— Gabriel Malor The Fourth Circuit will take up the first two ObamaCare appeals this morning in back-to-back arguments. First up is Liberty University, which lost below, and then the State of Virginia, which won on some, but not all issues.
Unlike the multi-state lawsuit out of Florida, which has a much better substantive and procedural posture and resulted in knocking the entire law down, these two lawsuits focused solely on the individual mandate. The big issues in today's hearing will be standing, whether economic inactivity is "activity" for the purpose of the Commerce Clause, and whether there are any meaningful limits on what is "necessary and proper" to the exercise of federal power. The acting Solicitor General will no doubt make the argument that "health care is different" to justify the sweeping, dare I say tyrannical, scope of ObamaCare.
Assuming the Fourth Circuit manages to activate circa-2000 technology (not a guarantee), audio of the argument should be available on its website around 2pm EST.

If health care is "different" I assume someone will explain how.
What I think is that once this is allowed to be implemented, the next thing will be food. Food will be labeled "different" because everyone has a right to eat.
Then housing, because everyone has a right to shelter.
etc.

Miss M: The liberal definition of "rights" is elastic to say the least.
I always thought it would be nice if ANY Repub Senator had had the stones to ask each SC nominee the George Will question "Can you name one thing that is undeniably exempt from the Commerce clause?"
On a related note, the reformers keep saying that if only we could "buy health insurance across state lines" somehow seem to forget that this is one of the few features of the current law that might be interpreted by a court as keeping health insurance as a State prerogative, rather than a Federal one.

Now we are undertaxed and only pay 14% of GDP. If you read this stupid article and think between the lines you would see why there could be a drop as compared to GDP. Remember that GDP includes government spending. The porkulous package has vastly increased government spending by running 1.7 trillion dollar deficits. Since that money was never “earned” by anyone it was never taxed.
The second problem with this article is that it is most likely an outright lie to begin with. I have seen articles recently that put the number at 18% which is what they say it always becomes regardless of what ever the rates are.
Remember the old saying; “Figures don’t lie but liars figure”.

More stupid politics from Obama
Obama to keep National Guard on border
President Obama will keep the National Guard on the U.S.-Mexico border past their current June deadline, agreeing to the demand by a number of border lawmakers who say having the military there deters illegal activity.
Why? They put these guys out there unarmed and they are not “arresting” anyone. Even border patrol has been told no arrests or deportations. So what is the point. And another question; who are these “number of border lawmakers”? That sounds like the typical cop out from liberal PR, the ubiquitous “they”.

Or could a basic policy be written and the onerous portions (such as covering drug addiction or whatever) be added as riders when people take up residence in states that require those riders?
I am no expert, just thinking.
As I said, though, this really isin't about health care, any more than the lack of drilling is about caring about the environment.
It's all about power and control.
And wrecking the economy on purpose.

This is the last sentence from the sidebar article on Islam. As depressing as it seems, it's actually wildly optimistic. The reality is that Islam is, by design, murderous and expansionist. Only when a leader arrives to change the tenets of the religion will there be a better way. And that won't happen.

More slanted biased and false reporting from AP
The headline reads:
New Boeing plant sparks uproarNo assholes, the plant doesn’t spark uproar. The uproar comes from the illegal actions of the NLRB. The story dutifully regurgitates everything the NLRB says, neglecting to mention that the move by the NLRB is unprecedented and exceeds their authority by a country mile. It also neglects to mention that the board has been staffed now with union thugs and has zero credibility as a “neutral arbitrator” which is what its function is supposed to be.
If the Dems are going to obviate the purpose of the board then the House Republicans need to simply defund it and eliminate it.

Bwhahahaha! This actually came out on the weekend, but I just read it today. Oprah Network ousts its CEO. From her pic, she looks like an affirmative action hire (Black Lesbian).
"In the middle of last week, OWN board members decided to replace Ms. Norman becasue they felt the channel needed new leadership to better establish itself, especially as Ms. Winfrey begins to turn her full attention to the network later this month...Ms. Norman, a former president at MTV didn't return calls for comment.
She was an early champion of bringing talk show star, Rosie O'Donnell to the network. Ms. O'Donnell will be doing a daily talk show on the network in the fall."
Yup, Rosie O'Donnell. That's sure to fire up the ratings.

They won't. A lot of her success came from the fact that she was on right after the soaps in a lot of markets, so TV's stayed on and women watched.
These same people will now be watching what comes on in the afternoon in their free or basic tier of cable. If it's Katie Couric, SHE will have "found her calling." Or if it is an hour of kittie videos, same deal.
Oprah is going to fail, and spectacularly, and I will chortle with glee.

About half voted to confirm. That is below normal for repukes. They did block one yesterday. That actually scares me because the guy had got in on a recess appointment.
If he was so bad the Republicans blocked him he had to be VERY bad.
One thing to keep in mind was the vote by the committee to send it to the floor WAS the confirmation vote. At this time the Dems didn't need ANY Republicans to confirm him. The Judiciary Committee does require at least 1 minority vote to go to the floor. They could have blocked him there. Only 2 Republicans voted no.

runningrn, I am pleased that Oprah is heading to her own little network, in the upper tier of cable channels, so that people will have to pay to see her.
She could just take P&G down with her. From ABC News some time ago:
P&G, the manufacturer of dozens of household name brands like Tide, Crest, Tampax and Pampers, committed to a deal reportedly worth more than $100 million over three years. The agreement, which includes the purchase of time and integration into programming, is unprecedented in that Winfrey's network (OWN for short) will not be on the air until January 2011, does not yet have a full programming lineup and has no audience and therefore no basis for ratings, reach or demographics.
There are sacred ground rules. If the show does not perform, advertisers generally get some type of "make good," generally the right to run additional commercials. Although we have to assume the deal between OWN and P&G has laid out parameters based on some kind of performance measures, the truth might be more juicy.
Procter & Gamble is probably making a good bet.First of all, the Winfrey deal is a mere morsel from their $2.71 billion dollar ad budget grand buffet. The onus is on OWN to make this work as advertisers have often followed P&G's lead. And if P&G is happy, other big advertisers are sure to follow.
It is likely therefore, that Procter can use this leverage to stretch its advertising dollars. The Chief Marketing Officer's role at Procter & Gamble is sometimes referred to as the most powerful job in advertising, and P&G is known as a conservative company that generally only makes sure bets.
Yeah, because everyone knows that success in advertising comes from getting to run a whole lot more ads on a station that no one is watching!

Total taxation, as suggested by a fair amount of research, can't exceed 20% of GDP. But these buffoons are talking about federal tax only. The last time I checked, my state taxes weren't optional. And if you add in all of the other taxes and fees we pay, our tax burden has grown, not shrunk.

I suspect that they had "over-interpreted" the rules. This is common in a lot of large companies that have a legal department that likes to play it safe. Generally speaking common household products in small quantities are exempt from the hazmat rules.
When they first came out with all that "chemical spill and hazorous stuff" mess though we had to put labels on damn near everything, including whiteboard cleaner. A bunch of us actually went into the regualtions and responded back to corporate that they had gone off the deep end. They backed off.

ALL Blue Laws are State laws, particularly liquor laws. When they repealed prohibition the amendment specifically states that it is up to the States how they wish to regulate it. SCOTUS has consistently ruled that States can do anything they want in the form of regulation.

Yes, the interpretations of all of the OSHA rules erred on the side of CYA. We had an unfortunate series of nasty accidents that we could show were the fault of the employees not working as trained, but OSHA hammered us anyway. The corporate settlement required internal audits and strict external oversight from an auditing company.
One of those accidents involved an employee who was later used as a pawn by the union. He had to return to the building in which he had lost his arm, and I inherited him. Needless to say, he had a bad attitude.

This is a rather pathetic attempt to harness the MoronSphere for good. It' basically a fundraising attempt (but for a good cause). If you think it's inappropriate, feel free to skip it (or even delete it if you're one of the mods) so you can get back to your Ewok PrOn.
If you're still reading: as many of you know, I lost a 10 year old son 2 years ago after a long (6-year) and horrific battle with cancer. He spent the equivalent of about 6 months during that time making visits to the hematology/Oncology unit for chemotherapy and blood transfusions (cancer is a nasty, nasty bastard of a disease). During his time at the hospital, he always looked forward to the visits from the Hole In the Wall Camp staff workers who'd come to the hospital to entertain the kids as part of their Hospital Outreach Program.
As one way to mark his passing, on May 29th, I'll be riding in a 50 mile bike ride (pretty much along the eastern border of Connecticut from North To South) to help raise funds for the Hole in The Wall Gang Camp. In case you're not aware of the work the Camp does, it was started by Paul Newman (and friends) as a way of giving the camp experience to very sick children. The kids stay in what is essentially a quality hotel completely tricked out as a Wild-West camp (it's named in honor of the Hole In The Wall Gang from Butch Cassidy and The Sundance Kid). While there, they get to all the things that are part of the camp experience (without the "funny" counselors) all while getting any medical supervision they need (area nurses and oncologists all volunteer their time so that there's always a full medical staff on site).
Over the over the last 20 years or so, the camp operation has grown to the point where they now have over a half-dozen camps in the US, Ireland, and Eastern Europe (among other places) - there's even one in North Carolina that has a NASCAR theme. During that time, they've been able to give a fantastic camp experience to over 160,000 very sick children. As an aside, my nephew Jacob died from the same cancer as my son, and he also spent many weeks at the camp (it's only a half-hour from my sister's house).
You can read more about the camp at
http://tinyurl.com/6axc7z5
or simply view a 5-minute video (caution: it will make your eyes water) at:
http://tinyurl.com/685rtey
I realize that most of you have your own charities to support (including research on breeding a meatier, tastier Hobo and on Ewok Mating Habits). However, if you care to give a bit (even $5 helps) to an extremely worthy organization, you can help sponsor me and support the camp, online at
http://tinyurl.com/6xdlhyx
It's true that Newman was generally a liberal twit (sorry - I repeat myself). But this shows that even liberals get it right sometimes.
So, if you can slide even a fiver towards the camp, it would be appreciated.

Louisiana - Sale is not state controlled. There are no restrictions of on or off-premise sale unless municipality decides on-premise sale must stop at 2 P.M. Off-premise sale is allowed in grocery stores and all other licensed stores. These sales can be 24/7 and no municipality can challenge this. In New Orleans you can drink alcohol in plastic cups in public and if allowed by the bar take your drinks from one bar to the next. It amazes me that men who are considered 'brilliant politicians' will flirt with creating a third party through their stupidity. Take that quisling idiot John Boehner. He's so committed to the idea that conservative principles will lead to electoral ruin for the GOP that he's willing to cause electoral ruin for the GOP to avoid it.

Did you know that every dui dismissal in Fairfax county has to have a MADD representative sign off on it? They go to every hearing and if the judge says that it's not a dui or if the blood test etc comes back negative that MADD has to agree? MADD then gets paid for the dui classes that are compulsory? They also then donate to candidates and endorse them? On top of that, cops get a "bonus" for every dui.
BTW, never take a "field" sobriety test. They will do it in such a way that you fail even if you are stone cold sober.

Louisiana - Sale is not state controlled. There are no restrictions of on or off-premise sale unless municipality decides on-premise sale must stop at 2 P.M. Off-premise sale is allowed in grocery stores and all other licensed stores. These sales can be 24/7 and no municipality can challenge this
That's what I found, too. But then I found several sites that have discussions like this:
Actually years ago, when I was a Shreveporter, Sunday alcohol sales were banned altogether. Progressive Bossier City started Sunday beer and wine sales and so it was the custom to drive over the S'port-Barksdale bridge to that gas station in front of the base after you had consumed what was left from the case you didn't polish off on the previous Saturday night.
Then the City of Shreveport saw how much tax revenue it was missing-out on and allowed Sunday beer and alcohol sales starting in 1994 or 1995. That was great because Thrifty Liquor was just around the corner on Youree drive from my house.
Strange.

I noticed that in upstate NY. You can buy beer in a grocery store but have to find a liquor store to buy wine. Very strange given NY is a wine producing state. You would think they would encourage wine consumption with food. I also noticed that the Italian-Amercians still buy wholesale grapes/juice and make their own wine at home. Smart people. In NC, it's State run ABC's (the Governor recently passed on a commission recommendation to sell off the stores) for all hard liquor, closed on Sundays.
PA was the worst. If you wanted beer and a gin and tonic, you had to go to three stores. State-run for the gin, package store or bar for beer and a grocery store for the tonic.
Alternately, there was New Jersey.

When I was in OH it was easier to get the hard stuff. Old drunks went in and bought bottle of liqueur and a bottle of water (2 separate transactions). They'd put the liqueur in the small of their back (hidden under their shirt) and outside the store they'd hand you the bag with the water in it. If cops showed up, they were buying you water (with the receipt) and if they didn't, they'd hand you the bottle with the liqueur in it. Bums are so freaking smart sometimes.

That horseshit about cops wanting you to blow and blow to get the highest reading pisses me off. Cops piss me off. And I'm a pro-law enforcement conservative.
And then there was the time I was standing quietly outside the bar to get away from the cigarette smoke when the little Napoleon came up and demanded my keys. I didn't give them to him, and I went to jail. No breath test, no FSBs, just little Napoleon with a hard-on for me.

Oh, folks, this is rich. I got my usual SEIU email alert this morning (I've been getting at least one a day every day for weeks now -- they're panicky). The headline topic is still NH HB474, our "Right-to-Work" bill that was passed in both the NH House and Senate and is on its way to the Governor. He's promised to veto it, but there're super majority Republican contingents in both legislative branches here in NH, so as long as no one steps away from the party line, that veto should be easily quashed and the bill enacted. The SEIU is so apopleptic about this legislation that they've taken to namecalling. Our House Speaker is William O'Brien, but they refer to him as "Bully" O'Brien because he's "bullying" people into voting for this legislation.
It's like grade school. I love it.
But none of that is what I find awesome about this email. I'm more drawn to the second item they discuss, NH Senate Bill 125, which is, "AN ACT relative to the business profits tax deduction for reasonable compensation." It repeals an earlier act related to "Reasonable Compensation" business tax deductions and reenacts it with new language. The crux of the bill is as follows:
"In the case of a proprietorship, partnership, or limited liability company filing a business profits tax return as a proprietorship, partnership, or limited liability company, a deduction equal to a fair and reasonable compensation for the personal services of a natural person who is a proprietor, partner, or member provided to the business organization..."
I bet you can already guess what the SEIU's party line against this legislation is.
The fiscal note to SB 125 predicts that the bill would cost New Hampshire about $50 million in business profits tax revenue each year.
Fifty million dollars is a substantial chunk of the stateÂ’s revenue. This one bill goes a long way toward explaining why the LegislatureÂ’s revenue projections were so pessimistic.
Fifty million dollars also happens to be the same amount of money that the Legislature wants to cut from state employee wages. Rep. Neal Kurk’s attacks on the SEA and other public employee unions were supposed to be “a way to trim state employee wage costs by $50 million.”
Fifty million dollars out of our pockets,
and into the pockets of LLC executives.
(Bold, red font theirs, other emphasis mine)
Get it? Instead of the state getting all that yummy, yummy money, it's STOLEN from the treasury - literally taken from the pockets of our State workers! - by those GREEDY LLC EXECS. I bet they're all named Koch and meet in secret cabals with likeminded villains who are bent on destroying the world through corporate profits.
Also, here's the full text of that fiscal note they mention. The one that says this bill will cost the state $50 million, as the SEIU breathlessly tells us.
The Department of Revenue Administration states this bill will decrease state revenue by $49,430,000 in FY 2012 and each year thereafter. There will be no fiscal impact on county and local revenue or state, county, and local expenditures.
Emphasis mine, because of course they're not going to mention that. I suspect the $50 million is, as they DO mention, expected to come from employee cuts, but trust me when I say there's plenty of deadwood that can be trimmed. Hell, rent alone could take a big chunk out of our budget shortfalls. NH's departments are scattered all over the place, especially in Concord. Consolidating would take a hefty splash of money and time in the short term, but long term it would be a huge savings; especially if some of the freed-up space was sold to private industry.
But wait, there's more!
Between now and May 18th, please contact your Representatives and let them know what you think about this bill. Cutting $50 million from the state budget – to create a loophole in the state’s business profits tax law – to allow LLCs to avoid paying their fair share of corporate taxes – is simply outrageous.
You know what's simply outrageous? That these people can get out of bed in the morning, look at themselves in the mirror, and not say, "Oh my God, I'm the stupidest creature to ever walk on two legs. How did I become such a vapid waste of space?" Pray tell, what is an LLC's "fair share" of corporate taxes, if not that which is designated by the legislature? Why do I have the feeling the SEIU's answer would be, "Any and all profit should become part of the State's revenue stream where it can do the most good for people."
Amazing. Just amazing.

I've become a light weight in my old age, so I won't drive if I've had more than one beer over a two-hour dinner. Mr Y-not is also super careful, although obviously he can handle a bit more than that. I'm sure if one of us were 0.001% over the limit they'd throw the book at us - and pretty much destroy our lives - but on a daily basis I read about DUIs involving repeat offenders or even folks with other "substance abuse" issues.
Last year there was a heroin addict, repeat offender, who tested for H as well as being over the limit when he took out a pedestrian (the dance instructor I mentioned above). She's still in rehab but can't work and he just got probation. The LDS culture here is really into forgiveness, but even the victim sounded mad about the light sentence.

Do you have a goal you are trying to reach? How many bikers are participating?
As an aside, my nephew Jacob died from the same cancer as my son, and he also spent many weeks at the camp (it's only a half-hour from my sister's house).
That is sad crazy. How rare is that? Did your son get to go to camp? How are you and your sister (and family) holding up. I offered up some prayers for all of you.
Do we have till the 29th to donate? I can't today but I will check out the link (can't watch the vid. or I'll just cry all day) when I can.
Good luck to you. I hope you are able to raise a great bit of money. It is a worthy cause.

Setting aside the MADD stuff for a bit (which I now realize was the main thrust of what you folks were talking about), in terms of "fault," if you have an accident when you're over the legal limit - yeah, you're screwed. But to me that's just a risk you assume if you drive under those circumstances. It may not be fair, but neither is it fair that if my front bumper touches your car I'm automatically at fault, even if you crossed my path illegally or stopped without warning.
But, yeah, I agree that there appears to be a very poor application of drunk driving laws and punishments. It's always struck me that it's the upstanding citizens who suffer the most from a single incident, while the perpetual drunks keep driving.
And, yeah, we were t-boned by a drunk back in Houston. DA called us for our opinion on what to do to the guy, but didn't take it, which was worse than if he hadn't called us at all.
I will say my husband has hired two people who had DUIs and both wound up being bad employees. So maybe if your judgment is that bad behind the wheel it says something about you.

Hi, Vic! I looked up your South Carolina liquor law regarding sales on election day. Here's the language:
SECTION 61-6-4160. Sunday sales; election day. [SC ST SEC 61-6-4160]
It is unlawful to sell alcoholic liquors on Sunday except as authorized by law, on statewide election days, or during periods proclaimed by the Governor in the interest of law and order or public morals and decorum. Full authority to proclaim these periods is conferred upon the Governor in addition to all his other powers. A person who violates this section is guilty of a misdemeanor and, upon conviction, must be punished as follows:
(a) for a first offense, by a fine of two hundred dollars or imprisonment for sixty days;
(b) for a second offense, by a fine of one thousand dollars or imprisonment for one year; and
(c) for a third or subsequent offense, by a fine of two thousand dollars or imprisonment for two years.

Newt's ego has its own gravitational field which means he's attracted to the MFM like a moth to a flame. The funniest thing I've ever heard about him came from, of all people, squishy Medved who knew one of his staffers. When he was moving either into or out of the Speaker's office, he had a giant and smaller transfile boxes to be moved. The huge one was labeled "Big Ideas" and the smaller one was titled "Really Big Ideas".

I don't think you realize how screwed you can become. Because of zero-tolerance, someone just over the legal limit involved in a vehicle accident with an injury is treated the same as someone who is two or three times over the legal limit. This is silly, considering we know someone just over the legal limit is not as impaired as someone massively over it. For that matter, the legal limit is arbitrary.
The problem is that zero-tolerance laws are too strict. The legal limit is too low and the punishments are too severe for people just over the legal limit. But groups like MADD have parlayed 'absolute moral authority' into pushing an agenda of punishing people who drink alcohol. The heavy drinkers are still out there and haven't been stopped by it at all.

Revenue. They need the money and they know parents wich children both have a vested interest in not being scofflaws, and probably don't have the time to fight the tix.
If speeding and traffic infraction tickets were intellectually honest, they would put all revenue collected into escrow and pay it out evenly to state licenced drivers without infractions at the end of the fiscal year.

If the person's alcohol concentration is sixteen one-hundredths of one percent or more, then the person must be punished by a fine of one thousand dollars or imprisonment for not less than thirty days nor more than ninety days. However, in lieu of the thirty-day minimum imprisonment, the court may provide for thirty days of public service employment. The minimum thirty days imprisonment or public service employment must be served at a time when the person is not working and does not interfere with his regular employment under terms and conditions as the court considers proper. However, the court may not compel an offender to perform public service employment instead of the thirty-day minimum sentence. Notwithstanding the provisions of Sections 22-3-540, 22-3-545, and 22-3-550, a first offense charged for this item may be tried in magistrates court;
So first offense with a 0.16 you get 30 - 90 days in jail and a $1,000 fine.
< 0.16 you get $400 and 48 hours.

I firmly believe that all public employees should be videotaped during the course of their work day, and that they have no right of refusal. They are given authority over us, and with that authority comes responsibility. Videotaping is simply one way of holding them responsible for their actions.

Be aware, the pay is likely to suck, so you will need to think about a cheap way of living in DC, probably forgo a car, and get a part-time gig at night. (I stocked shelves at Giant, bartending/waiting is bad.) Those places are not a career - they are stepping stones. Use them to first identify where you want to work, then make contacts, and move on - hopefully into a 2013 Republican administration.
You will also find the most important secondary skill you can have for any organization or politician is fundraising.

Kind of although it's not nearly as bad as the shithole of East Cleveland. Still there are a lot of libs that hold sway in the local gubbiment so it's worse than it should be. The cops are generally fairly kickass and don't take shit so it hasn't gotten out of control. The public schools are total garbage (I sent my youngest Hatette to private school) so I'd be outta here if it wasn't an empty nest.
The Cleveland Clinic expanding has forced a lot of low income people out into the inner ring 'burbs. Still the shitty economic climate has just forced a lot of people out of the whole fucking area. It's not nearly as bad as Detroit, for example; except to Detroit's credit they've dropped so fucking low that they're starting to kick out all the shitty pols that ruined the city, and Cleveland hasn't done that yet.

They can ask for your license and insurance and if you don't have it, guess what? Which essentially makes driving down the road probable cause.

If they can ever make a cheap, simple DNA test, that would be the way to go. At the moment I think it'd be prohibitively expensive, given the equipment that would be needed, the installation required, and the necessary calibrations.
I'm surprised they haven't managed to work out a simple DNA test yet, to be honest. Just think about how many episodes of daytime talk shows revolve around babymama's wanting to find out which of their past boyfriends is their kid's babydaddy, and therefore on the hook for child support. If you've got some venture capital lying around, maybe try and invest in that. I imagine the demand would be HUGE.

It seems to me that it would be hard to prove damages if a store decided categorically to not sell any particular product on a Sunday. I guess it depends on how the statute is written.

"SLAMABAD, Pakistan -- In the wake of Usama bin Laden's death, a former Pakistani intelligence officer Monday confirmed that US Navy SEALs launched a similar raid in Pakistan territory in 2006, targeting senior al Qaeda figure Ayman al Zawahiri."

Well, it only costs about $60 to have DNA run on your dog to see what breed(s) are in there. They do this to prove that your dog isn't a pit bull mix and therefore not subject to vicious dog rules.
So the testing itself is relatively inexpensive. If you had a device on the car that worked like a blood sugar tester. I small pinprick that takes a drop of blood and confirms that it's you and that there is no alcohol in your system. Then you can start your car.

No, I do. And I agree that it seems as if they enforce DUI laws much more toughly on the people who are easy to control - ie; law-abiding people who make one mistake. The repeat offenders - not so much.
All I'm saying is that given that I think that is the case, we are extremely careful about drinking and driving.
Fortunately, (!) it's so expensive to go out to eat that we rarely have more than one beer or glass of wine when we do so, anyway. Plus, we're in Utah County, so that acts as a deterrent.

Such devices have been ruining marriages and society for the past 50 years! Destroy them! Banish them from existence!

Bought a new HD LED flatscreen yesterday. The old TV died, and it was Mrs.'s birthday.
Anyway, last night, she remarked that she liked it so much, she wanted to have sex with it. I replied that that is actually a thing-- that there are people who are sexually aroused by objects and even have sex with them.
Really? She asked
Yep, I said, they call those people "women"
And then I ducked.

I'm always bemused when I'm driving along and I see an empty 30pack of Natural Ice on the side of the road. I think, "Aww. Someone was drinking and driving here. And they chose to litter to prove it! How sweet!"
I'm not a fan of over-stringent police action, but I am against people being that blatantly stupid. Especially with such a crappy beer.
Of course, I'm not really a drinker (one drink every year or two, on average).

Which reminds me, today is the day Utah's immigration law goes into effect. It's the one with a small stick (cops have to run immigration status on serious offenses, although I don't know what constitutes serious) and the huge carrot (employers can sponsor an illegal on a work permit arranged somehow with a Mexican state).
About a week ago the Utah County Republicans had a tumultuous meeting at which they passed a resolution demanding the law be overturned. I believe several other of our counties have done the same thing. We have a part-time legislature (it's like 6 or maybe 8 weeks) and they really rushed this bill through (also some others, one of which has already been put aside or over-turned or something; they also fucked up some budget stuff and passed something they didn't intend - we know some of the state legislators). The governor signed it - disappointingly.
Anyway, the amusing thing is reading in some of the comments of the Deseret News the Democrats slamming the Republicans in Utah County for not being Mormon-y enough. Matheson, I believe, is quoted on the record saying how the Democrats are more in line with the LDS church than the Republicans are.
I feel like I've fallen down the rabbit hole.

304 A new national alert system is set to begin in New York City that will alert the public to emergencies via cell phones.
An alert system that will alert the public? The deuce you say!
Have they never learned the core principle of writing a definition? Namely that you don't use the term you are defining within the definition?

Because the closest states to Texas demographically now are California and Nevada.
It will start to be difficult for a Republican Presidential candidate to carry Texas starting around 2020.

As one way to mark his passing, on May 29th, I'll be riding in a 50 mile bike ride (pretty much along the eastern border of Connecticut from North To South) to help raise funds for the Hole in The Wall Gang Camp.
Do you have a goal you are trying to reach? How many bikers are participating?
I originally hoped to raise $1000, but I'm now shooting for $2000.
The cancer (Neuroblastoma) is pretty rare - only about a couple hundred cases a year in the US. So two in a family is pretty much unheard of. In fact, having the two related cases was instrumental in his oncologist figure out some of the genetics behind predisposition to this beast.
As far as holding up, we manage. She has three other kids, and we have our 10 yo daughter and a 2 year old (born 6 weeks before our son passed). It helps when you have faith that this world is not all there is.
To add another wrinkle to the story, my younger brother also lost a child (21 year-old daughter) about 6 months before my son passed (and 18 months after my nephew). On New Year's Eve day she went out driving in a snowstorm, drifted across the line and hit a truck. So each sibling lost their eldest child within a 2 year time span (with the exception of my older brother who thankfully never contributed any material to the gene pool). . It's pretty unbelievable - if you used this as the premise for a novel, it would be rejected as totally implausible.
Do we have till the 29th to donate? I can't today but I will check out the link (can't watch the vid. or I'll just cry all day) when I can.
You're good until the 26th (they take a few days to post stuff up), SO far, it looks like a Moron or two has already pitched in. Sorry to cut into yur drinkin money gents, but I really appreciate it.
Good luck to you. I hope you are able to raise a great bit of money. It is a worthy cause.
Thanks - so far my team (5 people, all of who have a child with some experience w/cancer) has raised almost $4,000.

Re: breathalyzer car ignition interlock.
One of my neighbors here at my shop does the calibration on those systems. The drunks have to drive their car in to do cals every couple of weeks. NONE of them park in the parking spaces when they're waiting for their turn, they block access in the driveways all the time. About once a week I have to shoo away some DUI convicted miscreant who parks right in front of my open roll-up door.....and they always get pissy about it, like the world revolves around them. They wear an "I can do what I want, and I don't give a fuck if it inconveniences you" attitude on their sleeve, and it pisses me off.

"Enacted over a lone dissenting vote just three days after the 2001 attacks on the World Trade Center and Pentagon, the “Authorization for the Use of Military Force,” or AUMF, authorized President George W. Bush to use “all necessary and appropriate force” against those involved in the 9/11 attacks as well as anyone who harbored the perpetrators.
'ItÂ’s been a decadeÂ…. Bin Laden is gone. We need to update the law,' said Rep. Mac Thornberry (R-Texas.), whoÂ’s supporting language that he says would reaffirm and clarify the 2001 resolution. The proposal is part of the defense authorization bill House Armed Services Committee Chairman Buck McKeon (R-Calif.) released Monday, which that panel is is set to mark up on Wednesday."

I know someone who is trying to sell a 1943 Chevy truck. It's looking better every day.
The economy in this area was depressed before the latest downturn began and for a long time things here have been slow but not catastrophic. Suddenly in the last couple of months things have really gone to shit locally. Many businesses have failed and nobody is renting the empty spaces. Another couple of months like this and we will have a miniature Detroit.
