Why Did Obama Muzzle the EPA?
— Dave in Texas

Crazy guess here, politics.

And timing. The Energy Reliability Council of Texas on Thursday issued their impact assessment response to the EPA's Cross-State Air Pollution Rule, imposed in July, compliance demanded by January 2012.

ERCOT manages and operates the entire Texas power grid. If you haven't noticed, Texas and a good part of the central US has been gripped in the worst heat wave and drought since 1980. Six times this summer ERCOT has imposed "Level 2" restrictions as the power demand threatened to exceed the capabilities of the grid to supply, and large consumers who have established agreements with ERCOT were shut down to conserve power on those 108 degree days.

Level 3 is rolling blackouts.

By the way, the EPA also grabbed control from the State of Texas on new plant construction, so there isn't any.

ERCOT's assessment looked at three scenarios... I'll summarize them.

"Texas power producers will cut production from 2 to 8%. Period."

So here's what that means. Government imposed rolling blackouts.

Six times this summer demand rose within the threshold of reserve capacity. Reserve capacity is 1750Mw (or was, on August 4). That's less than 2% of total generation capacity.

I suspect the unpopularity of government imposed blackouts was a bridge too far for Obama. But it won't be if he survives the 2012 election. It'll be a feature, not a problem.

Also, why this is a big deal.

Because his policies, his directives to the EPA, hurt his re-election chances. They kill jobs. They piss people off with higher prices for energy and NO F*&IN access to energy.

Obama wants you to sweat and pay 4 times what you do now, for the privilege of sweating in the dark.

6 What if Texas tell the EPA to go to hell?

What would they do?

Stop federal money would only mean that Texas would shut off the money going to WDC.

What can the EPA realistically do to Texas? Little is my thought.

11 I agree that Texas should tell the EPA to pound sand. Look them straight in the eye and tell them to enforce it. And to wear uniforms when they cross the state borders so that the armed citizens know who is there to impose their will onto the citizenry. And further, tell their enforcement arm (who might be innocent personnel) that they should only proceed under direct leadership into a potential battlefield situation. Read that as the General leading the charge into battle.

15 The whole conservation movement is a crock. I remember Carter in the WH wearing a sweater and telling the nation that we needed to use less oil thence forth. How about we all conserve food and water by only eating and drinking on alternate days? Yeah, that will increase the amount of food and water. How about I take my last $400 and go to the store and buy that rifle on sale for $200 off $600? Then I'll use that extra $200 to buy bullets. And driving home I'll not speed through a red light which will save me another $350. Profit!

I'm actually glad we're in the position we've got now.
Yet another RINO would have caused the wound to fester until it killed us off completely.  Things would have remained "covered up" to the view of the average citizen.

Chu is academic in every sense of the word through and through, and has proved himself unable and unwilling to question the big picture. Just quit giving him the administration's absurd socialist energy policy positions to parrot, ask for no more petroleum coal and electric power industry liason ('energy prevention') and he'll tend to muzzle himself. One more year like this year, and there may not be a Texas left to consume power. The entire state is in a severe drought, although a small portion of North Texas is in moderate drought. Wildfires have burned and burned and burned. Most of our beloved ranch land is nothing but dead grass. The cattle industry has been decimated. When you start trying to feed 500 head of cattle it's bad. When you have to haul water to them, forget it. Some portions of West Texas have had 1 inch of rain this year, some of it has had 0.

We're overrun with illegals, our schools are getting their budgets cut, our roads and traffic suck. Obama's bullshit drilling rules are keeping us from producing even more gas and oil  than we are, thus killing our ability to create even more jobs than we have already.

But we still persevere. It will rain again sometime. And God willing, we won't have to put with a stuttering clusterfuck of a President past 2012.We are a lot of things in this State, but quitters ain't one of them. If we have to provide jobs to the rest of the country, so be it. And we still have lots of room for anyone that wants to move here and enjoy our Republic. However I'm sure the armed army would find a way to follow those orders and the constitution while circumventing the actual intent of the absurd orders. "We're sorry Mr. President but that tank division you ordered to crush the rebellion was 'overrun' and forced to abandon all their equipment, which has fallen into the rebels' hands. -Also the entire Navy had engine trouble and was forced to surrender to rebel privateers which have now commandeered our ships. -You won't believe me either sir, but apparently the entire air force is grounded due to most of our pilots having a 'stomach bug'...."

80 "But absent a declaration of secession, what justification does SCOAMF have to violate Posse Comitatus?"

The same authority that Eisenhower had when he sent the 101st Airborne into Little Rock to help desegregate the schools. And Obama could nationalize the TNG and use it to enforce the regime's edicts.

Forget about armed resistance: that ended when Pickett's Charge failed in 1863.

81 Of course, Eisenhower was Eisenhower, the hero of Normandy; and Obama is Obama, the stuttering clusterfuck. (Actually, he's a stammering clusterfuck, but why split hairs?) But the Army would still obey orders.

But so do RINOs.  Look at Romney, even Perry hasn't stood up to the EPA.  Jindahls done a far better job than Perry.  Look at the history of power plant construction.  When was the last plant built in the USA?  Now try and blame it on Obama.

Further look at Bush's record on energy and tell me that the RINOs can be trusted.

84 The military is sworn to uphold the Constitution and soldiers can/should/will disobey and unlawful order. The military is not to be used domestically on the citizenry. The military, the congress and the supreme court would work in concert to impeach the president, vote to remove him from office and then actually remove him with the military once he has been legally removed from office. It would look something like what happened in Honduras only the ousted president would be arrested and prevented from leaving the country.

85 Put money on it,  SCOAMF and Lady SCOAMF set the a/c cold enough to freeze hamburger.  They can't look all cool and in charge with sweat stains all over them

88 From his standpoint, the whole thing is a feature, not a bug. He's going to lose Texas, period, end of story, no matter what he does. And if he imposes rolling blackouts maybe he can hang the blame on Perry (with a big assist from the media), and in any case maybe kill some jobs in Texas, which helps defuse a major campaign issue.

89 God Bless Texas! Those of us who have been in the military know that the first officer who orders his men to fire on United States citizens will have a life expectancy of exactly zero. Those I know currently in our service have absolutely no love or respect for Obastard. Of that the is no doubt.

The timing on BHO's rollback of the EPA regs is.....interesting.

You just know he didn't want to do this. The question is, what's making him do it now?....The GOP candidates have been remarking on 'over regulation'. And Barry wants to at least look like he cares about it....but still, the timing of it makes it look like he's just doing it to lay the groundwork for his Big Speech.

And my prayers go out for Texas. I hope they get some rain soon. A long drought is such a slow heartbreaking nightmare.....plus the fires added to that misery....my heart goes out to my neighbors to the south. Texas has endured enough already. Here's hoping they get some relief soon.

Correct you are sir! The military is not the enemy of the people but the protector. It cannot be used against citizens.

For a "smart military blog" seems a lot of folks here don't understand how the military works. Perry needs to bring back the Draft so folks will become more knowledgeable in this area.

So it's safe to assert that the EPA is not so much concerned about the environment, but in how to wield democrat power.

Time to abolish it.

Sir!  Yes sir!

97 This is the oath every national guard member makes when enlisting (off about.com/military site): In the National Guard (Army or Air) I, (NAME), do solemnly swear (or affirm) that I will support and defend the Constitution of the United States and the State of (STATE NAME) against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the Governor of (STATE NAME) and the orders of the officers appointed over me, according to law and regulations. So help me God. Notice that primary allegiance is to the Constitution, then the President, then the Governor. If the Constitution and the Governor were in agreement, the President would have some real difficulty in getting his orders followed. Every officer and enlisted in the US Military is trained in the concept of a "Lawful Order." One of the great strengths of the American Armed forces is that they are trained to think. "Just following orders" is not an adequate defense later.

98 I think a huge number of our military members (officers and enlisted) would resign before attacking Texas or fellow U.S. citizens.
