Check Out Wisconin's Incoming Left-Liberal Chief Justice

I'm saying that not to predict it, exactly, but more to underscore what's on the line here, if Prosser is defeated.

It won't be pretty.

Abrahamson proselytizes for the legal school of thought known as “new federalism,” which encourages state supreme courts to interpret their state constitutions independently of the Supreme Court — that is to say, more broadly....

And to exclude more evidence in murder trials.

Abrahamson’s most notorious opinion, perhaps, was Ferdon v. Wisconsin Patient Comp. Fund, in which she struck down the state’s cap on medical-malpractice rewards. The legislature had capped the amount juries could award for noneconomic damages at $350,000, but the chief found the limit in violation of “equal protection.”

She held there that dividing people between merely injured and severely injured (and imposing a cap for noneconomic harm -- that is, pain and suffering) on the merely injured was somehow a violation of the equal protection clause. You know, the old racial prejudice against the lightly injured.

Update: If this horrible thing can pervert the equal protection doctrine to protect trial lawyers, you best believe she can make up some equally insipid crap to claim that unions have a right to everything they want.

Over the years, Abrahamson scored points for the Left, opposing school choice and citing foreign law to achieve her purposes. For her reliable jurisprudence, liberal activists rewarded her handsomely. The list of her campaign donors reads like the Democratic party’s roll call: The American Federation of State, County, and Municipal Employees; Services Employee International Union; Planned Parenthood; the American Federation of Teachers. Between 1989 and 2009, labor unions gave Abrahamson over $190,000 in campaign donations — more than they gave to the other six justices combined.

When an electoral opponent accuses her of being a liberal, she plays dumb. “I don’t know what these labels mean,” she told Isthmus in 2009.

The woman running against Prosser is Abrahamson's former intern. So I think you know which way she's voting, eh?

If Prosser loses, this lawless leftist becomes the Chief Justice.

Volunteer and vote, and drag ten people out to vote with you. It matters.

And you can still donate to Wisconsin Club for Growth, organizing on behalf of Prosser.

Not to bring you down but Prosser is polling evenly with his opponent which is always bad for an incumbent and plus you have a ferocious intensity among the left -- I don't see that on the right. I feel like we, pardon my french, blew our wad in November and now are sort of chillaxin' as the left comes roaring back.

Incidentally: A commenter mentions frustration at the Wisconsin Republicans. I guess he means about not re-passing the Budget Repair Bill.

I think they're not doing that yet because they don't want another left-base-enraging media circus until after this election.

But if Prosser loses, and this Abrahamson woman becomes the new Chief Justice -- don't think that re-passing the bill will save it. She'll come up with some new way to invalidate it completely.

Correction: Abrahamson is already the Chief Justice -- she's just outnumbered 4-3. A Prosser loss wouldn't make her Chief Justice, but would make her the senior vote in a 4-3 liberal majority.

11 Based on what you said the other day, we already knew there was no way he's going to win.  It's hard to work against a rising tide.  This morning I saw Andy Stern on CNBC and he was smug and cocky and he said this is one battle in the war.  He's talking about his unions battling a state of the union.  He's calling it a war.  He fully anticipates prosser going down and the republicans being recalled.  Like he knows it is a done deal.  what does that person always interject, oh yeah, that the SEIU maintains the voting machines.  I bet if they thought their guys were going down, all the machines would suddenly not work.  Problem is, the republicans have jobs and families and responsibilities.  Fro some reason the dems/libs/communists don't seem to take anything seriously but their ideology and their quest to make the country into their socialist utopia so they eat, sleep and breathe trounding the republicans.  How can you thwart that with a bunch of old people in the tea party.  It's depressing to see that we have lost before we have begun.   I've tried to be up beat but at every turn it looks hopeless.

Yeah, well I saw an election that was won by a Republican twice (the initial and the first recount) stolen by a Democrat (who won the second and final recount), so I don't have much hope.  And then you get stories like the one out of CO where 5000 non-citizens voted in a very close election, and the Democrap won.

I read on here a great post about how BO needs to win Wisconsin in 2012 and that is why he is pulling out all the stops.  The post was great and I've been looking for it for a while to show it to someone and I can't find it.  It was logical and made enormous sense.

After the last thread where the poor wisconsin people sounded like a battered wives meeting I think I started to get depressed for them.

I think an alternative is that every judge ought to be elected every two years.  The populace  has no recourse for bad judicial appointees.

I live in Dane County and work in Madison.  The Republican response might be best characterized as "none."  Nothing from the national level, nothing from the state, nothing at all as far as I can see.

Having said that, I must also add that I don't have a TV so I don't see TV ads and I don't know what's going on in the rest of the state.  Others may have a different experience.  But Madison is like someone stuck a stick in a beehive.

When you're a liberal judge, you don't make a decision based on law.  You make your decision, then use law to try and defend it.

Foreign law, cherry-picking and broadly interpreting precedents, applying phrases like "equal protection" completely out of context, whatever.  First decide the case, then hear arguments, then try to rationalize it to the 95% percent of the population who won't read or examine your ruling.

It will draw people out who have never voted in one of these elections. The Dems played this wrong. They should have just worked quietly for a huge turnout figuring they could do better in a low turnout election. Instead they have raised the profile of this election very high. Conservatives and the Tea party may not be very vocal about this but I doubt they will stay home.

I second that. He's also a great writer. He did a column when "deem and pass" was the issue of the day that was both very clever and exceptionally convincing. He is usually always worth my time (in the same way Sean Duffy is always worth Ace's time).

“It seems in bad form. Obviously, when it comes to information about my wife and daughters, it crosses the line. I find it offensive and so do they,” Brown told the Herald yesterday.

The NRA sent out a flier recognizing Kloppy as an anti-gun communist, but the unions have made the election all about "Adolph Walker" forcing the poor poor unions into slavery.

A potential game-changer released this morning: The victim in the sex abuse case used in Kloppy attack ad against Prosser speaks out, says Kloppy is full of shit.

Nobody's releasing internal polling, so the outcome is anybody's guess.

A co-worker and I were talking about China the other day.  He said one of the biggest differences between the U.S. and China is that the U.S. is very short sighted, instant gratification oriented.  China, however, is always looking farther down the line, willing to make immediate sacrifices as they plan for the future.  Very scary, that.

I sort of agree with you when it comes to enemy nations, which China is.  Though I'm not sure what harm it does unless we're selling military hardware or vital resources to China when they spend those dollars.  I don't agree, though, with friendlies and neutrals not being able to use dollars to buy stuff here.  It's a key selling point of the dollar as reserve currency.  Remember - if it's here, we can always nationalize it back if things get ugly.  And Americans own huge amounts of property all over the world, including productive assets.  It's tough to demand the right to buy from others when not granting that right yourself.

83 I agree about them waiting until this election is over.  Don't get too downhearted about Prosser.  I'm a tea party member since day one and the lesson I learned from the last couple of years is that protests only go so far.  What counts is votes.  People in power are going to do what they are going to do and it doesn't matter if a million citizens come out to ask them to stop.  Tea party people are working people and need to prioritize.  They'll be there to vote in my opinion and there is a lot more of us then there are of union members.Also, the union people tend to be violent and I think people are quietly going to go in and vote against them, to avoid being harassed, or threatened by union thugs. I thought about putting a Prosser sign in my yard, but if you do you take the chance of violence or vandalism.  We are out there watching, reading, and listening and I think you'll see us out in force on election day.

And the ad by the victim of sexual abuse denouncing Kloppenberg for using him as a political pawn is getting a lot of airplay here in SE Wisconsin. Are they gamechangers? I don't know. 118 I actually think Prosser would have won if the sexual abuse victim had cut his ad a week earlier.  It has been running quite a bit in the Milwaukee area, but 3-4 days just isn't enough time to get the needed coverage to counteract the initial smear.

And, as I said before, there is a huge Mayoral race in Madison between to lefties that will cause a massive turnout there.  There are no high profile races in the conservative counties that would need to match Dane and Milwaukee  in turnout to have a chance.

120 Greg: I think the Abele-Stone race in Milwaukee county will motivate a lot of conservatives to get out (and possibly depress the black/Latino vote, because who thinks they really care about a spoiled trust fund brat?) I was out in Oak Creek and Franklin last weekend and saw Stone signs everywhere - it's a bad sign for Abele, and certainly won't help Kloppy.
