A little perspective...I used to have my own little blog (and was accepted as an official "moron" correspondent.  No where NEAR the traffic as this very prominent blog...perhaps 1/100th.

I had a post in which I implored my handful of readers and anyone else who tripped upon it from google to NOT comment on or reveal certain information...and one comment got by the goalie so to speak.

No big deal, right? 

Until I was contacted by an attorney representing one of the parties.

Now liable or not for that slip up, it was a scary thing.  I would suspect that whatever income Ace derives from this blog, it's not enough to deal with lawyers.  

I don't know what happened, but sheesh people, why wouldn't you respect Ace's wishes here? Though perhaps he wouldn't be legally liable for anything the morons post in an attempt to be funny, why even open that door?

A lot of attorneys will take Anti-SLAPP stuff on what amounts to contingency - the statutes themselves provide for a mandatory award of fees, and SLAPP motions tend to be very tough to defeat.  It isn't surefire, but they are very, very nasty.

I did some head scratching and answered it myself. Thought of two times, actually; both were local news stories. Each involved a family with adults practicing god-awful judgment and a teenaged daughter that got dragged through a mess. The newsworthiness of each was questionable at best. Both times, all I could think was That poor kid.

Enough with the crap that contributes, in however small a way, to wrecking families. Legalities aside (and they're never really aside) it's nice that Ace has some standards of decency.

If that's the direction the prior thread had gone, I think ace made the right call. Impugning the chastity of a woman, or accusing someone of having a loathsome disease, is still actionable in a lot of states.  Sure, ace would ultimately win any lawsuit (particularly by a dumb broad like Gloria Allred), but lawsuits are expensive.  Unless somebody was stupid enough to sue him in a state with an anti-SLAPP law (like California where I practice - where the loser has to pay for bringing a frivolous anti-speech suit), even a frivolous lawsuit is still a major pain in the ass.

Ace feels, and probably rightly, that he has the most exposure to liability from some Weiner tweeter who now have convinced themselves they are victims of anyone besides themselves and Weiner...including liability from stupid commenters.  I'm sure he stands behind what he writes, but I don't think precedent has been set for legal responsibility in the blogger/commenter era.  So it doesn't hurt to be careful.  You have free speech in that you are free to set up SayWhateverYouWantHoneyBadgerDontGiveAShitBlog.com, but this is his blog and he's free to make the rules or take the ball home.  The comparisons to LGF are exaggerated, but I'd posit that even Charles has every right to make rules that make his blog suck so badly.

The Weiner stuff was an abolute blast and a gift from the Comedy/Righty Blogger gods, but it's past its expiration date and never had anything to do with the women Weiner chatted with, aside from the potential for legal issues regarding age.  It's also interesting to some to hear their stories, but that's really all just gossip.  It's done. 

(But man it was so awesome.  I hate a lot of people's politics but not the people, yet every time I saw Weiner on MS-NBC I hated the man just as a man...I'd hate him if he delivered pizza to my door with that attitude and personality.  I felt no sadness in watching him fall so spectacularly.  And, his last name is Weiner...awesome.)

First, even when you win a lawsuit, it is still a major pain in the ass.  More importantly, however, is that this situation is particularly risky. A lawsuit would cost Ace his anonymity. Because of Weiner, Ace is now a major enemy of certain lefties, and Ace understandably does not want to get the 'real world' harassment that falls on people like Breitbart. 

It's just a world of headaches that isn't worth it.  Look, I sue crazy and corrupt people all the time, but even I don't want to deal with internet driven crank calls, worrying about my car being keyed, or photos of that dead hooker my personal life being made public.

I don't know how you do it, ace.  Posting stupid things on Twitter freaks me out - thus, having to worry over other people's comments seems insurmountable.
