— LauraW The predatory lawsuit factory/ extortion scheme known as RightHaven has been having all sorts of legal problems, culminating in a rejection of their latest emergency motion.
Because of courtroom defeats at the hands of Hoehn and other defendants, RighthavenÂ’s financial condition has deteriorated.Its lawsuit settlement revenue is dwindling and it hasnÂ’t filed lawsuits for months while it waits for one or more of the Nevada judges to rule on whether it can sue under an amended lawsuit contract with the Review-Journal.
-------------------------------------------Righthaven had argued to the appeals court Sept. 27 that without a stay in the Hoehn case, “Righthaven may be forced to file bankruptcy to protect its intellectual property and propriety assets from seizure and liquidation.”
9th Circuit's response to RightHaven's plight, loosely paraphrased: "Boo-frickin'-hoo."

That's it in a nutshell as I recall.
However, one big weakness that they did not account for is if someone fought them in court and won on one of a myriad of issues. Here, if I remember correctly, they lost a battle on the basis of not having the standing to sue, which pretty much destroyed their business model (why settle with an entity that cannot sue you), and any funding that they had dried up almost overnight.
They get no love from the intarwebz for obvious reason, and it is kind of a big deal in the blogging world (one of their target revenue sources).

Sorry I goofed on the background story guys. There have been posts here about them over the last year or so, but basically a lot of bloggers have been stifled by this rogue copyright infringement lawsuit scheme.
Even if a blogger used an excerpt from a news story that was well within fair use standards, this company would attack them and file a copyright infringement suit without even asking the blogger to take the material down first. It cost the bloggers more money to defend themselves than to settle with RightHaven, so guess what they would do?

The only thing more delicious than these morons going out of business would be that the legal analysis I've heard of the case comes true. That analysis said that RightHaven not only didn't have rights to the material they were suing over, but that the contract was faulty to the point where it leaves their benefactor open to having his personal fortune seized to settle any debts incurred by RightHaven, such as punitive damages awarded by the courts.

Yeah, I remember reading about those Righthaven assholes; suing everybody with drive-by lawsuits. Apparently, Gibson and his flying monkeys troll the internet to find "copyright infringements" involving Las Vegas Review Journal articles. They buy the copyright then sue the blogger or website for the supposed "infringement". The whole Righthaven firms is chock full of rabid, obsessive fucksticks, whose livelihood depends on harrassing and threatening (READ: Extorting) for monetary gain. Their frivolous bullshit gets tossed out of court on a regular basis.

Here's a Wired story that details their earlier troubles.
"It turns out Righthaven didnÂ’t own the copyrights it was filing suit over. Instead, Stephens Media granted Righthaven permission to sue over the newspaper chainÂ’s content in exchange for a 50 percent cut of all the settlements and jury awards: the agreement did not grant Righthaven license to use the content in any other way. The EFF called it a 'sham.' Judge Hunt agreed, ruling that a 'copyright owner cannot assign a bare right to sue'"

Another detail about all of this that REALLY sucked is that these sites got sued even if a commenter posted a cut n' paste from a news article into their comments section. If this stuff had gone on and on, there would be no unmoderated comments anywhere.
To their credit, one of the first sites, if not THE first site, to actually fight these d-bags straight on, was Democratic Underground. We think they're wrong about everything else in life, but give credit where it is due.
