— Dave in Texas At first glance it appears to be a hit on Obama about his failure to deliver on closing Guantanamo. But the WaPo piece merely offers cover, dutifully so. It was the fault of the Congress, it was the popular fear of harboring terrorists on American soil (the stupidest claim ever).
Still, it calls him inept, so I can live with it.
For more than two years, the White House’s plans had been undermined by political miscalculations, confusion and timidity in the face of mounting congressional opposition, according to some inside the administration as well as on Capitol Hill. Indeed, the failed effort to close Guantanamo was reflective of the aspects of Obama’s leadership style that continue to distress his liberal base — a willingness to allow room for compromise and a passivity that at times permits opponents to set the agenda.
It's just too fine a legal point to explain the rights conferred upon Gitmo detainees upon entering our court system, and why this weakens the chance of conviction.
Obama simply miscalculated out of pure, stupid ignorance, that somehow he could take a campaign talking point, turn it into a Presidential edict, and show the country how the moron Bush had mucked it all up.
In the end it was merely a "vote for me because I'm not George Bush" talking point. When the rubber met the road, the boy-President found out some things are not so easily trumped by his "soaring rhetoric". His team warned him that the public by and large did not give a rats ass about Gitmo detainees, and he'd pay a heavy political price for loving on them. In the end he decided not to take that hit, blame others for his fecklessness, and move on to the next pretty colored balloon.
Idiot.

One more time: They are not smart.
They are not.
First, they never have solved any problems. That is not what law school is all about -- especially at the Ivys. It's about getting into the circles of power and gaming the system.
Second, it ain't math. There isn't any concept in law school that is too difficult for the layman to understand.
Third, even if they were smart, they aren't that smart. This is Hayek's fatal conceit. Nobody is smart enough to manage economies or climates or any sufficiently complicated system. Try to solve an open mathematics problem and you start to realize how simple you have to make it in order to solve it with any degree of precision.

From the accounts I've read, He (She) walked into the women's restroom. I'm not excusing those girls whopping on him or the people taping it and/or standing idly by (I mean does that even need to be said?).
But they (the girls) claim they asked him to leave the women's restroom and that's when it all started. He (She) claims it was because one of the girls thought He (She) was hitting on her man. So who knows on that but I do believe the video showed it started in the bathroom.
I see these as 3 sep incidents --
1. the Guy using the women's bathroom - wrong
2. the girls beating Him (her) down - wrong wrong wrong
3. all the people watching/taping- more wrong wrong wrong
There's just more to the story. And FWIW, I don't think He (She) had a seizure at the end. Sorry, I think that was a big fake-out.

The whole thing is utterly exhausting. First of all, get the "transgendered" fellow some help. Now. No more enabling--he is ill.
Second, those "girls" who beat him need to see the inside of a jail, and soon. Anyone who thinks it is okay to beat anyone, regardless of provocation, needs to go back and read their Emily Post. From a jail cell.
Third, all those employees need to be fired, and new ones brought in. Anyone who did nothing in that situation is complicit in the crime.
See--this law thing isn't all that hard at all. I think Amishdude has it right.

This isn't the law anymore, it's politics. My guess is that Holder won't touch it and will try to get Maryland to handle it. There won't be any federal civil rights charges.
The big question, both at the hypocrisy and the legal levels is, will the Lesbian/Gay/Bisexual/Transexual/Transgendered/Transformer/Decepticon groups make a big deal of this.
My answer is: No.
The usual left-wing groups won't touch it with a 10-foot pole, they know the hierarchy of victim groups and to have them fighting each other just undermines the Marxist goals. The center-left and even the center-right groups (yes, they do exist) aren't really interested in defending the "transgendered bathroom" issue. They're going to lose on that one.

This is where we descend into madness.
If you have a pee-pee, then you pee in the men's room. This is not a civil-rights issue, it is natural law. Pass as many laws as they like, the left cannot mess with natural law. That's the problem with the "gay marriage" snafu. It tries to transcend natural law. No can do. If tab B does not fit into slot A, then no marriage. QED.
Also, who really wants to mix it up with a couple of ghetto girls, anyway? The reason this doesn't have legs is that most folks know that the ghetto mentality is hit first, ask later, if at all. Nobody can fix that short-circuit of humanity, so they just let it go and hope it never comes to visit their neighborhood. Eric Holder included. Why piss off the Black Panthers when you know they will kill you next time you cross their path?
Except the marines. Nobody messes with them.

Amazing that one can have that much education and still be so incredibly stupid.
Not amazing at all. "Education" is little more than indoctrination these days. There are a set of beliefs one must have, even if they don't stand up to logic or data. The French term is "bien pensants," meaning "good thoughts." It's a religion, basically. You say the right things and you are a good person.
There's almost no questioning, but there is a lot of intimidation by expertise.
Peaches, you should have a rejoinder ready: "Yes, I can see that. I understand why you would think he's smart."
I won't even really debate if he's smart enough. It wouldn't matter how smart he is. I'm not smart enough. Nobody is. That's why we have the market. One person, a committee of people, a whole stadium of people is not smart enough to understand the magnitude of the quintillion numbers of subtle decisions and flappings of butterfly wings that goes into making the economy work.

Much like Nessie and Bigfoot, when you have that in a sack where I can see it, then I'll believe it.
This! I've never seen any evidence that would put him anywhere north of average.

I am looking this bright Easter morn at a Department of Homeland Security “Custody Receipt for Seized Property and Evidence”. Late last night, crossing the Quebec/Vermont border, my children had two boxes of “Kinder Eggs” (“Est. Dom. Value $7.50″
I feel safer already.

Since it's an event for the children, I think the schools pack the kiddies into the buses and take 'em over to the White House. I did the WH Easter Egg thing once when I was really young, don't remember if it was my parents or a school trip that got me there.

Fifty percent are already below average.
And here is the thing....if you actually believe that speculators drive oil prices in an era of massive budget deficits and a dollar that will soon rival the Mongolian torog in value, then you are an economic nitwit or a cynical liar. There is no middle ground.

To clarify, he's a white male and we were speaking on the occasion of his 66th birthday, so there's nothing "these days" about his education. There is simply NO excuse, just willful blindness to reality.

From Wiki:
"While Kinder eggs have been available in Canada since 1975, the product has never been allowed into the US for several reasons. In 1993 the Ferrero Group (the maker of Kinder eggs) applied to have the eggs sold in the USA, but was turned down because of a prohibition against having an inedible item inside an edible object. More recently, the US Consumer Products Safety Commission determined in 2008 that the product did not meet the small-parts requirement for toys for children under the age of three, creating a choking and aspiration hazard in young children. Since 1991, at least 7 children worldwide have died of choking after swallowing the toy inside the Kinder egg.
"On January 10, 2011, it was reported that a Kinder egg was seized from a woman's car during a random inspection while entering the United States from Canada. She was informed that bringing the egg into the United States could result in a $300 fine. Seizures such as that one, and even the prohibition of the product itself, have been cited on political blogs and web forums as an example of an overzealous application of law and an intrusion upon personal liberty. The rationale against a ban of the product also takes the form that deaths have been too few for it to be considered a serious danger. Additionally, the argument is made that there should be a consistent standard in place, with several worse dangers not being regulated, making it anomalous that a Kinder egg should be regulated."

Thanks to these two idiots, Obama a) can take a back seat to the whole affair, and b) has Republican cover.

I particularly liked the part where Obama was going to sneak two terrorists into the US and THEN announce they were going to try them on US soil. They had two all picked out who spoke English so would make a "good impression."
My second favorite part was where the defense attorneys at the Pentagon, when they heard the announcement, did a CONGA LINE chanting "rule of law, baby, rule of law!"
You guys should click over and read that whole thing. How many other people has he sneaked into the US and didn't get caught? What else is he doing?
That article is exhibit A in how he doesn't care about the Constitution or the opinions of the American people.
