Dearborn Suspends the First Amendment

The problem and genius of the First Amendment is that it even protects dumbasses and that in defending free speech we sometimes I have to defend efforts at speech that is of truly questionable value.

This is that problem case:

Dearborn denied a permit Wednesday for Quran-burning Pastor Terry Jones' planned protest outside the Islamic Center of America on Good Friday.

Jones could be arrested if he goes ahead with the protest outside the mosque without a permit, said city spokeswoman Mary Laundroche. She added that the permit had been denied for "public safety reasons."

The permit denial is just part of the First Amendment problem here. A county prosecutor, citing her fears that the protest will spark a riot, has also filed a petition with the local court to issue an injunction to prevent Jones from protesting. (I always wondered what happens to the lawyers in the bottom third of their class.)

Both of these actions -- the permit denial and an injunction, if the court grants it -- violate the First Amendment. This is a heckler's veto. Dearborn and the county prosecutor aren't saying that Jones will commit any violence. Rather, they expect that the Muslims in Dearborn will be simply unable to control themselves in the face of religious criticism and start a riot.

Right up front, please note that Jones says he's not going to burn a Koran at this protest; he's just going to waive signs and make a lot of noise, apparently. His is entirely lawful behavior; it is the anticipated unlawful behavior of Dearborn's Muslim population that is feared.

This sort of content-based prior restraint is presumptively unconstitutional and has only ever been upheld in seriously limited circumstances (actually, I'm having trouble thinking of one off the top of my head, but I'm sure it's happened a few times). According to the Supreme Court the Constitution permits this type of prior restraint only where it is both "necessary to serve a compelling state interest" and "narrowly drawn to achieve that end."

The city and the county prosecutor say that the compelling state interest is public safety and traffic, since they assume that the local Muslims will start a riot in the face of religious criticism from Koran-burner Jones. They've also offered to let Jones speak in a "free speech zone" at City Hall.

Assuming that public safety and traffic concerns are more than just mere state interests, but compelling state interests (traffic flow? really?), denying Jones' permit to protest in the traditional public forum (a sidewalk) across the street from the Islamic center is in no way narrowly drawn because it isn't Jones' entirely lawful speech, but the entirely speculative unlawful activity of others that are actually prompting concerns for safety and traffic. Both could also be addressed by increasing police presence and, you know, actually enforcing traffic and public safety laws.

But since that is too much trouble, they have apparently suspended the First Amendment in Dearborn. I also can't help but wonder if this is a simple attempt to suppress the speech of a despicable guy like Jones masquerading as "public safety" concerns.

I hope we get a chance to find out. Jones says he's going anyway and that he and his followers will be armed to protect themselves if the Dearborn PD won't. Everyone should say a prayer for Dearborn tomorrow.

I was under the silly impression that virtually all of America is a "free speech zone"...

What if Terry Jones had planned to hold an anti-war protest outside a recruitment center in Dearborn?  Would the permit for that have been denied on such shaky grounds?

Yeah, it does have the feel of the obligatory condemnation, doesn't it?  Honestly, I've never listened to the guy, I just read about him and all that I know is "he wants to burn a Koran".

Now, I'm not sure what sort of magic holiness there is in a post-Guttenberg Koran that is probably typeset in Times New Roman font, in English (they insist the only real Korans are in Arabic), with a cardboard cover stuffed into a cardboard box, shipped via a truck to your local Borders Barnes & Noble Amazon distribution center (thank you Tom Friedman!), put on shelves by (gasp!) women and sold to any silly kafir that pays for it.

I think they made the whole Koran protocol up as nothing more than to intimidate the West. The fact is that defacing a Koran is simply an insult, not to Allah, but to them and Muslims can't take being insulted. It's really nothing more nor less than sticking a middle finger in the air and directing it towards the Muslim world.

I've been thinking, more and more, that Jones is comparable to abolitionist John Brown, though.  A bit less batshit crazy, but there are comparisions.

Ace, you may not like Jones' methods, but he's doing a service by exposing a dangerous trend.  Too many Americans seem to buy into the notion that we need to self-censor to avoid offending the adherents of the religion of peace.  Unfortunately, a lot of those Americans occupy positions of power like prosecutor, judge, city councilperson or Senator *cough * *Lindsey Graham* *cough*.

Jones puts the conflict between western  values of free speech and the barbarian values of murder-anyone-who-doesn't-exhibit-complete-reverence-for-my-sacred-shit front and center.  If it causes some of the public to turn off American Idol and start asking uncomfortable questions, that's a good thing.

When Muslims' sensibilities might be offended and their feelings hurt, there seems to be no problem interpreting the law so as to provide for squelching these religious wackos from expressing themselves. OK, I get it, I guess.

Interesting, however, that when religious wackos decide to disrupt a military hero's funeral, a bereaved family and friends must all swallow their misery and suppress whatever feelings THEY might have, so as to accomodate the wack-jobs right of self-expression.

This interpretation of the law could conceivably be interpreted as Dhimmitude, or at best, kowtowing and catering to a politically correct group.

This is true, at least in part, but beside the point.  No matter what we fear those animals might do, we must preserve the right to free speech.  As for them taking over the nation - thankfully there's no chance of that yet.  Regular Americans are still too well armed.

This observation does speak to a different issue, though.  Most of the scum in the high security prisons are vermin who should be eliminated.  Muz indoctrination in the prisons is one of the best arguements there is for vastly expanded use of capital punishment.  As far as I'm concerned, anything from armed robbery on up should get the death penalty.

I LIKE this idea.  it has merit.  The most important thing, though, is that once you've burned the chosen box, you never open the other two.  Otherwise the wave form collapses and all the quantum is squandered.  No, you have to make sure the other boxes remain closed and unopened.  Then the Muslims will have to ask themselves:

"Do I riot because they might have burned the Koran, but by doing so risk rioting over a burned Bible or *shudder* Torah, thus making myself an apostate?  Or do I not riot, because there's no way of knowing if the book in the box was a Koran, but by doing so risk not being viewed as a good Muslim lunatic worthy of 72 virgins?"

Take my word for it, Pastor Jones is planning on yelling the Islamic equivalent of FIRE to a predominately Muslim crowd. The Dearborn adminstration is being proactive in preventing this as a stampede will most certainly result. And Jones most likely will be the one trampled, which is not necessarily a bad thing, but the Dearborn Police try to be fair to all in providing protection.  

He is being given an alternate site, he should use it to express his views, and is welcomed to do so, and I suspect he will be able to get the reaction he wants at that site also, despite plans for heavy police presence. Have at it, Pastor Jones, but be forewarned, these folks do not take kindly to insults to their beliefs.

As I recall, the koran burning is to take place in a designed "free speech zone" (spit) and to suggest that it carries the same threat as a cross burning is beyond absurd.  As for "incitement" let's get real.  Bible burnings and flag burnings and threats of violence against conservatives are daily events in this country and nobody bats an eye.  The muz have enough defenders and apologists.  Don't be one more. 

Beyond that, it is ultimately quite beneficial to the US if the muz feel threatened, or at least deeply unwelcome.  They're not a peaceful group of fellow citizens.  They're nothing less that 5th-columnists in our midst, waiting for their chance to strike.  If we had any sense at all we'd already be amending the constitution to remove any protections from that group.

I respect your viewpoint, MM, but that's the whole point.  If Jones were an Imam who wished to protest and hurl slurs at Jews attending a synagogue, this would not be an issue.  There would be no denial of a permit, because Jews don't kill people for protesting their religion.  If they did, Israel would have nuked the entirety of the Mid-East by now. 

Christians don't slaughter people for profaning Christianity, either.  Good Christians pray for the profaner's salvation; so-so Christians simply get angry; bad Christians don't care.  But anyone who claims to be a Christian but would pick up a weapon to enact revenge and claim some kind of holy justification for doing so could never be called a Christian.  That isn't Christian doctrine.  It is, however, Islamic law.

I understand Dearborn wishing to maintain order, but it shouldn't be at the expense of free speech.  Even if Jones chooses to protest in the designated "free speech zone" (a concept that frankly sickens me), do you really think that will stop a muslim riot from happening?  Jones burned a copy of the Koran in his backyard, and muslims half a world away lost their minds and started killing people.  If these Dearborn muslims are so prone to anarchy that they can't stomach the open practice of free speech, guaranteed by the Constitution and practiced on American soil, then why should we expect them to maintain their calm just because that freedom of speech is taking place a few miles away?

Well, if they want to claim themselves to be no better than a common animal, I'll leave that choice up to them - but, feel compelled to remind them how animals are usually treated in this country:

If they are domesticated:  it is up to the owner to be responsible for them and keep them under control.  If the owner refuses or does a poor job, the owner can be sued, fined, face jail time, and / or have the animal removed from their home.  The animal would be evaulated and either allowed to be adopted or, most likely, euthanized.

If they are stray / roaming loose through the streets:  the local agency will attempt to capture and detain them.  Typically after a week, if the owner has not picked them up or they are not adopted by another, they are euthanized.

If they are wild:   feral creatures are usually dealt with in the harshest of terms unless they are an endangered species - and even then, when they are captured, they are relocated.  At best, the wild ones may be protected for most of the year depending on population control, but there is usually open season at some point with the limit based on the current population.  As well, land owners can usually claim special dispensation during the off-season if they can show just cause to further protect their property.

And that's just a short synopsis... Should we ask if they still want to act like animals?

I should clarify that by "enact revenge" I mean revenge associated with something specific, such as this protest.  The Crusades were not revenge but reclamation.  The burning of witches was not revenge, but carried out through fear and superstition (and used to mask more than one petty act of human revenge, I'm sure).  If someone opens a Bible in front of me and proceeds to take a dump in the middle of Genesis, I'm not going to stab him to death with a stilleto heel.  I will kick him in the balls and throw his feces in his face (I'm not, I'm afraid, as good a Christian as I should be).

I grew up in South-West Detroit for 24 years and spent most of the next 25 here in what I call the West side of the Middle East. That being said, the local police are very well trained and I see them every day doing their job. Some locals would even say they do their job too well (those are the ones sitting in the police station waiting for their court date). Also, the head of the Dearborn police, his last name is Haddad. So, if you are a career patrolman, and he is your boss, it would be prudent to exercise your diplomatic skills when dealing with the local Arab population. Is it a double standard? You betcha. But see the Liberals have taken over most of the key government positions and as in the book Animal Farm, all citizens of Dearborn are equal. Some are just more equal than others. At any rate, for the most part this actually is a rather peaceful city, considering it borders Detroit and Inkster. Yes we do have a few Gentlemen's Clubs. From what I hear some of the female strippers are very entertaining. Not that I would have any first hand knowledge of such things. Heh. Anyways, elections have consequences and the last one was a good start. Hopefully the country will not collapse by 2012. Just remember the election of the Honorable Al Franken. It's not who votes, it's who counts the votes that matters.

My friendszh, I graduated at the bottom of my classh at the Naval Academy, and I'm living proof of how effective and productive a person can be despite that.  Just look at my record.

That's nuthin'  Barely got out of Punahou High.  (Thanks Tut)  Did two make up years at Occidental. Then some mystery matriculatin' in the Ivy League. (Don't ask.)  Coupla bar exams later and some Ayers ghost wrtin' and look where I am.  Sheesh. Is this a great country or what?

222 It is ok to have protesters against dead soldiers funerals and dead kids (the ones that burned to death in PA) but not near mooslems.  Oh no, that you can't do.  Why? Is it just hatred against Christians?  It is not hatred against religion, because I think islam is a so-called religion.  So that's not correct.  Or fear of getting killed by muslims for not supporting Islam?  Inquiring minds want to know!

I LIKE this idea.  it has merit.  The most important thing, though, is that once you've burned the chosen box, you never open the other two.  Otherwise the wave form collapses and all the quantum is squandered.  No, you have to make sure the other boxes remain closed and unopened.  Then the Muslims will have to ask themselves:

I like the cut of your jib, MisterMoney.  After careful consideration I've concluded any speech I find objectionable is like shouting fire in a crowded theater.

(BTW, shouting "fire" in a crowded theater is only wrong if THERE IS NO FIRE!)
