— Gabriel Malor Back in March I wrote about how the justices of the Wisconsin Supreme Court are entirely dysfunctional and generally unprofessional. At the time, it mattered only because we knew that the Wisconsin budget repair law was going to come before the court and these folks seemed more apt to childish squabbling than judicial review.
The justices are acting like toddlers again.
A source who spoke to several justices present during the incident told the Journal Sentinel that the confrontation occurred after 5:30 p.m. June 13, the day before high court's release of a decision upholding a bill to curtail the collective bargaining rights of public employees.At least five justices, including Prosser and Bradley, had gathered in Bradley's office and were informally discussing the decision. The conversation grew heated, the source said, and Bradley asked Prosser to leave. Bradley was bothered by disparaging remarks Prosser had made about Chief Justice Shirley Abrahamson.
Bradley felt Prosser "was attacking the chief justice," the source said. Before leaving, Prosser "put his hands around her neck in what (Bradley) described as a chokehold," the source said. "He did not exert any pressure, but his hands were around her neck," the source said. The source said the act "was in no way playful."
But another source told the Journal Sentinel that Bradley attacked Prosser. "She charged him with fists raised," the source said. Prosser "put his hands in a defensive posture," the source said. "He blocked her." In doing so, the source said, he made contact with Bradley's neck.
You can click over for some more details and analysis, but the short of it is that at this point it's a he-said, she-said story with very little actually known. A physical altercation occurred, that's clear enough, but who started it is unclear.
Court watchers often discuss whether the courts are losing credibility because sharp differences in conservative and liberal jurisprudence are producing ever more contradictory lines of cases. I think the courts are losing credibility because judges are idiots. Sometimes.

BTW, the original Journal Sentinel report pretty much said Prosser just attacked Bradley and choked her. They backtracked throughout the day when other "sources" (which can only be other Justices) said Bradley charged at Prosser with her fists up. Bradley is known as the "attack dog" for Abrahamson, so I'm sure she instigated the confrontation.

If Prosser had actually attacked another judge as "reported" then he would have been walked out of their offices in handcuffs. Common sense says she took a swing at him, started it and that's why she didn't call authorities. Right now they're all trying to get the stories straight and it's a given that someone will screw it up and the whole nonesense falls apart.

The decision from the WI S.C. was 4-3, along ideological lines. The Chief Justice, Abrahamson, who is a moonbat fool, was part of the minority opinion.

According to the left, the two justices had an argument. Prosser said something beyond the pale that infuriated Bradley, and then started choking her out of the blue. After being physically assaulted, Bradley decided to do nothing.
Or, looking at Althouse's take, the two justices had an argument. Prosser said something that infuriated Bradley, so she came at him. He defended himself and pushed her off. No one contacted the police, because Prosser defused the situation before it became a full fight.
Now, which of these two scenarios makes sense?

I notice comments by progressives in the Wisconsin newspaper web sites all recite some variation of "Prosser has a history of volence against women so it's time for him to go," and they cite calling Abrahamson a bitch last year as said history. Almost as if they've received their talking points.
I don't cotton to a "pox on both their houses" view of this. The progressives lost the court decision so they continue to fight their battle by other means. I think Prosser did nothing.

this is a different incident apparently, but i still agree with your basic point.
by repeating the charges of liberals it gives them the same weight as if they were true, it doesn't matter that they are false you just have to get them out there and mission accomplished, damage done.
moderate conservatives believe they are being "fair" when they do these things but what they are really doing is validating and empowering the progressive meme.
a storyline is being constructed right before your eyes, this storyline has one purpose - destroy Judge Prosser, because he is a symbol of conservative victory, the progressives won't rest until he is gone, they will recieve aid and comfort from moderates in this mission - as they always do.
being a moderate is not a political philosophy it is the political equivilent of Stockholm Syndrome.

Regarding the beahvior of liberal vs. conservative factions on the Wisconsin Supreme Court -
Ever been picked on by a bully in school day after day and finally have an exasperated teacher say "You two stop it!" I do believe that kind of false equation is in play when the whole court is said to have a collective problem. I think the problem resides in just a couple of the liberal justices eating away at the civility and professionalism of the court.
Take another look at Abrahamson's opinion. Evasive, backbiting and vindictive.
Her and Bradley, two crazy old activist termites. They goad, manipulate and insult. You know they do. But only one side gets reported.

Here's the scary part of this for the Wisconsin Supreme Court Justices. There were at least five of them in the room. If this goes forward, all will have to make sworn statements. How likely is it any of them will lie along political lines? Will we end up with sworn statements that give two completely different versions of what happened, making it obvious one side is lying? Or will there be one or more Justices with enough integrity to just tell the truth about what happened.
I tend to side with Prosser because after what he went through during the campaign nothing would have surprised him, and he simply stated that when the truth was known it would be clear he did nothing wrong. Very different from Bradley's leak and libel strategy. Maybe if she files a criminal complaint we'll know this is more than posturing to embarrass a political enemy.
All in all, the Court as a whole must be very, very unhappy today about this turn of events.
