I'm very sorry to hear that.  I lost a wonderful cat to mammary cancer 10 years ago- it sounds crazy, but she had helped me get through losing a job 15 years ago.

Huckabee's film.  The part that swayed Perry was the woman who was conceived during a rape saying her life had value.

Seems perfectly consistent with what we know about Perry's ability to empathize with people (like the cancer patient who helped him become convinced the HPV vaccine was a good thing). 

It's an incremental change in what seems to be a pro-life record on his part, so I don't see this changing voter responses, particularly in the general.

Some of our sister circuits have concluded the same and have applied Buckley to invalidate state laws requiring that candidate-petition circulators be registered voters See Lerman v. Bd. of Elections, 232 F.3d 135, 148 (2d Cir. 2000) (stating that there was “no basis to conclude” that the level of interactive political speech of candidate- and intiative-petition circulators differed); Krislov, 226 F.3d at 861-62 (noting that the burden on candidates is even greater than the burden on initiative proponents because a candidate’s circulators must “speak to a broader range of political topics”); see also Nader, 531 F.3d at 1035-36 (applying Buckley to case involving candidate-petition circulators). We agree with these courts that we should not categorically exclude candidate-petition circulators from Buckley’s analysis of registration requirements. Thus, we hold that Blackwell’s enforcement of the registration requirements against Nader’s circulators violated Nader’s First Amendment rights. *** Id. at 228 (Rehnquist, C.J., dissenting). I'm still waiting for the stupid union goons at UPS to deliver my husband's Christmas present.  They insist that it isn't lost but according to them has been at its destination point, which is 5 miles from my house, for 10 days.  I can't get hold of anyone at UPS who actually speaks English to put a tracer on the damn thing.  My husband said yesterday he actually saw a UPS truck on our street, but nothing was delivered to us.  The shipper says it is out of their hands once it leaves them.  ARRRRRGGGGHHHH

Needless to say, I will be using FedEx for all my shipping from now on!

I share Chief Judge Boggs’ views of most of the issues presented in this case, and write separately only to address a few passages in the lead opinion which I fear are likely to confuse future judges citing to Nader v. Blackwell as binding precedent. First, the lead opinion states that “his suit is a civil action for money damages against Blackwell in his personal capacity. It is not another chance for Nader to litigate the constitutionality of § 3503.06, the constitutionality of which is being challenged directly in other cases.” Lead Op. at 9. The lead opinion does nothing, however, to explain why the fact that Nader currently seeks only money damages somehow diminishes the implications of our holding that Ohio Revised Code § 3503.06 treads too far on constitutionally protected activity. As we correctly hold, “petition circulation activity constitutes core political speech, and any regulation of that speech is subject to exacting scrutiny.” Lead Op. at 13. The fact that we reach this holding in resolving a particular plaintiff’s claim for money damages does not diminish its applicability to all future cases, and judges bound by the Sixth Circuit’s decisions must treat Nader v. Blackwell as they would any other published opinion of this Court. Moreover, regardless of whether or not Nader has “directly” challenged the constitutionality of § 3503.06, Nader does raise a First Amendment challenge, and First Amendment challenges are governed by the overbreadth doctrine. Under that doctrine, a First Amendment plaintiff “may prevail on a facial attack by demonstrating there is ‘a realistic danger that the statute itself will significantly compromise recognized First Amendment protections of parties not before the Court.’” Triplett Grille, Inc. v. City of Akron, 40 F.3d 129, 135 (6th Cir. 1994) (quoting City Council of Los Angeles v. Taxpayers for Vincent, 466 U.S. 789, 801 (1984)). Thus, upon our declaration that portions of § 3503.06 are unconstitutional as applied to Ralph Nader, any subsequent plaintiff who challenges the same provisions may prevail, even if the statute is not unconstitutional as applied to them. In other words, our decision that § 3503.06 is unconstitutional as applied to Ralph Nader has the same practical effect as a declaration that the portions of § 3503.06 which Nader challenges are facially unconstitutional, because any future litigant who raises a First Amendment challenge to the provisions challenged by Nader may prevail by noting that § 3503.06 “significantly compromise” the recognized First Amendment rights of Ralph Nader. Id. Nothing in this Court’s holding should be understood to abrogate the overbreadth doctrine.

There is really little excuse for Virginia to be in violation for this long.

It's certainly more conservative to expand the risk pool and lower everyone's health insurance costs by making everyone buy insurance, than it is to directly subsidize health insurance with tax dollars in order to bring the costs down or to have a total goverbnmebnt single-payer health care system..  Free markets can't work if there are too many free riders.  It is an old conundrum in insurance, which is why states started making everyone who drives buy car insurance. 

Conservatives keep saying we need more competition and private sector control over health care, but they really have not offered much of a solutuon to the free rider problem.  In an aging society, more people need more health care as they get older, and the cost of insurance will keep going up to prohibitive levels as long as younger and healthier people are allowed to stay out of the risk pool.  It becomes and chicken and egg situation when young people refuse to buy insurance because it is too expensive, and it gets too expensive precisely because younger people refuse to buy it.  That is more or less where we are now.

My opinion is that there is more than one way besides traditional fee-for-service insurance to solve the problem.  We need markets to develop for other alternatives such as prepaid health care plans, HSAs, cheap clinics for routine care, etc.

91 The Supreme Court found that the in state residency requirement for petitioners is in direct violation of the First Amendment because it severely impedes citizen's ability to be heard or get their message out. VA might have tried to get around that by supposedly adding the "or eligible to vote in VA" clause but that is too cute by half because- elegible to vote is dependent upon residency.

No, they didn't.  They made everyone who drives on public roads show proof of liability- that's a huge difference.

There's also the part where I can choose not to drive a car.  I can't (legally or morally) choose not to live.

The big thing is the Government requiring hospitals to treat everyone regardless of ability to pay.  Remove that, and things will largely work themselves out.  Hospitals and doctors would still treat those with true emergencies, but would be able to say "no" to those who use ERs as their primary care.

It's not conservative to force people into private contracts (which forcing them to buy insurance is).

Read Ed Morrissey's summary of what actually happened in VA.  There is lots of good background there for those who are interested:

From the chair of the VA GOP: Second, the Republican Party of Virginia merely certifies petition signatures. We donÂ’t set ballot access laws. Those laws are set by the General Assembly, not by the RPV.

The other interesting item is that John Hinderaker (Powerline blog) has come out enthusiastically for Romney.  Again, read the whole thing at Powerline. 

If your only response to either of these items is to yell RINO!, then this whole discussion is pointless.

It's an incremental change in what seems to be a pro-life record on his part, so I don't see this changing voter responses, particularly in the general.

Incremental?  The public isn't ready to ban abortion except for rape, incest, and mother's life yet, but they are OK with politicians who advocate that.  But pushing for a ban on all abortions is extremism that is toxic stuff in a general election.  Somebody like Santorum might just be able to get away with it because of his religion and because he can actually articulate a convincing, coherent defense of his position.  All Perry has to offer is an inarticulate account of a politically convenient flip-flop. 

 

Sorry, but this move by Perry has evaporated what remained of my enthusiasm for him.  I'm back to not giving a damn who wins the primaries.

Which is pretty much everybody.  You can't get anywhere without driving on public roads in most states of the Union.  Maybe to New Yorkers and DCers this looks like a real difference, but to real people in fly-over country, the auto mandate is a real mandate.
