Rand Paul's Amendment Causes Reid To Adjourn Senate

He merely asked that Reid reaffirm Obama's own words in a nonbinding "sense of the Senate" resolution:

To make his point, Paul quoted, in the legislative language, from Obama’s 2007 remarks on the subject: “The President does not have power under the Constitution to unilaterally authorize a military attack in a situation that does not involve stopping an actual or imminent threat to the nation.” According to Paul’s office, “the measure aims to put the Senate on record affirming Congress as the body with constitutional authority on matters of war.”

Reid didn't even want Democrats to have to vote to table this motion, so he adjourned the Senate.

See if you can follow Dick Durbin's logic here:

Dick Durbin (D., Ill.), the Kentucky freshman argued that his amendment deserves a vote, and fast. “In Afghanistan and Iraq, with all the complaints from many people on these wars that we were involved in, President Bush did come and ask for the authorization of force,” he said. “We’ve had two to three weeks of this issue. They had time to go to the U.N. They had time to go to the Arab League. They had time to go to everyone. I think you should be insulted the way I am insulted they never came to Congress.”

Durbin fired back that Bush, by coming to Congress, actually “broke precedent.” Paul looked on, bemused.

16 He's probably talking about Kosovo.  The problem with Kosovo is that Bill Clinton did go to Congress.  He just didn't get the answer he wanted.  Congress, in fact, affirmatively rejected authorization for Kosovo.  Then Clinton did it anyway.  So Clinton's behavior was actually worse than President Obama's.  But that doesn't mean that President Obama can use that as precedent.

Paul makes such a great point.  We need an up or down vote from these democrats in the Senate, as well as those in the House, on this specific issue.

There will be a Republican in the White House again, and they hope to be able to hold him to the constitution that they don't hold Obama to.

Make them choose.

Every military oversight hearing and constitutional hearing should ask administration witnesses if Obama's quote was correct.  They threatened to impeach Bush if he bombed Iran.

The lawlessness itself is going to have a lasting effect, one way or the other.

This isn't how it works. There's a reason we have checks and balances. I don't care what the American people think. For some reason, I have NEVER seen just who in Congress Obama notified/consulted/informed of the decision that millions of lives were in the balance, thus he was immediately (but only after careful nuanced negotiation with the UN, NATO, AND the Arab League) releasing the US military to launch missile strikes (plus whatever detailed options he was considering, such as boots, or sneakers, on the ground, no-fly zones against a third world air force etc.).

Actually, I'm saying it was illegal.  Congress granted Obama their permission to go to war in a few emergency situations, but it's illegal to do so in this case because their permission doesn't extend to Libya by any reasonable stretch.  They weren't at war with us.  They weren't putting America in danger.  It's similar to Iraq in 2003.

Obama needed congressional approval to go to war at all, unless he was defending American in an emergency.  This is why he keeps pretending this is a new thing called 'kinetic action' instead of a war.

It is clearly time for the House to sue Obama in the Supreme Court over this constitutional crisis.

IMO: the whole intervention in Lybia makes no sense whatsoever.  It's bullshit.  There are only a few "rebels".  It looks to me that this whole thing was set up.  They thought they could ignite the general population against Ghadafi but it hasn't worked.  I think it was a huge miscalculation that is going to be very difficult for the administration (and now the left as they've joined themselves to his hip) to get out of.

They certainly could overthrow Ghadafi with enough firepower, but if they do that it will only underline the lie of the whole intervention in the first place.

They have painted themselves into a corner here, imo.

I don't know that this is illegal, frankly, (even though as senators and lawyers Obama and Biden both said so explicitly).   I believe the President does have the power to unilaterally utilize American military force on a short-term basis should he deem it in the national interest to do so.   IMO, the President *should* be able to use military force this way.

The issue becomes at what point does he NEED to seek Congressional approval.  Again, I think the statutory requirement is 60 days.  That still gives Obama plenty of time to get it.   Will he?

100.  The US Supreme Court is going to be highly disinclined to get involved here, and if they did, I think they'd find that the POTUS has the constitutional authority to use military force when he deems it appropriate, particularly if he sees it as necessary for defensive purposes.  Whether or not the SCOTUS, the Congress, you or I think so, is secondary.

Getting approval needs to be done at some point in the process, with sooner being better than later in case things go pear-shaped... like they appear to be doing in Libya.

I don't get it. He's just an unusually principled and outspoken (for an elected Republican) borderline-libertarian conservative. Are you worried he's going to vote no on too much terrible shit, and clearly explain why?

He'll probably be consistent and oppose almost every Kinetic-type thing that comes up, even if the president's a Republican, but he'll never be the deciding vote on that. In case you haven't noticed, the majority of Democrats are reliable start-the-war votes. They just want to lose the war after they vote for it, and blame you.

I can imagine that as a non-libertarian you might fear being identified with Paul's occasional unsociable outbursts of Constitutional principle, by people who hate you anyway, but...don't do that. Self-boning is a sin.

What worries me about this bill is that the Dems are right, you cannot constitutionally bind the Senate through deem-and-pass. But if you just use it as a trigger, then I understand why the House Parliamentarian would "okay" it.

ETA: Rep. Rob Woodall, freshman rep and sponsor of the bill, is speaking to this now. He says it's a trigger mechanism desiring a message from the Senate. In 1999, a bill was passed under a similar process-- need to look at that.
