hockey, and if there are any really tight races for the last spots, we'll see what we can do about those as well. Anyway... Many of you read my post about BountyGate, and I think these are fair punishments for the Saints. The only thing I'd point out is that fining a team half a million just means the wives don't get purses this year. You want to hurt a team? Have real fines count against the salary cap. With the Saints in particular, they're right up against the cap. Of course, if you're a Redskins or Cowboys fan, you're already getting ass-hammered by the league over fairly dubious stuff. The Saints now have ten days to wrap up the Drew Brees negotiatons (before Payton and Loomis begin their suspensions), so the player suspensions are hopefully not too far behind in being announced. The Saints will have to move some money around to make this work, and there are a few names on the chopping block. One would figure that either Pete Carmichael (the offensive coordinator) or Steve Spagnuolo (the defensive coordinator) will be the interim head coach for the year. And then there's my former schoolmate, Peyton Manning. I think he's out of his fucking mind to go back in at this point- he's one bad hit away from something seriously awful, and he and his wife just had twins recently. I don't know what his X-rays look like, and I'm certainly no neurologist, but this is the same guy who said all these lofty things about there being more to life than football as he was leaving Knoxville. He and I were not, are not, and are not ever going to be friends, but I pray for his safety. And, finally, Tebow... I always thought John Fox was a really classy guy in Carolina, but I now officially despise John Elway. I can appreciate the fact that Tebow would be a long-term developmental project, and I can equally appreciate that Manning instantly makes the team better on paper, but not keeping Tebow in the loop on what the plan was was beyond shitty. Given the fact that the kid has been a good troop all year, he deserved better than that. If my Saints kick the living shit out of them this season, I will savor it. Good luck to Tebow with the Jets.

230 I'm not a big New Orleans fan but I don't think any city deserves the kind of scandle that would erase their SuperBowl victory with the shame that their franchise did. The fans of that city have a right to throw the entire franchise and their owners out. It won't happen, but the people involved deserve it. Someone from the NFL should have to explain to the "Big Easy's" fans that a $500,000 fine is a "just penalty" for the damage their actions have done to the franchise and the Cities' image going forward. Throwing a couple of token coaches out of the league for a year or two doesn't cut it. Every team N.O. beat that year got shafted by one team that didn't play by the rules and penalizing the team with loss of future draft picks doesn't penalize the people who commited the crime as much as the fans that WOULD have stayed with the franchise.

238 Yeah, etch-a-sketch thing is a "meh" story.   Primary season you deal with politically active, partisan voters.

General election you now deal with all the "low-information" voters who have not been paying attention to the primaries.   Chances are they don't know and don't care about this "etch-a-sketch" story right now.   If you try to bring it back up 3 months later, these voters are going to care a tad more about current events.  (Like 9+% unemployment and $4+ gas)

Party primary is a different game than the general election, and candidates do get a fresh start.

The SCOTUS decision is a really big one and is it fabulous that it is 9-0.  My husband is a lawyer who has handled a lot of Clean Water Act cases and used to work for EPA.  The wetlands compliance orders are big and nasty for a reason, the EPA threatens gigantic fines in order to get mostly corporate landowners to comply quickly.  This case had the worst possible facts for EPA to justify this policy.  The decision hurts EPA badly because now anyone who gets a compliance order can immediately go to court and challenge it, and the fines are estopped while the matter is litigated.  So the EPA no longer has ther hammer of huge possible fines to force companies to comply.

What was really indefensible in this case is that the EPA claimed that property owners have no right under the Clean Water Act to appeal a finding by EPA that their propertyy is a wetland.  The Court found this preposterous.  Be sure to read Justice Alito's concurring opinion, he calls on Congerss to fix this appalling gap in the CWA.

250 The Supreme Court on Wednesday unanimously ruled for an Idaho couple who have been in a four-year battle with the Environmental Protection Agency over the governmentÂ’s claim that the land on which they plan to build a home contains sensitive wetlands.

The Court stressed that it was not deciding whether Michael and Chantell Sackett will win their court case, but only that they had a right to file it at their choosing, now that the EPA “compliance order” is final. The decision reflected the strongly negative reaction most of the Justices had to the denial of a right to sue when this case was argued in January. Justice Samuel A. Alito, Jr., who was among those protesting most strongly at that hearing, wrote a separate opinion Wednesday complaining that the scope of the Clean Water Act’s application to private property is unclear, and Congress or the EPA should move to clarify it. Alito also argued that the treatment of the Sacketts, and others denied a right to sue EPA, was “unthinkable” in a country that values due process.
