David Prosser: Don't Make Me Choke A B****

Yes, I can now use the headline I wanted, now that it seems like Prosser is in the clear (apparently), and that he was actually charged by this associate justice but blocked her off with his hands.

Around her neck, sure. But she came at him with fists, two reports say.

All I gotta say is: What in the hell is going on in this court?

Although the left speaks of impeachment, if it is true (and it's two sources who say so) that this other justice came at Prosser with her fists, looks like she'll be the one getting impeached.

And Of Course Althouse Was All Over This: I really should have given her the main link, as she was on this all weekend (and very skeptical of the left's claims).

Here's her big question: Since this one reporter presumably heard the other version of the story -- the one where Prosser was not the aggressor, but attempting to defend himself from a lunatic -- how, exactly, did his report manage to omit that?

If Lueders had the larger context of the story — including the allegation that Bradley was the aggressor — and he suppressed it in his original account, what he did was not only evil, shameful journalism, it was freakingstupid. All sorts of bloggers and tweeters like Millhiser committed themselves to the firm, righteous position that if Prosser did what is alleged, he must leave the court. Lueders’s article lured them into stating a firm and supposedly neutral principle about physical aggression. With that principle in place, they are bound to call for Bradley’s ouster, if Bradley really did take the offensive and transform the verbal argument into a physical fight.

See, the left has been agitating all weekend for impeachment based on physical aggression.

Having laid that marker down... well, they can reverse themselves, as they always do, when partisan interest conflicts with principle, but it will be a wrenchingly ugly maneuver.

5 HA is taking the "setup" angle in the reporting of this so far, and it makes more sense than the usual "oops" angle. The initial reports were about Prosser, not Bradley, and the blogosphere seems to have brought out the "other side of the story."

I would not be terribly surprised if the setup went all the way up to Bradley, given the history of the court.

Past reporting makes them all out to be a bunch of kindergartners. Then again, it's "reporting" so it could all be bullpuckey.

While the left has instituted much of its legislative agenda through lawfare, they have no trouble destroying the legitimacy of the court should it be turned against them.

That's a BS stretch of the 14th amendment. It fails to take into account that we have more than enough money coming in to service our debt. Also social security and medicare are self funding so Obama would have to break that promise by executive order.

If you look at the 14th Amendment from another point of view it requires Obama to service that debt from existing revenues. In other words he couldn't stiff bondholder to fund NPR.

Prosser's a Welsh name - ap Rhosier. Bradley was, also, of Welsh stock but her paternal ancestors migrated to England earlier: née Ann Walsh. (Husband is Rich Bradley.)

Typical Midwestern stock is Scandi and German.

I think that's "aggressive misuse" of the Amendment in question.

I don't think Amendment 14 can be read as to mandate the current level of debt spending be maintained.

I think we're going to have to recall and impeach a lot of politicians before we can force them to stop spending, or maybe vigilance committees, who knows.

PS while most Vigilance Committees have involved the use of force, they don't by necessity have to. A Vigilance Committee is a group of citizens that arrogate to themselves legal authority by overwhelming popular demand when duly elected or appointed officials are too corrupt or incompetent to manage a situation.

To my knowledge every VC in US history has voluntarily disbanded when the requisite number of wrongdoers has been driven out, exiled, or occasionally hanged. I don't know that a VC on a national scale is even possible, not to mention a "Debt Vigilance Committee."

Arguably the TEA Party is such a thing.

It's not just that they "reverse themselves," it's that they have some sort of defect in recognizing contradictions in their own ideas. I've actually "walked" liberals into their own contradictions, and anger and storming off are generally the result, occasionally bewilderment and even more occasionally a sort of embarrassed silence.

I don't bother much anymore because the entertainment value has gone out of it and it never accomplishes anything.

101 Re #33, I have always thought it a mistake to address judges as "Your Honor" when the odds are not insignificant that said judge is a petty criminal. I understand the desire to show respect for the institution, but that particular phrase shows what I think is an undue deferrence to an individual. Calling a judge "Judge" should suffice.
