4 Good Morning Morons. Today is Sunday, March 4, 2012.  On this day in 1789 the Constitution went into effect for the first time. It didn't last long though. Four years later in a plot hatched by John Adams and carried out by John Marshall, who Adams had appointed as chief justice during the midnight judicial stacking following the election of 1800.  In this case the federal government represented by John Marshall decided that it was the sole and final arbiter of what the Constitution meant.   Thus the big government wing of the federalists got what they wanted and could not get at the Constitutional convention, the ability to determine via the black robed unelected judges how much power the federal government had.  There is NOTHING in the Constitution that says the Supreme Court is the final and sole arbiter of what the Constitution meant.  Thus began the long slide into it becoming a meaningless scrap of paper.

Also before moving on to the news let me remind the Morons that there will be no Monty book thread today as he is on sabbatical.

The tornado killed everyone in her family except her.  She was found 10 miles away in a field, critically injured but alive.  Her name is Angel.  Surely she had one looking after her.

11 Palin says West should be considered for VP slot.  I wish people would get off this kick. The VP slot is rarely a meaningful job and is usually a dead end.  We need to keep conservative congress members and governors exactly where they are at in useful positions, not moving them into a warm spit job.  There are plenty of ex-governors and other officials out there to call up for VP.

12 This is a local story but I thought the Morons would be interested in it.  Here we have a dude who was out at night on Lake Murray drinking and partying in his boat.  Unfortunately he ran into another boat killing two young ladies and injuring two men.  In SC the laws for drunk boating are very similar to the laws for drunk driving. In other words, he has at least 4 counts of felony DUI, two of which involved death.  They are literally throwing the book at him with other charges as well just in case.  I am assuming that most States now have similar laws for drunk boating.

I know in the past everyone considered it OK to get out on the lakes and rivers and drink while fishing and boating, hell I have done it myself.  In the past most of the time people were doing that in a John Boat that never got above 5 mph so you were not too much of a danger to others.  But with all the new watercraft, some of which will easily do 70 mph it becomes quite dangerous.

Note also in this story the paragraph about some who wanted more regulations for "training" and lower "speed limits", neither one of which had anything to do with this accident.  This is how crap laws get passed. Luckily the State legislature was able to avoid that this time.

15 Here is something we have often talking about in the mortgage meltdown problem with bad loans.  Here we have a couple who bought a 5K sq ft mansion along the Potomac River in MD.  They have never made a single payment on the mortgage, not one in the 5 years they have been there.  They have been able to forestall eviction by invoking liberal laws in MD for bankruptcy and foreclosure. MD's governor thinks the laws are great because it reduces the foreclosure rate.

Sometimes the insanity is just breathtaking.  How about get rid of the corrupt CRA laws, that would reduce foreclosure even better and it would not drive anyone into bankruptcy?  This was a typical CRA type no money down load made to some one who was already on probation for bankruptcy fraud. In 1981 when I bought my house this fellow would have been laughed out of the bank when he applied for a $1.29 Million dollar loan with no perceived source of income.

But trashing CRA will not happen as long as the communists drive congress and the Republicans are afraid of the race card.

Quote:

In a new book out this week, Sen. James Inhofe (R-OK) traces the history of global warming hysteria and concludes it's a downright hoax. He also reveals how climate-change champions are benefiting financially by promoting the idea.

End quote

Sorry congressman, I have to disagree. A hoax is a humorous joke.  When a complicated plot is hatched using false testimony and number to benefit financially and politically it is not a humorous joke, it is fraud.  The perps should go to jail.

Blaming the CRA for the real estate collapse is a sucker's bet and libs have learned to invoke the fact that the vast majority of bad loans were not from companies under CRA jurisdiction. This is a dodge that avoid the reality of how the threat of CRA imposition was wielded against banks and other loan makers to get them to loosen their standards. Thus there was compliance with no direct intervention, just an implied threat.

Likewise, once the MBS racket went berserk, the CRA threat was a convenient means for a loan maker to explain why they were giving loans to plainly unqualified people but the real motivation was to keep feeding the voracious MBS east.

28 #20  When I got my degree in geology,  the talk was all about the coming Ice Age.  This was in 1976.  I worked for a while and then quit to raise my daughtr,  who was born with a cleft palate and required several surgeries and speech therapy.

Imagine my confusion when I started trying to catch up on the current science news and everything was about global WARMING.  I couldn't figure it out,  particularly when they were using the exact same excuses for the cause of the warming (carbon emissions from power plants and autos) as they had used for the cooling!  I felt like I was losing my mind.

Now here is my question:  Was this just some sort of lemming-like, get-on-the-bandwagon craze begun by a couple of grad students,  or did enemies of the West actively hatch this plot with the idea of crippling us while advancing their own countries and making money from the scam?

Was there a meeting in some little chalet in Zurich where Gore, Soros, and a Chinese government official decided this was a swell way to gain cash and market advantage?  I sure would like to know!

That falls apart even more when you read the regulations and interpretations issued by the banking regulators regarding CRA. This case would have been a prime example. You could not use previous credit history or lack of a job to judge creditworthiness.

Maybe just a shift in scary stories because the cooling disaster wasn't happening?  Like how we've already moved on from warming to climate change because the superheating wasn't occurring fast enough ... just like we didn't all die from SARS / AIDS / Y2K, avian flu, etc., etc., etc., so there's always something else right around the corner ... the libs always have to have something to scare the public with so they can "raise awareness," "be proactive," and "make a difference" in the world around them - in other words, get research grants, drink for free at government-sponsored boondoggles, and further delay having to do any real, valuable work.

The history of this scam is long an ugly.  It started with two crackpot British "scientists" that everyone considered loons until Margaret Thatcher latched on to them.  Every time a meeting of all the Western powers was held to discuss economic issue (G-8 etc) she would harp on this subject.

Finally in order to try to appease her Ronald Reagan recommended that they turn the issue over to the UN and a panel of scientists to "study".  Of course by the time the scietists were formed the UN had been taken over by third world commiecrats and thugs.

They saw this as a way to extort money from the West and away it went.  Following that came scam artists like Al Gore who saw a way to make a name and fortune for himself by promoting the fraud. \

What was simply amazing is that Western government, including the United States climbed on board with this thing despite the science being more flimsy than a dry cleaners plastic cover. Dems I can understand, but even a lot of Republicans jumped on this POS.

More proof the "stimulus" was a skush fund:

More than half of PennDOT's $1 billion in federal stimulus aid went to 20 Pennsylvania companies whose executives donated about $900,000 to state and federal politicians, a Tribune-Review analysis of campaign and contract records shows.

The 20 firms received the most money from PennDOT's stimulus share to perform bridge rehabilitation, road resurfacing and highway expansion projects. The value of each company's package of contracts ranged from $17 million to $67 million. PennDOT considers 70 of 115 companies' projects to be complete.

Pennsylvania received $33.8 billion from the stimulus.

Collectively, executives and rank-and-file employees from the firms gave at least $918,100 to campaigns from 2008 to 2011, before and after President Obama and Congress approved the $840 billion American Recovery and Reinvestment Act of 2009. Some donated as much as $246,400. Others gave as little as $1,000.

Company leaders and transportation officials say there's no connection between donations and contracts. But critics are troubled by the fact that employees from every one of the 20 companies donated some amount to campaigns.

47 Posted by: epobirs at March 04, 2012 08:18 AM (kcfmt) Somewhat correct in that some banks weren't "mandated", but the legislation did prevent "red-lining" Which in essence prevented banks from denying loans in crime ridden neighborhoods. Which was long standing bank policy for years, because the asset would not hold its value. Where it came into play was with Fannie/Freddie. They took the first step to comply and when banks found out they could dump the risk onto the GSEs with around a 2 point profit along with the servicing rights, it was a win-win. I was in the business for a long time and watched this all unfold. I remember lenders popping up left and right and each one offered more ridiculous programs than the previous. We would get memorandums from the GSEs (because we were wholesalers) telling us what loans they would accept this week. It blew my mind that week after week they got looser and looser. It was all downhill from there. I remember in '95 thinking "This can't end well".

The so-called red-lining study was found to be totally bogus almost immediately after it was released. Despite that the Democrats who controlled all three branches of government at the time used it and went full steam ahead.

The Republicans never had the balls to challenge the CBC and get rid of it. AND to this day still will not do it.

53 The CRA never "forced" a bank to lower credit standards - that is a right wing myth.  Sheila Bair (R) of the FDIC tore this myth apart in front of Congress and in a famous essay which is easy to Google.  All the CRA did was prevent redlining for application purposes.

Even the GSE's had FICO minimums.  It was the voracious private MBS market that went ape-shit on pushing bad paper.  (see Contrywide, WaMu, IndyMac, --- the feeders to Lehman, Bear, and Merrill)

An update on the Fattah fiasco:

The son of U.S. Rep. Chaka Fattah tried hard to keep up the image of a rising young entrepreneur, talking about his work for high-living clients and moving in to the luxurious Residences at the Ritz-Carlton in Center City.

But behind the facade, Chaka Fattah Jr.'s troubles were rising. Taxes went unpaid, checks started bouncing, and loan officers began calling about missed payments on a $50,000 loan, according to records and interviews.

And the FBI was secretly digging into his finances - even recording his conversations as he talked about his work as a budding political consultant.

Fattah Jr.'s image crumbled for good on Wednesday, when agents raided the Ritz-Carlton apartment and Fattah Jr.'s space at a law office, seizing a computer and records.

Agents are now asking about Fattah Jr.'s ties with politicians - including his father, Chaka Sr., the ranking Democrat on the House Appropriations Committee.

And they want to know what he did for David T. Shulick, a lawyer and owner of a for-profit education company that receives millions in contracts from the Philadelphia School District and other area schools to educate students with disciplinary problems or those at risk of dropping out.

The FBI also wants to know what happened to American Express gift cards that Fattah Jr. discussed on one of the tapes, according to interviews of two people who heard them. The cards were apparently purchased with at least $7,000 drawn on a school company check that Fattah Jr. cashed, Shulick said.

56 @VIC I would expect that people will begin to notice the lack of power, increasing rates, and ridiculous gas prices this summer when we don't have any capacity to generate. Those hit the hardest are the suburban/exurban populations. I would imagine that the left-leaning inner suburbs will begin to listen to Mittens (presumably the nominee) when he articulates the flaws in Bamster's energy policy. High energy costs coupled with high unemployment don't encourage votes for an incumbent president.

70 Even the GSE's had FICO minimums. It was the voracious private MBS market that went ape-shit on pushing bad paper. (see Contrywide, WaMu, IndyMac, --- the feeders to Lehman, Bear, and Merrill) Posted by: Clarence at March 04, 2012 08:56 AM (z0HdK) Trust me when I say, the GSE had NO MINIMUM FICO. There were many ways to get a loan "bought" by the GSEs. Fannie/Freddie had what was/is called DU Underwriting engine, input borrower profile ie. assets/income/value of house and the engine would chew through the info and either approve/eligible or "defer". I am ashamed to say it but I became the "expert" in many shops in how to get loans approved through DU. I was able to manipulate to info, get an appraiser to inflate the value of the home (holds head in shame), and was able to get many loans through with people with 500 FICO scores. Now the rates weren't good, but these people needed cash and didn't give a shit. Not only that, as a wholesale shop, we packaged loans and sold them to Fannie/Freddie/Ginnie and would bundle 10 great loans with 5 crappy loans and told them it was a package deal. They always took them, it was SOP. I was doing 2/28 ARMs back in 1993 with 500 FICO and 5% down purchases.

The real impact of CRA can be seen in that Washington Post article.  The guy was an 'entrepreneur" with no visible job. He had been convicted already of bankruptcy fraud and had no visible means of income other than rolling houses in a rising market.

Yet despite all of that he was able to get a $1.29M loan.  And on top of that he has been able to game the system for five years not paying a single payment.

Meanwhile the bank, and its investors are out $1.29M that this guy literally stole from them.

But that is all fine with the libtard commies.

Klarence needs a bite from a reality sammich:

Quoting from a study which declared that "underwriting guidelinesmay be unintentionally racially biased," the Boston Fed then called for what amounted to undermining many of the lending criteria that banks had used for decades. It told banks they should consider junking the industry's traditional debt-to-income ratio, which lenders used to determine whether an applicant's income was sufficient to cover housing costs plus loan payments. It instructed banks that an applicant's "lack of credit history should not be seen as a negative factor" in obtaining a mortgage, even though a mortgage is the biggest financial obligation most individuals will undertake in life. In cases where applicants had bad credit (as opposed to no credit), the Boston Fed told banks to "consider extenuating circumstances" that might still make the borrower creditworthy. When applicants didn't have enough savings to make a down payment, the Boston Fed urged banks to allow loans from nonprofits or government assistance agencies to count toward a down payment, even though banks had traditionally disallowed such sources because applicants who have little of their own savings invested in a home are more likely to walk away from a loan when they have trouble paying.

Of course, the new federal standards couldn't just apply to minorities. If they could pay back loans under these terms, then so could the majority of loan applicants. Quickly, in other words, these became the new standards in the industry. In 1999, the New York Times reported that Fannie Mae and Freddie Mac were easing credit requirements for mortgages it purchased from lenders, and as the housing market boomed, banks embraced these new standards with a vengeance. Between 2004 and 2007, Fannie Mae and Freddie Mac became the biggest purchasers of subprime mortgages from all kinds of applicants, white and minority, and most of these loans were based on the lending standards promoted by the government.

81   Private mortgage lenders "partnered" with Fannie Mae and Freddie Mac which were quasi-governmental agencies that bought the mortgages.  Both worked with Wall Street to bundle the mortgages into mortgage bonds.  Every professional investor in the 1990s knew FNM and Mac were backed by the federal government which was why both had lower financing costs than commercial banks.  Countrywide and Fannie Mae regularly promoted their partnership.  The government took over both and has been continually bailing out both with Fannie just requesting another $4.6 billion. The government was the root cause of the housing disaster as it turbocharged a real estate bubble.  Do not forget that the Fed lowered interest rates to almost zero after 9/11.

88 Posted by: Clarence at March 04, 2012 09:18 AM (z0HdK) Yes, they had to buy back loans written with "faulty data". In other words, fraud. We never used faulty data, the only thing that was questionable was the appraisal of the home. Each appraisal was based on the use of "comparables". 3 different homes of equal sq footage/age etc. that sold within a specific time period. Now the comps can't be older than 1 month and has to be around 1/4 mile radius. Back then the appraiser was able to go 10 fucking miles outside the radius and could have been sold in the last year. That was the 'Standard" for the GSEs so it wasn't faulty data, just faulty guidelines.

More for the Klown:

Many defenders of the government's efforts to prompt banks to lend more to minorities have claimed that this effort had little to do with the present mortgage mess. Specifically they point out that many institutions that made subprime mortgages during the market bubble weren't even banks subject to the Community Reinvestment Act, the main vehicle that the feds used to cajole banks to loosen their lending.

But this defense misses the point. In order to push banks to lend more to minority borrowers, advocates like the Boston Fed put forward an entire new set of lending standards and explained to the industry just why loans based on these slacker standards were somehow safer than the industry previously thought. These justifications became the basis for a whole new set of values (or lack of values), as no-down payment loans and loans to people with poor credit history or to those who were already loaded up with debt became more common throughout the entire industry.

What happened in the mortgage industry is an example of how, in trying to eliminate discrimination from our society, we turned logic on its head. Instead of nobly trying to ensure equality of opportunity for everyone, many civil rights advocates tried to use the government to ensure equality of outcomes for everyone in the housing market. And so when faced with the idea that minorities weren't getting approved for enough mortgages because they didn't measure up as often to lending standards, the advocates told us that the standards must be discriminatory and needed to be junked. When lenders did that, we made heroes out of those who led the way, like Angelo Mozilo, before we made villains of them.

Now we all have to pay.

96 Posted by: Vic at March 04, 2012 09:16 AM (YdQQY) Yep, the "Entrepreneur" was the go-to career of those that wanted to purchase a home bigger than they could afford. With bad credit, Real Estate Agents would make up a land contract with the seller and buyer stating he had been living there for a year and making the mortgage payments, the GSE treated this purchase as a "refinance". Inflate the value of the home and now this douchebag is buying the home with zero percent down, but to the GSE the loan was 70% of the value of the home. So you could do a "Self employed No income/No asset also known as a "NINJA" loan. I never did these, that is fraud. But it was done.

126 Back from SS&S and thought of one other thing.

Lets not confuse CRA and ease of obtaining loans to the total cause of the housing boom and bust, which ultimately caused the collapse of the economy.

While true it was a significant contributer, particularly with respect to bank failures, but is wasn't the sole cause of the boom and bust.

The boom and bust was also caused by a number of factors such as extended very low interest rates along with stupid "green space" laws that artificially limited available housing and thus jacked up the price of said available housing.  You can see that in the liberal areas that had the biggest boom such as CA, LV,and FL. Thomas Sowell has written an entire book on it.

Everything was fat dumb and happy as long as a defaulting loan could be shifted to a new customer at a higher price so that the banks could recoup losses on a default.  However as soon as the fed made noises of raising interest rates to something more reasonably approaching normal the housing values quit shooting up. The banks could no longer recoup losses on those defaulted loans and the whole house of cards started falling down.

Hence his half ass apology, which is what it was. He apologized then used the apology to lay into the left and the media.

147 Rush could very well pull off a solid victory here. I hope he's busy writing up a good opening monologue for tomorrow's show, as it will be one of the most listened to in years.

Just as an anecdote, I brought this up to my mom yesterday, she hadn't heard about it yet so I begin by telling her how this Sandra Fluke girl sat in front of Congress and explained the thousands of dollars she has to spend on 'birth control'. Before I could even get to the Rush part, my mom exclaimed, "How the hell is she spending that kind of money on birth control? She must be getting an abortion every month, or is getting fucked all day!" I just burst out laughing and told her that Rush is now gonna get it for calling the girl a 'slut'. My mom said that the girl is a slut if she isn't a liar.

If Rush's apology for using the horrific s-word doesn't mollify the MFM (looks like it won't) then it's game on, and we've got a warehouse of equivalencies we can throw right back at them (Bill Maher's $1 million donation, anyone?). Ace and Rush and everyone else should continue to expose and ridicule this jizz sponge. I smell victory. Smells like fish.

151 CoolCzech,  I agree with you.  There were plenty of ways to go after Ms. Fluke,  starting with her exagerration of costs and her obvious far-left activism,  including enrolling at Georgetown for the express purpose of going to war with the Catholic Church.

Rush shot from the hip without thinking.  It was a bone-headed move and not the first time he has done this.  His mocking of Michael J. Fox contributed to the election of Clalire McCaskill in Missouri,  and I have evidence to prove that based on the low reelection figures of a Limbaugh relative with the same last name who serves as a judge;  his reelect numbers were significantly lower  than those of the other judges who were also re-elected.

It's time eopple realize that we have one Target in this election: Obama.  Not Carbonite, or Ms. Fluke, or any other peripheral figure.   Rush spent TWO DAYS calling her vulgar and derogatory names.  It missed the point about RELIGIOUS FREEDOM AND VIOLATING THE CONSTITUTION.   It was the EXACT same tactic the left used in the Clinton impeachment,  making it all about sex and then accusing us of hypocrisy and prying into people's bedrooms.  nly Rush gave them the evidence for their narrative.

Ms. Fluke is a greivance professional who is no doubt a Marxist at heart.  I have no idea about her sex life, and that is not relevant to the discussion.

I am pissed at Limbaugh for this absolute stupidity,  which was on my local Indiana radio every darn hour for the entire two days until the tornadoes happened.   Limbaugh has been deemed the spokesman for the GOP by the left.  I will not defend him on this because his comments were stupid and completely off the point.  And he has armed the left through his arrogance and idiocy.

It's an unforced error. Rush could easily have pointed out that Fluke is a professional shill for feminism, spinning tall tales, and spewing lies. He could have pointed out that paying for your own contraceptives is NOT a ban.

But no, he had to go for the big sound bite. Well guess what? That sound bite is the ONLY sound bite the media is playing, and it bit him right in the ass.

206 While at Cornell, FlukeÂ’s organized activities centered on the far-left feminist and gender equity movements. Fluke participated in rallies supporting abortion, protests against war in Iraq and efforts to recruit other womensÂ’ rights activists to change its policy. ----------------------------- Which one of the Big 3 reported this? ABC, NBC, CBS? I just want to know who to give credit to. Heh heh.

207 I haven't written a post this election cycle; been lurking. I would normally be in the conservative camp, and be out jumping all over what most perceive to be a moderate Mitt.. My goal this election cycle is ABO. I have heard friends, pundits, other conservatives declare that if Mitt were to win the nomination they wouldn't vote. How self serving, and needless to say a big bunch of cry babies. While they shout that their is not a whole lot of difference, might I point out alone the Supreme Court. And, before you start saying we don't know who Mitt would appoint, we DO know who Obama would. That is just one area alone. There are dozens of other areas that could make a big difference to our Country on who is elected. Put on your Big Boy Panties and support whoever becomes our nominee.

I was watching the news and reading my local paper on line this morning and discovered that the Economy is definately picking up, unemployement is dropping and the Dow is at 13,000!!!! Then a commercial comes on telling people not to be embarrassed if they need to visit a food bank, cause heck, all their neighbors are there too.  Gave a website to find the nearest on near you!

I am becoming more sure that we are headed for a big, fat boom sooner than later.  It is surreal how the media and govt keep lying and pretending with no concern (or realization) that the American people recognize they are lying and that nothing they are saying to pacify is true.  It seems to be creating more distrust and fear and determination than they have imagined.

215 We need to become as organized as the left. Many posters have been saying that they have contacted Carbonite and are canceling their memberships. That is all well and good but it is reactive and defensive. We need to be ready to go after the left's mouth pieces with as much energy as the left does ours. Ace you and your co-bloggers need to step up and help lead us. You have the technical skills to create a one stop place for us to contact the left's financial backers. You and the rest of the leading Conservative bloggers need to create a database of all left wing sponsors and have a simple link that we can click on to file complaints quickly and easily. I am sad to say that many of us out here are somewhat computer and technology challenged and we need your help in order to help the cause. Ace you and other conservative bloggers like Michelle Malkin and Glenn at Instapundit and others need to point us in the right direction so that we focus on one or two sponsors (especially at first) so that we can have an immediate impact. Ace please, please step up and take on Andrew's example and help us your moron army take the fight to the enemy. Otherwise we will be picked off one by one by the left until there is no one left.

218 I had almost forgotten to put Kim Jong Un onto my list of things that don't matter in the big scheme of things, but that are smelly and dirty and might stick to your shoes and make you gag later when you have to clean it up if you don't get rid of it as soon as you notice it.

223 "Neville Chamberlain might be too good for the Bamster. Neville at least was wishcasting with his views on Europe. JEF is actually rooting against our interests."

Agreed. In John Lukacs, "Five Days in May," which describes the early crisis of Churchill's government and how Britain came within an eyelash of surrendering to Germany, Chamberlain was one of Churchill's firmest supporters. He realized that Hitler had made a fool of him, and he wasn't about to let it happen again.

So, can you imagine Obama admitting to having made a mistake, like Chamberlain did? Or supporting a Republican president in a crisis? No, me neither.

227 So is ex-Breitbart "new Jeebus" hereabouts? http://tinyurl.com/6v9z55o Just asking; cuz it's sure starting to look like it. Breitbartery to forward to: ginormous hi-def renditions of Breitbart throwing the Occupiers out of CPAC; Breitbart turning a scarfed press pass over-written in crayon, two expired Vegas tokens & a Hello Kitty key chain into enough comped booze to buzz the multitudes; My Own Personal Breitbart on Toast; Touchdown Breitbart reaching for the overthrow. Still, mighta been a poor career move not to show up today somewhere in Talk Radio land, what with 3-day-later show-ups being so market-tested. "Alex Jones here. We got Andrew Breitbart coming on, right after our exclusive video feed with Dr. Jerome Corsi on the New World Order conspiracy. Hold on a bit, we gotta take a station break". But out there in Mall America, in a nation of 300 million plus, there's moran enough shaggy blond haired pudgy mid-lifers to get spotted pretty regular - so maybe going with the Elvis model will turn out better; at least less obviously derivative.
