Reid didn't even want Democrats to have to vote to table this motion, so he adjourned the Senate.
See if you can follow Dick Durbin's logic here:

When war-hawks tell you that "you can't just stick to the Constitution because the world is different now and we have interests abroad blah blah" they're trying to sell you the exact same line the liberals do when they try to describe the Constitution as a "living document" and use it to meet their ends by reinterpreting it.
If you want to change what the document says, add an Amendment. Don't just try to say "it doesn't apply this time" because you're slowly destroying the very foundation this nation is built on.

I sorely wish Palin was in the Senate, even though she's got more executive experience than Mccain or Obama.
Paul makes such a great point. We need an up or down vote from these democrats in the Senate, as well as those in the House, on this specific issue.
There will be a Republican in the White House again, and they hope to be able to hold him to the constitution that they don't hold Obama to.
Make them choose.
Every military oversight hearing and constitutional hearing should ask administration witnesses if Obama's quote was correct. They threatened to impeach Bush if he bombed Iran.
The lawlessness itself is going to have a lasting effect, one way or the other.

This isn't how it works. There's a reason we have checks and balances. I don't care what the American people think. If they believe something, then Congress should (theoretically) agree with them and he'd have no problem getting authorization. Actually, I'm saying it was illegal. Congress granted Obama their permission to go to war in a few emergency situations, but it's illegal to do so in this case because their permission doesn't extend to Libya by any reasonable stretch. They weren't at war with us. They weren't putting America in danger. It's similar to Iraq in 2003.
Obama needed congressional approval to go to war at all, unless he was defending American in an emergency. This is why he keeps pretending this is a new thing called 'kinetic action' instead of a war.
It is clearly time for the House to sue Obama in the Supreme Court over this constitutional crisis.

IMO: the whole intervention in Lybia makes no sense whatsoever. It's bullshit. There are only a few "rebels". It looks to me that this whole thing was set up. They thought they could ignite the general population against Ghadafi but it hasn't worked. I think it was a huge miscalculation that is going to be very difficult for the administration (and now the left as they've joined themselves to his hip) to get out of.
They certainly could overthrow Ghadafi with enough firepower, but if they do that it will only underline the lie of the whole intervention in the first place.
They have painted themselves into a corner here, imo.

Ultimately, whether Durbin is correct that Obama "notified" Congress or not is utterly irrelevant. Obama put US troops in harms way without getting Congressional approval first. That's the point Rand wants to clarify. . .to what extent does the POTUS have the ability to do this?
I don't know that this is illegal, frankly, (even though as senators and lawyers Obama and Biden both said so explicitly). I believe the President does have the power to unilaterally utilize American military force on a short-term basis should he deem it in the national interest to do so. IMO, the President *should* be able to use military force this way.
The issue becomes at what point does he NEED to seek Congressional approval. Again, I think the statutory requirement is 60 days. That still gives Obama plenty of time to get it. Will he?

The US Supreme Court is going to be highly disinclined to get involved here, and if they did, I think they'd find that the POTUS has the constitutional authority to use military force when he deems it appropriate, particularly if he sees it as necessary for defensive purposes. Whether or not the SCOTUS, the Congress, you or I think so, is secondary.

Getting approval needs to be done at some point in the process, with sooner being better than later in case things go pear-shaped... like they appear to be doing in Libya.
If the War Powers Resolution is still considered to be the law of the land, Obama would have to justify what kind of immediate threat a civil war in Libya posed to the US in order to circumvent the requirement that he consult Congress, which has taken the form of a vote in previous cases such as Lebanon (1980s), Iraq (1990-1991, 2003), and Afghanistan (2001).

War Powers is a strange law because it probably gives the president more latitude in going to war and a period without any approval (but the Arab League). So they never challenge it even though it's a statutory provision at odds with clear constitutional language.

What worries me about this bill is that the Dems are right, you cannot constitutionally bind the Senate through deem-and-pass. But if you just use it as a trigger, then I understand why the House Parliamentarian would "okay" it.
ETA: Rep. Rob Woodall, freshman rep and sponsor of the bill, is speaking to this now. He says it's a trigger mechanism desiring a message from the Senate. In 1999, a bill was passed under a similar process-- need to look at that.
