Supreme Court Takes Up Arizona Immigration Law Case; Kagan Recuses
— Ace

Honestly, I think she's just recusing herself so she can not recuse herself on ObamaCare, and then say "But I recused myself before!"

Anyway, she won't be deciding this one:

In its notice, the court said Justice Elena Kagan had recused herself from the decision to take the case.

Justice Kagan has come under fire for not recusing herself from the decision to hear challenges to the new health care law.

1 I think like Ace on her not recusing her fat-toad self for ObamaCare, in spite of the emails supporting her views on the subject.

2 But then the question is, how can she justify this recusal and not justify the Obamacare recusal?

What is interesting is this shows how they system our Founders set up, has gotten whacked all out of shape.

Note that they were very careful to balance power, so no single branch could dominate... yet the Supremes really have no check upon their power, or legal authority.  There is no oversite of the Court, and no authority to over ride their decisions, no matter how silly.

But then, the Founders did not envision them as being the Only Arbiter of Constitutionality... they thought the STATES would be the 'check' on Federal Power... which sadly ended during the Civil War.

16 Doesn't Kagan just establish conditions when she ought to recuse?  It's hard to see how she says 'I should recuse in this case' and later says 'but my advocacy for Obamacare doesn't count too'.  I guess for the low info voters, this doesn't matter.  They just see 'hey, she was honest enough to recuse on one issue, so she's clearly totally honest about it all the time'.

UGHGUGHGHGHGHGH

This is why we need better education standards.  If this is Kagan's plan, she must think Americans are dumb as hell, and if it works, she is right.

I agree.  Court picks are long term problems, so this 'let's teach the party a lesson' idea is a bad idea because the consequences aren't just during the president's term.

Had Mccain won, he would have probably had a mixed record on appointments.  Romney in particular has a horrible record on appointments, 75% of them being liberals.  But both are way better than Obama's.

46 OT: In November of 2001 Fox News had a report about attempts to close the so-called "Gun Show Loophole".

Even lamer was the claim that the Sept. 11 attacks were an argument for closing the (nonexistent) "gun show loophole." This claim, made first in a Brady Campaign press release and then in a suspiciously similar op-ed  bearing the byline of former Clinton Administration official Eric Holder, just plain flopped. Nobody could be persuaded that Usama bin LadenÂ’s boys would have trouble laying their hands on an AK-47, regardless of what rules govern gun shows.

Of course there is authority.. In Congress AND in the states.

If SCOTUS throws out a badly written law, it can simply be re-written.

If SCOTUS throws out a law than can never pass the test of Constitutionality, Congress and the states can write and pass an amendment to make it Constitutional.

scissoring

A Lesbian sex act where two partners interlock their spread legs (like two pairs of scissors) and grind their vulvae together to stimulate each other's clitoris to orgasm. Also called tribadism, the practice has many colloquialisms. In some Central American countries it is called "making tortillas," and the Chinese refer to the act as "polishing mirrors".

I felt myself get hard as I peeked through the window and watched Ellen and Anne get naked and make out on the bed, but it wasn't until they began scissoring that I realized I had just creamed in my pants.

I'm just trying to toughen you up for the very nasty campaign ahead. It's called tough love. But if it helps, cleanse your brain with thoughts of 2 hot ladies scissoring like a good moron.

86 Hey, we went from constitutional issues to lesbian sex practices in less than 70 comments. Well done, morons.

I know! ....This is why I love coming here.....learning new stuff.  'Scissoring' is a term that I didn't realize that I didn't know. Heh.

93 This is very constitutionally oriented. There are penumbras regarding rights of privacy, cast by the First Amendment, that place beyond the purview of state authority the docking of two canoes and their consensual little men.

96 A Lesbian sex act where two partners interlock their spread legs (like two pairs of scissors) and grind their vulvae together to stimulate each other's clitoris to orgasm.

It's always been said that to expand your knowledge on any subject is a good thing.  I disagree.  Like fisting, this does not exist in my world according to the rules I have set in my mind.

97 Honestly, I think she's just recusing herself so she can not recuse herself on ObamaCare, and then say "But I recused myself before!"

Yep.

98 Look, be fair. Consider: Elena Kagan Sonia Sotomayor Janet Napolitano and for good measure, Janet Reno While all these women share legal and juridicial notoriety, when they are mentioned it's lucky we all don't end up discussing the Dinah Shore Classic and tricking out Subarus.

...how can she justify this recusal and not justify the Obamacare recusal?

What's going to make her justify anything?:

a.  The MSM's integrity

b.  The GOP's courage

c.   Obama's honesty

d.  HAHHAHAHAHAHAHAH- sometimes I just kill myself!

Underneath the brilliance, the insight, the ready command of facts and logic lies the humorous thoughts and impulse control of a 13-yr old boy.  Always ready to spring forth unbeckoned, like his tallywhacker.  Can we call it a tallywhacker, please?

101 I'm sure someone will correct me if I am wrong..

But.. If she recuses herself on Obamacare, it does absolutely nothing for our side.  She is pro Obamacare.. she would vote against throwing it out.  How does her recusing herself help us get Obamacare thrown out?

I'm not up on my SCOTUS history - have there been many cases of a SC Judge recusing him/herself on hearings/decisions/etc. in the past?

'Cuz 10 out of 25 so far seems to me like Ms. Kagan is - like her appointer - voting "present" on an awful lot of stuff.....

Perhaps an amendment that a President cannot appoint someone who is currently serving so "close" to his/her administration would not be out of line?

103 'Cuz 10 out of 25 so far seems to me like Ms. Kagan is - like her appointer - voting "present" on an awful lot of stuff... No kidding. Next time I'm appointing someone with more guts and loyalty. Recusals are for losers. At least Sonia has my back.

105 If I ran the zoo, Supreme Court justices would be term limited (12 years, maybe?) and there would be some limit on how many justices a President could place on a court per term.  Throw in some kind of temporary appointment mechanism to cover unplanned openings (deaths, sudden illness, etc.) and I would think this idea would get bi-partisan support.

Well sure, there will be a handful of cases in the beginning of her 45-year career on the SC bench that she will need to recuse herself from.  But after that, baby, WhooooHooooo!

108 This one's easy. She recuses herself on immigration and the Arizona law is  upheld. That give the stuttering clusterfuck an issue to rile up the Hispanic vote. OTOH, liberals know that the Court must uphold Obamacare because it will be decades before such an atrocity makes its way through Congress again.

110 This is how I think this went down: The administration got some inkling of which way Kennedy might vote, and concludes that he will side with the non-ass-clown wing of the supreme court. The admin quietly told Kagan to recuse. This is a triple score for Obummer. -the issue he fares worst on is off the table for nov -the repeal of the bill at the hands of conservative supreme court energizes his liberal base. -he gets to caterwaul about how the rethuglicans forced a centrist purer-than-driven-snow judge to recuse using underhanded techniques.

It's a pretty normal aspect of nominating the solicitor general.  This has happened many times before... they just have to recuse on a lot of stuff for a while.

Because the lower court ruled it UnConstitutional, and the Court therfore must overrule the lower court... which a 4 to 4 tie does not do... as it takes a Majority to 'overrule' the lower Court decision...

Tie, favors us...

120 People who side with tenuous concepts of a broad across the board immigration policy obviously do not live in a state overrun with illegal aliens. Did I say overrun? I mean OVERRUN. Once the rest of the states experience this then, and only then, can their citizens express their stupid, whining OVERLY liberal opinions about the unfairness of aggressive immigration.
