— Gabriel Malor This morning on Fox News Sunday, Governor Perry proposed a constitutional amendment to allow organized prayer in public schools. It's an extension of the campaign's current strategy of hoping that social conservatives will give him a boost out of fourth or fifth place in the Iowa caucuses.
Appearing on "Fox News Sunday," the Republican presidential hopeful went a step further than his previous calls for the Supreme Court to reverse its 1962 decision that banned organized prayer in public schools.Perry said he would support "a constitutional amendment that would allow our children to pray in school any time that they would like."
Such a proposal would easily pass if put to a nationwide vote, Perry said. The step is necessary because of what Perry called "activist judges" appointed to the U.S. Supreme Court like Sonia Sotomayor and Elena Kagan.
I think Perry is right that such an amendment would be exceptionally popular. But this late-adopted plea for social cons to save him will have about as much success for Perry as it had for Santorum and Bachmann.
This is the eighth constitutional amendment Perry has suggested during the campaign. The others were a pro-life amendment, a marriage amendment, a balanced budget amendment, an amendment repealing the income tax, an amendment repealing direct election of senators, an amendment abolishing lifetime tenure for federal judges, and an amendment giving Congress a veto of Supreme Court decisions.

This marks the end of any support for me for Perry. I know he would be better in so many ways that Newt or Romney, but he has been flailing since he is in the race. This is not going to work at all.
I'm in Florida, and I think he has made himself near unelectable here with his debate performances and erratic statements. He was not destined to be electable, but he just wasn't up to the task. It is a shame.

They have incredibly over-complicated what this election is about. It is not about appeasing interest groups and bringing together a coalition. It is about saving the country AFTER we get rid of this Marxist fucker.

I think Perry is hoping to give religion at least some of the same protection in schools that sexual preference has. In California, for example, public schools are now required to specifically teach children the valuable contributions made by Gay/Lesbian/Bisexual/Transgender people in history (Harvey Milk, for instance).
Of the listed amendments proposed by Perry (assuming an accurate list), I'm at least initially in favor of all of them. The actual sad commentary is that the Federal government has gotten so out of control that this many amendments would even get proposed. We are definitely off the rails, WAY off, from what the founding fathers had in mind.

I think people understand that, but social conservatives often don't get the right reaction. They think what is called for is to legislate in the opposite direction, and it never goes over well with the general public.
Instead Perry should rail against the excesses like the California law and instead talk about local control and a culture of respect for religious values. Anything more is just a trap, and Perry is happily jumping into it.

That is great, but not many other people are going to do so.
He received horrible treatment among conservative press and the major newspapers. Conservative leaders here were shocked by how poorly he did in the Orlando debate. His numbers are below 6-8% in every poll. He is not going to do well here.
We can't just wish Perry to victory. He had to give us something to work with. The 2% of the Republican electorate that reads AoS is not going to give him enough momentum just because we understand the bigger picture. I've talked to people I know about his strengths over Romney/Newt, and it just doesn't stick. They think he is unprepared for a general election.

It sure looks like even this proposed amendment has a 10th amendment aspect to it. The line immediately after Gabe's quoted text is: "The issue of prayer in school should a local decision, rather than an issue foisted on the public by the Supreme Court, Perry said."
So basically he's saying that the decision of prayer in school being acceptable should not be something done at the federal level.

Iowa was the state in which supreme court judges invented a right to same-sex marriage and three were tossed out in retention elections. It allows him to pander to socons and pivot to the excessive power of the judiciary as well as getting in digs at lawyers (Perry is hated by trial lawyers).

Saving the country with what? Adjustments to Overhauling the tax code? Raising Restructuring SS retirement by 2 years so that it is sustainable and rational? Cutting spending 1% until the budget is balanced?
Difficult tasks each but more achievable than a bucketfull of Constitutional Amendments. Just as important, the majority of the country undertands that. Look, I support most of the goals Perry has outlined with his Amendment proposals, but like most folks I understand that this is posturing, not a realistic outline of how he will address our grave, nation threatening challenges.

No one needs a constitutional amendment in order to say a prayer anywhere they want, any time. Jesus advised people to pray in private and not make a big scene over self righteous antics in public. It isn't as if Perry's constitutional amendment would sanctify God. Just imagine the outcries from every religious sect (including atheists) regarding the wording and the practice or ritual to be observed in "prayer" whether supplication or meditative reflection.
Just stick to keeping the Pledge of Allegiance politically acceptable. If Perry's eliminating the Dept. of Education, then what government entity would enforce his prayer amendment?

Well considering that in the article he said its a decision that should be left to the local level rather than the Supreme Court, there isn't really anything to enforce at the federal level with this.

2) Texas has a pretty easy amendment process, we have a lot of amendments. I think we had 10 on the ballot alone this last cycle. Something like this doesn't sound like too many amendments to a Texan.
3) I like the "it would be super popular but it's stupid" line here. Seems some like their wedgies from the MSM a little too much. "Oh, no!! Can't have the lefties making fun of us 'cause we believe in prayer." 'Course what do I know, I'm not a consistent true GOProud conservative like what we need to win and all that . . . .

I'd been arguing that it's about the smartest thing Perry's ever proposed. Mind you, to read buzzion 156, Perry might be right for the wrong reason here.
Where the Supreme Court rules beyond its jurisdiction, like in Roe v Wade, then it's okay to blame the Court; and the solution is to impeach those judges who launched that coup d'etat. But in a case like this the Court had ruled upon the design and intent of the Bill of Rights. Perry's solution is perfect, given his assumptions: don't hit the Court; instead, repeal that part of the Bill of Rights.
I don't actually think that Perry should launch this Amendment. But I like that he recognises that he has to, to do what he wants.

The Amendment which Perry proposes would allow organised prayer, but only if the students organised the group themselves. It would also grant to the Federal State the authority to ensure that no State or local authority could hinder the students / groups from their prayer - "in school any time". This by analogy with the "militia" of the Second Amendment.
So buzzion is right that this does not conflict with the First Amendment.
It is, nonetheless, a horrible idea. How about five times a day? How about some backwoods cult that does it all day? Guess what! They can call some bureaucrat in the D of E and, under this Amendment, the D of E would have to save those poor kids from the persecution of actually having to learn stuff on school time.

Students are already allowed to pray in public schools, as long as it's not organized prayer. They're restricted by the Supreme Court from engaging in organized prayer. To the extent you are suggesting that Perry doesn't know that students can already pray in public schools as long as they're not organized, you're giving Perry less credit than I am.

Give him a few more weeks and he'll repeal the whole Constitution and replace it with his own. Let's see, what has Perry offered up that he could actually accomplish?
NOTHING, NADA, NOTHING AT ALL. He's an empty suit running for President. Promises to support everything that he can't accomplish and fails to offer up any ideas that he could accomplish.
Let's see if he could balance a budget without gimmicks, Yes, that is right, in order to balance the budget in Texas he had to do the same thing with laugh at the Dems for doing....24 months of revenue, but only having 22 months of expenses.... or rather, holding out a government payment for one day to make it the problem of the next administration's budget.
Just like his campaign, end of the reporting period comes around, he reports a lot of cash on hand.....because he held off expenses for a couple days so he wouldn't have to report them at that point in time.

Constitutional amendments are a way of 'putting it before the people' to decide. ....So I see this as Perry being consistent with his stong 10th amendment outlook.

If the people don't want these amendments, they won't pass. It's that simple, isn't it?
I'm still voting for Perry....and praying for a miracle. He did good in the debate last night, and did good with Chris Wallace this morning. So this was encouraging.

Yes. Since coaches are not allowed to bow their heads in prayer, nor can traditional Christmas songs be played/sung at the "Winter Concerts," can someone explain how those rules square with the "... or prohibiting the free exercise therof; ..." part of the First Amendment.
My poor understanding being that states and subdivisions thereof cannot enact laws more restrictive on our enumerated rights than what the Constitution allows.
Maybe Perry is laying out to the voters all the things he believes in and stands for, since he is so "unknown" outside of Texas.

Had not heard of this proposal until this post. Did AoSHQ hash this out a long time ago in a post far, far away?
I believe Congress already has this power in the form of, 1) enacting another bit a legislation, or 2) with 2/3 of both houses propose a Constitutional Amendment. Tough to do, but there it is. I would hope that, unlike the recent experiences some of the states had with amending their state constitutions, that a US Congress-led constitutional amendment would not be deemed unconstitutional.

I agree with the sentiments of those who believe that Christians and others of faith simply abandon public schools and push for school vouchers.

"On paper", Perry should have been everything a Republican candidate needed to be. Long experience running a big government. Relatively low unemployment in his state. I was open-minded and hopeful.
But what I saw was a guy with an unpresidential (sometimes downright goofball) manner, and no Big Ideas, or meaningful charisma. Now he comes up with this mean-spirited gay-bashing, and then this goofball assault on separation of Church and State (a self-destructive fixation of the Religious Right - they can't help themselves, I guess).
At this point, I'm really glad the guy is falling by the wayside.
Now we're left with who? Newt? Deja vu! He's got the Big Idea possibilities, but he's another problematic recycled old Republican and he's always getting himself into trouble. Romney? The grandfather of ObamaCare?? Yikes! Ron Paul, with the insane foreign policy ideals?
This is the Republicans election to lose, and if I were a Democrat I would take some solice in their ability to do just that.
