Eric Holder Subpoenaed!

Deleting and shredding party scheduled.

“Top Justice Department officials, including Attorney General Holder, know more about Operation Fast and Furious than they have publicly acknowledged,” Issa stated. “The documents this subpoena demands will provide answers to questions that Justice officials have tried to avoid since this investigation began eight months ago. It’s time we know the whole truth.”

To that end, Holder is required to produce virtually every communication anyone associated with the Justice Department or ATF ever sent to anyone regarding Operation Fast and Furious, or “any Organized Crime Drug Enforcement Task Force firearms trafficking case based in Phoenix, Arizona.” The subpoena specifically names no less than 16 DOJ officials, including Holder, his deputy James Cole, Assistant Attorneys General Lanny Breuer and Ronald Weich, and Deputy Assistant Attorney General Kenneth Blanco, among other names familiar to students of the Fast and Furious scandal.

Also specified in the subpoena are communications with Acting ATF Director Ken Melson, United States Attorney Dennis Burke, and ATF Special Agent in Charge William Newell. House Oversight wants all communications to or from Newell from 12/14/10 – 01/25/11 and 03/16/19 – 03/19/09. It looks like they’re trying to pin down exactly what Newell might have shared with his White House pen pal, national security staffer Kevin O’Reilly.

They’re also keenly interested in documents relating to the murder of U.S. Immigration and Customs Enforcement Agent Jaime Zapata, whose death has long been suspected of links to gun walking… but not Operation Fast and Furious, which ran out of the Phoenix, Arizona ATF office. The Zapata murder weapon was traced back to Dallas, Texas. Further documentation relating to the death of U.S. Border Patrol agent Brian Terry, whose murder scene produced two Fast and Furious guns plus a third “mystery weapon” that might also point back to Texas, is also sought.

Nope.  The subpoena is out and official.  So  a) he complies (bad for him), b) he does not comply and is held in Contempt of Congress (bad for him and Obama), or c) he claims Executive Privilege (bad for him, and very bad for Obama).

Even if he resigns, that doesn't get him out from under the subpoena.  In that case, it just changes to "he complies or goes to jail."

Indeed, I would only look for a resignation prior to the documents being delivered if Holder wants to roll-over on Obama.

I think Ed Morrissey was right on this one: best thing SCOAMF could do to mitigate the damage would be to reinforce the claim that this was a flawed law enforcement operation that was poorly executed, apologize to the Mexicans, and throw Holder and the others under the bus (but coordinate with big Democrat donors to make sure they get cushy new jobs). Take quick action, try to show that you're holding people accountable, and make it go away fast.

But he won't do that because he's a SCOAMF.

If Complying with the subpoena is bad enough, Obama (well, his Chicago-Way handlers) will figure it's worth the damage of not complying, and will try to use the Race Card to diffuse the worst of the damage.

I don't think so.  Because giving subpoenaed documents to a congressional committee should not jeopardize any ongoing investigations.  It's not the same as a FOI request- they're not being shown to everyone, only the Oversight and Governmental Reform Committee.

They don't need to convince people that they screwed up, they need to make it go away. The public apologies are for the benefit of the press and once those are made, the press will have their justification for never mentioning it again. The goal would be to make this go away as quickly as possible and not allow it to drag out into next year and they know that the average American has a very short attention span.

SCOAMF won't even stoop to address F&F.  The last press conference he had, he was asked a question about it at the end, and he basically blew off the reporter and said he had full confidence in Holder.  He will have one of his underlings (like Jay Carney perhaps) deal with the fallout from all this which will basically be Carney stammer and lie his ass off.

One talk/training I attended one time had to do with PR responses to mistakes. The Tylenol poisoning from the early 80s was given as the textbook example for how to do it right: take complete ownership, deal with it quickly and above board, make it clear that you understand the gravity of the situation, and get it done. It may cost more up front but you make up for it by maintaining public confidence.

But, the pattern is already set for this guy, he's going to do exactly what every other politician does, and that's stonewall, obfuscate, and try to slick his way through it. Clinton got away with that because the subject was very touchy and (more importantly) because the economy was in great shape.

One thing about the "shredders", in this day and age of the $5 - 2 Gig flash drives: there's just no telling if some peon, underling in the email BCC list didn't cover their ass and make a copy. One thing that is made abundantly clear by the East Anglica Climate Research email "hack", it is cheap and easy to store emails. That email archive (which had numerous emails) was only 62 meg.  One could easily move that out on an MP3 player or smartphone or even burn a CD if they were a dinosaur. With an anonimizer, it's even easier to spread those around afterwards without risk.  I'm sure some news outlet or blogger somewhere will pick up the story.  Plus, even the most primitive cro-magon can print an email and store it in a folder "for later".

So, when you think you've deleted all the files, and you think you've cleaned up all the paper, and you think you've threatened all the witnesses to silence, just ask yourself this question before you go before congress and commit perjury (5-year felony sentence per count there), "do you feel lucky?"

There isn't one, but when you're trying to cover up the true intent you make something up. You throw something out there for a sympathetic press and let them fill in the blanks. Kirsten Powers has already done this; she accepted the claim that this was a law enforcement operation and then pooh-poohed those asking the same questions you're asking.

Again, he needs to make it go away and the best way to do that is resignations and a statement that will give the press the justification they need to say, "Story's over. Next topic."

I think Calderon is in on it. You may recall that he joined in with Hillary and Obama's chorus back in early 2009 about the horrible terrible weapons from the U.S. that were killing so many Mexicans. (the everlovin 90% figure that was a complete, baldfaced lie)

I've also read somewhere that Calderon's "government crackdown" on "the cartels" may actually be a crackdown by one cartel (that owns Calderon) against the others, just trying to knock out the competition. In Mexico, this is certainly a possibility. We all know about the corruption. Ever see the movie "Traffic"? Fictional, sure, but pretty accurate in its depiction of the general scene down there. (Except that the movie, whose violence shocked me when I first saw it years ago, turns out to be very tame compared to what's going on now.)

My regret is that I am not an elected law enforcement officer in TX, NM, or AZ so that I could be the one to "serve" Mr. Holder with a arrest warrent as an accessory to murder.
