On this day in history one of the worst episodes of judicial misconduct in history was concluded.  The charges against Daniel Ellsberg were dismissed based on illegal “evidence gathering” by federal authorities under uber-liberal Nixon. This as a follow-up to the BS ruling by SCOTUS that the government could not prevent publication of classified documents by a newspaper.

Both of those rulings really have zero basis in the Constitution contrary to what the liberal courts have to say. Dismissal of charges due to police misconduct is an artificial construct that should have never been allowed and should be eliminated. What should happen is that if police are guilty of misconduct then they should be charged with crimes. Instead what we get is two sets of criminals going free, the original criminal who committed the crime and the police who violated laws to hunt them down.

The infamous case of NYT vs United States is one of the most misunderstood cases in history. Most people think that as a result of the case a newspaper can print anything it wants with virtual immunity. This is not the case. The ruling was that the government can not “pre-censure” publication of information unless they first show in court clear and imminent danger would result from such publication.  The problem with that is that such a trial would only release more of the classified information. All that being said, the ruling did allow the newspaper to be prosecuted AFTER the fact if it was shown that publication did harm the national security. Ironically, publication of the Pentagon Papers did reveal sources and methods that directly resulted in the death of U.S. agents and informants.

However, by the time those events unfolded the government was already so embroiled in the mess stemming from this series of events that they decided no further action would be taken. The final fallout has been that despite the actual ruling the NYT continues to publish classified information (when Republicans are in office) that harms the U.S. and no government official will take any action.

Second hit against Haley

She will sign the bogus “ATV Safety” bill today that pops in a host of new regulations on ATVs “for the children”.More damn intrusive government control to save the children from stupid parents. Also, this bill allows police to enforce these regulations on the vehicles on private property. This is a new precedent for laws on vehicles which to date have always depended on the implied consent rule in operating on public roads. Sanford had vetoed this bill last time it came up.

One more “ironic” thing that comes to mind here is how the Dems yell about the “cost of photo ID” for voting and how it prevents poor blacks from voting. Yet not a damn peep about this and the cost of sending your children to a safety training course before they are allowed to operate an ATV in your own yard. Training that they will remember for about 5 seconds after they leave the course.

This also demonstrates that the regulatory fascists never rest. You can kill their shit but it always comes back. Dracula was a piker compared to the regulation Czars.

Washington Times is center-right?

A number of Morons have said the WT is center-right while I have maintained that it is just another left wing Dem PR rag. Here is their take on ObamaÂ’s host of campaign lies with amnesty round III

The headline:

Obama says border is secure enough to begin legalization

That alone screams to be refuted by the paper. Do they? Of course not.

Oh, and did you know that “immigration reform” is being blocked by “legislative gridlock”? Hahahahaha. How about the fact that another round of amnesty by the idiots in the commies Party has no support from Republicans or even many Democrats.

Piss on the Washington Times.

My concern is that he will use this as a justification for an executive order, and that his hinting at this (and promising it in private talks) is what  he is using to get the Hispanic vote.

My latest trope:

RINO. I do not think it means what you think it means.

"RINO" presumes that the default position of a Repubilcan is the conservative position.  This is not so, and has never been so.  The default position of a Republican is whatever gets the Republican re-elected.

We're using "RINO" wrong.

30 For everyone who is upset about the field,  I would like to remind you of the group we had in 2000:

Orrin Hatch,  Lamar Alexander,  Elizabeth Dole,  Dan Quayle,  Alan Keyes,  Steve Forbes,  Bob Smith,  John McCain,  and George W. Bush.

Bush's debut came at the governor's conference in Indianapolis,  where he gave a very boring speech.

So,  despite not having a bunch of exciting candidates currently,  we can still win this and should not despair.  One of these people will turn out to be better than we thought (or maybe more than one) so take heart.  The media's reporting on our candidates is geared towards making us depressed and unenthusiastic. Don't let them win.

36 From Vic's link:

The law will make it illegal for children younger than 6 to operate ATVs and for children younger than 16 to carry passengers on them.

That is pure nosense.  They have governs on them so your child can't go fast.  They have REMOTE off switches so a parent can turn the thing off if the kid gets too reckless. Age 5 is the perfect age to start your child on one because he is willing to still listen.  By the time they turn 6, they have so many outside influences that it is harder to teach safety. Plus, a fucking class won't help.  Ignorant parents will think 'No, my kid is cool.  I don't have to keep that close an eye on him.  He did pass that safety class.'

My almost 4 year old and my 5 year old both ride them.  As with gun safety, you have to start at age three or so because that is the easiest time to 'influence' your child.

I did too. I figured he would be just like his daddy, another NE liberal Republican who would sell us out at the drop of a hat. But he ran further and further to the right during the primary and he didn't go very far back during the general.

I voted for him in the end, but I had some misgivings. Again, he was the lesser of two evils. When his first act was no child gets an education those misgivings started showing fruit.

49 We all know that the idiots on MSNBC lie for Dear Leader, but I can't stand it when they say shit like this, knowing their 7 followers will believe the shit the spew.  How can people be so dumb? Seriously, how can people watch someone who gets paid to lie to them, only because the entire network thinks they are stupid, ignorant mouth breathers?:

Chris Matthews: ‘I’m Not A Bush Hater’ But Bush’s Attitude Towards Bin Laden Was ‘Wise-Ass’

“I’m not a Bush hater, but that was wise-ass behavior there. Just wise-ass. I mean this is the rich kid acting like I don’t care about that old girlfriend that dumped me. That was behavioral weirdness right there.”

Walsh agreed, suggesting she found it especially difficult to hear BushÂ’s chuckle from the clip. Yet Walsh theorized there actually was a plan behind BushÂ’s eagerness to steer the conversation away from Bin Laden:

“They were making the case – they decided it was bigger than Bin Laden – they were going to blame the whole thing on Iraq and lie about it. . . . He was laying the groundwork to shift the focus from Bin Laden as the mastermind and the bad guy to Saddam Hussein and Iraq.”

52 Today is going to be a slow news day. Obama will continue to campaign offering up stupid programs that he thinks will damage Republicans that he knows have zero chances of going anywhere. The MFM will continue to fellate him at every opportunity and hide his screw-ups (or at least try to). Its 2007/2008 all over again.

53 This is a good description of the potential problem with winning back enough of the 52%'ers in '12 at AT.

I'm not usually big on psychiatry but this is a clear description of the mentality of both the recently fooled and the true believers, while also explaining the apparent raving insanity in the current MBM.

But most people on the left choose denial, if not outright delusion.  Why?  Because, unlike conservatives, progressives don't just carry beliefs; they are their beliefs.  Their ideology is their identity.
And stripped of this, what would they have left?  Nothing, emptiness, being lost in an unfathomable universe.  This is precisely why people create alternative realities...because the real one is too unbearable.
So the left attacks and intimidates the messengers, and they do this not just for political expediency.  They do this to quell the doubts inside of them, the ones that threaten to break through their stealth defenses.

The chief government investigator in Congress was initially planning to subpoena budget director Jack Lew to probe why the White House is considering tying government contracts to political contributions.

This isn't a GD contracting dispute you idiots. It is outright blatant corruption. if a Republican did this it would not have been a "no subpoena" issue after the fact. The initial report would have 50 point headline news for a month.

And on top of this Issa has folded like a cheap dime store suit.

Think you are right on there--economics is a multi-dimensional problem.  In the two D model it seems there is a supply and demand component AND there is a intrinsic/perceived value assigned to the exchange currency (which has a speculative element as dollars received today may not be spent until next week).

If more people need energy, the price goes up due to finite capacity.  If I perceive the fiat dollars will be worth less next week, the price goes up.  The former problem "might" be solved by an increase in production (if possible or allowed).  The latter one might never be solved (within our lifetimes).

At long last. His handicap revealed. Since he always lies, it must be at least a 27. With a 17 (or 27) handicap, it means they stop counting strokes over par after 2-3 over per hole.

96 As usual Obama is lying.  A 17 handicap means he shoots (depending on the course) around a 90-95 straight up.  I golf regularly and I've seen his swing.  I won't go off on a big golf tangent, but suffice to say it's clear by inspection that he can't shoot 90.  My guess is he can't break 100 if he's scoring correctly.  It's no sin or anything because most people can't, but whatever you shoot it's silly to lie about it because everyone who plays can tell by watching.

Son says bin Laden sea burial demeans family

1) Good, because your family deserves to be demeaned, son.

2) I agree that bin Laden shouldn't have received a sea burial.  He should have been strung up by his ankles in the middle of Islamabad, surrounded by pressure sensitive landmines to prevent anyone from reaching his body, and left to rot and fester, and then his bleached bones crushed and churned into meal and fed to pigs.  I think that would have been much more appropriate and fitting to a man of his standing.

3) You want to sue for proof?  Really?  Oh, kiddo, bring it ON.  Our President is so messed up in the head you won't get anything of value.  Though he may give you an iPod fully stocked with all of his speeches, including the one announcing your asshole father's double-tap death.  Enjoy.

108 Vic, EXIM Bank, really the Export Bank, dont think they do imports any more, is the stick for us in settling trade disputes.  Basically, somebody - say France - subsidizes and bribes their Airbus into a competitive position via Boeing.  It gets documented and discussed, the WTO either rules or it doesn't, then EXIM gives Boeing a loan guarantee for the job - which allows Boeing to finance the program at a better rate and undercut the French.  They are referred to as the Boeing Bank in DC.

In order to balance out the Beoing deal; EXIM has to do hundreds of small business loan guarentees for political risk and currency risk (balance of payments issues).  They are also the US Berne Union - balance of trade/payments bank.

I think they are entirely fee supported or mostly as well.  So EXIM would be one of the last agencies I would cut; OPIC should go before EXIM.  You could probably merge EXIM with the USTR (US Trade Representative); for a minor savings in rent/support staff - last time I dealt with them they were both in old government buildings in DC so that wouldn't be much.

A group of Pakistani politicians including a former minister hijacked proceedings in parliament to offer prayers for the death of Osama bin Laden, little more than a week after he was killed in a US Navy Seal raid. Their actions will heighten suspicions that parts of the Islamabad government or the powerful military establishment sympathised with the al-Qaeda leader, and may have sheltered him from justice. "Bin Laden was an international figure and above all a Muslim ... I took it as my religious duty to offer prayers for him," said Maulvi Asmatullah, an independent Member of the National Assembly
