— Ace Via the stalwart Michelle Malkin, David Hogberg of IBD reports some good news.
Aaron Walker has retained the services of attorney Reginald Bours to fight the peace order. Uploaded here is a letter Bours has sent to Kimberlin. Bours does not mince words:
This is a complex case, and, as a lawyer, I try to see both sides of an issue. However, based on my review of the facts, I do not believe you have had a proper basis to file either of the peace orders you have presented to District Court Commissioners, usually late at night on weekends.The attached motion addressed every citizenÂ’s right to free speech. If you truly respect that right, you should withdraw this peace order.
The motion Bours refers to is an emergency motion he has filed for a partial stay or a modification of KimberlinÂ’s peace order that would in effect lift the peace order until the Appeals Court hears the case on July 5th.
She also links and quotes Curt Levey's op-ed on Fox, The Left Can Protest All It Wants, But It Can't Use Government to Silence Critics.
“There is a growing threat to political speech in America,” warned Senate Republican leader Mitch McConnell in a speech in Washington, DC last week. “Sadly, a growing number of people on the left … appear to have concluded that they can’t win on the merits. So they’ve resorted to bullying and intimidation instead.”McConnell focused on “an [Obama] administration that has shown an alarming willingness itself to use the powers of government to silence [conservative] groups.” I focus here on the other half of the threat, intimidation and harassment by private groups on the left.
Some people dismiss the threat from outside organizations as beyond the scope of the First Amendment, which applies to actions by government. Indeed, some unsavory intimidation tactics – such as shouting down speakers or strong-arming companies to drop their sponsorship of conservative broadcasters – actually enjoy First Amendment protection. However, the Constitution affords no protection to criminal acts, which the left is increasingly turning to to silence conservatives.
Most importantly from a constitutional perspective, groups on the left are increasingly enlisting the coercive power of government in their intimidation and harassment campaigns. When they do, they threaten the First AmendmentÂ’s guarantee that government shall not abridge the freedom of speech.
Levey expressly connects this to the George Soros-funded catspaw Brett Kimberlin.
Why Isn't Rush Talking About This? As Stace McCain reports, the StopRush campaign is itself astroturf, and part of the (non-criminal but also non-ethical) effort of the left to shut up conservative voices in advance of the 2012 elections.
And that effort is also linked to Kimberlin, through his "security" expert Neil Rauhauser. When the organizers of the protest suspected they had a mole or some other interloper, they turned to Rauhauser for his help.
The StopRush effort may be, in bold strokes, itself non-criminal and protected by the First Amendment (though why the astroturf?), but it is interesting that a host of a supposed news organization (Krystal Ball on MSNBC) is coordinating with the effort.

I have this quixotic hope that this whole mess will shine a light on the massive abue of protective orders. I could pick a random guy's name out of the phone book, run down to the courthouse right now and handwrite out a complaint saying that I live or have lived with him and that I'm afraid he'll hurt me. Yes, a judge will question me but the system is designed to presume I'm telling the truth. The order will be issued. That guy gets served and any firearms he has are automatically taken. The hearing is held, I'm proven to be a lying scrunt and. And nothing. The odds are extraordinarily high that not a single thing will happen to me for lying under oath and for filing a false action. Sure, in theory I could be criminally charged and the guy could go to small claims court against me but that will probably not happen. The guy will still have to file a claim to get the sheriff to give his guns back. The entire system is ripe for abuse.
Hell, if I were an enterprising criminal who knew a guy with high value items and a gun collection, I'd pay some chick $10 to go file one to get the guns out of the way so I can rob the place.

Two reasons:
1) He doesn't care about #StopRush. It's not actually affecting him.
2) I mentioned in an earlier thread that there seems to be some snobbery against the Blogosphere/New Media. For all Rush calls himself part of the "Alternative Media," he's Big Media. So is Fox News. I think they don't want to mention it because they're a little embarrassed to admit they read blogs- especially specific blogs.

In most systems you have to affirmatively agree to accept a "pro tem" or retired judge to hear the case. You're entitled to a sitting judge by law. Also, you usually get one peremptory challenge to reject an assigned regular judge, but it has to be exercised within a short time after assignment. You can't wait until the judge screws you to "paper" him.
That said, I've used pro tems and retired judges many times and have had no problems. If you do your research carefully they're no riskier than some of the foul balls who sit as "regular" judges.

I don't think that's actually the case. Rush is pretty free with admitting when he's seen stuff on a blog, and he's specifically mentioned the HQ on air to hat tip a story or three.
Rather, I think it's that the whole thing with BK is an infinite time-sink of complexity. I've read everything Stacy McCain's posted about it for the past month and each new item makes me more confused about how it all fits together, tbh. And if you try and distill it down, you end up with something less outrage-worthy than the whole thing ultimately is.

A lawyer once told me that it's "whoever gets to the courthouse first" sets the jurisdiction...in a case that crosses state lines.

Personal jurisdiction is a complex question, but usually entails a "continuing relationship" with the forum state, or activity within the forum state itself.
Blog posts are not usually looked at as a continuing relationship, and are usually considered action where teh blogger is at, not where it's going. But who knows? Judges can do anything, and the only recourse is higher up judges.

No, that was the arrest. The arrest was based on BS and those charges were dropped. Though Walker did indeed beat a peace order from Kimberlin previously. MD moves like pond water when it's on the way to justice, and it moves like the Millennium Falcon when it's making mistakes.
Vaughey will not be the judge.
I've heard Mr Bours argue a case and he is the real deal. Aaron is in excellent hands. He's got excellent help beyond Mr Bours.
I don't think those bashing Aaron's handling of this case are being fair (beyond his not using a lawyer itself). Aaron did well in that hearing, considering. I'm not sure any lawyer could have even changed anything, though not using one was an error.

As I've had to explain over and over the years to my kids: I may not like WHAT a person is saying, but as long as they are not breaking the law, they have a RIGHT to express their opinion. And I will defend another person's right to say things that I may not personally agree with.
By the same token, OTHER people do not have the right to suppress my speech/opinion as long as the same guidelines are followed. And I expect them to respect my right to speak my opinion.
That's where we get into trouble (on both sides).

I don't think so. Rush has jumped the shark imo with the onset of new media and I believe he's gotten increasingly sloppy and lazy. I don't begrudge him one iota of what he's attained but I also don't regard him as particularly interesting these days.

An internet blog, or a broadcast....goes out to a wide audience, across state lines.
No 'contract' is entered into, between the parties.

Two reasons:
1) He doesn't care about #StopRush. It's not actually affecting him.
2) I mentioned in an earlier thread that there seems to be some snobbery against the Blogosphere/New Media. For all Rush calls himself part of the "Alternative Media," he's Big Media. So is Fox News. I think they don't want to mention it because they're a little embarrassed to admit they read blogs- especially specific blogs.

Yeah, it's obvious they read blog. There have been times I've listened or watched as a host/hostess seems to be ticking off one by one items on this and other blogs. It must be maddening if you are ace or the co bloggers....at least if they are going to rip you off, they could at least mention the blog/blogs and how to find the blogs.
Not saying rush does this, just saying in general i've noticed this.

Basically the notion is that media always has been biased. The difference is that one had lots of different publications from which to choose. That is no longer true. Warren Buffett, for example, recently announced that he had purchased over 60 newspapers, mostly in the deep red Southeastern US, and was considering buying more of them.

And he has been buying up nationwide for years. One company owning more than one news outlet in an area used to be illegal. Somehow that law got changed.
